§ 160D-1115. Revocation of building permits. The appropriate inspector may revoke and require the return of any
building permit by notifying the permit holder in writing stating the reason for the revocation. Building permits shall
be revoked for any substantial departure from the approved application, plans, or specifications; for refusal or
failure to comply with the requirements of any applicable State or local laws; or for false statements or
misrepresentations made in securing the permit. Any building permit mistakenly issued in violation of an

Good morning,
From our discussion on Wednesday (9-4-2024), a question has been raised about whether the property at 5007
Trailing Vine Lane can be converted from a single-family detached dwelling into a duplex. We have reviewed the
county’s requirements and the Vineyard Green Subdivision and have determined the following:
The R-15 zoning district allows a maximum of 2.5 dwelling units per acre for performance subdivisions.
The Vineyard Green Subdivision is a performance residential subdivision in the R-15 district that was
platted between 1995 and 1997.
According to the TRC documents and verified with GIS, the total acreage of the subdivision is 20 acres.
That would allow no more than 50 dwelling units in the subdivision (20 acres x 2.5 du/ac = maximum 50
dwelling units).
According to the recorded plats and verified with GIS, there are currently 50 dwelling units in the
subdivision.
Because the subdivision has reached the maximum dwelling unit cap, no additional dwellings are
permitted in the Vineyard Green Subdivision.
StaƯ’s understanding is the owner of 5007 Trailing Vine Lane initially applied for permits to enclose and renovate a
garage as a spare room or “bonus room.” That kind of project is allowed with appropriate permits. Based on our
conversation Wednesday it sounds like the owner of 5007 Trailing Vine Lane has modified their original intent and
may be attempting to construct a duplex.
If the proposed (or currently underway) construction meets the Building Code standards as a duplex it is also
considered a duplex under county zoning and would not be permitted under the county’s Unified Development
Ordinance for 5007 Trailing Vine Lane. They will need to modify their project so it does not qualify as a duplex
before Planning can approve it.
