The attached documentation has been revised accordingly and we offer the italicized responses to the comments below. Planning, Zach Dickerson 910-798-7450 1. Zoning: B-1 a. Use: Convenience Store, Fuel Station - Added to site data table on sheet C-1.0 2. General Comments: a. a. Please be sure to apply for a demolition permit prior to demolishing the existing structures on the property. - Understood, applications are in process and will provide as approvals are obtained. b. Are any traffic calming devices planned for this development? None are required, but if there are any planned, please show them on the site plan. - None are being proposed at this time. c. Please note the below standards from UDO Section 4.3.4.I.2 for Fuel Sales: a. Fuel sales in all districts where allowed shall comply with the following standards: 1. The premises shall not be used for the sale of vehicles. - Understood, note has been added to general notes. 2. Fuel pump canopies shall meet the setbacks of the underlying zoning district, as measured from the outer edge of any supportive structure physically connected to a fuel pump and the ground along a straight line to the nearest point of the property line. - Understood, dimensions have been added to the closest right of way / property lines. 3. Setback distances from street rights-of-way may be reduced by one-half. - Understood, structures meet required setback. 3. Tree Retention: a. For the significant trees planned to be removed on-site, please apply for a Tree Removal Permit. - Applications are in process and will provide as approvals are obtained. b. Please be aware that a Tree Removal Permit is required prior to any land disturbance activities. Please provide the specific species (Loblolly Pine, Long Leaf Pine, etc.) of the trees to be removed or retained to determine required mitigation. - Trees to me removed with location and type are shown on sheet C2.0. a. Clearly illustrate what trees are being preserved and what trees are proposed to remain. - Trees to remain are shown on sheet C2.0. b. Please see the chart below for an example of what Staff is looking for as a tree inventory requirement. - Table has been added to sheet C2.0 showing calculation for tree removal. All specimen trees located within subject tract are required to be illustrated as well. UDO Section 5.3.5.C The removal of any specimen tree is prohibited on any parcel unless exempt according to Section 10.3.11, Variance Zoning and Subdivision. If a specimen tree is removed without a permit, the penalty for this violation shall be twice the mitigation fee. - Understood, no changes to plans required. d. Please be aware that there are optional incentives for retaining trees on site, UDO Section 5.3.8.A.2. -Understood, no changes to plans required. e. Please see the chart below indicating the documented, significant, and specimen trees regulated by the County. - Understood, no changes to plans required. f. Per UDO Section 5.3.4.C, of the UDO requires a minimum of 15 trees at least 2” DBH must be retained or planted on the parcel where development occurs for each acre or proportionate area disturbed. Please add a note to the Landscape Plan showing has this requirement has been met. a. Please note that required landscaping for the project can be credited to meet this requirement, however, required landscaping does not count towards mitigation, if applicable. - Landscaping plan has been updated. g. Per UDO Section 5.3.6.B, please be aware that prior to any construction activity protection fencing is required around protected trees or tree stands. The fencing shall be a minimum of four feet and shall remain in place through completion of construction activities. - Note 16 has been added to sheet C2.0. h. When submitting for the Tree Removal Permit, please include a Tree Inventory Table. - Understood, no changes to plans required. 4. Landscaping: a. Please indicate on the landscape plan where the interior parking lot landscaping will be located. - Landscaping plan has been updated. b. Please indicate on the landscape plan where the foundation plantings for the convenience store will be located. - Landscaping plan has been updated. 5. Lighting: a. Please note that with the latest update to the UDO, a lighting plan is not required at time of TRC Approval. See below excerpt from Section 5.5.3: a. Information about the exterior lighting for the site that demonstrates compliance with the Firm License No. P-1199 2755-B Charles Boulevard, Greenville, NC 27858 252-558-0888 www.arkconsultinggroup.com standards in this section shall be submitted in conjunction with an application for site plan approval (Section 10.3.6, Site Plan) or zoning compliance approval (Section 10.3.8, Zoning Compliance Approval), whichever comes first, approved no later than at time of construction plan approval. - Site Lighting Calculations / plan has been included with resubmittal. b. When available, please send over lighting plan for review and approval. - Site Lighting Calculations / plan has been included with resubmittal. 6. Signs: a. Please note that all signs are subject to section 5.6 of the UDO. - Note 19 has been added to sheet C1.0. b. Please submit for sign permits prior to installation. - Understood, applications will be submitted. 7. Please provide all NCDOT approvals upon receipt. Please be aware that no building permit will be issued until NCDOT has issued the Driveway Permit approval. - Understood, applications are in process and will provide as approvals are obtained. All underground fuel tanks shall be permitted through New Hanover County Building Safety - Understood, all applicable permits will be obtained and approvals will be provided as they are obtained. 2. A section 510 study is required for Emergency First Responder Radio Coverage - Understood, note has been added to plans. 3. Please follow the Guidelines of Appendix J for Building Information Signage - Understood, note has been added to plans. 4. All roadways, parking areas, approaches from the street into the parking areas shall not exceed a 10 % in grade. - Understood, proposed driveway aprons do not exceed 10%. 5. All applicable Safety Signage and NFPA 704 Signage shall be placed in the fueling dispensing area. - Understood, note has been added. NHC Engineering, Galen Jamison 910-798-7072 1. A land disturbing and a stormwater permit issued by the County are required for this project in addition to the State stormwater permit. Please submit for permits as the design is completed. - Understood, permit has been applied for. 2. A public drainage easement sized in accordance with Section 2.6.5 of the NHC Stormwater Design Manual is requested for the existing ditch in the SW corner of the site. The easement shall be centered on the ditch and the County will work with the adjacent parcel for full easement width. - 35’ easement has been added centered on stream as requested. 3. Please contact NCDOT for confirmation of pond outfall location and tie in to 23rd Street roadside ditch. - We are coordinating with NCDOT for proposed outfall. Cape Fear Public Utility Authority, Bernice Johnson 910-332-6620 1. CFPUA TRC Comments provided are preliminary comments only. - Understood, comments have been addressed on plans. 2. CFPUA water and sewer available via a mainline extension. - Understood, coordinating with developer who is working on sewer main extension. 3. The project is currently in CFPUA Review. First review comments have been provided to the engineer. - Comments should be addressed in resubmittal. Environmental Health, Dustin Fenske 910-798-7324 1. Environmental Health records from 1999 reflect a well and septic system on this parcel. Other well heads may exist on this parcel. If other wells are encountered they shall be identified, protected and properly abandoned by a certified well driller. Surrounding properties may utilize well water for their potable water supply. Underground storage tanks shall maintain 100 feet from any surrounding properties wells. - Understood, note 15 has been added to sheet C2.0. 2. Application states the site will be on public water and sewer. Environmental Health records from 1999 reflect a well and septic system on this parcel. If the septic tank is encountered/found it must be properly abandoned. - Understood, note 14 has been added to sheet C2.0. WMPO, Jamar Johnson 910-343-3915 1. Provide turning templates for the largest design vehicle to access the site. - Turning template has been added. 2. Development has a TIA that is currently undergoing TIA review. All improvements listed in the TIA approval with conditions letter will be required of the development. - Understood, required improvements have been added to the plans for resubmittal. If the tributary in the lower Southwestern corner of the property is impacted, a permit may be required. - Understood, applications are in process and will provide as approvals are obtained.
