BRIEF SUMMARY:
The Greater Wilmington Chamber of Commerce Education Foundation has requested a resolution recognizing its
efforts through the Leadership Wilmington program. Chair Rivenbark and Vice -Chair Pierce will be participating in the
April 1, 2025 County Government Issues session and will present the resolution at that time.
Chair Rivenbark will present and read the proclamation during the Leadership Wilmington program panel discussion on
April 1, 2025.

RESOLUTION RECOGNIZING THE EFFORTS OF
THE GREATER WILMINGTON CHAMBER FOUNDATION THROUGH THE LEADERSHIP
WILMINGTON PROGRAM
WHEREAS, the objective of Leadership Wilmington is to educate, challenge and motivate citizens
and to develop future leaders to work for the betterment of our community; and
WHEREAS, the program consists of ten sessions to promote leadership skills, community issues
and challenges, regional social and economic change, diversity, equity, and inclusion; and
WHEREAS, the Leadership Wilmington members work together and individually to plan and
execute a day of service for schools and nonprofits, known as Work on Wilmington; and
WHEREAS, Leadership Wilmington is committed to providing a continuous, diverse supply of
creative leaders to the community by developing their knowledge of the region and providing
them the opportunity for meaningful action.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners
recognizes the Leadership Wilmington Class of 2025 and the Greater Wilmington Chamber
Foundation for their commitment and dedication for contributing to the quality of life in New
Hanover County and surrounding areas.

BRIEF SUMMARY:
BA 25-042 amends the budget for a $17,769 payment due to the IRS related to excess investment earnings while the
county held the proceeds from the 2020 General Obligation bonds. Also called "arbitrage earnings," this payment is
due because the county borrowed when interest rates were at historic lows following Covid-19 and was able to invest
a portion of the proceeds until they were spent in investments earning more than the cost of the borrowing. Earnings
in excess of the borrowing cost must be remitted to the IRS, which discourages local governments from borrowing,
using their tax-exempt status, and earning a positive spread from the earnings on the proceeds.

Section 2: Explanation

Approval of Change to the Cape Fear Public Utility Authority Articles of Incorporation
BRIEF SUMMARY:
At the Cape Fear Public Utility Authority (CFPUA) Board's regular meeting on February 12, 2025, the Board formally
requested a change to the Articles of Incorporation. Currently, the Articles impose a limit on the number of
consecutive three-year terms that appointees may serve on the Authority, and the Board has requested the removal of
this limitation. Both the County and the City of Wilmington must approve the proposed change. The Wilmington City
Council is expected to consider CFPUA's request at its March 18th meeting.

Re: Amendment to Cape Fear Public Utility Authority Articles of Incorporation
Dear Commissioner Rivenbark:
On February 12, 2025, the Cape Fear Public Utility Authority (CFPUA) Board authorized staff to engage our
sponsoring agencies to seek an amendment of Section 3.2 of the CFPUA Articles of Incorporation for the
limited purpose of removing term limitations for appointees to CFPUA's Board.
As you are aware, CFPUA is about to embark on the largest single project since its creation, the
replacement and expansion of South Side Wastewater Treatment Plant (SSWWTP). This project is critically
important for continued environmental stewardship and the orderly growth of the City and County.
Current CFPUA Board members have significant institutional knowledge of and experience with CFPUA's
operations and finances; knowledge critical to the successful implementation of the SSWWTP project.
Over the next 5-10 years, the need for institutional stability is at odds with the limitations set forth in Sec.
3.2 of the Articles of Incorporation. CFPUA staff believe that our sponsoring agencies, New Hanover
County and the City of Wilmington, should have as much flexibility as possible in the appointments
process, so institutional stability may be properly considered in selection deliberations.
Upon CFPUA's creation in 2007, the Articles of Incorporation included a term limitation for appointees to
no more than three full consecutive terms (See, Sec. 3.2). Each term is for a three-year period. We are
requesting that the Articles of Incorporation be amended as follows:
3.2 A proportionate number of the initial members of the Authority shall have terms
expiring three years, two years and one year respectively from the date of issuance of
the Certificate of Incorporation or Charter for the Authority by the North Carolina
Secretary of State. After the initial terms each member of the Authority shall be
appointed for a three-year term. No appointee shail: serve mere than three full
eenseetitove terms. An appointee who serves three full: eanseetitive terms shall not
be eiggibLe foF re appeintment to the Autherity for one year
Under the Articles of Incorporation, any amendment must be made by the express agreement of both
New Hanover County and the City of Wilmington. At the urging of staff, the CFPUA Board is asking the
Board of Commissioners - March 24, 2025

County to remove the above language from Section 3.2 to enable the County and the City the freedom to
reappoint CFPUA's Board members that would be otherwise term limited, if they so choose.

