Mr. Farrell - I live at 6149 Sweet Gum Drive in Tarin Woods II subdivision. While I am general to not take
exception to this proposed land use, I have a few concerns regarding the special use permit referenced
above.
1) The applicant is proposing to use pervious pavement to offset the 40% max pervious area
requirement. While I understand that from an engineering perspective this makes since, I do not believe
that is the intention of the requirement to preserve landscape area around a development. These areas
of pervious pavement should not be required to count against the 40% max.
2) The maintenance of pervious pavement should not be passed along to the Tarin Woods
homeowner's association.
3) The maintenance of these buildings should not be included in the requirements of the Tarin Woods
homeowner's association.
4) The intersection that is proposed to be used for this development at Shilloh Drive is inadequate for this
level entrance traffic. While the traffic counts may work, the physical arrangement of the intersection
will cause confusion to drivers. Trucks already cut the corner and drive through the median at this
location.
5) Since this transitions from a single family use to a multi-family use a Type A: Opaque Buffer should be
required of the developer.
6) The access road to Carolina Beach Road should be constructed as part of this development to
alleviate traffic on Manassas Drive.
7) Shilloh Road is shown as future circulation road. Head in townhome parking along the road should not
be allowed. Also, there is no guest parking spaces shown for the townhome units which will encourage
parking on the narrow streets.
8) Vehicular circulation should be identified.

Public Comment I think the currently proposed SUP should be denied. Having
apartments and townhomes in the front of the neighborhood,
butting up against our single family homes is not a proper
transition with the surrounding properties 2.5 units per acre. I
believe the developer should continue the smaller single family
homes off Appomattox or just have a similar plan to the
townhomes he proposed last year, when he was denied, but
with a bit less density. This level of density (more than 4x the
surrounding area) is not cohesive with the community

surrounding or an appropriate density transition to the adjoining
commercial property. This community is one of the top 5 in the
county for active families. Please don’t ruin that for us and the
MANY children that live here. As a less dense and active
community we adore all the precious memories our children
are able to make, much like we had from our own childhood.

Public Comment This number of units in our already crowded neighborhood
would be a disaster. There is one main road out to CB
(Manassas) which is the egress for 2 large neighborhoods and
a new park. That traffic stop has numerous accidents due to
the traffic and no U-Turn and a traffic study has not been
updated since 2020.
The developer has made promises to fix our current amenities
and some of our roads are crumbing and he doesn’t care.
Our schools are close to capacity and with reduced funding

coming up next year how can we support more kids? Please
consider all factors when making this decision.

Public Comment I am opposed to the changes in density requested by the
developer for Tarin Woods. The traffic on Carolina Beach Road
is already abundant. Adding higher density in this
neighborhood will only make it worse. The schools are
overwhelmed. The bus stops in the neighborhood block traffic
with all the parents needing to drive their children to them.
Manasas is a narrow, poorly paved, single lane rode in either
direction. New Hanover pines increased traffic to the area

already. The new target will increase traffic tenfold. The areas
roads seem as though they’re already maxed out.

Public Comment As the Phase II of Tarin Woods has built out, the Appomattox
Drive has been populated with families with small children that
are outside at play. most days. The road has been
experiencing drastic increases in traffic and with a lot of
vehicles speeding up and down the road. As I look at the
proposed platts, I do not see any additional points of ingress
and egress to reduce the already stressed access to Phase II
on Manassas and Lt. Congelton. This is a safety issue and an
unnecessary stress on the existing Tarin Woods Roads due to

all the construction vehicles and additional density of people
and vehicles. The roads in Phase II are already in substandard
conditions due to the excessive heavy construction equipment
usage and no committment to bring the roads up to acceptable
repair and standards

Public Comment The infrastructure of schools, roads and water barley
accommodate the single family homes that are built there
today. Water pressure drops from the standard in the morning
due to too many sprinklers and showers. Schools are already
over capacity adding additional cottages to account for
children. A single egress to collage is un safe with the amount
of traffics today. Parking on those streets are already unsafe,
adding 2x to 4x the possible cars will make it very unsafe. The

