RE: TRC Review resubmittal, Phillips Center of Wilmington, New Hanover County, North Carolina

We received the comments from the initial TRC meeting and have addressed them.
Below you will find the comments and some detail on how they have been addressed.
Planning, Robert Farrell 910-798-7164
1. General Comments ( if applicable)
a. The properties are zoned I-2, Heavy Industrial and the project proposes the
installation of a road network a future commercial / industrial park.
b. Project is in both New Hanover County and Pender County. New Hanover
County and Pender County must both separately approve the project in order to
proceed with any construction in New Hanover County.
Understood.
c. Consider shifting a section of Phillips Center Loop east away from running
directly parallel to US 421 ( shown in red). This would provide an area to retain
trees and provide a vegetative buffer along the highway ( shown in green).
The owner would like to keep the drive along 421 adjacent to the R/W. there is
also an easement agreement with CFPUA to access the pump station that is
within the same footprint as the planned road.
2. UDO Section 5.1, Parking and Loading
a. No parking required for the initial infrastructure phase of the project. Each
future site will be responsible for providing adequate off-street parking in
compliance with Section 5.1 Parking and Loading.

3. UDO Section 5.3, Tree Retention
a. A separate tree retention permit will need to be submitted through COAST.
The owners intension is to Timber this site prior to moving to construction.
No reference to “Tree Retention Permit” was found in the UDO. It is assumed
that the above references the “Tree Removal Permit”. We have this application
and will submit through the COAST portal.

We have the Tree Removal Permit application and will be submitting this
through the COAST portal.
c. The TRC application includes a plot sampling survey of trees on site.
d. The Site Data Table on page C 2.0 indicates 64 total disturbed acres. Is that the
acreage of the proposed roadways and infrastructure for both Phase I and II?
This is the total footprint area of the site that will incur land disturbance
due to grading or utility installation. There is some grading that is called for in
the Phase II area to allow for access to uplands in the rear of the site. There is no
infrastructure being installed in the phase II area. This value have been updated
to 66.1 ac.
e. And is that inclusive of the acreage disturbed in Pender County?
Yes, this is all of the disturbed area for the planned grading both in
Pender and New Hanover.
f. In order to calculate any required mitigation the tree removal permit
application materials should indicate the areas disturbed, the total acreage in
New Hanover County.
We have broken out the planned disturbance based on county on the
data block on the site plan C-2.0.
g. The tree removal permit can apply only to the roadway and other
infrastructure proposed. Each individual future development in the industrial /
commercial park within New Hanover County would be subject to the tree
retention standards.
The intension is to timber the entire site and the site is being mass
graded. The grading plan gives the best view of what area is being graded. It is
the area for the roads and all of the “interior” land is being graded in preparation
for the future lots.
h. Any trees that may be required for mitigation for this infrastructure phase of
the project may not count for mitigation on future tree removal activities.
Understood. It is our hope that the tree calculations will yield that the 19
acres delineated for conservation will cover the mitigation requirements for tree
removal.

4. UDO Section 5.4, Landscaping and Buffering
a. Landscaping and buffering are not required for the installation of
infrastructure. Each development in the industrial / business park will be
responsible for providing the required street yard, parking, and any other
required landscaping and buffering on their
individual sites.

5. UDO Section 5.5, Lighting
a. Are streetlights included in the infrastructure phase? If so, streetlights must
comply with the lighting standards of Section 5.5.
Streetlights are not a part of this phase.
b. Each future site will be required to submit their own individual lighting plan
for approval at the time of development.

6. UDO Section 5.6, Signs
a. The primary entrance is in Pender County’ s jurisdiction. If a primary
development sign is proposed at the entrance, it must meet the requirements of
Pender County.

b. Any signs inside the jurisdiction of New Hanover County will need to meet the
county’s sign requirements.