AMENDMENT TO THE ARTICLES OF INCORPORATION
CAPE FEAR PUBLIC UTILITY AUTHORITY
The Articles of Incorporation of the Cape Fear Public Utility Authority adopted June 21, 2007
are hereby amended as follows:
1. Section 3.2 is modified to remove term limitations to now read:
Each member shall be appointed to a three-year initial term, or until the completion of
any expiring term to which they are being appointed to complete. After the initial term,
each member of the Authority may be reappointed to additional three-year terms, at the
discretion of the appointing agency. The term of any elected official shall expire
immediately when the elected official no longer occupies the elected office.
2. Except as specifically amended above, the Articles of Incorporation adopted June 21,
2007 shall remain affixed and in full force and effect.
IN WITNESS THEREOF, the City of Wilmington, North Carolina has cause this
Amendment to the Articles of Incorporation to be executed by Mayor Bill Saffo and its corporate
seal to be affixed hereto and attested by the City Clerk as of this day of ,
2025; and
New Hanover County, North Carolina has caused this Amendment of the Articles of
Incorporation to be executed by its Chair William E. Rivenbark and its corporate seal to be

CAPE FEAR PUBLIC UTILITY AUTHORITY
ARTICLE I
NAME AND PRINCIPAL OFFICE
1.1 The name of the authority shall be the Cape Fear Public Utility Authority
(Authority).
1.2 The address of the initial principal office of the Authority is 320 Chestnut Street,
Wilmington, North Carolina 28401.
ARTICLE II
ORGANIZATION
2.1 The Authority is organized under Chapter 162A, Article 1 of the North Carolina
General Statutes known as the North Carolina Water and Sewer Authorities Act,
as amended (Act).
2.2 The names of the organizing and initially participating political subdivisions are
the City of Wilmington, North Carolina (Wilmington or City) and New Hanover
County, North Carolina (County).
ARTICLE III
MEMBERS
3.1 The Authority shall consist of eleven members who shall be residents of New
Hanover. County.
3.1.1 The governing body of each participating political subdivision shall appoint to the
Authority the number of members set forth opposite its names below:
City of Wilmington 5
New Hanover County 5
No more than two of the members appointed by the City and two of the members
appointed by the County may be elected officials.
3.1.2 The eleventh member of the Authority shall be appointed jointly by the City of
Wilmington and New Hanover County.

expiring three years, two years and one year respectively from the date of

3.2.3 The name, address and term of the eleventh initial member of the Authority
appointed by Wilmington and the County is:

3.2.4 The initial terms of office begin on the date of issuance of the Certificate of
Incorporation or Charter by the North Carolina Secretary of State.
The governing body of each participating political subdivision shall be
empowered to remove at any time any member of the Authority appointed by it
with a three fourth (3/4) majority vote of the appointing governing body.
In addition, persons serving because of their positions as elected officials may be
removed when they leave elected office.
The governing body whose member is removed shall appoint a successor member
to fill the unexpired portion of the removed member's term.
ARTICLE IV
PURPOSES AND POWERS
4.1 The purposes for which the Authority is formed is to exercise all the powers
granted to the Authority to acquire, finance, construct, manage and maintain and
operate a water system and a sewer system as defined and authorized under the
Act, and may include stormwater and other services as authorized by law and if
approved by the City and County.
4.2 The Authority shall have all the rights, power and duties of an Authority under the
Act.
4.3 The Authority shall serve its designated service area of the unincorporated area of
New Hanover County that constitutes the New Hanover County Water and Sewer
District and the City of Wilmington. The Authority may serve such other political
subdivisions and private entities as the Authority may determine upon the terms
and conditions established pursuant to contract.

