Planning (Katherine May): 1. General Comments a. The zoning district is I-2. b. The use is for a gas station and convenience store. c. There does not appear to be transmission lines on the property. Response: Noted. 2. UDO Section 5.1, Parking and Loading a. The site provides 26 parking spaces. The use of convenience store requires a minimum of 2.5 parking spaces for every 1,000 square feet of building area. Required parking is 3,500/ 1,000 = 3.5 x 2.5 = 9 required parking spaces. b. EV parking is required when over 25 parking spaces are provided. Response: Conduit added for future EV space infrastructure. Refer to C8 for conduit location. 3. UDO Section 5.2, Traffic, Access and Connectivity a. a. Please note that no building permit for any structure shall be issued which requires NCDOT approval for a Driveway Permit until NCDOT has issued the permit approval. Evidence of approval shall accompany the application for building permit. Response: Noted. 4. UDO Section 5.3, Tree Retention a. A tree removal permit must be submitted prior to TRC approval. b. Retained trees on neighboring parcel do not count towards mitigation. Trees located outside of parcel do not count towards mitigation. c. d. Please update tree legend to include only the trees on the subject site. e. Note which trees are being removed or remaining on the tree legend. f. Replacement trees should reflect the type being removed. g. Note: Land disturbance permits can be issued by county Engineering before a Tree Removal Permit is approved by Planning. However, any trees removed before the Tree Removal Permit is issued may result in enforcement action under Section 5.3.2 of the S ITE D ESIGN , I NC. CIVIL ENGINEERS • LAND SURVEYORS • LANDSCAPE ARCHITECTS Unified Development Ordinance to include prohibiting any development of the site for 3 to 5 years. Response: Tree legend updated with remove/save status and trees on neighboring parcel removed from list. See L0. 5. UDO Section 5.4, Landscaping and Buffering a. Thank you for providing the landscape plan! b. The site does not abut residential property so no buffers are required. c. The dumpster is sufficiently screened. d. The parking lot landscaping is sufficient and meets the minimum requirements. Excellent choice of shade trees, thank you. e. Section 5.4.6.B: Street Yard i. The landscape notes list 13 trees in the street yard, but I counted 12. Please let me know if I just missed the extra tree or add it to the plan. f. Section 5.4.7: Foundation Plantings i. Please provide foundation plantings calculations on landscape plan. Response: There were only 12 trees in the street yard- added one more tree for a total of 13. Founding planting calculations added to L1. 6. UDO Section 5.5. Lighting a. Please note that a lighting plan is not required for TRC approval but will be required prior to issuance of construction plan approvals. b. Is any lighting proposed for the site? Response: Yes. Lighting is planned. Lighting/Photometric plan to be provided. Will be obtained created by architectural/electrical team. 7. UDO Section 5.6, Signs a. For any signs on the site, please submit for a sign permit, referencing Section 5.6 of the UDO for standards. Response: Noted. Sign permit to be obtained by others. 8. UDO Section 5.7, Conservation Resources a. Site shows Leon soils on half of the parcel which is a class III soil type. Class III is defined as severe limitations; requires extensive modification and intensive maintenance. Response: Noted. 9. UDO Article 9, Flood Damage Prevention a. The site is not in a flood plain. Response: Noted. 2. NHC Fire Services (Ray Griswold): 1. Fire Finals required. Response: To be address as part of building plans. 2. Portable Fire extinguishers required per NFPA 10 Response: To be address as part of building plans. 3. Underground Fuel tank & piping permits required Response: Will be submitted with building plans. 3. NHC Soil & Water Conservation (Dru Harrison): 1. Comments are attached. Response: Noted. 4. A request for additional information has been provided to the applicant for County stormwater permit and land disturbing permit. The stormwater and land disturbing review fees must be paid prior to permit issuance. Response: Stormwater comments addressed in separated document. 2. Please contact the State for their stormwater permit requirements. Response: Spoke with NCDEQ. We will be applying for an off-site stormwater permit separately. 5. NHC Environmental Health (Dustin Fenske): 1. Septic: Site plan reflects connection to public sewer. Infrastructure does not impede on surrounding properties septic systems. Response: Noted. 2. Well: Site plan reflects connection to public water. Infrastructure does not impede on surrounding properties drinking water wells. Response: Noted. 6. NHC Sustainability Manager (Madelyn Wampler): 1. No comments. Response: Noted. 7. NHC Addressing (McCabe Watson): 1. Existing address is acceptable. Response: Noted. 8. Cape Fear Public Utility Authority (Bernice Johnson): 1. CFPUA TRC Comments provided are preliminary comments only. Response: Noted. 2. Utility Plan review required by CFPUA. CFPUA is moving towards becoming paperless. When ready to submit plan review package, upload all documents to https://www.cfpua.org/FormCenter/Engineering-3/Engineering-Plan-Review-103. Response: Noted. Utility Plan & additional documentation submitted May 15th. Comments provided May 15th. Comments have been addressed on updated plans and will be resubmitted for additional review. 3. CFPUA water is available; CFPUA sewer is available via a forcemain-to-forcemain connection (please refer to CFPUA Detail S-14). Response: Noted. Detail S-14 added to plans. 4. Meter Sizing Form will be required. Response: Noted. Meter Sizing Form submitted with Utility Plan. 5. Capacity is dependent on the analysis of the pipe collection system (gravity and force mains). Response: Noted. 6. A capacity determination can be provided upon submittal of the NC DWQ FTA/FTSE Application Form and a Preliminary Plan, this determination does not guarantee capacity. Response: Noted. 7. Capacity is issued to projects on a first come, first serve basis, when capacity is available, the plans meet Authority requirements, and the NC DWQ FTA/FTSE forms are signed by the Authority. Response: Noted. 9. NCDOT (Nick Drees): S ITE D ESIGN , I NC. CIVIL ENGINEERS • LAND SURVEYORS • LANDSCAPE ARCHITECTS 1. General Comments a. NCDOT Driveway Permits, and Encroachments are submitted through the NCDOT online portal. https://connect.ncdot.gov/municipalities/Utilities/Pages/help.aspx Response: Noted. 2. NCDOT Driveway Permit a. An NCDOT Driveway Permit is required. Submit plans in accordance with pages 14 and 15 of the Policy on Street and Driveway Access to North Carolina Highways to include access locations within 500’ of the proposed access on both sides of the State Road. Submit to the local NCDOT District Engineer’s Office. Response: Noted. NCDOT Driveway Permit to be submitted. 3. NCDOT Encroachment Agreement a. An NCDOT Encroachment Agreement is required for any utility connections or installations within the NCDOT right-of-way (form 16.6). Response: Noted. NCDOT Encroachment Agreement 16.6 to be submitted. 4. Required Roadway Improvements a. A TIA is under review, once it is approved additional comments will be provided by NCDOT. Response: Noted. TIA Approval with Conditions has since been received. Plans have been updated to show right-in/right out and signalized intersections as required per Approval Letter. Please advise of any additional changes to be made. 5. Site Plan Comments: a. Due to the TIA not being approved, any design related items associated with the proposed driveways design, stem length requirements, roadway improvements, etcetera will be provided once the TIA is approved. Response: TIA has been approved as noted above and recommendations incorporated into plans. 10. WMPO (Caitlin Cerza): 1. Comments are attached. Response: Approval with conditions letter was received May 20, 2025. Site Access D1 shown as right-in/right-out with stop control for eastbound approach and an internal protected stem of 100’ measured from r/w line. Site Access D2 shown as single ingress, double egress with signalized intersection and turn lanes as stated in approval letter. 11. Army Corps of Engineers (Brad Shaver): 1. No comments.