7. UDO Section 5.7, Conservation Resources
a. There are approximately 31.5 acres of Swamp Forest conservation resources
b. There are approximately 18.5 acres of Pocosin conservation resources in the
project area. 6.5 acres are underlaid with Class IV soil.
c. A minimum of 5 acres of a conservation resource triggers additional ordinance
requirements under Section 5.7.
d. Table 5.7.3.A.5 establishes the calculation for determining the minimum
amount of conservation space required. The calculation is the total acreage of
the conservation resource multiplied by 0.5.
i. 31.5 acres x 0.5 = 15.75
ii. 6.5 acres x 0.5 = 3.25
iii. 15.75 + 3.25 = 19 total acres required for conservation.
Based on the provided calculation we have designated 19 acres for conservation
for this site. This area will not be timbered, disturbed or molested in any way through

the development process. 5.7.2 (B) indicates that the Conservation Resources should be
shown on the site plan. I looked through the GIS maps available but did not find a map
of these resources. What is the best way for us to get this data if it is to be shown on the
site plan?
e. Table 5.7.4 Additional Performance Controls states that when there are 3 or more
acres of a Swamp Forest or Pocosin conservation resource additional standards are
required under Section 5.7.4.C
i. All structures and impervious surfaces shall be set back 50 feet from the
conservation resource.
Once we have the data needed to show these items on the site plan the
50’ setbacks can be verified.
ii. On-site retention and percolation areas shall be required for the entire parcel
sufficient to control, at a minimum, the first 0.5 inches of runoff that will
originate from all impervious surfaces anticipated to be on the site upon final
development. The specified amount of runoff from impervious surfaces shall be
disposed of by percolation into the soil, evaporation, transpiration, or other
methods of treatment or handling acceptable to the County Engineering
Department.
We are working with the County Engineering Department and NCDEQ to
ensure that all of the storm water requirements are met.
8. UDO Section 5.8, Open Space Requirements ( if applicable)
a. Not applicable to the installation of infrastructure.

b. While open space is not required, the Conservation Resource standards of
Section 5.7 require a minimum of 19 acres of conservation space.
The 19 acres of conservation space is shown on the site plan.
9. UDO Article VI Subdivision Design and Improvements
a. Section 6.2.2.A.7.g Street Connectivity Standards
i. There are 6 links and 4 nodes within the New Hanover County portion
of the project. 6/ 4 = 1.5 which meets the required street connectivity
ratio requirements.

a. Understood, assuming this pertains to buildings built on the site.
2. I spoke with Tommy Batson, he has agreed to have one plan reviewer all by New
Hanover County Fire' s DFM Ray Griswold. He will be kept in the loop. The
reasoning, is that the majority of the project belongs in New Hanover County.

developer and the PE.

4. Any storage tanks located on the properties shall be permitted by the
appropriate AHJ.

appropriate fire protection as outlined in the fire code.

inspections. This is why we ask that no buildings straddle the county line.

1. A land disturbing issued by the County is required for this project. Please digitally
submit the permit application documentation with requisite review fees for County

We will verify that this has been done and follow up.
2. A County stormwater permit issued by the County is required for this project. Please
digitally submit the permit applications documentation with requisite review fees to the
COAST online permit portal (https:// newhanovercountyncenergovpub.tylerhost. net/
apps/ selfservice#/ home). Applicable forms can be found at https:// www.nhcgov. com/

251/ Stormwater however the application form is not required as the information will
be gathered by the COAST portal.
We will verify that this has been done and follow up.
3. This parcel qualifies for an exemption to the County’ s pre and post storm attenuation
requirements should it be design in accordance with the City and County’ s Low Impact
Design LID) Manual (http:// laserfiche. nhcgov. com/ weblink/ 0/ edoc/ 3273331/ LID-
Manual. pdf). Please provide requisite documentation for compliance with LID manual
and a variance request in accordance with NHC UDO, Section 7.12 during the County
stormwater permitting process. As park’ s parcel’ s are developed and impervious area
added, each parcel will need submit for a County stormwater permit and meet the pre
and post storm attenuation requirements unless LID measures are proposed.
We will verify that this has been done and follow up. Understood that individual
development sites within the project will need individual permits.
4. Please contact the State for the stormwater permit requirements. It is assumed a low
density permit with future pockets of high density will be obtained.

obtained then individual septic and well permits must be applied and received.

c. The intersections internal to the development will not be signalized. Stop
bars are not required at non signalized intersections (STD 1205.04) so
they have not been shown on the internal intersections. Stop sign
locations have been shown at all intersections on the site plan.
d. Sight distance easements shown at all intersections.
e. Turning template wheel track lines shown for entering the development.