ARTICLE V
AMENDMENT AND ACTIONS
5.1 These articles shall not be amended or changed without the express agreement of
each of the governing bodies of the organizing political subdivisions.
5.2 None of the following actions shall be taken or permitted to occur by the
Authority without the affirmative vote of a majority of the members appointed by
each incorporating political subdivision:
(a) The inclusion of additional political subdivisions or other entities in the
Authority in accordance with the Act.
(b) Agreements with other political subdivisions, entities, or persons for the bulk
sale of surplus water or the acceptance and treatment on a bulk basis of
wastewater, hauled waste and/or sewage.
ARTICLE VI
ANNUAL BUDGET, AUDIT AND ENVIRONMENTAL REPORTS
6.1 A certified copy of the annual budget and annual audit and a copy of annual
environmental compliance reports shall be delivered promptly to each of the
participating political subdivisions and any other participating entities.

LEGISLATIVE INTENT/PURPOSE:
N.C.G.S. Chapter 162A, Article 1 known as the North Carolina Water and Sewer Authorities
Act, as amended (the "Act") authorizes political subdivisions, including cities and counties, to
create a water and sewer authority to operate their water system and/or sewer system.
On September 20, 2005 the Wilmington City Council and on September 19, 2005 the New
Hanover County Board of Commissioners adopted a concurrent resolution setting forth their
intent to form an authority to consolidate their water and sewer utilities. The governing bodies
directed City and County staff to research and develop a proposed implementation plan to
include, legal, financial, engineering and administrative issues relating to the consolidation of
water and sewer utilities and to present the final plan to them and to hold a public hearing.
The City and County engaged Municipal & Financial Services Group (MFSG) as the Project
Manager to plan for the consolidation and formed the joint Water Sewer Advisory Committee to
guide the consolidation and to make recommendations to the City and County governing bodies
regarding creation of a consolidated water and sewer authority for the City and County water and
sewer systems, excluding stormwater.
MFSG developed a consolidation plan and implementation schedule that identifies
responsibilities, organization structure, timeline and preliminary utility rates and fees.
The Water Sewer Advisory Committee has made its recommendations to the City Council and
Board of Commissioners, including a recommendation to create an Authority pursuant to the Act.
In accordance with the requirements of the Act, pursuant to notice a public hearing was held
before the Wilmington City Council and New Hanover County Board of Commissioners, and
they have determined that it is in the best interest of the City and County to create the Cape Fear
Public Utility Authority pursuant to the provisions of the Act and desire to do so by the adoption
of concurrent resolutions.

NAME AND PRINCIPAL OFFICE
1.1 The name of the authority shall be the Cape Fear Public Utility Authority (Authority).

ARTICLE 11
ORGANIZATION
2.1 The Authority is organized under Chapter 162A, Article 1 of the North Carolina General
Statutes known as the North Carolina Water and Sewer Authorities Ad, as amended (Act).
2.2 The names of the organizing and initially participating political subdivisions are the City of
Wilmington, North Carolina (Wilmington or City) and New Hanover County, North Carolina (County).
ARTICLE III
MEMBERS
3.1 The Authority shall consist of eleven members who shall be residents of New Hanover
County.
3.1.1 The governing body of each participating political subdivision shall appoint to the Authority
the number of members set forth opposite its names below:

No more than two of the members appointed by the City and two of the members appointed
by the County may be elected officials.
3.1.2 The eleventh member of the Authority shall be appointed jointly by the City of Wilmington ani
New Hanover County.
3.1.3 A proportionate number of the initial members of the Authority shall have terms expiring
three years, two years and one year respectively fsom the date of issuance of the Certificate
of Incorporation or Charter for the Authority by the North Carolina Secretary of State. After
the initial terms each member of the Authority shall be appointed for a three-year term. No

