Public Comment Representing Coastal Christian High School, I have the
following questions regarding the Tarin Woods application:
1. Has there been approval for the Tarin Woods egress point to
go all the way out to Carolina Beach Road from the traffic
circle?
2. Has the traffic from Target, Home Depot, future business
development, and the two schools (CCHS and MGCS) been
analyzed for additional impact on Carolina Beach Road from

the higher density proposal of Tarin Woods?
3. What is the purpose of the dead end road that is shown
joining the CCHS property on the NW corner of the diagram?
This road is shown ending against the CCHS fence line. Why?
4. Will there be any requirement for privacy fencing or sound
barriers between CCHS and Tarin Woods? CCHS is always
concerned about safety of its students. CCHS also receives
regular complaints about noise from our neighbors who bought
houses in Kailey's Cove. The noise is simply from cheering
sports fans and usual school outdoor activities. Police officers
are called often by the Kailey's Cove homeowners to address
this when our students are simply cheering on their teams. Is
the 50 foot distance to the quadraplexes enough for safety and
noise control?
5. Will there be any other fencing or barrier requirement of the
Tarin Woods developers to prevent foot and bicycle traffic from
passing out of the NW corner of the development and crossing
through the CCHS school property to get to the new Target
store? People tend to walk the shortest distance possible to
their destination. Again a safety concern and larger problem
with the higher density of the development.

Public Comment I am worried about land being used for higher density house.
Our infrastructure in the Monkey Junction/Myrtle Grove area
does not allow for what has already been developed in the last
several years and this will only make it worse. By allowing
higher density housing it will increase traffic collisions and
transit time. Not to mention the schools are already
overcrowded and cannot allow for many more students. Please
do not approve this. Thank you.

Public Comment It is a matter of public record that this developer, Hoosier
Daddy LLC, has repeatedly requested special use permits to
build high density dwellings on this same property and been
consistently denied by the NHC Planning Board ("the Board").
This history goes back years. The previous denials by the
Board were quasi-judicial and are now legally binding
precedent, such that the Board cannot now approve a proposal
by Hoosier Daddy LLC which does not address past concerns
underlying previous denials. Yet, rather than come back with a

proposal modified in light of past denials, Hoosier Daddy LLC
appears to be doubling down by proposing more, not less,
high-density (based on my recollection previous proposals
were for mixed single family and high density). As before, high
density dwellings would have substantial negative impacts on
the surrounding R-15 neighborhoods and community
infrastructure which cannot be justified. The transparent
justification for Hoosier Daddy's special use requests is
maximizing profit at the expense of the surrounding community.
Hoosier Daddy's repeated requests despite consistent denials
reveal a disregard for the Board's decisions and the affected
community.

Public Comment I oppose this project because our neighborhood schools are
already at maximum occupancy and cannot sustain high
density development. It would add too many students to an
already maxed out situation. Also, our infrastructure does not
support this development. Traffic is already so bad that it takes
40 minutes to go 8 miles down College Rd through town.
Further, it will be impossible to evacuate during a hurricane
with the amount of traffic trying to leave the area. This puts all
of our lives in danger.

There are also problems with flooding in Tarin Woods II and
the board has not signed off on infrastructure development
because of these issues. Flooding risk will be even worse if the
developer is allowed to build more impurmeable space here.
Finally, this are is a community of single family owned homes.
Developing high density right next to these homes is
incompatible with these communities and puts a strain on living
conditions here. We have Battle Park, Tarin Woods I and II,
Covington, and Congleton homes which all share Manassas
Dr. as the primary enter and exit points for traffic. It is at
maximum capacity now and cannot sustain more traffic.
The County Commissioners already voted down this
developer's attempts to build high density units in this
community. He refuses to listen to their comments or decisions
and continues to attempt to bypass their decisions. It's time he
was stopped for good.

Public Comment This area is already congested. Adding new homes will be
detrimental to the infrastructure. Where will these new-to-the-
area children go to school? Bellamy is already full. The natural
habitat and trees need to remain for natural filtration of water
so the homes do not flood. There is already an issue with
drainage in some of the homes in this area.
This is a terrible idea to add more homes to this area.

