Subject: 5820 HWY 421 N – Phillips Commercial Center - TRC Review
The following comments have been received for the September 4, 2024, TRC meeting. Additional
comments may be made upon further review of subsequent revisions.
Please note: following the TRC meeting, a revised preliminary plan addressing each of the below items
must be resubmitted prior to receiving preliminary plan approval.
Planning, Robert Farrell 910-798-7164
1. General Comments (if applicable)
a. The properties are zoned I-2, Heavy Industrial and the project proposes the installation of
a road network a future commercial / industrial park.
b. Project is in both New Hanover County and Pender County. New Hanover County and
Pender County must both separately approve the project in order to proceed with any
construction in New Hanover County.
c. Consider shifting a section of Phillips Center Loop east away from running directly parallel
to US 421 (shown in red). This would provide an area to retain trees and provide a
vegetative buffer along the highway (shown in green).

2. UDO Section 5.1, Parking and Loading
a. No parking required for the initial infrastructure phase of the project. Each future site will
be responsible for providing adequate off-street parking in compliance with Section 5.1
Parking and Loading.
3. UDO Section 5.3, Tree Retention
a. A separate tree retention permit will need to be submitted through COAST.
b. The Tree Removal Permit application can be found on our website at:

c. The TRC application includes a plot sampling survey of trees on site.
d. The Site Data Table on page C 2.0 indicates 64 total disturbed acres. Is that the acreage
of the proposed roadways and infrastructure for both Phase I and II?
e. And is that inclusive of the acreage disturbed in Pender County?
f. In order to calculate any required mitigation the tree removal permit application
materials should indicate the areas disturbed, the total acreage in New Hanover County.
g. The tree removal permit can apply only to the roadway and other infrastructure
proposed. Each individual future development in the industrial / commercial park within
New Hanover County would be subject to the tree retention standards.

h. Any trees that may be required for mitigation for this infrastructure phase of the project
may not count for mitigation on future tree removal activities.
4. UDO Section 5.4, Landscaping and Buffering
a. Landscaping and buffering are not required for the installation of infrastructure. Each
development in the industrial / business park will be responsible for providing the
required street yard, parking, and any other required landscaping and buffering on their
individual sites.
5. UDO Section 5.5, Lighting
a. Are streetlights included in the infrastructure phase? If so, streetlights must comply with
the lighting standards of Section 5.5.
b. Each future site will be required to submit their own individual lighting plan for approval
at the time of development.
6. UDO Section 5.6, Signs
a. The primary entrance is in Pender County’s jurisdiction. If a primary development sign is
proposed at the entrance, it must meet the requirements of Pender County.
b. Any signs inside the jurisdiction of New Hanover County will need to meet the county’s
sign requirements.
7. UDO Section 5.7, Conservation Resources
a. There are approximately 31.5 acres of Swamp Forest conservation resources
b. There are approximately 18.5 acres of Pocosin conservation resources in the project area.
6.5 acres are underlaid with Class IV soil.
c. A minimum of 5 acres of a conservation resource triggers additional ordinance
requirements under Section 5.7.
d. Table 5.7.3.A.5 establishes the calculation for determining the minimum amount of
conservation space required. The calculation is the total acreage of the conservation
resource multiplied by 0.5.
i. 31.5 acres x 0.5 = 15.75
ii. 6.5 acres x 0.5 = 3.25
iii. 15.75 + 3.25 = 19 total acres required for conservation.
e. Table 5.7.4 Additional Performance Controls states that when there are 3 or more acres
of a Swamp Forest or Pocosin conservation resource additional standards are required
under Section 5.7.4.C

i. All structures and impervious surfaces shall be set back 50 feet from the
conservation resource.
ii. On-site retention and percolation areas shall be required for the entire parcel
sufficient to control, at a minimum, the first 0.5 inches of runoff that will originate
from all impervious surfaces anticipated to be on the site upon final development.
The specified amount of runoff from impervious surfaces shall be disposed of by
percolation into the soil, evaporation, transpiration, or other methods of
treatment or handling acceptable to the County Engineering Department.
8. UDO Section 5.8, Open Space Requirements (if applicable)
a. Not applicable to the installation of infrastructure.
b. While open space is not required, the Conservation Resource standards of Section 5.7
require a minimum of 19 acres of conservation space.
9. UDO Article VI Subdivision Design and Improvements
a. Section 6.2.2.A.7.g Street Connectivity Standards
i. There are 6 links and 4 nodes within the New Hanover County portion of the
project. 6/4 = 1.5 which meets the required street connectivity ratio
requirements.
NHC Fire Services, Ray Griswold 910-798-7448

