Sheriff Ed McMahon has requested the Board consider adopng a proclamaon declaring Thursday, August 7, 2025, as
Purple Heart Day in New Hanover County. Purple Heart Day honors the courage and sacrifice of U.S. Service
Members who were wounded or killed in combat. The proclamaon will be formally presented at the Cape Fear Purple
Heart Dinner on Saturday, August 2, 2025.

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
PROCLAMATION FOR PURPLE HEART DAY ON AUGUST 7, 2025
WHEREAS, in August 1782, General George Washington, Commander in Chief of the Continental Army,
established the "Badge of Merit," which became the forerunner of the Medal of Honor and inspired the
modern Purple Heart; and
WHEREAS, the Purple Heart is awarded to those who have been wounded or killed while serving the
United States against opposing armed forces; and
WHEREAS, National Purple Heart Day, observed annually on August 7, honors the bravery and sacrifice of
military personnel who have been wounded or killed in combat while serving in the U.S. Armed Forces;
and
WHEREAS, since its inception and through multiple wars and conflicts, the Purple Heart has been awarded
to more than one million service members wounded or killed in defense of our nation; and
WHEREAS, the mission of the Military Order of the Purple Heart is to foster goodwill and camaraderie
among combat-wounded veterans, promote patriotism, support vital legislative initiatives, and, most
importantly, provide service to all veterans and their families; and
WHEREAS, the Purple Heart Foundation continues to honor and support our nation's most dedicated
heroes.
NOW, THEREFORE, BE IT PROCLAIMED that the New Hanover County Board of Commissioners hereby
recognizes Thursday, August 7, 2025, as "Purple Heart Day" in New Hanover County and encourages all
citizens to observe and participate in this day of recognition.

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
RESOLUTION RECOGNIZING THE 1775 DISTRICT OF WILMINGTON RESOLVES
WHEREAS, Safety Committees were established in the American colonies after the First Continental congress
in the Fall of 1774. They became the colony’s government after the breakdown of royal rule; and
WHEREAS, in late May, 1775, North Carolina’s colonial governor, Josiah Martin, fled from the state capital,
then located in New Bern, to Fort Johnston, near what is today the city of Southport. He issued a proclamation
in June, condemning safety committees and Patriots’ actions; and
WHEREAS, the Safety Committees of New Hanover, Brunswick, Bladen, Duplin, and Onslow Counties (the
District of Wilmington) met in Wilmington on June 20, 1775, and formed a committee to respond to this
proclamation; and
WHEREAS, this committee recommended that residents sign a resolution declaring that Governor Martin’s
proclamation contained “many things asserted to be fact which are entirely without foundation…” And when
the District of Wilmington Resolves were published in the newspaper, they included a resolution applauding
the “People of New Hanover” for their “Attachment to the Cause of Liberty”; and
WHEREAS, New Hanover County established the New Hanover County America 250 NC Committee on March
18, 2024, to support the commemoration of the 250th anniversary of the United States and North Carolina’s
integral role in that event; and
WHEREAS, local chapters of the Sons of the American Revolution and Daughters of the American Revolution
recognize the importance of this historical moment and the significance it played in the outcome of the
American Revolution.
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners, does recognize
June 20, 2025 as a day to observe the District of Wilmington Resolves and commemorate its 250th anniversary,
and encourages all citizens to recognize this historical event.

T he owner of a ho me lo cated at 21 South 13th Street has listed the property fo r sale fo r $275,000. T his pro perty is
located one blo ck o ff of Market Street a t the co rner of 13th S treet and Dock Street and is o n the same block as, and
immediately adjacent to , N ew Hanover H igh Scho o l. T he land size is approximately 3,150 square feet and the home is
three (3) bedro o ms and 960 square feet in size.
T his property is the only land o n that block not currently owned by the N ew Hanover C ounty Scho o ls (the "Scho o ls").
C o unty staff believes that acquiring this pro perty and immediately deeding it to the Schools is advantageous f o r beer
campus security, as well as to provide space for future gro wth.
T he tax value of the pro perty is $232,800.
Staff requests approval to pro ceed with the purchase at the negoated price of $275,000 and to deed the property to
the Schools a<er a purchase.
Appro val o f the aached budget amendment is also requested. T he purchase price is propo sed to be f unded with
appro priated f und balance, which is an amount tha t is no t signifi cant to the C ounty's o verall f und balance.

