Please include in the notes for this site plan that this site is tied to Rezoning case Z24-19, and is zoned (CZD) CS, Conditional Commercial Services. Please include the conditions of approval on the site plan in the notes table as well. i. UDO Section 5.1, Parking and Loading a. No parking minimums are required for wholesale nurseries. b. Please show the length of the loading berth. 3. UDO Section 5.2, Traffic, Access and Connectivity a. Please note that no building permit for any structure shall be issued which requires NCDOT approval for a Driveway Permit until NCDOT has issued the permit approval. Evidence of approval shall accompany the application for building permit. 4. UDO Section 5.3, Tree Retention a. Note: Land disturbance permits can be issued by county Engineering before a Tree Removal Permit is approved by Planning. However, any trees removed before the Tree Removal Permit is issued may result in enforcement action under Section 5.3.2 of the Unified Development Ordinance to include prohibiting any development of the site for 3 to 5 years. b. Please confirm no trees are being removed. 5. UDO Section 5.4, Landscaping and Buffering a. Landscape plan is missing. b. 5.4.2.B – Minimum of 15 trees planted or retained on site per acre disturbed c. 5.4.3 Transitional buffers - No buffer is required between Agricultural and residential d. 5.4.4 Screening – Please make sure the loading areas and dumpsters are screened from the residentially zoned parcel to the west. e. NHC Engineering, Galen Jamison 910-798-7072 1. A land disturbing permit issued by the County is required for this project since the anticipated limits of disturbance is greater than 1 acre. Please digitally submit the permit application documentation with requisite review fees for County issued permit directly to gjamison@nhcgov.com. Please digitally submit the permit applications documentation with requisite review fees to the COAST online permit portal (https://newhanovercountync-energovpub.tylerhost.net/apps/selfservice#/home). Applicable forms can be found at https://www.nhcgov.com/251/Stormwater however the application form is not required as the information will be gathered by the COAST portal. 3. The offsite drainage coming from the south and west that will be routed around the site shall be placed in a public drainage easement sized in accordance with NHC Stormwater Manual. Wholesale Nursery – 308 Hermitage Road – TRC Review Page | 4 Construction within this offsite drainage conveyance measure that will be maintained by the county will need to be observed during construction by Stormwater Services and a turnover meeting scheduled once the system is ready to be conveyed to the county. It appears the existing ditches will remain undisturbed. Note, should the applicant elect to maintain the conveyance measures themselves, the POA covenants shall indicate the operation and maintenance roles and responsibilities for the conveyance measure. 4. It is recommended the offsite existing damaged and full of mud 24” culvert be repaired since the parcel owner is the same. 5. Please contact the State for their stormwater permit requirements. Appropriate septic applications and permits must be received prior to building permit issuance. This can be done through local Environmental Health or a Private Option Permit through a consultant. 3. Site plan reflects a pump house which indicates connection to a well. The private drinking water well must maintain 25 feet from any structure to the well head. Comments not received at this time from: Emergency Services & E911, Steve Still NCDEQ, Chad Coburn NCDEMLR, Dan Sams DCM, Tanya Pietila TO: New Hanover County Planning Department, November 27th, 2024 FROM: Dru Harrison, Director RE: Hermitage Rd - 308 - Plant Nursery I HAVE REVIEWED THIS PLAN AS REQUESTED AND HAVE THESE COMMENTS: The soil is predominantly Bayboro loam (Ba), Stallings fine sand (St), and Torhunta loamy fine sand (To). According to the booklet “Wilmington/New Hanover Classification of soils for Septic Tank Suitability,” Stallings is a Class II soil; and Bayboro and Torhunta are Class III soils. The Soil Survey of New Hanover County lists Stallings as somewhat poorly drained; and Bayboro and Torhunta as very poorly drained. Bayboro and Torhunta soils are on the New Hanover County Hydric Soils Ä list which means they are possibly wetland areas and subject to regulation under the Clean Water Act. Stallings is on the Hydric Soils “B” list, which means it may contain areas of wetland. It should be noted, according to the Soil Survey of New Hanover County, the limitation for dwellings with or without basements and for small commercial buildings is severe for all the soils on this site. The limitations are due to flooding and/or wetness. An adequate drainage and maintenance plan is needed for suitable housing. The U.S. Army Corps of Engineers has federal jurisdiction over 404 Permits and the NC Department of Environmental Quality, Water Quality Division, has state jurisdiction over 401 Permits under the Clean Water Act. Before disturbing possible wetland areas, developers should contact these agencies to stay in compliance with State and Federal regulations.