3.2.4 The initial terms of office begin on the date of issuance of the Certificate of Incorporation or

The governing body of each participating political subdivision shall be empowered to remove at
any time any member of the Authority appointed by it with a three fourth (3/4) majority vote of the
appointing governing body.
In addition, persons serving because of their positions as elected officials may be removed when
they leave elected office.
The governing body whose member is removed shall appoint a successor member to fill the unexpired
portion df the removed member's term.
ARTICLE IV
PURPOSES AND POWERS
4.1 The purposes for which the Authority is formed is to exercise all the powers granted to the
Authority to acquire, finance, construct, manage and maintain and operate a water system and
a sewer system as defined and authorized under the Act, and may include stormwater and other
services as authorized by law and if approved by the City and County.
4.2 The Authority shall have all the rights, power and duties of an Authority under the Act.
4.3 The Authority shall serve its designated service area of the unincorporated area of New
Hanover County that constitutes the New Hanover County Water and Sewer District and the City of
Wilmington. The Authority may serve such other political subdivisions and private entities as the
Authority may determine upon the terms and conditions established pursuant to contract.
ARTICLE V
AMENDMENT AND ACTIONS
5.1 These articles shall not be amended or changed without the express agreement of each of
the governing bodies of the organizing political subdivisions.
5.2 None of the following actions shall be taken or permitted to occur by the Authority without the
affirmative vote of a majority of the members appointed by each incorporating political subdivision:
(a) The inclusion of additional political subdivisions or other entities in the Authority in accordance
with the Act.
(b) Agreements with other political subdivisions, entities, or persons for the bulk sale of surplus
water or the acceptance and treatment on a bulk basis of wastewater, hauled waste and/or sewage.
ARTICLE VI
ANNUAL BUDGET, AUDIT AND ENVIRONMENTAL REPORTS
6.1 A certified copy of the annual budget and annual audit and a copy of annual environmental
compliance reports shall be delivered promptly to each of the participating political subdivisions and
any other participating entities.

BRIEF SUMMARY:
A Beach and Inlet Management Plan (BIMP) serves as a common reference point and data resource when having
stakeholder and strategy discussions for the management of regional beach and inlet systems.
The first North Carolina BIMP was funded via House Bill 1840 (Session Law 2000-67), and the original plan was
completed in 2009. The plan was led and coordinated by the North Carolina Department of Environmental Quality
through the Division of Water Resources and the Division of Coastal Management with assistance from a professional
consulting firm, Moffatt & Nichol. It included detailed technical data, provided socio-economic values, and explored
funding mechanisms and strategies related to the management of the shoreline and inlets.
In 2016, the BI MP was updated to incorporate new coastal and socioeconomic data, reflect policy changes since the
original plan, and include beach nourishment and dredging activities and efforts. The updated BIMP also helped refine
cost projections for the current and future management of the shorelines throughout the state.
The North Carolina Beach, Inlet, and Waterway Association has asked its members to pass a resolution of support for
the North Carolina General Assembly to fund an update to the BI MR With the current plan approaching ten years, an
update is necessary to incorporate the many changes over the last several years, particularly as they relate to costs
and policies when communicating the importance of effectively managing the state's shoreline infrastructure.

THE 2016 NORTH CAROLINA BEACH AND INLET MANAGEMENT PLAN (BIMP)
WHEREAS, the first BIMP was funded via House Bill 1840 (Session Law 2000-67) and completed in
2009, providing necessary information to address North Carolina's (N.C.) natural resources, funding
mechanisms, and strategies for the comprehensive management of the state's ocean and inlet
shorelines; and
WHEREAS, the BIMP provided essential socioeconomic values of N.C. beaches and recommended
management strategies; and
WHEREAS, in 2016, an updated BIMP incorporated new coastal and socioeconomic data and
reflected policy changes implemented since the original plan, including the latest beach
nourishment and dredging activities completed over the previous seven (7) years; and
WHEREAS, the 2016 updated BIMP also projected the necessary funding required to maintain the
state's coastline while offering several potential revenue options; and
WHEREAS, due to continued growth in N.C. coastal communities, a regularly updated BIMP is
necessary to effectively guide state and local management resources in complex planning efforts
that support 326 miles of ocean shoreline, barrier islands, and 19 active inlet complexes that
collectively generate over $4 billion in annual revenue.
NOW, THEREFORE, BE IT RESOLVED that the New Hanover County Board of Commissioners
supports the efforts of the North Carolina Beach, Inlet, and Waterway Association encouraging the
North Carolina General Assembly to fund the update to the 2016 North Carolina Beach and Inlet
Management Plan.

