The approved plan consists of two (2) buildings: a 10,500 square foot flex commercial space near Castle Hayne Road and a contractor office consisting of an 1,800 square foot office and 5,350 square foot workshop / garage for the use of the contractor office. The parcel is 4.98 acres located at 3121 and 3125 Castle Hayne Road (PID# R02519-001-012-000). Rezoning Conditions The site was rezoned to (CZD) B-2 on June 3, 2024 under rezoning case Z24-03. The site has the following seven (7) conditions: 1. The proposed use of a restaurant will have a cap of 3,000 square feet. Any change in square footage must be reviewed and approved by the County in order to verify compliance with the zoning district standards. 2. Permitted uses shall be limited to: a. Animal Grooming / Veterinary (Kennel or Daycare prohibited) b. Business Service Center c. Contractor Office d. Offices for Private Businesses & Professional Activities Commercial Site Plan TRC Approval – Rainstorm Solutions – 3121 Castle Hayne Road Page 2 of 3 e. General, Personal Services (Tattoo Parlors prohibited) f. Instructional Services & Studios g. General, Retail Sales h. Restaurant 3. Pedestrian access will be provided from Haven Place to the proposed flex space commercial structure as shown on the concept plan. 4. The existing vegetation as shown on the concept plan will be retained to meet the Type A opaque buffer requirement. 5. A Type A opaque buffer will be provided along the southern boundary of the parcel adjacent to parcels zoned R-10. *NOTE: This condition no longer applies to this site. The R-10 zoned property to the south was rezoned on June 2, 2025 to (CZD) B-2 under rezoning case Z25-09. If the property to the south is ever rezoned back to an R-10 district, Planning staff will confer with the County Attorney’s Office to discuss the potential impacts of this condition. 6. A 50-foot-wide stream buffer is required between the proposed structures and the Ness Creek Tributary as shown on the concept plan. 7. No Contractor Office with outdoor storage shall be allowed east of the Ness Creek Tributary. Minor Deviation The site is also approved for a minor deviation from the approved concept plan related to the orientation of the contractor office building. The concept plan showed the contractor office building facing south. The approved concept plan turns the building 90 degrees and faces east. This minor deviation is administratively approved under Section 10.3.3.C.7.b 1 and 2: 1. Modifications in building or structure placement, provided the placement complies with the setbacks of the corresponding base zoning, and does not decrease the setbacks agreed to by more than 10 percent from what was originally approved; 2. Modifications in the configuration of building(s), structure(s), or site plan. As shown on the TRC approved plans, a sidewalk will also be installed running from the sidewalk listed in Condition 3 above along the southern boundary of the parking lot out to Castle Hayne Road. Additional Permits Required The approved site plan is attached. This approval is valid for two years unless a building permit application or evidence of another substantial improvement for all or a portion of the project is Commercial Site Plan TRC Approval – Rainstorm Solutions – 3121 Castle Hayne Road Page 3 of 3 submitted to the County. If the TRC approval expires it would require a new application that would subject the project to all development standards in effect at the time of the new application. Please note the project may be subject to additional regulations of the County’s development ordinances. In addition, this approval does not relieve the applicant from any law, regulation, or requirement of any other federal, state, or local government or regulatory agency. Approval of this plan allows for construction plans to be submitted in COAST for the subject project. Applicants must consult with New Hanover County Engineering on any required land disturbance and stormwater permits and CFPUA on utility permits. A tree removal permit for this site is currently under review. Construction plans must also be approved through the building and zoning permit review process before starting any construction. In addition, a floodplain development permit will be required in addition to the construction and zoning permits.