Public Comment Dear Members of the Planning and Zoning Committee,
S25-02 Tarin Woods additional dwelling allowance
I am writing as a concerned resident of Kaylie’s Cove
Neighborhood to formally object to the proposed development
of a high-density residential dwellings located approximately
500 feet from my home at 5657 Claremont Ct 28409
While I understand the need for housing development to

accommodate population growth, I believe this particular
proposal poses serious concerns that outweigh potential
benefits. Specifically:
Impact on Traffic and Safety: Increased population density in
the area is already strained. Constant accidents on the roads of
Carolina Beach, Piner, and College. It is a dangerous area and
the roads are already crowded.
Strain on Infrastructure: Our local infrastructure, including
schools, water supply, sewage systems, and emergency
services, is already under pressure. Adding a high-density
complex without clear plans for infrastructure upgrades is
unsustainable.
Environmental and Noise Concerns: The natural character and
quiet enjoyment of our residential area will be significantly
disrupted. The scale of the proposed development is
inconsistent with the surrounding neighborhood’s character and
may negatively affect property values.
Community Character and Aesthetics: Our neighborhood was
developed with a low-density vision in mind. Introducing a high-
density structure undermines that vision and may set a
precedent for future developments that would alter the
community’s identity.
For these reasons, I respectfully urge the committee to
reconsider or reject the proposed high-density housing
development. I—and many of my neighbors—would appreciate
an opportunity for further community input and dialogue before
any final decision is made.

Public Comment The proposal is not in harmony with the surrounding
neighborhoods. Battle Park, Covington, Tarin Woods,
Congleton Woods, and Sentry Oaks are all single family
homes.
The area is overwhelmingly crowded already with excessive
traffic. There has been deep flooding on Sand Ridge,
Appomattox, and Sweet Gum. These roads, along with the
anticipated development on Shiloh will all lead out to Manassas
which is heavily trafficked already. The median on Manassas is

still waiting to be replenished after all the trees shrubs,
neighborhood sign, and barriers have been removed as a
result of what Hoosier daddy refers to as improvements they’ve
made. This used to be a a nice quiet neighborhood. Harmony
will be totally discarded by this proposal.

Public Comment This is unbelievable that anybody would consider 444 units in
this space. We drive in and out 4-5 times a day and traffic is
horrific on Carolina beach road. Not to mention apartments up
against two schools…. How in this world do you think that’s ok?
If you live in these communities, you know. I invite ALL county
officials to spend a day in this subdivision and you will be
convinced this isn’t feasible and NOT what these families want.
We chose this subdivision as our retirement home and love it.
We would hate to see these changes. PS- I was born and

raised in Wilmington and I think the commissioners need to
decide as well as the city …. Do you want to be a Myrtle Beach
or do you want to be a Hilton Head???

Dear Planning Board Members and Commissioners,
I am writing on behalf of the communities of Tarin Woods, Battle Park, Congleton Farms,
Covington, and other nearby neighborhoods to formally oppose the proposed Special Use
Permit that would allow for an increase in residential density to 10.2 units per acre in an R-
15 zoned area, which currently allows for a maximum of 2.5 units per acre.
The applicant’s proposal—to introduce high-density residential units such as apartments and
townhomes into an established, single-family neighborhood—is deeply concerning for
several reasons and does not align with the character, capacity, or infrastructure of our
community.
Our major concerns include:
Repeated Attempts to Circumvent Zoning Intent: This developer has submitted five previous
requests for rezoning or increased density via Special Use Permits. All have been denied or
withdrawn, largely due to consistent concerns expressed by this Board and the
Commissioners. Despite clear feedback that the proposed densities are excessive, each
new request continues to push even higher density levels—further straining local
infrastructure and disregarding community input.
Poor Construction & Oversight History: The developer’s track record in the existing phases
of Tarin Woods raises serious concerns about their capacity to responsibly manage a
higher-density project. Road surfaces have deteriorated rapidly, stormwater systems have
proven inadequate during routine storms, and common areas are poorly maintained. These
are not minor grievances—they reflect a pattern of low-quality workmanship and neglect,
which would only be magnified in a high-volume, high-density buildout.
Traffic & Safety: Carolina Beach Road and surrounding streets are already congested, and
this development would introduce hundreds more vehicles. This increase would raise safety
risks and strain emergency response times in the area.
Stormwater Management & Flooding: New phases of Tarin Woods are already seeing
frequent flooding, worsened by tree removal and poorly designed water systems. The
proposed plan adds nearly 18 acres of impervious surface over land with Pamlico soils, a
historically wetland type. This is a serious hazard for future and current homeowners.
Environmental Impact: Increased density, clear-cutting, and paving over sensitive soils will
irreversibly alter the local ecosystem and amplify flooding, erosion, and pollution issues that
are already emerging.
School Overcrowding: New Hanover County Schools are over capacity. This development
could generate 400+ additional students, equivalent to the population of a new school—
without any plan or infrastructure to support them.
Neighborhood Incompatibility: The applicant argues this is a "transitional" area, but that’s
inaccurate. This site is fully surrounded by low-density, single-family homes and is not
adjacent to commercial or higher-density areas. The development would be an outlier, not a
transition.

