1. General Comments
a. Zoning district: B-2. Proposed use: Convenience Store, Fuel Station
Response: We have revised the Site Data Table to match the terminology used in the
UDO.
b. Please note the below standards from UDO Section 4.3.4.I.2 for Fuel Sales:
i. Fuel sales in all districts where allowed shall comply with the following standards:
a. The premises shall not be used for the sale of vehicles.
b. Fuel pump canopies shall meet the setbacks of the underlying zoning
district, as measured from the outer edge of any supportive structure
physically connected to a fuel pump and the ground along a straight line to
the nearest point of the property line.
c. Setback distances from street rights-of-way may be reduced by one-half.

2. UDO Section 5.1, Parking and Off-Street Loading
a. Parking is sufficient.

3. UDO Section 5.2, Traffic, Access and Connectivity:
a. Any access questions, please refer to NCDOT comments.
b. Please be aware that no building permit will be issued until NCDOT has issued the
Driveway Permit.

4. UDO Section 5.3, Tree Retention:
a. Tree Removal Permit has been received.

5. UDO Section 5.4, Landscaping and Buffering:
a. Please use distinct graphics to illustrate trees to be removed
Response: As we discussed in the TRC meeting, there is a table on Sheet C1.3
indicating which trees are to be removed. On Sheet C1.2, the trees to be
removed are printed dark. The trees to remain are printed lighter to provide
some contrast.
b. Please show sight triangles on the landscape plan.
Response: Sight triangles are now shown on the landscape plan.
c. Exemption request from foundation plantings at drive through granted, UDO
5.4.7.C.1.
Response: Thank you.
d. Perimeter landscaping includes existing trees, please ensure tree protection is used
during disturbance.
Response: Tree protection fence is now shown on the Tree Clearing Plan
(Sheet C1.2), and keynote TC08 has been added to indicate that tree
protection fencing should be installed prior to tree clearing.
e. Parking lot interior landscaping appears to meet requirements, UDO Table 5.4.5.C.
Response: Thank you.
6. UDO Section 5.5, Lighting:
a. Please note that with the latest update to the UDO, a lighting plan is not required at
time of TRC Approval. See below excerpt from Section 5.5.3:
i. Information about the exterior lighting for the site that demonstrates
compliance with the standards in this section shall be submitted in
conjunction with an application for site plan approval (Section 10.3.6, Site
Plan) or zoning compliance approval (Section 10.3.8, Zoning Compliance
Approval), whichever comes first, approved no later than at time of
construction plan approval.
b. When available, please send over lighting plan for review and approval.
Response: A revised lighting plan is in process and will be sent over once we
receive it.

7. UDO Section 5.6, Signs:
a. Please note that all signs are subject to section 5.6 of the UDO.
b. Please submit for sign permits prior to installation.
c. Please note that per UDO Section 5.6.2.J.4.a.3, Carolina Beach Road, Freestanding
signs along Carolina Beach Road shall comply with the provisions of this section
except that only one freestanding ground sign not to exceed six feet in height and a
maximum surface area of 150 square feet is permitted.
Response: Acknowledged; signage will be designed per the UDO. Permitting
will be completed prior to installation.
8. UDO Section 5.7, Conservation Resources
a. Per the New Hanover County Conservation Resource Overlay map, there are no
Conservation Resources on this portion of the site.
Response: Acknowledged, thank you.
NHC Fire, Sunnie Batson - 910-798-7464
1. Required for Plan Review Submittal:
a. The complete TRC/Site plans comments by fire during review shall be submitted
along with the building plans for review to New Hanover County Fire Marshal’s
Office. This shall include the complete set of civil plans showing existing and
proposed fire hydrant locations. Failure to submit the comments or a complete
set of civil plans will result in a resubmittal for review for verification of
compliance.
Response: Acknowledged; the civil plans and comments will be submitted
at building permitting.
b. Any plans involving an underground storage tank (UST) shall include an
engineered plan complying with the NCFC Chapter 23, 57 and NFPA 30 for
Underground Storage Tank Cover requirements. This plan shall also show all
vent lines.
Response: Acknowledged.
2. Accessibility – Fire Apparatus Access Road:
a. Fire apparatus access is required at the time of construction. These roads are
required to be capable of supporting 85,000 lbs. in all weather conditions.