WHEREAS, the Congressional Medal of Honor is the nation's highest award for individual valor
and has been awarded to more than 3,500 people since 1863; and
WHEREAS, in 1991, Congress established Medal of Honor Day to "foster public appreciation and
recognition" of Medal of Honor recipients; and

WHEREAS, today the Board of Commissioners recognizes the service of local Medal of Honor
recipients Edwin A. Anderson, Charles Patrick Murray, Jr., William D. Halyburton, Jr., and Eugene
Ashley, Jr.; and
WHEREAS, Rear Admiral Edwin A. Anderson was the first New Hanover County native to be
awarded the Medal of Honor. Anderson was born in Wilmington in 1860, graduated from the
U.S. Naval Academy in 1882, and became a career Navy officer, serving in the Spanish-American
War and World War I until his retirement in 1924. He was awarded the Medal of Honor for his
service in Vera Cruz, Mexico, in 1914. Anderson's "indifference to heavy fire, to which he himself
was exposed at the head of his regiment, showed him to be fearless and courageous in battle."
He died in 1933 and is buried in Arlington National Cemetery; and
WHEREAS, Colonel Charles Patrick Murray, Jr. was the second New Hanover County native to
receive the Medal of Honor. Born in Maryland but raised in Wilmington, Murray graduated from
New Hanover High School in 1938. A career military officer, he served in World War II, Korea, and
Vietnam. Murray earned the Medal of Honor as a first lieutenant in France in December 1944.
Putting himself in the line of fire in enemy territory, he killed at least 20 German soldiers,
captured 10, and wounded many more. Despite being wounded, he continued to lead his men.
According to his citation, he "stopped a counterattack, established an advance position against
formidable odds, and provided an inspiring example for the men of his command." Colonel
Murray died in 2011 and is buried in Arlington National Cemetery; and
WHEREAS, William D. Halyburton, Jr. was the third New Hanover County native awarded the
Medal of Honor, sacrificing his life in combat on May 10, 1945, in Okinawa, Japan. A 1943
graduate of New Hanover High School, Halyburton served as a pharmacist's mate 2nd class in the
U.S. Navy. He was killed while shielding and tending to a wounded Marine. His citation states that
"he shielded the fallen fighter with his own body and... persevered in his efforts until he himself
sustained mortal wounds and collapsed, heroically sacrificing himself that his comrade might
live." Halyburton is buried in the National Memorial Cemetery of the Pacific; and

WHEREAS, Sergeant Eugene Ashley, Jr. was the fourth New Hanover County native awarded the
Medal of Honor. Born in Wilmington, Ashley joined the U.S. Army in 1951 and was posthumously
awarded the Medal of Honor for his actions in the Vietnam War. He led five gallant charges
against enemy forces during a 1968 battle, demonstrating extraordinary courage. His citation
states, "The resolute valor with which he led five gallant charges placed critical diversionary
pressure on the attacking enemy... Ashley's bravery at the cost of his life was in the highest
traditions of the military service and reflects great credit upon himself, his unit, and the U.S.
Army." Sergeant Ashley is buried at Rockfish Memorial Park in Fayetteville, North Carolina; and
WHEREAS, the Board of Commissioners urges the community to learn more about these heroic
individuals and recognize their valor, service, and contributions to the nation.
NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of Commissioners that
March 25, 2025, will be recognized as Medal of Honor Day in New Hanover County.

Jr., who resides in North Carolina. Major Capers is not only a national hero but also a distinguished member of North
Carolina's military community, embodying the values of service, sacrifice, and resilience that define both the Marine
Corps and our state.
A highly decorated Marine Corps veteran, Major Capers demonstrated exceptional heroism during the Vietnam War,
leading his Force Reconnaissance team through intense combat while sustaining life -threatening injuries. Although he
was awarded the Silver Star, military leaders, veterans' organizations, and local governments, including the City of
Wilmington, Onslow County, and surrounding counties, have passed resolutions advocating for the Medal of Honor as
the appropriate recognition of his service.
Adoption of this resolution reinforces New Hanover County's commitment to honoring Major Capers' extraordinary
bravery and sacrifice while supporting all veterans who have served and continue to serve our community.

