Subject: 3705 US HWY 421 N – 7/11 Convenience Store - TRC Review
The following comments have been received for the January 8, 2024, TRC meeting. Additional comments
may be made upon further review of subsequent revisions.
Please note: following the TRC meeting, a revised site plan addressing each of the below items must be
resubmitted prior to receiving site plan approval.

1. General Comments
a. Zoning: I-2, Gas Station and Convenience Store
b. This project is not located in the City of Wilmington. Please make sure the site abides by
the New Hanover County UDO.
c. Plans note a Duke easement on this property. Please confirm with Bill Wilder of Duke
Energy (Bill.Wilder@duke-energy.com) to get Duke approval for this site plan before
proceeding with any other permits.
2. UDO Section 5.1, Parking and Loading
a. Parking minimum of 12 spaces has been met.
b. Provided parking exceeds 25 spaces which will require EV capable spaces
c. Please note that the UDO requires all commercial development that exceeds 25 parking
spaces to provide conduit for future electric vehicle parking – EV- Capable spaces.
i. The number of EV-Capable spaces is calculated based on 20% of the parking
provided.
ii. This caps at a maximum of 15 EV-Capable spaces per project.

d. Please indicate on the site plan which spaces will be EV-capable and where the conduit
will be run.
3. UDO Section 5.2, Traffic, Access and Connectivity
a. Please note that no building permit for any structure shall be issued which requires
NCDOT approval for a Driveway Permit until NCDOT has issued the permit approval.
Evidence of approval shall accompany the application for building permit.
4. UDO Section 5.3, Tree Retention
a. A tree removal permit is required.
b. Please explain method of mitigation inches. See Section 5.3 of the UDO.
c. Please show where the replacement trees will be going. There are optional incentives for
retaining trees. Per section 5.3.8.A.6 for properties zoned I-2 along the HWY 421 corridor
– retention of existing tree coverage may replace required street yard and transitional
buffer landscaping.
d. Note: Land disturbance permits can be issued by county Engineering before a Tree
Removal Permit is approved by Planning. However, any trees removed before the Tree
Removal Permit is issued may result in enforcement action under Section 5.3.2 of the
Unified Development Ordinance to include prohibiting any development of the site for 3
to 5 years.
5. UDO Section 5.4, Landscaping and Buffering
a. Transitional buffer yards are not required between I-2 districts.
b. The landscape plan shows a table titled “City Requirements”. This project is not in the
city. Please update this table using the county requirements for landscaping and buffering
per section 5.4 of the UDO.
6. UDO Section 5.5, Lighting
a. Please note that a lighting plan is not required for TRC approval, but will be required prior
to issuance of construction plan approvals.
7. UDO Section 5.6, Signs
a. For any signs on the site, please submit for a sign permit, referencing Section 5.6 of the
UDO for standards.
8. UDO Section 5.7, Conservation Resources
a. Per the New Hanover County Conservation Resources map, there are no Conservation
Resources on the site.

1. A land disturbing permit issued by the County is required for this project since the anticipated
limits of disturbance is greater than 1 acre. Please digitally submit the permit application
documentation with requisite review fees for County issued permit directly to
gjamison@nhcgov.com. Application and forms can be found at
https://www.nhcgov.com/249/Sediment-Erosion-Control.
2. A County stormwater permit issued by the County is required for this project. Please digitally
submit the permit applications documentation with requisite review fees to the COAST online
permit portal (https://newhanovercountync-
energovpub.tylerhost.net/apps/selfservice#/home). Applicable forms can be found at
https://www.nhcgov.com/251/Stormwater however the application form is not required as the
information will be gathered by the COAST portal.
3. Please contact the State for their stormwater permit requirements. A high density permit is
anticipated.
4. An O&M agreement between the 2 parcel owners identifying the demarc location for the
maintenance of the SCM/piping system with the addition inlet A1. Please forward a copy of the
agreement.
5. 2’ separation between seasonal high water table is not provided as the bottom of the infiltration
basin as it is 5’ below existing grade but SHWT is 39 to 54 inches below existing grade. A different
SCM or regrading of the SCM may be necessary.