2. I spoke with Tommy Batson, he has agreed to have one plan reviewer all by New Hanover
County Fire's DFM Ray Griswold. He will be kept in the loop. The reasoning, is that the majority
of the project belongs in New Hanover County.
3. Please review the typical TRC comments that will be e-mailed to both the developer and the PE.
4. Any storage tanks located on the properties shall be permitted by the appropriate AHJ.
5. Any structures over 7,500 sq. feet shall have a Section 510 study completed - Emergency First
Responder Radio Coverage.
6. Buildings requiring High Piled Storage - They shall be provided with the appropriate fire
protection as outlined in the fire code.
7. No gates on the fire dept. access roads unless permitted by the and sprinkler permits shall be
obtained fr AHJ

8. Knox Boxes will be required on structures that have a fore alarm / sprinkler system. Based on
design, buildings may require more then one.
9. An Engineered fire flow analysis will be required.
10. What water purveyor will be used? CFPUA / Pender Utilities / Both?
11. Any buildings that are sprinklered, an FDC shall have a fire hydrant within 100 feet.
12. Fire alarm and sprinkler permits shall be obtained from the appropriate AHJ.
13. Hopefully any buildings being constructed are in one county or the other.
14. Buildings that will be built. The appropriate AHJ will handle the reviews and inspections. This is
why we ask that no buildings straddle the county line.

1. A land disturbing issued by the County is required for this project. Please digitally submit the
permit application documentation with requisite review fees for County issued permit directly
to gjamison@nhcgov.com. Application and forms can be found at

2. A County stormwater permit issued by the County is required for this project. Please digitally
submit the permit applications documentation with requisite review fees to the COAST online
permit portal (https://newhanovercountync-
energovpub.tylerhost.net/apps/selfservice#/home). Applicable forms can be found at
https://www.nhcgov.com/251/Stormwater however the application form is not required as the
information will be gathered by the COAST portal.
3. This parcel qualifies for an exemption to the County’s pre and post storm attenuation
requirements should it be design in accordance with the City and County’s Low Impact Design
(LID) Manual (http://laserfiche.nhcgov.com/weblink/0/edoc/3273331/LID-Manual.pdf). Please
provide requisite documentation for compliance with LID manual and a variance request in
accordance with NHC UDO, Section 7.12 during the County stormwater permitting process. As
park’s parcel’s are developed and impervious area added, each parcel will need submit for a
County stormwater permit and meet the pre and post storm attenuation requirements unless
LID measures are proposed.
4. Please contact the State for the stormwater permit requirements. It is assumed a low density
permit with future pockets of high density will be obtained.

1. Site plan reflects connection to public water and sewer. If water and sewer cannot be obtained
then individual septic and well permits must be applied and received. Environmental Health has
no records for well or septic systems on this/these parcel(s).
NHC Addressing,
1. Street names will need to be submitted and approved for areas in New Hanover County.
2. Additional coordination with Pender County may be required for streets in both jurisdictions.

These are preliminary comments and are based on the plans as submitted for the proposed
site. They are subject to further review upon receipt of any additional information.
Subsequently, additional comments and/or requirements may be necessary for this site.
General Comments:
The industrial park is proposing state-maintained roadways.
The site must be reviewed and approved by NCDOT per General Statute 136-102.6.
No encumbrances will be allowed in the public right of way.
NCDOT Driveway Permits, and Encroachments are submitted through the NCDOT
Online Portal.https://connect.ncdot.gov/municipalities/Utilities/Pages/help.aspx
NCDOT Driveway Permit:
An NCDOT Driveway permit has been submitted to NCDOT for review. However, the
permit will not be approved until the site has been given preliminary plan approval by
NCDOT.

NCDOT Encroachment Agreement:
An NCDOT Encroachment Agreement is required for any utility connections or

• Site access subject to NCDOT review.
• The site appears to be Roadway Infrastructure. The project streets may be subject to
NCDOT Policy on Driveway and Subdivision Roads Minimum Construction Standards.
• The project application references a TIA for the proposed Industrial Park. Please provide
a copy of the completed TIA for this site.
• Please show the installation of a Traffic Signal at US Hwy 421 and Site Access B, per the
US 421 Industrial Park TIA. Traffic Signal plans will be subject to NCDOT approval.
• Provide AutoTurnsTM Movements for the largest vehicle entering and exiting the site.
Please show Fire and Rescue vehicles with a separate template.
• Provide Stop Bars and Stop Signs per MUTCD and NCDOT guidelines.