Inadequate Public Notice: Inadequate Public Notice: We were given just two weeks’ notice
before the May 1 Planning Board hearing—hardly enough time to coordinate responses,
consult experts, or gather data. Communities deserve better consideration in decisions of
this magnitude. We respectfully request a continuation of this case to allow residents
sufficient time to prepare evidence, consult with qualified professionals, and ensure a fair
and informed public process, particularly with the special procedures in place for Quasi
Judicial Hearings.
We urge the Planning Board and Board of Commissioners to preserve the intent of R-15
zoning and reject this request. To approve this Special Use Permit would be to reward a
developer with a documented history of substandard work and a pattern of ignoring public
and governmental input, while placing an enormous and unnecessary burden on area
residents and county resources.

Public Comment Residents of Tarin Woods, Kaylie's Cove, and Myrtle Gardens
strongly oppose a special use permit to be issued for the
project located at 5741 Carolina Beach Road (Tarin Woods
Additional Dwelling Allowance). It is pretty audacious for the
developer to propose building at a density that is over 4x over
the limit for R-15 zoning. A special use permit of this nature will
put additional strain on roads that are already being pushed to
the limit, particularly Myrtle Grove Rd., Piner Rd. and Carolina
Beach Rd. This present a clear danger of increased automobile

crashes. Beyond the safety issues and lack of existing
infrastructure to support this may units, this project would also
have a negative impact on residential property values nearby.
Finally, this proposal is very different from its surrounding
neighborhoods. It would disrupt the flow of neighborhoods of
single family homes in an ugly way. I stand united with my
neighbors in opposition to this proposal. Please do not let this
beautiful area of New Hanover County be disrupted by
quadrupling the allowable density.

Public Comment This request will inevitably create a significant traffic situation
for both the neighborhood and externally. There is a current
issue with u turns at Manassas drive, adding additional traffic
that's motivated to either u turn or go through the neighborhood
to get to new homes will cause increase concerns. Also, most
people get to Myrtle Grove Rd through Sweet Gum and Lt.
Congleton neighborhood, that traffic will only increase and
cause additional concerns with apartments. This neighborhood
is a family centered and cared for neighborhood where

neighbors consider that children are out playing or riding bikes.
That mindfulness disappears when you add non- families and
additional people. I have concerns about the property value of
my home as well.

Public Comment In this latest request, the developer has increased the amount
of high density housing from what was rejected in previous
submittals/plans. It’s obvious he is completely ignoring any of
the previous concerns raised by residents and neighbors and is

addressing the real issue with his plans (increased traffic,

etc). I understand the developer is not responsible for the lack
of infrastructure in New Hanover County and shouldn’t be

