September 4th, 2024
New Hanover County’s Technical Review Committee (TRC) will meet Wednesday, September 4, 2024
at 2:00 p.m. to discuss the below items.
PLEASE NOTE:

Item 1: 5820 US HWY 421 – Phillips Center of Wilmington – SITECN-24-000032
Request by Phillip McCorquodale of Phillips Leasing Systems, LLC for roads and other
infrastructure for a new industrial park. The site is located at 5820 US HWY 421 and is 66.1
acres, zoned I-2. A portion of this site crosses into Pender County, they are going through TRC
with Pender County for this project. The engineer is Scott Brown, PE
(sbrown@4dsitesolutions.com), the case planner is Robert Farrell (rfarrell@nhcgov.com, 910-
798-7164).
Item 2: 2117 Castle Hayne Road – Backyard Specialists Flex Space – SITECN-24-000033
Request by Jennifer and Gene Robbins of Backyard Specialists for a contractor’s office and flex
space. The site is located at 2117 Castle Hayne Road and is 2.26 acres, zoned Conditional B-2.
This site was rezoned in 2023, case Z23-20. The engineer is Andrew Isenhour with Bluewater
Engineering (AndrewI@bluewater-eng.com), the case planner is Amy Doss
(adoss@nhcgov.com, 910-798-7571).
Item 3: 514 Hermitage Road – Laydown Yard and Pole Barn – SITECN-24-000034
Request by Butch Saunders of GES Investments Properties, LLC for a laydown yard and pole
barn. The site is located at 514 Hermitage Road and is .81 acres, zoned I -1. The engineer is Mark
Hargrove with Port City Consulting Engineers, PLLC. The case planner is Zach Dickerson

Subject: 5820 HWY 421 N – Phillips Commercial Center - TRC Review
The following comments have been received for the September 4, 2024, TRC meeting. Additional
comments may be made upon further review of subsequent revisions.
Please note: following the TRC meeting, a revised preliminary plan addressing each of the below items
must be resubmitted prior to receiving preliminary plan approval.
Planning, Robert Farrell 910-798-7164
1. General Comments (if applicable)
a. The properties are zoned I-2, Heavy Industrial and the project proposes the installation of
a road network a future commercial / industrial park.
b. Project is in both New Hanover County and Pender County. New Hanover County and
Pender County must both separately approve the project in order to proceed with any
construction in New Hanover County.
c. Consider shifting a section of Phillips Center Loop east away from running directly parallel
to US 421 (shown in red). This would provide an area to retain trees and provide a
vegetative buffer along the highway (shown in green).

2. UDO Section 5.1, Parking and Loading
a. No parking required for the initial infrastructure phase of the project. Each future site will
be responsible for providing adequate off-street parking in compliance with Section 5.1
Parking and Loading.
3. UDO Section 5.3, Tree Retention
a. A separate tree retention permit will need to be submitted through COAST.
b. The Tree Removal Permit application can be found on our website at:

c. The TRC application includes a plot sampling survey of trees on site.
d. The Site Data Table on page C 2.0 indicates 64 total disturbed acres. Is that the acreage
of the proposed roadways and infrastructure for both Phase I and II?
e. And is that inclusive of the acreage disturbed in Pender County?
f. In order to calculate any required mitigation the tree removal permit application
materials should indicate the areas disturbed, the total acreage in New Hanover County.
g. The tree removal permit can apply only to the roadway and other infrastructure
proposed. Each individual future development in the industrial / commercial park within
New Hanover County would be subject to the tree retention standards.

h. Any trees that may be required for mitigation for this infrastructure phase of the project
may not count for mitigation on future tree removal activities.
4. UDO Section 5.4, Landscaping and Buffering
a. Landscaping and buffering are not required for the installation of infrastructure. Each
development in the industrial / business park will be responsible for providing the
required street yard, parking, and any other required landscaping and buffering on their
individual sites.
5. UDO Section 5.5, Lighting
a. Are streetlights included in the infrastructure phase? If so, streetlights must comply with
the lighting standards of Section 5.5.
b. Each future site will be required to submit their own individual lighting plan for approval
at the time of development.
6. UDO Section 5.6, Signs
a. The primary entrance is in Pender County’s jurisdiction. If a primary development sign is
proposed at the entrance, it must meet the requirements of Pender County.
b. Any signs inside the jurisdiction of New Hanover County will need to meet the county’s
sign requirements.
7. UDO Section 5.7, Conservation Resources
a. There are approximately 31.5 acres of Swamp Forest conservation resources
b. There are approximately 18.5 acres of Pocosin conservation resources in the project area.
6.5 acres are underlaid with Class IV soil.
c. A minimum of 5 acres of a conservation resource triggers additional ordinance
requirements under Section 5.7.
d. Table 5.7.3.A.5 establishes the calculation for determining the minimum amount of
conservation space required. The calculation is the total acreage of the conservation
resource multiplied by 0.5.
i. 31.5 acres x 0.5 = 15.75
ii. 6.5 acres x 0.5 = 3.25
iii. 15.75 + 3.25 = 19 total acres required for conservation.
e. Table 5.7.4 Additional Performance Controls states that when there are 3 or more acres
of a Swamp Forest or Pocosin conservation resource additional standards are required
under Section 5.7.4.C