I n 2023, C hemours no fied the N ew Hanover C ounty (C o unty) that P FAS compo unds co vered under the C o nsent
O rder were found at elevated levels in the well water at Fire Stao n #12, located at 3805 U.S. Highway 421 N o rth.
U pon discovery, bo 3led water was pro vided, and a Granular Acvated C arbon (G AC ) filtrao n system was installed
and verified as effecve.
I n the f all o f 2023, C ounty staff began exploring the f easibility of co nnecng the stao n to the public water supply.
A7er reviewing several opo ns with the C ape Fear Public U lity Autho rity (C F PUA), they idenfied extending an
exisng water line by 440 feet on the west side of Highwa y 421 to reach Fire Stao n #12 as the best so luon.
Although discussions were held with C hemours abo ut sharing pro ject co sts, no wri3en f unding commitment has been
secured. We recommend the c o unty move forward with the water line extensio n independently but will co nnue to
wo rk with C hemours to pursue a cost-sharing arra ngement, as this need f alls under the co nsent o rder.
An interlocal agreement between the C ounty and C F P UA has been dra 7ed to suppo rt the extension o f a public water
line to the stao n. T he agreement o utlines the C o unty ’s commitment to fund engineering design services and
establishes the framewo rk f o r construcon of the new wa ter line. C F P UA B oard is scheduled to approve the
agreement at its meeng on J une 11, 2025. Design costs are esma ted at $26,500, funded through the Fire District
Fund in F Y 25. T he F Y 26 budget request includes $85,000 f ro m the Facilies General O perang Fund f o r co nstrucon
costs.

THIS INTERLOCAL AGREEMENT (hereinafter, “Agreement”) is entered into and

CAPE FEAR PUBLIC UTILITY AUTHORITY, a public utility authority duly authorized
under Article 1 of North Carolina General Statutes Chapter 162A (“Authority”) and NEW
HANOVER COUNTY, a political subdivision of the State of North Carolina (“County”),
collectively hereinafter referred to as the “Parties.”
WITNESSETH:
WHEREAS, the Authority provides water to customers located within its service area;
WHEREAS, the County owns a certain property located at 3805 US Highway 421 North,
Wilmington, North Carolina (the “Property”); and
WHEREAS, the Property is located within New Hanover County and the service area of
the Authority;
WHEREAS, per- and polyfluoroalkyl substances (PFAS) have been identified in the
groundwater of New Hanover County;
WHEREAS, the Authority has installed and implemented Granulated Activated Carbon
and Reverse Osmosis systems at its water treatment facilities for the removal of PFAS;
WHEREAS, certain properties in New Hanover County do not receive water from the
Authority, instead obtaining their water from private drinking water wells;
WHEREAS, a Consent Order was issued in Bladen County in the matter of State of North
Carolina Department of Environmental Quality, et al v. The Chemours Company (17 CVS 580) in
February 2019 (the “Consent Order”). On November 3, 2021, NC DEQ determined that Chemours
was responsible for contamination of groundwater monitoring wells and water supply wells in
New Hanover County, expanding the scope of the Consent Order to include New Hanover County;
WHEREAS, the Consent Order provides for Chemours to establish and maintain
permanent replacement drinking water supplies, including connection to the public water supply,
for those with a private drinking water wells based upon certain PFAS concentrations;