To whom it may concern:
As the elected Board of Directors representing the Tarin Woods Property Owners Association (“POA”), we
respectfully submit this formal response opposing the Special Use Permit Request (S25-02) filed by Samuel
Potter of Equitas Law Partners, LLP on behalf of Hoosier Daddy, LLC, the developer of the Tarin Woods
community.
Since its establishment through a Declaration of Covenants, Conditions, Restrictions, and Easements
(“Covenants”) recorded on February 15, 2013, Tarin Woods has grown into a vibrant residential community of
345 single-family homes. It includes approximately 30 acres of open space, a community pool, clubhouse,
playground, sports courts, 11 ponds (all with fountains), and four mailbox stations. Our roads—though
privately owned—are widely used, not only by our residents but by neighboring communities including Lt.
Congleton, Sentry Oaks, Covington, and Battle Park, as well as commuters cutting through from Carolina Beach
Road to Myrtle Grove Road.
The community is deeply concerned by the developer’s new proposal to add 290 apartments, 146
townhomes, and a 5–6 story building ("Manor House"), which would bring an estimated 543 additional
vehicles (according to the plan submitted by the developer) through our already overburdened
infrastructure—daily. These plans are alarming not only in scope but in timing and context, given the current
state of neglect and disrepair in the still-incomplete Tarin Woods II section.
Our private roads, including Sweet Gum Drive, Short Leaf Way, Ironwood Drive, Black Ash Run, Sweet Shrub
Court, and Canopy Way, are deteriorating at an unsustainable rate. We are currently undergoing a road study
with a certified engineering firm, funded entirely by our POA, which will cost tens of thousands of dollars.
Preliminary findings indicate these roads—many less than five years old—are projected to fail entirely within
1–3 years. Additionally, there is indication that pipes underground moving storm water may be failing which is
causing areas of roads to sink. Despite repeated appeals to the developer to address sinkholes, potholes,
alligator cracking, and general substandard construction, no action has been taken. Meanwhile, these roads
continue to be damaged by the developer’s own construction vehicles—vehicles hauling dirt for other projects
entirely unrelated to Tarin Woods.
The financial burden of these repairs is unfairly being pushed onto the residents, while the developer, who
still holds ownership of these roads, continues to benefit. This is not only unsustainable—it is unacceptable.
Further compounding the issue is the developer’s continued failure to uphold obligations laid out in Article VI,
Section 2 of the Covenants, which clearly state that “Common Areas…shall at all times be maintained in good
repair and condition…by the Developer, and upon conveyance, the Association.” The Developer has not
conveyed the land to the POA as of this date. Yet numerous Common Areas in Tarin Woods II remain
incomplete, neglected, and in some cases, hazardous. These include:
• An unfinished and deteriorating walking path posing safety risks ($20,000+ estimated to repair)
• A large, unsodded field overgrown with weeds, which the POA is forced to maintain
• Dead trees removed at POA expense to protect adjacent homes
• An amenity area—pickleball court, basketball court, and a mail station—that has never been properly
maintained
• Large berms and weedy open spaces left in disrepair
• A concrete slab installed by the POA (at its own cost) to avoid halted mail service due to soggy,
impassable terrain—despite and offer by the POA to split the cost with the developer, who refused to
contribute
These failures already place undue financial and logistical strain on the POA and its homeowners. Now, the
developer is asking for approval to dramatically increase the size of the community by 444 additional
housing units—with no assurances that similar neglect will not be repeated.
Let us also be clear: The Covenants written by the developer do not include provisions for apartment
complexes within Tarin Woods. Introducing multi-family apartment units into a single-family community with
shared POA obligations—without consultation or collaboration with the Board—is not only a dramatic shift
from the original community structure, but it raises serious concerns about fairness, resource allocation, and
community character.
We recognize that the remaining undeveloped land will eventually be built upon. However, approving this
application as proposed—at this scale and without addressing the developer’s past failures —is deeply
irresponsible. The existing community should not be penalized or destabilized for the developer’s expansion
ambitions.
We invite members of the Planning Commission and the Board of Commissioners to personally tour Tarin
Woods II to witness the current state of developer-owned infrastructure and common areas. We fear the same
neglect will befall any new development unless strong oversight and accountability are required up front.
We urge you to deny this Special Use Permit in its current form. At minimum, no approval should be granted
until:
• The existing infrastructure is repaired to acceptable standards
• Outstanding Common Area projects are completed
• A full review of how apartments would affect the community, Covenants, and POA financial structure
is conducted—with POA involvement

zone, as you can see from the attached photos taken after a
storm last September, this subdivision is not capable of moving
storm water in a timely rate. If the new section is added with
the impervious surfaces shown, this will only serve to
exacerbate the current situation and will also worsen it for new
and existing homes. The first two pictures show Sand Ridge
Ave at the intersection with Appomattox. The road was virtually
impassable at this point. The third photo shows the retention

and where it is overflowing its banks onto the road. The last
photo shows the level of the retention pond almost reaching
and overflowing its banks.

yet to be approved access point, unwanted traffic onto a private
road serving the Rosa Parks neighborhood, and using an
already over-used road, Manassas, that serves Battle Park,
Covington, Tarin Woods, Congleton Farms, plus others that
use it as a cut through from Myrtle Grove Road to get to the
Harris Teeter complex across from it. Additionally, the
developers proposed increase in traffic is way low given how

most families make trips to work, to take care of children, to run
errands, and trips south to the beach and north into
Wilmington.
This is about the same proposal that was turned down last
spring that is just north of what was proposed. The Coastal
Christian School will be impacted and it is expected that the
Developer will try again to access his development from that
road way. With the addition of the new Target store under
construction, this development dramatically add to the already
overcapacity Carolina Beach Road near Monkey Junction. No
one objects to the density for which he already has permits.

Public Comment I oppose this project because of the higher dwelling density
proposed, more traffic problems onto Carolina Beach Road and
flooding concerns.
The developer who is proposing this density change is the
same developer who has been rejected in the past. For
instance, at the May 1 2023 Commissioners meeting the
developer’s proposal was rejected 4-1. The proposal at this
meeting was for 338 dwellings which he reduced at the
meeting to 304. Now he is proposing 444 dwellings over a

smaller area than in 2023. The additional traffic produced by
444 dwellings would inject more traffic onto Carolina Beach
Road which already seems to be overcrowded.
I would assume if the 2023 proposal was rejected by the
Commissioners board then this 2025 proposal would also be
rejected since it has even higher density.
The attached pictures are from Tropical Cyclone 8 which hit our
area on September 16 2024. A common path behind our house
was flooded and a nearby common area was flooded. Note the
water was very very close to two electrical transformers (the
green boxes). I would be concerned that if water seeped into
the transformer it could have caused an explosion. This new
444 dwelling proposal would eliminate many acres of pervious
land and would force the rainwater into the existing Tarin
Woods development.
Please reject this 444 dwelling proposal.