i. All structures and impervious surfaces shall be set back 50 feet from the
conservation resource.
ii. On-site retention and percolation areas shall be required for the entire parcel
sufficient to control, at a minimum, the first 0.5 inches of runoff that will originate
from all impervious surfaces anticipated to be on the site upon final development.
The specified amount of runoff from impervious surfaces shall be disposed of by
percolation into the soil, evaporation, transpiration, or other methods of
treatment or handling acceptable to the County Engineering Department.
8. UDO Section 5.8, Open Space Requirements (if applicable)
a. Not applicable to the installation of infrastructure.
b. While open space is not required, the Conservation Resource standards of Section 5.7
require a minimum of 19 acres of conservation space.
9. UDO Article VI Subdivision Design and Improvements
a. Section 6.2.2.A.7.g Street Connectivity Standards
i. There are 6 links and 4 nodes within the New Hanover County portion of the
project. 6/4 = 1.5 which meets the required street connectivity ratio
requirements.
NHC Fire Services, Ray Griswold 910-798-7448
1. Fire Finals required
2. I spoke with Tommy Batson, he has agreed to have one plan reviewer all by New Hanover
County Fire's DFM Ray Griswold. He will be kept in the loop. The reasoning, is that the majority
of the project belongs in New Hanover County.
3. Please review the typical TRC comments that will be e-mailed to both the developer and the PE.
4. Any storage tanks located on the properties shall be permitted by the appropriate AHJ.
5. Any structures over 7,500 sq. feet shall have a Section 510 study completed - Emergency First
Responder Radio Coverage.
6. Buildings requiring High Piled Storage - They shall be provided with the appropriate fire
protection as outlined in the fire code.
7. No gates on the fire dept. access roads unless permitted by the and sprinkler permits shall be
obtained fr AHJ

8. Knox Boxes will be required on structures that have a fore alarm / sprinkler system. Based on
design, buildings may require more then one.
9. An Engineered fire flow analysis will be required.
10. What water purveyor will be used? CFPUA / Pender Utilities / Both?
11. Any buildings that are sprinklered, an FDC shall have a fire hydrant within 100 feet.
12. Fire alarm and sprinkler permits shall be obtained from the appropriate AHJ.
13. Hopefully any buildings being constructed are in one county or the other.
14. Buildings that will be built. The appropriate AHJ will handle the reviews and inspections. This is
why we ask that no buildings straddle the county line.

1. A land disturbing issued by the County is required for this project. Please digitally submit the
permit application documentation with requisite review fees for County issued permit directly
to gjamison@nhcgov.com. Application and forms can be found at

2. A County stormwater permit issued by the County is required for this project. Please digitally
submit the permit applications documentation with requisite review fees to the COAST online
permit portal (https://newhanovercountync-
energovpub.tylerhost.net/apps/selfservice#/home). Applicable forms can be found at
https://www.nhcgov.com/251/Stormwater however the application form is not required as the
information will be gathered by the COAST portal.
3. This parcel qualifies for an exemption to the County’s pre and post storm attenuation
requirements should it be design in accordance with the City and County’s Low Impact Design
(LID) Manual (http://laserfiche.nhcgov.com/weblink/0/edoc/3273331/LID-Manual.pdf). Please
provide requisite documentation for compliance with LID manual and a variance request in
accordance with NHC UDO, Section 7.12 during the County stormwater permitting process. As
park’s parcel’s are developed and impervious area added, each parcel will need submit for a
County stormwater permit and meet the pre and post storm attenuation requirements unless
LID measures are proposed.
4. Please contact the State for the stormwater permit requirements. It is assumed a low density
permit with future pockets of high density will be obtained.