WHEREAS, pursuant to the Consent Order, the Property qualifies for either three Reverse
Osmosis (RO) systems or Granulated Activated Carbon (GAC) system located at the Property; and
WHEREAS, a GAC system was installed and is currently operating at the Property; and
WHEREAS, the County desires, and the Authority agrees, to proceed with the installation
of a permanent replacement drinking water supply system for the Property, to consist of the
connection of the Property to the Authority’s public water supply in lieu of the continued operation
of the property-specific GAC system;
WHEREAS, pursuant to N.C. Gen. Stat. Chapter 162A, Article 1, the connection to
existing water service lines are improvements to the Authority’s system, enabling the Authority to
place or to maintain the system in proper condition for its safe, ef ficient, and economic operation
by providing access to potable water for those in areas which may be served by the Authority and
for which no existing service is being rendered; and
WHEREAS, to the extent applicable, this Agreement is entered into pursuant to Article
20, Part 1 of North Carolina General Statutes Chapter 160A and N.C. Gen. Stat. §153A-278; and
WHEREAS, the Parties are entering into this Agreement to memorialize their respective
duties, responsibilities, and entitlements regarding the funding, installation, operation,
maintenance, use, and ownership of the water connection.
NOW, THEREFORE, in consideration of the promises and other considerations, the
receipt and sufficiency of which are hereby acknowledged, the parties hereto agree as follows:
I. PURPOSE.
This Agreement establishes a framework for funding the engineering design services, and initial
agreements regarding construction, maintenance, operation, and ownership of the infrastructure
improvements for the connection to the Authority’s public water supply, through Public Water
Connections to the Property located at 3805 US Highway 421 North, Wilmington, North Carolina,
currently served by a private drinking water well that is identified as eligible for a permanent
alternative drinking water supply pursuant to Chemours’ February 1, 2022 letter to NC DEQ and
the associated Four Counties Sampling and Drinking Water Plan (the “Project”).
II. TERM.
This Agreement shall become effective upon the date it is properly authorized and executed by the
last of all the Parties named in the introductory clause of this Agreement (“Effective Date”) and
continue for five (5) years, or the final completion and acceptance of the infrastructure
improvements under the Project, or the cessation of funding as provided under this Agreement,
whichever is earlier, unless earlier terminated in accordance with the terms of this Agreement. This
Agreement is conditioned upon the authorization and execution by all Parties.

III. DEFINITIONS
A. “Authority Fees” – All applicable fees and charges as set forth within the published
Cape Fear Public Utility Authority Rate and Fee Schedule for the prevailing fiscal year. Authority
Fees may include, without limitation, Water System Development Charges, Inspection Fee, Meter
Set Fee, and System Capacity Cost Recovery Fees.
B. “Authority Water Infrastructure” – Any water main or water line owned and
operated by the Cape Fear Public Utility Authority.
C. “Private Drinking Water Well” – Any manmade opening into the ground developed
for the purpose of meeting a property’s potable drinking water needs provided said well does not
supply a public water system.
D. “Private Water Connection” – Those specific plumbing services and installations
necessary to provide a lateral connection from the Property to the Authority’s Water Infrastructure,
to include the entire distance between any building and the Authority’s meter box.
E. “Public Water Connection” – Those specific services necessary to connect the
Property to the Authority’s Water Infrastructure within the distance from the public right of way
to the Authority’s meter box.
F. “Work” – The entire engineering, design, and construction or the various separately
identifiable parts thereof required to be provided hereunder. Work includes and is the result of
performing or providing all labor, services, and documentation necessary to produce such
engineering, design, or construction, and furnishing, installing, and incorporating all materials and
equipment into such construction, all may be required.
IV. PROJECT SCOPE
A. The connection of the Property under this Agreement is not subject to restrictions
relating to adjacency and potable use as may be defined or referenced within the Agreement.
B. Public Water Connection.
1. The Authority, by its own efforts or through a contract bid, awarded, and entered
into as an Authority contract, will undertake the engineering, design, and construction
of a water main extension to the Authority’s Water Infrastructure to provide a Public
Water Connection to the Property.
2. The Authority will obtain any permits, permanent public utility easements,
temporary public utility easements, or licenses necessary to accommodate and allow
the performance of the Public Water Connection work.
C. Engineering Services. The design phase of the Project will be funded by the County
and managed by the Authority. Any Engineering Services contract for the Project will be
advertised, awarded, and entered into as an Authority contract; provided, however, the Authority

