The following comments have been received for the July 17, 2024, TRC meeting. We have copied the comments
received verbatim and offer our responses to each in blue text immediately following.
We understand that you will be the point of contact from New Hanover County Planning & Land Use for this project’s
permitting review process.
Planning, Love Ott 910-798-7444
1. General Comments
a. Zoning District: 1-2
b. Use: Electric Substation is permitted in the 1-2 zoning district.
- Response: Acknowledged.
2. UDO Section 5.1, Parking and Off-street Loading
a. No minimum off-streeting parking for the use of electric substation.
- Response: Acknowledged.
3. UDO Section 5.2, Traffic, Access and Connectivity
a. Access is sufficient.
- Response: Acknowledged.
4. UDO Section 5.3, Tree Retention
a. For the trees planned to be removed, please submit a tree removal permit.
Response: The tree removal permit was submitted via the COAST portal on June 13th, 2024 (at the same time
that the Commercial Site Application was submitted). The Tree Removal Permit Plan # is TR-24-000030.

5. UDO Section 5.4, Landscaping and Buffering
a. 7’ chain link fence is sufficient.
- Response: Acknowledged.
6. UDO Section 5.5, Lighting
a. Is any lighting proposed for this development?
Response: Yes, lighting is proposed for the development. Site lighting plan is included as a
supplemental attachment to the resubmittal package.
b. Please note a lighting plan is not required at time of TRC approval. See below excerpt from
Section 5.5.3:
i. Information about the exterior lighting for the site that demonstrates compliance with
the standards in this section shall be submitted in conjunction with an application for
site plan approval (section 10.3.6, Site Plan) or zoning compliance approval (Section
10.3.8, Zoning Compliance Approval, whichever comes first, approved no later than at
time of construction plan approval.
- Response: Thank you. Acknowledged.
7. UDO Section 5.6, Signs
a. If there are any new signs proposed for this development, please apply for sign permits prior to
installation.
- Response: No regulator signs are proposed.
8. UDO Section 5.7, Conservation Resources
a. Per the New Hanover County Conservation Resource Overlay may, there are no Conservation
Resources on this portion of the site.
- Response: Understood.
NHC Fire Services, Ray Griswold 910-798-7448
1. Fire Final Required Show Fire Dept. access road. Is it through the Sutton Plant or another Path? It
should support the weight of 80,000 lbs.

- Response: Access to the substation is a private road off Sutton Lake Road. Refer to plan and figures for
location. Private road will support vehicle weight of 80,000 lbs.
2. Fire truck and have a clear width of 16 feet street signage shall be placed with appropriate street number
to the site Install normal Duke Energy signage for emergency contact info.
- Response: Fire truck access will have a clear width of 16 feet to the site. Refer to plan and truck analysis
figure. Duke Energy signage shall be placed with street number and emergency contact information.
NHC Engineering, Galen Jamison 910-798-7072
1. A stormwater permit issued by the county is required for this project. Please digitally submit the permit
applications documentation with requisite review fees for County issued permit directly to
gjamison@nhcgove.com. Application and forms can be found at
https://www.nhcgov.com/251/Storemwater. The application should include any variance requests and
supporting materials for low impact design should it be pursued.
- Response: Understood.
2. The erosion Control permit will be issued by NC DEQ DEMLR. Please submit the permit as the design is
complete.
- Response: Understood. Erosion Control Permit will be submitted to NCDEQ DEMLR, Wilmington Regional
Office for standard ESC Review. Issued permit will be forwarded to NHC Engineering, upon receipt.
3. Please contact the State for the stormwater permit modification requirements.
- Response: NCDEQ Stormwater Minor Modification submitted 6/27/2024. Awaiting response. NCDEQ
Wilmington Regional Office indicates permit issuance or request for additional information will be provided on
or before September 25, 2024. Permit being modified is SW8 150902.
NHC Environmental Health, Dustin Fenski 910-798-6732
1. Septic System and Well Review is not necessary on construction of a new electrical substation.
- Response: Understood.
NHC Addressing, Katherine May 910-798-7443
1. No Comments
- Response: Substation address (901 Sutton Lake Road, Wilmington, NC 28401) was issued 7/24/2024 via email.
New address letter pdf from Ms. May is included in this resubmittal.

1. CFPUA TRC Comments provided are preliminary comments only.

2. Utility Plan review required by CFPUA. CFPUA is moving toward becoming paperless. When ready to
submit plan review package, upload all documents to https://www.cfpua.org/FormCenter/Engineering-
3/Engineering-Plan-Review-103.
Response: Acknowledged.
3. There is no CFPUA water and sewer available.
Response: Understood. The substation site does not require water or sewer public utilities.
4. CFPUA Plan Review is not required.
- Response: Understood.
NCDOT, Nick Drees 910-343-3915
1. Comments Forthcoming
Response: No comments received from NCDOT at time of resubmittal. We are assuming there are not NCDOT
comments as the project is not adjacent to NCDOT right of way.
WMPO, Scott James 910-473-5130
1. Comments Forthcoming.
Response: WMPO Comments were received under separate letter dated 7/15/24.
2. Provide Stop Signs, Yield Signs and other required signs per MUTCD and NCDOT standards.
- Response: The site is located adjacent to a private road. No regulatory signs are required.
3. Please show AutoTurnsTM vehicles movements for Fire and Rescue vehicles on the site.
- Response: Refer to truck turning analysis figure.
4. Please show the proposed fences and gates around this structure.
Response: Refer to site plan for fences and gates.
5. NCDOT Projects: N/A
Response: Understood.
6. TIP Projects in the Area: N/A

7. New Hanover County CTP: N/A
