Good morning,
We were reviewing the upcoming board cases and noted Section 3.4.9.E.1 Access (attached) that specifies that
any AC zoned property cannot be accessed through a residential area.
I pulled the information from when the AC district was adopted in 1976, and that language has been consistent
since the original adoption (second attachment beginning on page 11 of the PDF).
My current understanding is the intent of the district requirement was for incremental expansions of the AC district
adjacent to other AC zoned properties, most likely as a protection for the Acorn Branch community and other
nearby residential. Given the Old Winter Park rezoning is proposed adjacent to residential on all sides it would be
creating a non-conformity and staƯ would not be able to recommend approval.
I’ll be in a meeting this morning until 10:30 but can be available afterwards if you would like to call to discuss.