will communicate with representatives of the County as needed in the administration and
management of the Project contract.
D. Construction and Construction Management.
1. The construction phase of the Project will be funded by the County and managed
by the Authority. Any Construction or Construction Management contract for the Project
will be bid, awarded, and entered into as an Authority contract; provided, however, the
Authority will consult and communicate with representatives of the County as needed in
the administration and management of the Project contract. Construction bid results and
professional services’ contracts for construction administration will be presented to County
staff for review and approval prior to award.
2. The Project will be bid, awarded, and entered into as an Authority contract;
provided, however, the Authority will consult and communicate with representatives of the
County, in the administration and management of the Project contract. During construction,
any changes in design or other changes in the Project work shall be subject to the prior
review and approval of the Authority and the County.
3. The Authority will obtain any permits, permanent easements, temporary easements,
or licenses necessary to accommodate and allow the performance of Project work. The
County will reimburse the Authority reasonable costs necessary for the Project.
V. PROJECT COSTS
A. The County shall bear the total third-party costs of the Project, for the Authority’s
standard costs relating to the Public Water Connection for the Property. The County shall
reimburse the Authority for third-party costs of the Project relating to Engineering, Construction,
and Public Water Connection work.
B. Engineering Costs.
1. The County shall bear the cost of the Engineering Services fees for the Project,
which are estimated to be twenty-six thousand five hundred dollars ($26,500.00).
2. Payments to any engineer shall be timely made by the Authority based upon
Project work completed. The Authority will prepare and transmit on a quarterly basis to
the County a reimbursement invoice for the Authority’s payment of engineering costs for
the Project, which invoices shall be paid to the Authority within 30 days of receipt by the
County.
C. Construction Costs.
1. The County will bear the cost of the construction phase of the Project occurring
in FY2026, which is estimated to be eighty-five thousand dollars ($85,000), inclusive of
contract administration services. Construction bid results and professional services
contracts for construction administration will be presented to County staff for review and
approval. Reimbursement to the Authority will be based on actual construction costs.

based upon Project work completed. The Authority will prepare and transmit to the

construction costs for the Project, which invoices shall be paid to the Authority within 30
days of receipt by the County.
3. The County shall reimburse the Authority the costs incurred by the Authority
to acquire permits, permanent easements, temporary easements, or licenses necessary for
the performance. The Authority will provide the County reimbursement invoices for the
Authority’s payment of such costs on a quarterly basis, which invoices shall be paid to the
Authority within 30 days of receipt by the County.
D. Public Water Connection. Payments for any Public Water Connection services by
any contractor or subcontractor shall be timely made by the Authority based upon Project work
completed. The Authority will prepare and transmit to the County on a quarterly basis a
reimbursement invoice for the payment of costs for the Project, which invoices shall be paid to the
Authority within 30 days of receipt by the County.
E. Project Cost Offset. Any payments received by CFPUA from a third party, not the
County, relating to the Project will be applied by CFPUA to offset any costs to be reimbursed by
the County and reflected on any invoices submitted.
VI. OWNERSHIP.
A. Public Water Connection. Upon completion of the Public Water Connection, the
Authority will have continued ongoing ownership and responsibility for the operation,
maintenance, and repair of the Authority Water Infrastructure.
B. Private Water Connection. Upon completion of any Private Water Connection, the
County will have the continued ongoing ownership and responsibility for the operation,
maintenance, and repair of said Private Water Connection.
VII. TERMINATION AND SUSPENSION.
A. Termination for Cause. Any party may terminate this Agreement for cause if the
other party materially breaches a provision of this Agreement and fails to cure such breach within
thirty (30) days of receipt of written notice describing the breach in reasonable detail. In the event
of early termination, the Authority will be entitled to receive just and equitable compensation for
actual costs incurred prior to receipt of notice of termination and for the satisfactory work
completed under the Agreement as of the date of termination. The Authority shall have the right
to cease performance immediately upon receipt of any notice of termination.
B. Non-Appropriation. If the governing board does not appropriate the funding
needed by the Authority to perform under this Agreement for a given fiscal year, the Authority
will not be obligated to perform beyond the end of the last fiscal year for which funds were
appropriated. In such event, the Authority will promptly notify the County of the non-appropriation