Public Comment How can you not see this community doesn’t want this project
to move forward. This is the third or fourth time we’ve been thru
this. I think developer assumes we will stop trying to oppose
because they have more money or power.
Please if you only lived here you would know…. Traffic is
horrible already on CB rd. To add this many units is unheard of
really. The building has to stop or the town I was born and
raised in will loose its appeal. I do t want us to be another
Myrtle beach. Also, our story began 7 years ago when my

husband was preparing to retire at 50 yr old from sheriffs office.
We search for over a year to decide on a neighborhood and we
choose tarin woods. Our kids all went to coastal Christian
highschool and we wanted to be close. The family style and
community of these folks is wonderful. We do not want to be
crowded by so many units . It will disrupt this neighborhood.
AND how do you anticipate providing services like schools for
the kids who live in these apartments???? And other vital
services???? Not to mention, we will never be able to exit out
onto CB rd in a timely fashion. Please show big developers that
our BOUCE COUNTS AND NOT THE MONEY THE COUNTY
WOULD EARN IN REVENUE FTOM THIS PROJECT. WE
ARE THE COUNTY. We are citizens who are telling you what
we need and want. Please hear our voice and reject this
proposals.

Public Comment I oppose approval of this Special Use Permit for the following
(and many more) reasons:
Criteria 1 requires: The use will not materially endanger the
public health or safety if located where proposed and
approved. The following points speak to that criteria not being
met:
Strain on Education System: The existing school district is

already facing significant challenges, including overcrowding
and underfunding, leading to a $20 million deficit. Introducing
more families into the area exacerbates these issues,
compromising the quality of education and essential services
(including access to mental health resources, free breakfast
and lunch program, special needs services, AIG services and
more) that is available to students, thus constituting a public
health concern. Additionally we currently have 10 buses
running just to service Battle Park and Tarin Woods, only
accounting for public school and not private or charter. It has
been confirmed with NHCS transportation that adding 100+
more school age children to the subdivision would be a
logistical nightmare.
Environmental and Safety Risks: The land's documented and
confirmed classification as wetlands and the widespread
presence of Class IV Pamlico Soil in this development raises
significant environmental concerns. Drainage issues,
evidenced by the deterioration of existing roads and potential
threats to stormwater management systems, pose safety risks
to surrounding communities. Ignoring these facts jeopardizes
both property integrity and public safety.
Emergency Evacuation: The addition of hundreds of
residences, all relying on a single emergency evacuation route,
US 421, as outlined in the NC DOT Evacuation Routes, raises
significant concerns regarding emergency evacuation
preparedness in the event of a hurricane or an incident at the
Brunswick Nuclear Plant. According to the NC Coastal Region
Shelter and Evacuation Guide, mandatory evacuation in the
county begins 48 hours prior to the event. However, the
decision-making process for full county evacuation, as
exemplified by Hurricane Ian in Lee County in 2022, may not
occur until 48 hours prior to impact, potentially leaving
residents with limited time to evacuate safely. This delay in
decision-making, coupled with unclear clearance times for
densely populated areas such as Carolina Beach, Kure Beach,
and Monkey Junction, where thousands of residences have
been added since the last evacuation study conducted 20+
years ago, presents a significant risk to public safety. Without
adequate evacuation planning and infrastructure, there is an
increased likelihood of loss of life and property damage in the
event of a Category 3 or higher storm surge.
Criteria 2 requires: The use meets all required conditions and
specifications of the Unified Development Ordinance.
The following points speak to that criteria not being met:

Outdated Traffic Impact Assessment: The submission of an
outdated TIA from 2019/2020 raises concerns about the
accuracy of traffic projections for the proposed development. It
is imperative to use the most current data to assess the true
impact on traffic flow and safety in the area. Furthermore, the
absence of summer 2023 traffic count data, despite
assurances give to former chair Girardot from Mike Kozlowsky
(WMPO) and corroborated by Scott James (WMPO) at a
February 2, 2023 Planning Board meeting, raises questions
about the transparency and reliability of the information
provided by the developer and the Wilmington Metropolitan
Planning Organization (WMPO). The community deserves
access to accurate and up-to-date traffic data to make informed
decisions about the proposed development's impact on local
infrastructure and safety.
Criteria 4 requires: The location and character of the use if
developed according to the plan as submitted and approved
will be in harmony with the area in which it is to be located and
in general conformity with the New Hanover County
Comprehensive Land Use Plan.
The following points speak to that criteria not being met:
Infrastructure Discrepancy: The proposed area lacks essential
infrastructure such as sidewalks, proper lighting, and access to
public transit, contradicting the criteria set forth in the 2016
comprehensive plan for urban/community mixed-use
development. Without these amenities, the area is ill-equipped
to support high-density housing. Not to mention that the plan
for multi-family housing is not in harmony with the low density,
single family home communities surrounding. The developer
stated in the application that “the proposed use is consistent
with surrounding uses, as both are residential in nature”. This
comparison is completely irrelevant to the argument, it’s the
high density/multi-family homes being placed in the middle of
low density neighborhoods that is the issue with disrupting the
harmony.
I ask that the Boards consider these factors when finding a
decision. Thank you.

Public Comment At a minimum, please continue this forum until such date as the
applicant has provided a complete application that meets all
requirements for consideration. The site plan provided is
inadequate, contains multiple scales used within the
presentation and appears to not provide the required amount of
parking to meet requirements (making it impossible to evaluate
true impact when built) and relies on stormwater systems from
other phases of Tarin Woods (some existing some may not
be).

Drainage and flooding is already a significant concern. Many
Tarin Woods II residents who already has inadequate drainage
and flooding problems and have had to install french drains at
their own expense to allow for their yards to drain properly.
However, it is unclear why this would not be part of a greater
re-zoning request looked at as part of the totality of
development being undergone as the various Tarin Woods
phases rather than trying to carve out this one high density
request separately. All impacts to traffic, stormwater tun off of
this now large development surrounded by other new
developments should be evaluated as one cohesive plan. As a
resident of Tarin Woods, this feels fundamentally against the
transparency of governance we expect in New Hanover
County.

Public Comment As a proud resident of this wonderful community, I must
strongly oppose the absolutely disastrous Special Use Permit
application (S24-01) proposed for the once-peaceful Tarin
Woods area on Shiloh Drive. This terrible idea seeks to cram
high-density multi-family housing into a single-family
neighborhoods. This is a total mismatch and a massive mistake
that could destroy the character and tranquility that we all

Destruction of Community Character: Injecting high-density
housing into our low-density, serene neighborhoods is a
complete disaster for the character and aesthetics that drew
everyone here. This radical change threatens to tear apart our
community fabric, ruining the quality of life and cohesion
among residents, and would have a negative impact to the
entire community. It’s just wrong!
Traffic Nightmares: The flood of additional people and cars
from this high-density mess will create traffic nightmares. We're
already dodging illegal U-turns and witnessing accidents and
near-misses, especially during school rush hours. Parents are
desperately cutting through shopping center parking lots just to
drop off their kids safely. 300 more cars? That’s a recipe for
chaos and danger, clearly against the county’s mission to
ensure safety and security.
Ignoring the People's Voice: We’ve said 'no' to rezoning time
and again. If this is approved it will be ignoring good
governance and the voices of real people. We demand
transparency and fairness.
I urge the Planning Board and the Board of Commissioners to
see the truth of this terrible plan and reject the Special Use
Permit application. We need smart development that improves
our community, not a disastrous plan that threatens everything
we’ve built. Let’s keep our community great!
In light of these points, I urge the Planning Board and the
Board of Commissioners to consider the long-term impacts of
this development and to reject the Special Use Permit
application. Our community deserves development that
enhances our area and aligns with the county’s mission, not
one that undermines it.

Public Comment The builder is attempting an end around to the process to get
his position passed. I hope the commissioners realize that the
voting base is talking to them directly with this opposition. We
have valid reasons to not want the overcrowding and increased
drain on already poor infrastructure.
The reason the planning committee decided not to allow the
zoning change request was because it was using an old traffic
study. Which is still the case. There is no reason to allow this

special permit hearing to approve the request. The builder will
say he can't make money putting single family homes on the
land closer to commercial properties; But that is a falsehood
spread by the greed to want to make more on multi-dwelling
properties. Now he is adding in apartment complexes to the
plan.
This builder has tried strong arm tactics to get people to not
oppose his plan. Stating he will "sell of the land, and we will get
whatever we get then". But he is wrong, even if a new builder
buys the land, we will protest any plan that contributes to
overcrowding.