3. Addressing:
a. Premises identification signage is required during construction. The signage is
permitted to be temporary until permanent signage is installed.
Response: This requirement has been noted on the Utility Plan.
4. Water Supply (Chapter 5 and Appendix C) – Fire Hydrants:
a. All fire hydrants shall be installed to Cape Fear Public Utility Authority
specifications. CFPUA specifications are available from the Fire Marshal’s Office
or CFPUA.
Response: Acknowledged. We have noted this in the fire hydrant keynote
on the Utility Plan, and the CFPUA fire hydrant detail is on Sheet C7.9.
b. A fire hydrant will be required to be installed at the entrance to the project site off
Carolina Beach Road.
Response: As we discussed during the TRC meeting, we have proposed a
hydrant near the corner of Carolina Beach Road and Shade Tree Lane. The
keynote is U23.
5. Construction and Demolition
a. Chapter 33 must be adhered to during the construction process and any
demolition.
Response: Acknowledged; this has been added as Note #15 on the Utility
Plan.
NHC Engineering (Stormwater), Galen Jamison - 910-798-7072
1. The County stormwater and land disturbance permit is currently under review. Any
comments will be forwarded the designer.
Response: Thank you; we have received your comments and are working through
them. We will email our revised plans & comment response directly to you.
2. The offsite drainage coming from the north that is conveyed in culvert FE300-301 shall be
placed in a public drainage easement sized in accordance with NHC Stormwater Manual.
Construction within this offsite drainage conveyance measure that will be maintained by the
county will need to be observed during construction by Stormwater Services and a turnover
meeting scheduled once the system is ready to be conveyed to the county. Please add a
plan note to ensure county construction observation and a turnover meeting occurs. Note,
should the applicant elect to maintain the conveyance measures themselves, the POA
covenants shall indicate the operation and maintenance roles and responsibilities for the
conveyance measure.
Response: We are now showing an easement for the offsite drainage conveyance.

3. Please contact the State for their stormwater permitting requirements. It is anticipated a
high density permit will be necessary.
Response: This project has been submitted to the State for stormwater permitting.
NHC Environmental Health, Dustin Fenske - 910-798-7324
1. Site plan reflects connection to public water. Environmental Health has a record of a well being
installed on this property in 1995. There is also a record for a well abandonment but specifics
are not given. The developers must be mindful if there is a well head encountered during
demolition, and it has not been properly abandoned; it must be properly abandoned by a
certified well driller. This is extremely necessary since this will be a gas station. Environmental
Health does not have any records on surrounding properties in which setbacks (sewer and
UST's) will be violated.
Response: Understood. This has been noted on Sheet C1.4.
2. If food service is occurs at this facility then application submitted and approval must be
received from the NC Environmental Health Plan Review Unit.
Response: Understood; this will be submitted with building permits.
3. Site Plan reflects connection to public sewer. Environmental Health records reflect a septic
system being installed in 1981. If a septic tank is encountered during demolition, then it shall
be pumped, crushed and filled. Proposed infrastructure does not violate setbacks to any
surrounding properties septic systems.
Response: Understood. This has been noted on Sheet C1.4.

Response: Understood; we submitted to CFPUA through the online portal and are

3. CFPUA is moving toward becoming paperless. When ready to submit plan review
package, upload all documents to https://www.cfpua.org/FormCenter/Engineering-
3/Engineering-Plan-Review-103.
Response: Understood.
4. CFPUA water available via mainline extension
Response: Water mainline extension is not required for this site. We will connect to
the existing watermain along Carolina Beach Road.
5. CFPUA sewer will be available through mainline extension and installation of pump station.
Response: Understood; forcemain & lift station plans have been included.
6. Capacity is dependent on the analysis of the pipe collection system (gravity and force
mains).
Response: Acknowledged.
7. A capacity is determination can be provided upon submittal of the NC DWQ FTA/FTSE
Application Form and a Preliminary Plan; this determination does not guarantee capacity.
Response: The FTSE has been submitted to CFPUA.
8. Capacity is issued to projects on a first come, first serve basis, when capacity is available,
the plans meet Authority requirements, and the NC DWQ FTA/FTSE forms are signed by
the Authority.