and this Agreement will be terminated at the end of the last fiscal year for which funds were
appropriated. No act or omission by the Authority, which is attributable to non-appropriation of
funds shall constitute a breach of or default under this Agreement.
VIII. INDEMNITY
To the extent allowed by North Carolina law and except to the extent caused by the sole negligence
or willful misconduct of the Authority, the County shall indemnify and hold and save the
Authority, its officers, agents and employees, harmless from liability of any kind, incl uding all
claims, costs (including defense) and losses, accruing or resulting to any other person, firm, or
corporation furnishing or supplying work, services, materials, or supplies in connection with the
performance of this Agreement, and from any and all claims, costs (including defense) and losses
accruing or resulting to any person, firm, or corporation that may be injured or damaged in the
course of its performance of this Agreement. This representation and warranty shall survive the
termination or expiration of this Agreement.
IX. DISCLAIMER OF WARRANTY
THE AUTHORITY MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND
WHETHER EXPRESS, IMPLIED, OR STATUTORY, WITH RESPECT TO THIS
AGREEMENT, OR ANY DESIGN OR INSTALLATION ARISING HEREUNDER. THE
AUTHORITY SPECIFICALLY DISCLAIMS ALL WARRANTIES, INCLUDING THE
IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
PURPOSE. THE AUTHORITY DOES NOT GUARANTEE THAT ANY DESIGN OR
INSTALLATION ARISING HEREUNDER WILL MEET THE REQUIREMENTS OR NEEDS
OF THE COUNTY.
X. GENERAL PROVISIONS.
A. Mutual Cooperation. The Parties agree to mutually cooperate to meet their mutual
goals and objectives as set forth herein and, specifically, in achieving completion of the Project.
B. Waiver. No failure by any party to insist upon the strict performance of any
covenant, duty, agreement, or condition of this Agreement or to exercise any right or remedy
consequent upon a breach thereof shall constitute waiver of any such breach of any other covenant,
duty, agreement, or condition.
C. Applicable Law. All matters relating to this Agreement shall be governed by the
laws of the State of North Carolina, without regard to its choice of law provisions, and venue for
any action relating to this Agreement shall be New Hanover County Civil Superior Court or the
United States District Court for the Eastern District of North Carolina, Southern Division.
D. Dispute Resolution. In the event of conflict or default that might arise for matters
associated with this Agreement, the Parties agree to informally communicate to resolve the
conflict. If any such dispute cannot be informally resolved, then such dispute, or any other matter
arising under this Agreement, shall be subject to resolution in a court of competent jurisdiction.

E. No Waiver of Sovereign or Governmental Immunity. Nothing in this Agreement
shall be construed to mandate purchase of insurance by any Party to this Agreement; or to in any
other way waive any Party’s defense of sovereign or governmental immunity to any cause of action
alleged or brought against a Party if otherwise available as a matter of law.
F. No Waiver of Qualified Immunity. No officer, agent or employee of any Party
shall be subject to any personal liability by reason of the execution or implementation of this
Agreement, or any other documents related to the transactions contemplated hereby. Such
officers, agents, or employees shall be deemed to execute this Agreement in their official capacities
only, and not in their individual capacities. This section shall not relieve any such officer, agent,
or employee from the performance of any official duty provided by law.
G. Notices. Any communication required or permitted by this Agreement must be in
writing except as expressly provided otherwise in this Agreement. Any communication under this
Agreement will be sufficiently given and deemed given when delivered by hand, by confirmed
facsimile transmission or by Federal Express or similar express delivery service, or on the date
shown on a certified mail delivery receipt, when addressed as follows:

Any addressee may designate additional or different addresses for communications by
notice given under this Section to the other party.
H. Severability. If any provision of this Agreement will be determined to be
unenforceable, that will not affect any other provision of this Agreement.
I. Amendments. This Agreement constitutes the entire agreement between the Parties
with respect to its general subject matter. This Agreement may not be changed except by
subsequent written agreement, consented to and duly executed by all Parties.

J. Assignments; Binding Effect. No party may sell or assign any interest in or
obligation under this Agreement without the prior express written consent of the other party.
Subject to the specific provisions of this Agreement, this Agreement will be binding upon and
inure to the benefit of and be enforceable by the Parties and their respective successors and assigns.
K. Time. Time is of the essence for this Agreement and each of its provisions.
L. No Third-Party Beneficiaries. There are no entities which are, or which are
intended as, third-party beneficiaries of this Agreement.
M. Counterparts. This Agreement may be executed in several counterparts, including
separate counterparts. Each is an original, but all of them together constitute the same instrument.
N. Complete Agreement; Exhibits. This Agreement is the complete and exclusive
understanding and agreement between the Parties regarding the subject matter of this Agreement
and supersedes all prior agreements, understandings, and communications, oral or written, between
the Parties regarding the subject matter of this Agreement.