RESOLUTION IN SUPPORT OF AWARDING THE MEDAL OF HONOR TO RETIRED MAJOR JAMES CAPERS, JR.
WHEREAS, the Medal of Honor is the nation's highest military decoration, awarded to fewer than 3,600
individuals in U.S. history for acts of extraordinary valor, unwavering courage, and selfless service
beyond the call of duty; and
WHEREAS, Retired Major James Capers, Jr., a distinguished United States Marine Corps veteran,
displayed exceptional heroism and unwavering leadership during the Vietnam War, particularly from
March 31 to April 3, 1967, in Quang Tri Province, where he courageously led his Force Reconnaissance
team against an entrenched and numerically superior enemy force; and
WHEREAS, during this engagement, Major Capers and his team were ambushed by a numerically
superior enemy force, sustaining devastating casualties. Despite his own severe injuries, he refused to
yield, maintaining command, orchestrating life-saving air and artillery strikes with pinpoint accuracy,
and relentlessly engaging the enemy to ensure his fellow Marines' survival; and
WHEREAS, despite suffering multiple life -threatening wounds, including severe shrapnel injuries and a
broken leg, Major Capers continued leading counteroffensives, shielding his Marines, and ensuring their
survival until the last of his men were evacuated; and
WHEREAS, Major Capers' extraordinary valor was initially recognized with the Silver Star, but his actions
on the battlefield far exceed the criteria for that distinction. Military leaders, fellow service members,
and congressional representatives have continuously advocated for the Medal of Honor to properly
reflect the magnitude of his heroism; and
WHEREAS, a growing coalition of national veterans' organizations, including the Fleet Reserve
Association, The American Legion, The Navy League, Veterans of Foreign Wars, Societe La Quarante et
Huit, and the Vietnam Veterans Association, along with local governments such as the City of
Wilmington, NC; Onslow County, NC; the City of Bishopville, SC; and Lee County, SC, have formally
recognized his sacrifice and passed resolutions in support of awarding Major Capers the Medal of Honor.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners expresses
its appreciation for the extraordinary bravery and sacrifice of Retired Major James Capers, Jr., and
supports the continued efforts to award him the Congressional Medal of Honor, ensuring that his legacy
of valor and dedication to country is honored for generations to come.

This March, New Hanover County joins the Administration for Community Living (ACL) in celebrating the anniversary
of the National Senior Nutrition Program. Since 1972, this program, funded by the Older Americans Act, has delivered
essential nutrition services to help older adults maintain their health and independence.
New Hanover County extends these efforts through local programs at the Senior Resource Center, including its Home
Delivered Meals and Congregate Nutrition programs, expanding access beyond federal funding. In Fiscal Year 2023-
2024, the county served 257,337 nutritious meals to 3,292 older adults. These programs not only promote healthy
eating but also foster social connections, provide education, and offer access to additional support services, enhancing
overall well-being.

NATIONAL SENIOR NUTRITION PROGRAM AWARENESS MONTH PROCLAMATION
WHEREAS, since 1972, the National Senior Nutrition Program has funded local agencies and
organizations to serve home -delivered and congregate meals that help ensure older adults have
opportunities to stay healthy, independent, and connected; and
WHEREAS, more than 10 million older Americans face hunger each year, and food insecurity
disproportionately impacts older adults with limited ability to obtain food or prepare meals; and
WHEREAS, local senior nutrition programs help older adults access healthy foods, nutrition screening,
education, and counseling; social opportunities; and other supports that encourage well-being; and
WHEREAS, the Nutrition Services Programs at the Senior Resource Center are an integral part of New
Hanover County by providing sustenance, connections, education, and so much more to our older
community members, especially those most vulnerable to chronic health conditions and social isolation;
and
WHEREAS, the Nutrition Services Program is having a positive impact on our community and its senior
members, as demonstrated by:
115.7% increase in home -delivered meal clients over the last 10 years; and
• 342.3% increase in congregate nutrition clients over the last 10 years; and
75% of congregate nutrition clients who agree the Senior Resource Center increases their ability
to access food; and
• 89% of home -delivered meal clients report that the nutrition program has improved social
connectivity to people and services; and
• 95% of congregate clients report that the nutrition program has improved social connectivity to
people and services.
NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of Commissioners that March
2025 will be recognized as "National Senior Nutrition Program Awareness Month" in New Hanover
County.