NCDOT Driveway Permit:
An NCDOT Driveway permit has been submitted to NCDOT for review.
o Permit # D033-065-24-00079.
Submit plans in accordance with pages 14 and 15 of the Policy on Street and Driveway
Access to North Carolina Highways to include access locations within 500’ of the proposed
access on both sides of the State Road. Submit to the local NCDOT District Engineer’s
Office.
o Refer to the NCDOT checklist (included) for required documents and site plan
information.
Response: We received comments on the driveway permit through the portal on
7/9. We are in the process of addressing these comments.
NCDOT Encroachment Agreement:
An NCDOT Encroachment Agreement is required for any utility connections or installations
within the NCDOT right-of-way (form 16.6).
o No private utilities are allowed to run parallel in the NCDOT right-of-way.
Response: We are not proposing any private utilities running parallel in the
NCDOT right-of-way. The forcemain is outside of the right-of-way.
An NCDOT Encroachment Agreement is required for any sidewalk or multi-use paths
installed within the NCDOT right-of-way (form 16.6).
Response: Understood; the encroachment has been submitted with the driveway
permit on the portal. We received comments on 7/9 and are in the process of
addressing them.
Required Roadway Improvements:
Roadway improvements are required per the approved TIA (included):
o The required roadway improvements can be incorporated into the driveway permit
and will not require a separate encroachment agreement.
Refer to the NCDOT Roadway Design Manual for help with the design of any required
roadway improvements.
o Figure 8-10 Recommended Treatment for Turn Lanes (Included).
Response: We have combined the driveway permit and encroachment on the portal.

Site Plan Comments:
Hydraulic calculations and associated plan sheets will need to be submitted for the site.
o This will be reviewed by the NCDOT Hydraulics Unit.
Include/update the NCDOT Standard Drawings (2024) that are applicable to the
development.
o Sheet C7.4
The proposed driveways need to be designed accordingly to allow for the ingress and
egress without any conflicts.
The proposed pavement design and the limits of the final layer of asphalt will be
reviewed during the driveway permit review.
Sight Triangles and Sight Distance:
o Show and label the 10’ X 70’ NCDOT sight triangles.
No obstructions shall be placed within the NCDOT sight triangles.
o Show and label the stopping sight distance.
No obstructions shall be placed within the stopping sight distance.
Reference table 3-1 below for design requirements.
Label the internal protection stem length for the proposed driveway connection.
o Measured from the right-of-way line.
o These will need to meet the minimum requirements of the approved TIA.
You can coordinate with the district office with any questions 910-398-9100.
Response: We will submit hydraulics calculations with the next submittal on the
NCDOT portal. We have updated the NCDOT standard details on our plans to the
latest version. Sight triangles are shown on the Site Plan (C2.0).

Comments per the attached appendix from WMPO:
1. The project is part of the Sheetz Shade Tree TIA Approval with Conditions, dated March 13,
2024. The project is required to build the necessary improvements listed.
Response: Acknowledged.
2. Driveway will be subject to NCDOT review.
Response: We have started the review process for the NCDOT driveway permit.
3. Please label the drive thru length from the menu board.
Response: The drive thru length is now labeled on the Site Plan (Sheet C2.0).

4. The proposed eastbound left-turn lane does not meet the TIA conditions of approval: 300’
full storage, 100’ taper and appropriate full width deceleration length. Please revise.
Response: The eastbound left-turn lane has been revised per the TIA conditions of
approval. There is now a 150’ deceleration and 100’ taper length shown.
5. The proposed westbound right-turn lane does not meet the TIA conditions of approval: 175’
full storage, appropriate full width deceleration length and taper length. Please revise.
Response: We are in discussions with NCDOT on this comment and will continue to
work toward a solution. There are challenges and limitations in this area due to the
existing grades and culvert pipes next to the roadway.
6. The proposed “storefront bumper posts” appear to block access to the parking spaces.
Please revise.
Response: The parking spaces are 20’ long, allowing plenty of space for vehicles and
the bumper posts. The bumper posts are intended to protect pedestrians and the
storefront. Below is an image of how they are installed:
