Planning
General Comments
Comment: Property was zoned CZD B-2, Conditional Regional Business on June 3, 2024. Case Z24-03.
Response: Current zoning located on Cover sheet under general notes.
Comment: The zoning district includes 7 conditions which should be listed as additional site notes on the plans:
Response: Conditions have been added to sheet 1
Comment: Please show the location of the pedestrian access to Haven Place on the site plan to meet the
requirements of Condition 3 above.
Response: Sidewalk connection has been added.
Comment: There do not appear to be any Duke Energy transmission lines or easements through the
property. If any easements are identified we recommend contacting Bill Wilder of Duke
Energy (Bill.Wilder@duke-energy.com) to get Duke approval for this site plan before
proceeding with any other permits.

UDO Section 5.1, Parking and Loading
Comment: Site plan shows the minimum parking requirements have been met.

UDO Section 5.2, Traffic, Access and Connectivity
Comment: Note: Building permits may not be issued for projects until NCDOT has issued the
driveway permit for the site.

UDO Section 5.3, Tree Retention
Comment: A tree removal permit was submitted with the site plan application. The tree removal
permit is currently under review.
Response: Acknowledged
Comment: Note: Land disturbance permits can be issued by county Engineering before a Tree
Removal Permit is approved by Planning. However, any trees removed before the Tree
Removal Permit is issued may result in enforcement action under Section 5.3.2 of the
Unified Development Ordinance to include prohibiting any development of the site for 3 to 5 years.

UDO Section 5.4, Landscaping and Buffering
Comment: Landscaping plan exceeds the minimum landscaping requirements and meets additional
conditions of the conditional zoning district.

UDO Section 5.5, Lighting
Comment: Is any exterior lighting proposed for the site?
Response: Still under consideration
Comment: Note: A lighting plan is not required for TRC approval but will be required before the
county can issue construction or building plan approvals.
Response: Acknowledged
UDO Section 5.6, Signs
Comment: Any wall or freestanding signs require separate permitting through COAST.
Response: Acknowledged
Comment: If a freestanding sign is planned along Castle Hayne Road, staff recommends shifting some
of the plantings shown on the landscaping plan to accommodate that future sign.

UDO Section 5.7, Conservation Resources
Comment: The New Hanover County Conservation Resource Map indicates there are approximately
1.6 acres of Swamp Forest resources on the property.
Response: Acknowledged
Comment: Section 5.7.3.A.4 states if the total aggregate acreage of a conservation resource exceeds
5 acres on a parcel, the resource must be preserved and meet additional requirements
listed in Section 5.7.4 Additional Performance Controls.
Response: Acknowledged, site has less than 5 acres.
Comment: The 1.6 acres on the parcel do not qualify for conservation or additional setbacks. The
adjacent Haven Place Subdivision currently under development field identified there was
less than 5 acres of Swamp Forest on their development. No conservation space was
required for the adjacent development that would have resulted in building setbacks for
the Rainstorm Solutions project either.

Comment: While the conservation resource standards of Section 5.7 do not apply, the project sites
the structures outside the resource and in a way that restricts future development inside the resource.

NHC Engineering
Comment: A land disturbing permit issued by the County is required for this project since the anticipated
limits of disturbance is greater than 1 acre. Please digitally submit the permit application
documentation with requisite review fees for County issued permit directly to
gjamison@nhcgov.com. Application and forms can be found at
https://www.nhcgov.com/249/Sediment-Erosion-Control.

submit the permit applications documentation with requisite review fees to the COAST online
permit portal (https://newhanovercountyncenergovpub.
tylerhost.net/apps/selfservice#/home). Applicable forms can be found at
https://www.nhcgov.com/251/Stormwater however the application form is not required as the
information will be gathered by the COAST portal.
Response: Acknowledged
Comment: The offsite drainage coming from the north that will be routed through the site shall be placed
in a revised public drainage easement sized in accordance with NHC Stormwater Manual.
Construction within this offsite drainage conveyance measure that will be maintained by the
county will need to be observed during construction by Stormwater Services and a turnover
meeting scheduled once the system is ready to be conveyed to the county. Please add a plan
note to ensure county construction observation and a turnover meeting occurs. Note, should
the applicant elect to maintain the conveyance measures themselves, the POA covenants shall
indicate the operation and maintenance roles and responsibilities for the conveyance measure.

Comment: Please contact the State for their stormwater permit requirements. A high density permit is anticipated.
Response: Acknowledged
NHC Environmental Health
Comment: Site plan reflects connection to public water and sewer. Environmental Health records reflect
homes at 3121 and 3125 Castle Hayne Rd. with septic systems. Septic tanks must be pumped,
crushed and filled for proper abandonment. Proposed infrastructure does not violate setbacks
to any surrounding properties well or septic systems.

Comment: Site plan reflects connection to public water and sewer. Environmental Health records reflect
homes at 3121 and 3125 Castle Hayne Rd. with two well heads. Well heads shall be properly
abandoned by a Certified Well Driller. Proposed infrastructure does not violate setbacks to any
surrounding properties well or septic systems.
