BA 25-039 budgets funding for health departments to prepare and begin using the National Fatality Review -Case Reporting
System (NFR-CRS). Funds appropriated by the General Assembly to support the implementation of changes to restructure
child death reviews by local teams and to offset the costs associated with the participation in the NFR-CRS. No new positions
are requested for this program and no county match is required.

This ordinance shall be effective upon its adoption.

WHEREAS, the North Carolina Department of Transportation has submitted a request to use the
$386,000 of remaining Division 3 High Impact/Low-Cost funds for traffic improvements at the
intersection of NC 133 (Castle Hayne Road) and SR 1335 (Parmele Road); and
WHEREAS, the proposed traffic signal will be located at the intersection where the new Castle Hayne
Road fire station will be located, and the signalization of the intersection should improve the safety
and efficiency of traffic movements by the public and fire and emergency vehicles; and
WHEREAS, this request has been supported by New Hanover County Fire and Emergency Services;
and
WHEREAS, the cost estimate exceeds $250,000, the Chief Operating Officer for the North Carolina
Department of Transportation requires the inclusion of a Resolution of Support from New Hanover
County for approval of the fund request; and

WHEREAS, the New Hanover County Board of Commissioners has considered the above -described
request and is in support of road improvements at the intersection of NC 133 (Castle Hayne Road)
and SR 1335 (Parmele Road); and
NOW, THEREFORE, BE IT RESOLVED, by the New Hanover County Board of Commissioners, that it
expresses its support of the above -described project recommended by the North Carolina
Department of Transportation and requests that the project proceed once the necessary funding has
been established.

productive U.S. economy;
• Domestic leisure travel spending reached $876 billion in 2024;
• Travel spending generated $89 billion in state and local taxes across the U.S. in 2024;
® Eight million workers are directly employed within the travel industry; and

WHEREAS, in New Hanover County:
• Visitor spending infuses millions of new dollars into our local economy each year, helping to fund
beach nourishment, the Convention Center, lifeguard programs, and more;
• Room Occupancy Tax collections in 2024 exceeded $24.4 million, setting a new benchmark;
In 2023, visitor spending was estimated at more than $1.1 billion ($1,122.17 million), representing an
increase of 5.9 percent over 2022;
• In 2023, travel generated approximately $77.3 million in state and local tax receipts, thereby
contributing to our quality of place and providing a $323.85 tax savings to each county resident;
• The local travel industry provided more than 6,790 jobs in 2023 and supported a payroll of $278.9
million;
Travel is essential to the County's economic success; and
WHEREAS, this proclamation recognizes the significant effect the travel industry has on our local economy and
the profound impact it has on the lives of New Hanover County's citizens.

CHILD ABUSE PREVENTION MONTH PROCLAMATION
WHEREAS, infiscal year 2O23-2O24,Carousel Child Advocacy Center /C[A[\received 351child abuse case
referrals, with 140 of those referrals concerning children in New Hanover County; and
WHEREAS, children are our most vulnerable members aswell asour most valuable resources, helping to
shape the future of our communities; and
WHEREAS, child sexual abuse, physical abuse, emotional abuse, and neglect are serious problems
affecting every community and can have long-term psychological, emotional, and physical consequences
throughout onindividuo|'slifetime, impacting future generations; and
WHEREAS, children who have access to safe adults and protective environments and who live in families
with access to concrete economic and social supports are less likely to experience abuse and neglect; and
WHEREAS, positive childhood experiences (PCEs), such as loving caregivers and safe,stable, and nurturing
relationships —can help mitigate trauma and the negative impact of adverse childhood experiences
(ACEs), promoting the social, emotional, and developmental well-being of children; and
WHEREAS, nurturing positive childhoods and preventing child abuse is possible because of the
partnerships created among families, intervention and prevention advocates, child welfare professionals,
educators, health providers, community and faith -based organizations, businesses, |avx enforcement
agencies, and local, state, and national governments; and
WHEREAS, addressing child abuse requires eshared commitment to changing social norms, removing
barriers, supporting families, and encouraging education and action across all sectors of society; and
WHEREAS, New Hanover County is committed to preventing child abuse and recognizes the importance
of investing in prevention efforts, intervention services, and responsive systems that ensure all children
and families are healthy and thriving.

SEXUAL ASSAULT AWARENESS MONTH PROCLAMATION
WHEREAS, April is recognized as Sexual Assault Awareness Month {SRAM), a time to bring attention
to the serious issue of sexual violence and encourage efforts to prevent it in our communities; and
WHEREAS, this year's SAAM theme, "Together We Act, United We Change," highlights our collective
power to create safer environments for all; and
WHEREAS, sexual assault affects individuals and families across all walks of life, impacting their well-
being, safety, and sense of security; and
WHEREAS, education, awareness, and community involvement play a critical role in preventing
sexual violence by promoting respect, personal responsibility, and the importance of speaking out
against harmful behaviors; and
WHEREAS, supporting survivors, holding offenders accountable, and ensuring access to resources for
those affected by sexual violence strengthen the fabric of our communities and uphold the values of
justice and dignity for all; and
WHEREAS, the Rape Crisis Center (RCC) of Coastal Horizons provides essential services, including 24-
hour crisis response, individual counseling, and advocacy, to victims in New Hanover, Pender,
Brunswick, and Duplin Counties, ensuring that those impacted by sexual violence receive the help
and support they deserve; and
WHEREAS, working together to foster a culture that prioritizes safety, respect, and accountability
helps ensure that every individual can live free from the threat of sexual violence.
NOW, THEREFORE, BE IT PROCLAIMED by the New Hanover County Board of Commissioners that
April 2025 is recognized as "Sexual Assault Awareness Month" in New Hanover County. All residents
are encouraged to take part in efforts to prevent sexual violence, support survivors, and help foster

Resolution to Sponsor Water Resources DeveiggMgnt Grant
WHEREAS, the New Hanover County Board of Commissioners desires to sponsor Living with Water
to reduce tidal flooding site impacts, protect visitors, and safeguard the USS North Carolina
Battleship's cultural and historic operations through the installation of green infrastructure and
nature -based solutions including completing parking lot improvements with installation of a
stormwater bioswale; and constructing an overflow parking area with educational signage
highlighting coastal marshland and resiliency features; and
WHEREAS the New Hanover County Board of Commissioners also recognizes the USS North
Carolina Battleship Commission as a project partner that will assist with fulfilling the grant
requirements for this project, pursuant to a Memorandum of Agreement.
1) The New Hanover County Board of Commissioners requests the State of North Carolina
to provide financial assistance to New Hanover County, to be administered through the
USS Northa Carolina Battleship Commission for Living with Water project in the amount
of $ 1,289,333;
2) The New Hanover County Board of Commissioners, while assuming full obligation for
payment of the balance of project costs as a formal requirement of grant, will obligate
the USS North Carolina Battleship Commission to the balance of project costs under the
terms of their Memorandum of Agreements, including required 33% cost- share;
3) The New Hanover County Board of Commissioners, working with the USS North Carolina
Battleship Commission, will obtain all necessary State and Federal permits;
4) The New Hanover County Board of Commissioners, working with the USS North Carolina
Battleship Commission under the terms of their Memorandum of Agreement, will fulfill
all applicable reporting requirements governing the grant and comply with all applicable
laws governing the award of contracts and the expenditure of public funds by local
governments.
5) The New Hanover County Board of Commissioners, working with the USS North Carolina
Battleship Commission under the terms of their Memorandum of Agreement, will
supervise construction of the project to assure compliance with permit conditions and to
assure safe and proper construction according to approved plans and specifications;
6) The New Hanover County Board of Commissioners, working with the USS North Carolina
Battleship Commission under the terms of their Memorandum of Agreement, will obtain
suitable spoil disposal areas as needed and all other easements or rights -of -way that may
benecessary for the construction and operation ofthe project vvhhoutcosturob|keation
tOthe State;
7) The New Hanover County Board of Commissioners, working with the USS North Carolina
Battleship Commission under the terms of their Memorandum of Agreement, will assure
that the project isopenforuseby1he public ononequal basis with norestrictions;

Commission will hold the State harmless from any damages that may result from the
construction, operation and maintenance ofthe project;

CONTRACT AND DELIVERY THEREOF AND PROVIDING FOR CERTAIN OTHER

of North Carolina (the "State");
WHF,RF,AS, the County has the power, pursuant to the General Statutes of North Carolina to
(1) enter into installment contracts in. order to purchase, or finance or refinance the purchase of, real or

property and (2) create a security interest in some or all of the property financed or refinanced to secure
repayment of tire purchase.price;
(1) an Installment Financing Contract dated as of June 1, 20 1, 0 (the "2010 Contract") with the
New Hanover Financing Corporation (the "Corporation"), the proceeds of which were used to finance the

a portion of the County's government center complex (the "Government Center") in 2005 and 2007 and
acquisition of the County's judicial building in 2000 and a 5-story expansion of the judicial building in
2002 (the "Judicial Building"), which was subsequently amended by Amendment Number One to the
Contract dated as of September 1, 2012 (the "First ContractAmendment"), Amendment Number Two to
the 2010 Contract dated as of February 1, 2020 (the "Second Contract Amendment"), Amendment Number
Three to the 2010 Contract dated as of March 1, 2021 (the "Third Contract Amendment"), Amendment
Number Four to the 2010 Contract dated as of June 1, 2022 (the "Fourth Contract Amendment"), and
Amendment Number Five to the 20 10 Contract dated as of June 1, 2023 (the "F�flh Contract Amendment"),
each between the County and the Corporation, the proceeds of which financed and refinanced the projects
specified therein; and
(2) a Deed of Trust, Security Agreement and Fixture Filing dated as of June 1, 2010 granting
a lien on the sites of the Government Center and the Judicial Building, as modifled by (a) a Notice of
Extension of Deed of Trust to Additional Property dated as of February 1, 2020 extending the lien of the
Deed of Trust to the site of the Juvenile Justice Facility (as defined in the Second Contract Amendment),
(b) a Deed of Partial Release dated as of February 6, 2020 releasing the lien on the Government Center
from the Deed of Trust, and (c) a Notice of Extension of Deed of Trust to Additional Property dated as of

(e) other miscellaneous capital outlay, including, but not limited to, the acquisition of various County
vehicles and a new j ail door system (collectively, the "2025.Projects");
WHEREAS, the Corporation will execute and deliver its Limited Obligation Bonds, Series 2025
(the "Bonds") in an aggregate principal amount not to exceed $22,000,000, evidencing proportionate
undivided interests in rights to receive certain Revenues (as defined in the Contract) pursuant to the
Contract, under the terms of an Indenture of Trust dated as of June 1, 2010 (the "20.10 Indenture"), as
previously supplemented by Supplemental Trust Indenture, Number I dated as of September 1, 2012 (the
"First Supplement,"), Supplemental Indenture, Number 2 dated as of February 1, 2020 (the "Second
Supplement'), Supplemental Indenture, Number 3 dated as of March 1, 2021 (the "Third Supplement"),
Supplemental Indenture, Number 4 dated as of June I 2022 (the "Fourth Suvvlement"). and SuDolemental
Supplement, and the Fifth Supplement, the "Indenture."), each between the Corporation and U.S. Bank
Trust Company, National Association, as successor trustee (the "Trustee")-,
WHEREAS, in connection with the Corporation's sale of the Bonds to PNC Capital Markets LLC
(the "Underwriter"), the Corporation will enter into a Contract of Purchase (the "Contract qJ*Purchase")
between the Corporation and the Underwriter, and the County will execute a. Letter of Representation to
the Underwriter with respect to the Borids (the ".Letter q/'Representation");
WHEREAS, there have been described to the Board the forms of the following documents
(collectively, the ".Instruments'), copies of which have been made available to the Board, which the Board
proposes to approve, enter into and deliver, as applicable, to effectuate the proposed installment financing:
(1)
the Sixth Contract: Amendment;
(2)
the Sixth. Supplement;
(3)
the Contract of Purchase;
(4)
the Letter of Representation;
WHEREAS, to make an offering and sale of the Bonds, there will be prepared a Preliminary
Official Statement with respect to the Bonds (the "Preliminary Official Statement"), a draft thereof having
been presented to the Board, and a final Official Statement relating to the Preliminary Official Statement
(together with the Preliminary Official Statement, the "Official Statement"), which Official Statement will
contain certain information regarding the County;
WHEREAS, it appears that each of the Instruments and the Preliminary Official Statement is in an
appropriate form and is an appropriate instrument for the purposes intended-,
WHEREAS, a public hearing on the Sixth Contract Amendment and the 2025 Projects to be
financed thereby after publication of a notice with respect to such public hearing must be held and the Board
conducted such public hearing at this meeting;
WHER-EAS, the County has filed an application to the LGC for approval of the Sixth Contract
Amendment-,

WHEREAS, Parker Poe Adams & Bernstein LLP, as bond counsel., will render an opinion to the
effect that entering into the Sixth Contract Amendment and the transactions CODWIT[plated thereby are
authorized by law;

Section 1. Ratification ofInstruments. All actions of the County, the Chair of the Board (the
"Chair"), the Clerk to the Board (the "Clerle'), the County Manager, the Chief Financial Officer of the
County, the County Attorney and their respective designees, whether previously or hereinafter taken, in
effectuating the proposed financing, are ♦ ratified and authorized pursuant to and in accordance
with the transactions contemplated by the Instruments.
Section 2. Authorization oj'the Official Statement. The form, terms and content •' the
Prelimina: Official Statement are in all resi ,2ects authorized, Mi2roved and confirmed. aw-1 th
changes, insertions and omissions as he or she may approve.
Section 3. Authorization to Execute the Sixth Contract Amendment. The Board approves
the financing of the 2025 Projects in accordance with the terms of the Sixth Contract Ameni'ment. which

and the County Manager and their respective designees are authorized, empowered and directed,
individually and collectively, to execute and deliver the Sixth Contract Amendment, including necessary
counterparts, in substantially the form and content presented to the Board, but with such changes,
modifications, additions or deletions therein as they may deem necessary, desirable or appropriate, their
execution thereof to constitute conclusive evidence of the County's approval of any and all changes,
modifications, additions or deletions therein from the form and content of the Sixth Contract Amendment
presented to the Board. From and after the execution and delivery of the Sixth Contract Amendment, the
Chair, the Clerk, the County Manager and the Chief Financial Officer of the County are authorized,
em_poweredand directed, individually and collectivell, to do all such acts and
documents as may be necessary to carry out and comply with the provisions of the Sixth Contract
Amendment as executed.
Section 4. Letter of Representation. The form and content of the Letter of Representation
are approved, and the Authorized Officers are authorized to execute the Letter of Representation for the
purposes stated therein,
Section 5. County Representative. The Authorized Officers are designated as the County's
representatives to act on behalf of the County in connection with the transactions contemplated by the
.Instruments and the Preliminary Official Statement, and the Authorized Officers are authorized to proceed
with financin the 2025
and to seek opinions as a matter of law from the County Attorney, which the County Attorney is authorized
to furnish on behalf of the County, and opinions of law from such other attorneys for all documents
contemplated hereby as required by law. The County Manager and the Chief Financial Officer are
authorized, individually and collectively, to select a co -managing underwriter for the Bonds if they
determine such selection to be in the best interests of the County. The County's representatives or their
respective designees are authorized, empowered and directed, individually and collectively, to do any and

all other acts and to execute any and all other documents, which they, in their discretion, deem necessary
and appropriate to consummate the transactions contemplated by the Instruments and the Preliminary
Official Statement or as they deem necessary or appropriate to implement and carry out the intent and
purposes of this Resolution and to administer the transactions contemplated by this Resolution after the
execution and delivery of the Bonds.
Section 6. Severability. If any section, phrase or provision of this Resolution is for any reason
declared to be invalid, such declaration shall not affect the validity of the remainder of the sections, phrases
or provisions of this Resolution.
Section 7. Repealer. All motions, orders, resolutions and parts thereof, in conflict herewith
are repealed.
Section 8. Effective Date. This Resolution is effective on the date of its adoption.
