On Wednesday, December 18, 2002, New Hanover County's Technical Review
Committee (TRC) approved the above referenced plan by a vote of 5-0. Marsh Oaks: sections 7,
8, & 9 was approved for a total of 119 single family lots as displayed on your site plan design of
the project. Please note that in their approval, the TRC required the following:
1) A field check by the County and your office will need to be made to determine
whether a natural pond (WPN) located on the project site actually exists. A 50 foot
conservation setback will be required along with 100 percent preservation of the pond
if the resource does exist. Access to the pond will be required either through an
easement or road adjustment.
2) Improved public road access will be required to Bayshore Drive when 80 percent of
the lots are platted/recorded within Sections 7, 8, and 9. This access will provide an
alternate for the Bayshore and Marsh Oaks neighborhoods out to Market Street.
3) The TRC agreed with Fire Services that fire plugs located at lots 507, 549 & 518 be
removed. However, a new plug will need to be installed at lot 502.
TRC members attending the meeting were: Walt Conlogue, Planning Board; Dexter
Hayes, Planning Director; Adam Rahhal, County Engineering; Mark Tinkler, MPO and Wayne
Burns, Fire Services. Also attending were Holt Moore, County Attorney; Bill Cameron,
Bayshore Estates, Inc; Jabe Hardee, Cameron Company; interested County citizens, members of
the Planning staff (Burgess, Stewart), and you.
Marsh Oaks: sections 7, 8, & 9 will be valid as preliminary site plans for 24 months in
accordance with Section 33 of the County's Subdivision Regulations. If a final plat for all or a
part of the project is not approved prior to the 24 month time frame, the project will become null
and void. A preliminary plan extension may be granted by the TRC for 12 months prior to
expiration. The TRC may grant a maximum of two (2) one (1) year extensions. In the fixture, this

project may be served by County sewer. However, due to the limited capacity of the County's
wastewater treatment facilities, sewer capacity may not exist. DEHNR wastewater sewer
construction and operations permits and/or final plat approval of sections may be withheld, if in
the opinion of the County Engineer, adequate sewer capacity does not exist. Please also be
advised that all other local, State, and Federal regulations may be applicable.
As you know, final plat approval for all or part of the project can not be obtained until
construction plan drawings are submitted and approved by County Engineering staff. Several
"significant" trees (at least 2) were determined to be on site and will need to be mitigated.
