Additional comments may be made upon further review of subsequent revisions. Please note: following the TRC meeting, a revised site plan addressing each of the below items must be resubmitted prior to receiving site plan approval. Planning, Robert Farrell, rfarrell@nhcgov.com 1. General Comments a. Property was zoned CZD B-2, Conditional Regional Business on June 3, 2024. Case Z24-03. b. The zoning district includes 7 conditions which should be listed as additional site notes on the plans: i. The proposed use of a restaurant will have a cap of 3,000 square feet. Any change in square footage must be reviewed and approved by the County in order to verify compliance with zoning district standards. ii. Permitted uses shall be limited to: a. Animal Grooming / Veterinary (Kennel or Daycare prohibited) b. Business Service Center c. Contractor Office d. Offices for Private Businesses & Professional Activities e. Restaurant iii. Pedestrian access will be provided from Haven Place to the proposed flex space commercial structure as shown on the site plan. iv. The existing vegetation as shown on the concept plan will be retained to meet the Type A opaque buffer requirement. v. A Type A buffer shall be provided along the southern boundary of the parcel adjacent to parcels zoned R-10. vi. A 50-foot-wide stream buffer is required between the proposed structures and the Ness Creek Tributary as shown on the concept plan. vii. No Contractor Office with outdoor storage shall be allowed east of the Ness Creek Tributary. c. Please show the location of the pedestrian access to Haven Place on the site plan to meet the requirements of Condition 3 above. d. There do not appear to be any Duke Energy transmission lines or easements through the property. If any easements are identified we recommend contacting Bill Wilder of Duke Energy (Bill.Wilder@duke-energy.com) to get Duke approval for this site plan before proceeding with any other permits. 2. UDO Section 5.1, Parking and Loading a. Site plan shows the minimum parking requirements have been met. 3. UDO Section 5.2, Traffic, Access and Connectivity a. Note: Building permits may not be issued for projects until NCDOT has issued the driveway permit for the site. 4. UDO Section 5.3, Tree Retention a. A tree removal permit was submitted with the site plan application. The tree removal permit is currently under review. b. Note: Land disturbance permits can be issued by county Engineering before a Tree Removal Permit is approved by Planning. However, any trees removed before the Tree Removal Permit is issued may result in enforcement action under Section 5.3.2 of the Unified Development Ordinance to include prohibiting any development of the site for 3 to 5 years. 5. UDO Section 5.4, Landscaping and Buffering a. Landscaping plan exceeds the minimum landscaping requirements and meets additional conditions of the conditional zoning district. Note: A lighting plan is not required for TRC approval but will be required before the county can issue construction or building plan approvals. 7. UDO Section 5.6, Signs a. Any wall or freestanding signs require separate permitting through COAST. b. If a freestanding sign is planned along Castle Hayne Road, staff recommends shifting some of the plantings shown on the landscaping plan to accommodate that future sign. 8. UDO Section 5.7, Conservation Resources a. The New Hanover County Conservation Resource Map indicates there are approximately 1.6 acres of Swamp Forest resources on the property. b. Section 5.7.3.A.4 states if the total aggregate acreage of a conservation resource exceeds 5 acres on a parcel, the resource must be preserved and meet additional requirements listed in Section 5.7.4 Additional Performance Controls. c. The 1.6 acres on the parcel do not qualify for conservation or additional setbacks. The adjacent Haven Place Subdivision currently under development field identified there was less than 5 acres of Swamp Forest on their development. No conservation space was required for the adjacent development that would have resulted in building setbacks for the Rainstorm Solutions project either. d. While the conservation resource standards of Section 5.7 do not apply, the project sites the structures outside the resource and in a way that restricts future development inside the resource. A land disturbing permit issued by the County is required for this project since the anticipated limits of disturbance is greater than 1 acre. Please digitally submit the permit application documentation with requisite review fees for County issued permit directly to gjamison@nhcgov.com. Application and forms can be found at https://www.nhcgov.com/249/Sediment-Erosion-Control. 2. A County stormwater permit issued by the County is required for this project. Please digitally submit the permit applications documentation with requisite review fees to the COAST online permit portal (https://newhanovercountync- energovpub.tylerhost.net/apps/selfservice#/home). Applicable forms can be found at https://www.nhcgov.com/251/Stormwater however the application form is not required as the information will be gathered by the COAST portal. 3. The offsite drainage coming from the north that will be routed through the site shall be placed in a revised public drainage easement sized in accordance with NHC Stormwater Manual. Construction within this offsite drainage conveyance measure that will be maintained by the county will need to be observed during construction by Stormwater Services and a turnover meeting scheduled once the system is ready to be conveyed to the county. Please add a plan note to ensure county construction observation and a turnover meeting occurs. Note, should the applicant elect to maintain the conveyance measures themselves, the POA covenants shall indicate the operation and maintenance roles and responsibilities for the conveyance measure. 4. No comments TO: New Hanover County Planning Department, November 21st, 2024 FROM: Dru Harrison, Director RE: Castle Hayne Rd - 3121 - Rainstorm Solutions I HAVE REVIEWED THIS PLAN AS REQUESTED AND HAVE THESE COMMENTS: The soils are predominantly Craven fine sandy loam (Cr), Johnston Soils (JO), Lynchburg fine sand (Ls), Onslow loamy fine sand (On), and Wrightsboro fine sandy loam (Wr). According to the booklet, “Wilmington/New Hanover Classification of soils for Septic Tank Suitability, Lynchburg, Onslow, and Wrightsboro are Class II soils, Craven is a Class III soil, and Johnston is a Class IV soil. The Soil Survey of New Hanover County lists Craven and Wrightsboro as moderately well drained, Lynchburg and Onslow as somewhat poorly drained, and Johnston as very poorly drained. Johnston soil is on the New Hanover County Hydric Soils Ä list which means it is possibly wetland area and subject to regulation under the Clean Water Act. Lynchburg is on the Hydric Soils “B” list, which means it may contain areas of wetland. It should be noted, according to the Soil Survey of New Hanover County, the limitation for dwellings with or without basements and for small commercial buildings is severe for all the soils on this site. The limitations are due to flooding and/or wetness. An adequate drainage and maintenance plan is needed for suitable housing. The U.S. Army Corps of Engineers has federal jurisdiction over 404 Permits and the NC Department of Environmental Quality, Water Quality Division, has state jurisdiction over 401 Permits under the Clean Water Act. Before disturbing possible wetland areas, developers should contact these agencies to stay in compliance with State and Federal regulations.