Public Comment We moved to Tarin Woods because it has single family homes
& is safe. A large scale project such as proposed will destroy
the balance of the community & will endanger the people;
especially children; that live here because there will be too
much traffic going through the community. It will also lead to
more destruction of the roads in the surrounding area.
The proposal will cause flooding because the water will buildup
on the concrete instead of going into the land. We had some
flooding during the Unnamed cyclone that hit last September

but the high density build will make this much worse.
There are already too many apartments being built on Carolina
Beach road. Many apartments In Wilmington are vacant. We
do not need more. We need affordable homes not apartments.

Public Comment As a young couple, my partner Jake and I chose Tarin Woods
as the place to lay down roots and eventually start to grow our
family. We were drawn to its peaceful atmosphere, the sense
of community, and the promise of a safe environment for our
future children. The neighborhood’s design, with its single-
family homes and green spaces, offered the ideal setting for
the life we envisioned.
The proposed high-density development threatens to disrupt

this carefully cultivated environment. An increase of multi-
family units would not only increase traffic congestion on roads
already strained but also place additional pressure on local
schools and community resources. The developer’s history of
poor construction practices and inadequate infrastructure
maintenance raises serious concerns about the quality and
sustainability of the proposed expansion.
We believe in responsible growth that respects the character of
existing neighborhoods and the well-being of current residents.
(Wilmington is struggling with this as a whole as we’ve seen
the last few years) This proposal appears to prioritize density
over community, quantity over quality. We urge the Planning
Board and Board of Commissioners to consider the long-term
implications and to reject the Special Use Permit for this high-
density development.

Public Comment I am writing in strong opposition to the proposed addition of
444 new units—including a 50-foot-tall apartment building with
92 apartments—adjacent to our existing community. There are
multiple serious concerns that must not be ignored:
Safety and Overpopulation: Tripling the number of residences
in this area will severely strain our already limited
infrastructure. It will compromise emergency services and will
absolutely impact our ability to safely evacuate during storms

or hurricanes, which is a critical concern for our coastal
community.
Developer's Track Record: The developer proposing this
project has already demonstrated an inability—or
unwillingness—to meet their commitments. In Tarin Woods 2,
promised amenities like a pool were never delivered, and
upkeep has been virtually nonexistent. We have every reason
to believe these same broken promises will be repeated here.
Increased Flood Risk: This project will dramatically increase
impervious surfaces, which will worsen the serious flooding
issues we already experience. I will be submitting photographic
evidence of existing flood conditions to demonstrate how the
area is already unable to handle current water runoff, let alone
a massive new development.
Declining Home Values: Inserting 444 new units, including a
massive apartment complex, will drastically alter the character
of our neighborhood. The density and the type of construction
proposed will inevitably drive down property values for existing
homeowners—many of whom made significant investments in
their homes under the expectation of a well-maintained, low-
density community.
In short, this proposed development will severely degrade the
safety, value, and livability of our community. I urge you to
reject this project.

Public Comment This request is for additional dwelling allowance should be
declined. There is a reason this allowance is in place and there
is no reason this situation should allow a special consideration.
This neighborhood already has significant traffic issues
entering and exiting Carolina Beach Road. There have been a
number of accidents at this intersection as well as a high daily
load of backed up traffic. There was recently a news story on
WECT about this intersection and the issues that are prevalent.

The neighborhood plans were originally for more single family
housing and this request for high density townhomes and
apartments will cause significant issues in the rest of the
neighborhood. This is one of the most popular family
neighborhoods in the area and is full of kids playing outside.
Increased traffic coming through everyday will cause risks to
kids that are outside playing, biking, etc.
It is clear that the developer has no concern for the residents of
this neighborhood and is only concerned with maximizing their
profit at the expense of the current homeowners.

Public Comment Dear planning board, I ask you to please thoroughly consider
the increased traffic the proposed project would bring, both to

several new developments in the immediate vicinity. Target is

the area. In the event of an emergency Carolina beach road is
so congested residents will not be able to leave the area.
Please also consider overcrowding of our schools. The
kindergarteners at Bellamy elementary school already have
