Subject: 5124 US HWY 421 N – Renewable Natural Gas Facility – Commercial Site Plan
The following comments have been received for the June 5th, 2024, TRC meeting. Additional comments
may be made upon further review of subsequent revisions.
Please note: following the TRC meeting, a revised preliminary plan addressing each of the below items
must be resubmitted prior to receiving preliminary plan approval.
Planning, Love Ott 910-798-7444
1. General Comments
a. Per the Zoning Consistency Determination Letter issued on November 15, 2023 the
proposed use of the site is “Utility Lines, Structures, and/or Facilities, General”. This use
is compatible with the intent of this I-2 zoning.
2. UDO Section 5.1, Parking and Off Street Loading
a. Parking is sufficient.
b. Required 1.4 spaces, provided 4 spaces.
3. UDO Section 5.2, Traffic, Access and Connectivity
a. Any access questions, please refer to NCDOT comments.
4. UDO Section 5.3, Tree Retention
a. An approved Tree Removal Permit issued on January 31, 2024.
b. Permit number TR-24-000007
5. UDO Section 5.4, Landscaping and Buffering
a. Please include landscape plan, one was not provided in the packet submitted. A
landscape plan is required prior to TRC approval.

6. UDO Section 5.5, Lighting
a. Is any lighting proposed for this development?
b. Please note a lighting plan is not required at time of TRC approval. See below excerpt from
Section 5.5.3:
i. Information about the exterior lighting for the site that demonstrates compliance
with the standards in this section shall be submitted in conjunction with an
application for site plan approval (Section 10.3.6, Site Plan) or zoning compliance
approval (Section 10.3.8, Zoning Compliance Approval), whichever comes first,
approved no later than at time of construction plan approval.
7. UDO Section 5.6, Signs
a. If there are any new signs proposed for this development, please apply for sign permits
prior to installation.
8. UDO Section 5.7, Conservation Resources
a. Per the New Hanover County Conservation Resource Overlay map, there are no
Conservation Resources on this portion of the site.

1. Is New Hanover County funding any portion of this project?
2. A land disturbing (depending on comment #1 response) and a stormwater permit issued by the
County are required for this project. Please submit the permit applications documentation with
requisite review fees for County issued permit directly to gjamison@nhcgov.com. Forms can be
found at https://www.nhcgov.com/251/Stormwater and
https://www.nhcgov.com/249/Sediment-Erosion-Control.
3. A curiosity review of the stormwater management report resulted in the below unofficial
stormwater permit request for more information.
a. It is recommended NC DEQ erosion control details, specification and maintenance
requirements be used for all details. As an example, what is the size of the washed stone
for the construction entrance? The maintenance requirements for the wattle are missing.
b. How will a check dam along the slopes of the infiltration basin function? Check dams are
intended in channels, not along slopes.
c. The required NCG01 forms are missing from the plans.
d. Please indicate the proposed contours for the 4 channels, as it appears the minimum
depth of 0.78 isn’t provided in channel 4 and the limits of disturbance (LOD) may increase
for channel 1.
e. The LOD will need to include the FM connection.

f. The dimensions of the energy dissipaters, stone size and filter blanket or fabric
requirements couldn’t be found in the plans.
g. The ¼ acre of drainage to 100’ of silt fence appears to be violated along the southern
boundary of the site.
h. Will any of the foundations impose loads on the proposed storm sewer piping? Several of
the pipes are very close to proposed equipment/structures.
i. The sequence of construction notes should be tailored to the project and not indicate
recommended. They should also reference NHC as the authority having jurisdiction.
j. Is the infiltration basin going to be used as a sediment basin during construction?
k. There are no erosion control measures indicated in the proposed channels to protect
against erosion prior to stabilization. Rock check dams, wattles or compost socks are
recommended.
l. Per Section 2.3.2.1, table 2-4 of the NHC Stormwater Design Manual, items 5, 8, 14, 21,
22 and 26 appear to be missing from the plans.
m. Per Section 2.3.2.2, table 2-5, items 2, 5, 6, 11 and 12 appear to be missing from the
narrative report.
n. Per Section 2.3.2.3, table 2-6, items 6 and 7 appear to be missing from the narrative
report.
o. Per Section 2.3.2.3, table 2-7, the minimum requirements for the pipe design are not
found in the narrative report.
p. Per Section 2.3.2.3, table 2-8, the design calculations for the driveway culvert appear to
be missing from the narrative report.
q. Per Section 2.3.2.3, table 2-10, items 5 and 6 (pond routing with infiltration not
functioning) could not be found in appendices to the narrative report.
r. Per Section 2.3.2.5, please provide a notarized operation and maintenance plan
agreement form.
s. Per Section 2.4, please include the certifications on at least one drawing. Cover page
preferred.
t. Per Section 3.5, please include the frequency factor, Cf, for all calculations that rely on
the rational method.
4. Please contact the State for the stormwater permit requirements. It is anticipated a high-density
permit will be required.

3. CFPUA water available. CFPUA sewer will be available through a forcemain-to-forcemain
connection.
4. Capacity is dependent on the analysis of the pipe collection system (gravity and force mains).
5. A capacity determination can be provided upon submittal of the NC DWQ FTA/FTSE Application
Form and a Preliminary Plan, this determination does not guarantee capacity.
6. Capacity is issued to projects on a first come, first serve basis, when capacity is available, the
plans meet Authority requirements, and the NC DWQ FTA/FTSE forms are signed by the
Authority.

NCDOT Encroachment Agreement:
An NCDOT Encroachment Agreement is required for any utility connections or
installations within the NCDOT right-of-way (form 16.6).
Roadway Improvements:
Additional information is needed to verify if roadway improvements will be required.

Site Plan Comments:
It is recommended that an 18” driveway pipe be installed.

Label the internal protection stem length for the proposed driveway connection.

Engineering Studies
The applicant may be required by the District Engineer to submit studies based on, but not limited to, the parameters outlined
herein. If study requirements of the local government agency are more restrictive than the NCDOT requirements, then local
government requirements will govern. However, this does not imply that the NCDOT is obligated to approve entrance designs
that are too constrictive to allow smooth and safe traffic flow. All studies including, but not limited to, Traffic Impact Analyses
(TIA), traffic signal studies, and drainage studies, must be prepared under the direct charge of and sealed by a North Carolina
licensed Professional Engineer.