Future Changes to the North Carolina
Child Fatality Prevention (CFP) System
•New legislation--Changes became law via the 2023 Appropriations Act

Most Recent Guidance Document
•Local Teams are no longer required to review every death of a resident child. Instead, Local
Teams shall review all deaths of resident children under age 18 that fall into one of the
following categories (and may elect to review additional deaths that fall outside these
categories):
−Undetermined causes.
−Unintentional injury.
−Violence.
−Motor vehicle incidents.
−Pursuant to criteria set forth in G.S. 7B-1407.5, deaths related to child maltreatment or child deaths
involving a child or child's family who was reported or known to child protective services.*
−Sudden unexpected infant death.
−Suicide.
−Deaths not expected in the next six months.*
−Additional infant deaths according to the criteria established by the State Office under G.S. 7B -
1407.6.
*Criteria and guidelines will be established by NCDHHS to further define these
categories.

§ 7B-1407. Local Teams; composition and leadership.
(a) Each Local Team shall consist of representatives of public and nonpublic agencies in the community that provide services to
children and their families and other individuals who represent the community.
(b) Each Local Team shall consist of the following persons:
(1) The director of the county department of social services or the director of the consolidated human services agency and
a member of the director's staff.
(2) A local law enforcement officer, appointed by the board of county commissioners.
(3) An attorney from the district attorney's office, appointed by the district attorney.
(4) The executive director of the local community action agency, as defined by the Department of Health and Human
Services, or the executive director's designee.
(5) The superintendent of each local school administrative unit located in the county, or the superintendent's designee.
(6) A member of the county board of social services, appointed by the chair of that board.
(7) A local mental health professional, appointed by the director of the area authority established under Chapter 122C of
the General Statutes.
(8) The local guardian ad litem coordinator, or the coordinator's designee.
(9) The director of the local department of public health.
(10) A local health care provider, appointed by the local board of health.
(11) An emergency medical services provider or firefighter, appointed by the board of county commissioners.
(12) A district court judge, appointed by the chief district court judge in that district.
(13) A county medical examiner, appointed by the Chief Medical Examiner.
(14) A representative of a local child care facility or Head Start program, appointed by the director of the county
department of social services.
(15) A parent of a child who died before reaching the child's eighteenth birthday, to be appointed by the board of county
commissioners.
(c) The chair of the Local Team may invite a maximum of five additional individuals to participate on the Local Team on an ad
hoc basis for a specific review if the chair believes the individual's subject matter expertise or position within an organization will
enhance the ability of the Local Team to conduct an effective review. The chair may select ad hoc members from outside of the
county or counties served by the Local Team. As a condition of participating in a specific review, each ad hoc member is required to
sign the same confidentiality statement signed by a Local Team member and is subject to the provisions of G.S. 7B-1413.
(d) One or more members of the State Office staff may serve as an ex officio member of any Local Team. Vacancies on a Local
Team shall be filled by the original appointing authority.
(e) Each Local Team shall elect a member to serve as chair at the Team's pleasure.
(f) Each Local Team shall meet as frequently as necessary to fulfill the requirements imposed by this Article, but no less than
twice per year.
(g) The chair of each Local Team shall schedule the time and place of meetings and shall prepare the agenda. Prior to presiding
over a Local Team meeting, the chair shall participate in the appropriate training provided by the State Office. (1993, c. 321, s.