5. UDO Section 5.2. Traffic, Access, & Connectivity
a. Please note on the site plan that “No building permit for any structure shall be issued
which requires NCDOT approval for a Driveway Permit until NCDOT has issued the permit
approval. Evidence of approval shall accompany the application for the building permit.”
6. UDO Section 5.3 Tree Retention
a. Please provide a note stating existing vegetation to remain undisturbed as approved on
the concept plan.
b. Please apply for a tree removal permit if trees are to be removed.
c. Per UDO Section 5.3.4.C, of the UDO requires a minimum of 15 trees at least 2” DBH must
be retained or planted on the parcel where development occurs for each acre or
proportionate area disturbed. Please add a note to the Landscape Plan showing has this
requirement has been met. Please note that required landscaping for the project can be
credited to meet this requirement, however, required landscaping does not count
towards mitigation, if applicable.
7. UDO Section 5.4 Landscaping and Buffering
a. Please illustrate the 20’ buffer yard located along the southern boundary as illustrated on
the approved concept plan.
b. Please illustrate the 20’ buffer yard along the western and northern boundaries of the
property as illustrated on the approved concept plan.
c. Please provide a landscape plan that includes the location, number of plantings required,
and number of plantings provided.
d. Please reflect one canopy tree in the street yard plantings as there are no powerlines
overhead.
8. UDO Section 5.5 Exterior Lighting
a. Is any lighting proposed for the development?
b. Please note that with the latest update to the UDO, a lighting plan is not required at time
of TRC approval. See below excerpt from Section 5.5.3:
i. Information about the exterior lighting for the site that demonstrates compliance
with the standards in this section shall be submitted in conjunction with an
application for site plan approval (Section 10.3.6, Site Plan) or zoning compliance
approval (Section 10.3.8, Zoning Compliance Approval), whichever comes first,
approved no later than at time of construction plan approval.

c. When the lighting plan is submitted, please ensure that the foot candles from the street
lights at the lot lines do not exceed 0.5, as the adjacent land is residential.
9. UDO Section 5.6 Signs
a. Please note that all signs are subject to Section 5.6 of the UDO.

3. The existing northern ditch that is assumed to be undisturbed qualifies for NHC Stormwater
Services maintenance. Therefore, a public drainage easement sized in accordance with NHC
Stormwater Manual is requested on this parcel. The county will work with then northern
property owner to obtain the remaining width of the drainage easement.
4. The offsite stormwater drainage coming from the south and routed through the site in the
pond’s outfall ditch qualifies for NHC Stormwater Services maintenance and will need to be
placed in a public drainage easement sized in accordance with NHC Stormwater Manual.
Construction of offsite drainage conveyance measures that will be maintained by the county will
need to be observed during construction by Stormwater Services and a turnover meeting
scheduled once the system is ready to be conveyed to the county. Please add a plan note to
ensure county construction observation and a turnover meeting occurs. Note, should the
applicant elect to maintain the conveyance measures themselves, deed restrictions shall be
recorded that indicate the operation and maintenance roles and responsibilities for the
conveyance measure.
5. Please contact the State for the stormwater permit requirements. It is assumed a high density
permit will be obtained.

Engineering Studies
The applicant may be required by the District Engineer to submit studies based on, but not limited to, the parameters outlined
herein. If study requirements of the local government agency are more restrictive than the NCDOT requirements, then local
government requirements will govern. However, this does not imply that the NCDOT is obligated to approve entrance designs
that are too constrictive to allow smooth and safe traffic flow. All studies including, but not limited to, Traffic Impact Analyses
(TIA), traffic signal studies, and drainage studies, must be prepared under the direct charge of and sealed by a North Carolina
licensed Professional Engineer.

Case Z23-20 Approved Conditions
Conditional Approval Items:
1. No more than a total of 100 peak hour trips can be generated from the use or combination of uses
located within the zoning district. Change of use proposals must be reviewed and approved by the
County in order to verify compliance with the zoning district standards.
2. The development shall comply with all provisions of an approved NCDOT driveway permit prior to
issuance of the Certificate of Occupancy.
3. Freestanding signage shall be limited to monument signs, in that the sign must have a support structure
that is a solid-appearing base constructed of a permanent material, such as concrete block or brick.
Freestanding signs supported by poles and any flashing digital signs shall be prohibited.
4. Existing vegetation must remain within the bufferyards and be supplemented as necessary to provide
the 100% visual opacity requirement.
5. Building height is restricted to 25-feet.
6. Outdoor storage area (only one) to be enclosed with a minimum eight (8) foot opaque fence.
7. Exterior lighting, including luminaries and security lights, shall be arranged, or shielded so as not to cast
illumination in an upward direction above an imaginary line extended from the light sources parallel to
the ground. Fixtures shall be numbered such that adequate levels of lighting are maintained, but that
light spillage and glare are not directed at adjacent property(ies), neighboring areas, or motorists. Light
posts shall be no taller than twelve (12) feet.
8. A bicycle and pedestrian easement will be located along Castle Hayne Road as shown on the concept
plan, including the installation of a sidewalk from the southern border to the northern border.
9. Permitted Uses shall be limited to:
a) Indoor Recreation Establishment (Shooting Ranges prohibited);
b) Animal Grooming / Veterinary (Kennel or Daycare prohibited);