NEW HANOVER COUNTY
ADULT CARE HOME COMMUNITY ADVISORY COMMITTEE
Number of Members: 13 State mandated; May appoint up to 18 (1 member for each permitted facility).
The Adult Care Home Administrators may nominate one-third of the members. If possible, one member
must be a person involved in the area of intellectual disability.
Compensation: None, but may be reimbursed for actual expenses.
Term of Office: 1-year term initially; 3-year term thereafter
Qualifications: Must be a resident of New Hanover County. No person or immediate family member of a
person with a financial interest in a home served by the committee, or employee or governing board
member of a home served by the committee, or immediate family member of a resident in a home served
by the New Hanover County Adult Care Home Community Advisory Committee may be a member of this
committee. Immediate family is defined as mother, father, sister, brother, child, grandmother, and
grandfather, as well as in-laws. Applicants must complete all Community Advisory Committee (CAC)'
Orientation training before being certified, designated, and appointed as a CAC volunteer. Upon
application, an Ombudsman with the Cape Fear Council of Governments will work with applicants through
the training process.
Purpose: The committee supports the spirit of the Adult Care Home Resident's Bill of Rights, visits adult
care homes quarterly, promotes the wellbeing of residents and encourages community involvement.
Statute establishing Committee: NCGS 131D-31.
Regular Meeting: Quarterly Meetings are held on the first Wednesday of January, April, July, and October
at 9:30 a.m. at the Cape Fear Council of Governments, 1480 Harbour Drive, Wilmington, NC.

Number of Members: 5 plus 3 alternates

Regular Meetings: Fourth Tuesday of every month at 5:30 p.m. in the Lucie F. Harrell Conference Room
at the Government Center, 230 Government Center Drive, Wilmington, NC.
Compensation: $20.00 per member per meeting plus auto mileage
Statute or cause creating Board: N.C. General Statutes 160D-302 (as of 2019). The Commissioners
increased board membership to 3 alternates on 11/21/94 (officially 4/1/96). The Unified Development
Ordinance (UDO) requires members to be appointed from different areas within the County's zoning
jurisdiction insofar as possible.
Brief on Functions: In New Hanover County, the duties of the Board fall into two general categories:
granting variances and hearing appeals.
Granting of Variances: When unnecessary hardships would result from carrying out a strict application
of the UDO, the Board of Adjustment has the authority to vary any of the provisions of the ordinance after
holding a public hearing and determining that the greater weight of evidence and testimony demonstrates
that four conclusions have been met supported by findings of fact:
1. Unnecessary hardship would result from the strict application of the ordinance.
2. The hardship results from conditions that are peculiar to the property, such as location, size, or
topography.
3. The hardship did not result from actions taken by the applicant or the property owner.
4. The requested variance is consistent with the spirit, purpose, and intent of the ordinance, such that
public safety is secured, and substantial justice is achieved.
In summary, a variance is an approval enabling a property owner to make use of his property in some way
which is in conflict with the literal provisions of the Ordinance.
Hearing Appeals: The Board of Adjustment is also tasked with hearing and deciding on appeals where it
is alleged by the appellant that there is error in a decision made by the planning director or Technical
Review Committee (TRC) in administering or enforcing the LIDO.

frequent visitor to Wilmington and Wrightsville Beach and now
as a Wrightsville Beach resident. My family and I participate
broadly in what NHC offers: sailing, biking, running, Broadway
Shows, museums, social clubs, church, retail, golf, and parks.
I want to contribute to enabling future generations to enjoy this

NEW HANOVER COUNTY
SPECIAL BOARD OF EQUALIZATION AND REVIEW
Number of Members: 5 Regular Members and 3 Alternates, in the following categories when possible:
• North Carolina licensed property appraiser
• Attorney, accountant, or other professional
• Business owner
• Individual engaged in the commercial production of agricultural, livestock, timber, or
horticultural products, or a North Carolina licensed real estate broker
• Single-family residential property owner
Function: The Special Board of Equalization and Review will meet to hear appeals filed by property owners
on their tax assessment. Duties are set forth under Article 21 of the Machinery Act of North Carolina.
Term of Office: 1-year; the Board will remain active until the conclusion of the tax appeals.
Compensation: $50 for half day meetings and $100 for full day meetings, effective 3/16/2015.
Qualifications: Applicant must be a resident of New Hanover County for a minimum of two years and have
paid all taxes imposed by the county, municipalities, service districts, and any property tax abatements
and special assessment taxes currently due. Each member must take an oath of office.
Regular Meetings: As required and called by the Tax Administrator (may require weekly meetings for
several months)
Statute or cause creating Board: NCGS 105-322 authorizes Boards of County Commissioners to appoint
by resolution a Special Board of Equalization and Review to hear tax appeals; Board adopted resolution
on January 20, 2009; Board modified number of members 3/15/21

I hope that this letter finds you well. After serving on the board for 4 years now
(including as chair), with one unprecedented revaluation already under my belt, I am eager to
remain on the board through the 2025 term to help during this revaluation. After learning much,