1. Well review: Satellite imagery indicates a well house and potential existing well on the property.
Well head must identified and protected during demolition. Existing well head must be properly
abandoned by a Certified Well Driller. Site plan shows connection to public water.
2. Septic review: Existing building has a septic system. Building was built in 1972 and records for the
septic system cannot be easily found. Site plan reflects connection to a septic system. This septic
system (and repair) must be installed in virgin soil and not in area already utilized by a septic
system. Old septic tank must be located and pumped, crushed and filled. Appropriate septic
system applications and permits must be obtained either through Environmental Health or a
Private Option Permit (AOWE or EOP). These will need to be issued prior to building permit
issuance. Any food service within the facility will also need plan review approval from the NC Food
Service Plan Review Unit with Environmental Health.

I HAVE REVIEWED THIS PLAN AS REQUESTED AND HAVE THESE COMMENTS: The soils are predominantly Lakeland sand (La) and Leon sand (Le).
According to the booklet “Wilmington/New Hanover Classification of soils for Septic Tank Suitability,” Lakeland sand is a Class I soil and Leon is a Class III soil.
The Soil Survey of New Hanover County lists Lakeland as excessively well drained and Leon as poorly drained.
Lakeland is on the Hydric Soils “B” list which means there may be areas of wetland included in the mapping unit. It should be noted, according to the Soil Survey of New
Hanover County, the limitation for dwellings with or without basements and for small commercial buildings is severe for all the soils on this site. The limitations are due to
flooding and/or wetness. An adequate drainage and maintenance plan is needed for suitable housing.
The U.S. Army Corps of Engineers has federal jurisdiction over 404 Permits and the NC Department of Environmental Quality, Water Quality Division, has state
jurisdiction over 401 Permits under the Clean Water Act. Before disturbing possible wetland areas, developers should contact these agencies to stay in compliance with
State and Federal regulations.

General Comments:
NCDOT Driveway Permits, and Encroachments are submitted through the NCDOT Online

NCDOT Driveway Permit:
An NCDOT Driveway permit has been submitted to NCDOT for review.
• Permit # D033-065-24-00152.
NCDOT Encroachment Agreement:
An NCDOT Encroachment Agreement is required for any utility connections or installations
within the NCDOT right-of-way (form 16.6).
Required Roadway Improvements:
US 421 and Mid Atlantic Roofing Northern Driveway / Existing Access A:
• Construct a southbound right turn lane on US 421 with 100 feet of storage and
appropriate full-width deceleration and taper.
• Restripe the existing two-way-left-turn-lane (TWLTL) to establish an exclusive
northbound left turn lane on US 421 with 50 feet of full-width storage.
• Reconstruct existing access A (eastbound approach) with one ingress lane and one egress
lane.
• Provide an internal protected stem length of 100 feet, as measured from the right-of-way
line.
• Provide stop controls for the eastbound approach.

Refer to the NCDOT Roadway Design Manual for help with the design of any required roadway
improvements.
Site Plan Comments:
The site plan will need to show all required roadway improvements for both site access points per
the TIA letter.
Drainage/Stormwater Conveyance:
• If the drainage does not naturally flow to the NCDOT right of way the historic drainage
pattern should be maintained.
Include/update the NCDOT Standard Drawings (2024) that are applicable to the development.
Refer to the NCDOT Subdivision Manual for design requirements on the proposed island.
Sight Triangles and Sight Distance:
• Show and label the 10’ X 70’ NCDOT sight triangles.
o No obstructions shall be placed within the NCDOT sight triangles.
• Show and label the stopping sight distance.
o No obstructions shall be placed within the stopping sight distance.
Label the radii for the driveway proposed driveway/driveways.
• Make sure to accommodate the largest proposed vehicle.
• Provide auto turn templates for the largest proposed vehicles.
Label the internal protection stem length for the proposed driveway connection.
• Measured from the right-of-way line.