Local Transition Recommendations
Below are the recommendations of the New Hanover County Health and Human Services, New Hanover County
Social Services and Public Health Directors transition for local CPT/CFPT- in compliance with the 2023 Appropriations
Act [Section 9K.15. of Session Lay 2023-134]. The changes to the Local Team will become effective January 2025.
Recommended Team Membership Per NCGS § 7B-1407 (2023). Local Teams; composition and leadership:

Recommendation: Vacant – recruitment efforts are ongoing and appointee will be brought
forward for Board of County Commissioners approval at a future date.
(c)The chair of the Local Team may invite a maximum of five additional individuals to participate on the Local Team

Subject: Recommendation to Proceed as a Single-County Local Child Fatality Prevention Team
Pursuant to Section 9H.15 of Session Law 2023-124, each North Carolina county is now required
to establish a Local Child Fatality Prevention Team (CFPT), consolidating the former Child
Fatality Prevention Team and Community Child Protection Team functions. Counties must
designate their team as either single-county or multi-county. These teams are tasked with
reviewing child fatalities, identifying systemic issues, and issuing policy recommendations in
accordance with N.C.G.S. 7B Article 14.
At its recent meeting, the New Hanover County Health and Human Services Board reviewed this
requirement and considered the operational needs of our county—including population size,
infrastructure, and interagency coordination capacity.
After deliberation, the Health and Human Services Board supports New Hanover County’s
designation as a single-county Local Child Fatality Prevention Team. We believe this structure
provides the strongest foundation for:
• Focused attention on county-specific trends and systemic challenges
• Efficient and timely collaboration among local agencies
• Continuity in the fatality review process and response strategies
On behalf of the HHS Board, I respectfully recommend that the Board of County Commissioners
take formal action to confirm New Hanover County’s designation as a single-county Local Child
Fatality Prevention Team under the updated state requirements.

ORDER TO DENY A SPECIAL USE PERMIT
Additional Dwelling Allowance in an R-15, Residential Zoning District
S25-02 – Tarin Woods Additional Dwelling Allowance
The County Commissioners for New Hanover County (hereinafter “County Commissioners”),
having held a public hearing on the 2nd day of June, 2025, to consider application number S25-02
submitted by applicant Attorney Samuel Potter with Equitas Law Partners, LLP, on behalf of
property owner Hoosier Daddy, LLC, for a special use permit for an Additional Dwelling Allowance
for additional density up to 10.2 dwelling units per acre in a R -15, Residential district on
approximately 43.50 acres located at 5741 Carolina Beach Road , and having heard all of the
evidence and arguments presented at the hearing, the County Commissioners make the
following CONCLUSIONS OF LAW:
1. That the proposed use DOES NOT satisfy the second general requirement listed in the
New Hanover County Unified Development Ordinance (hereinafter “UDO”); namely that
the use meets all required conditions and specifications of the UDO due to the following
FINDINGS OF FACT:
a. Section 3.2.8.D states the maximum building height in the R -15 district is 40 feet.
The maximum building height may go up to 44 feet for structures elevated on
open foundations consisting of piers, posts, columns or piles. Building 46 on the
concept plan is proposed at 50 feet tall, exceeding the maximum height allowed
in the R-15 district.
b. Section 3.1.3.E.2.b states the development shall have direct access to and from an
existing major or minor arterial as indicated on the most recent officially adopted
Wilmington MPO Functional Classification Map. This direct access requirement
will be satisfied if one or more property boundary lines is contiguous with and
utilizes access to and from an existing major or minor arterial, or the development
accesses an existing major or minor arterial roadway by a NCDOT-maintained
public street, or by a private street designed and constructed in accordance with
the County’s minimum standards for a collector road. There was not sufficient
evidence presented to determine if Rosa Parks Land complies with the County’s
access requirements.
2. That all of the specific requirements set forth in Section 10.3.5.D of the UDO WILL NOT
be satisfied if the property is developed in accordance with the plans submitted and the
evidence in the record.
3. That the inability to meet one of the four requirements under Section 10.3.5.D means the
project must be denied. The County Commissioners, having made the FINDINGS OF FACT
and CONCLUSIONS OF LAW that the applicant’s project was not supported by competent,

material, and substantial evidence showing that this project meets all required conditions
and specifications of the UDO, and understanding that failing to meet one required
condition means the project is denied, did not move forward to consider the other three
requirements.
Wherefore, all of the general and specific conditions precedent to the issuance of a special use
permit HAVE NOT been satisfied, IT IS ORDERED that the application for the issuance of a special
use permit be DENIED.
