TECHNICAL REVIEW COMMITTEE AGENDA
July 9th, 2025
New Hanover County’s Technical Review Committee (TRC) will meet Wednesday,
July 9th, 2025 at 2:00 p.m. to discuss the below items.
The Technical Review Committee (TRC) is a staff-level group that reviews projects for compliance
with the regulations administered by each respective review agency. The TRC meetings are
considered staff meetings with applicants and are not public hearings.
The TRC meeting is an opportunity for applicants to speak with county staff and any voluntarily
participating state agencies about the review comments they have been provided.
No voting is involved in the technical review process and no approvals or denials are made at TRC
meetings. Following the TRC meeting, applicants are responsible for updating their plans to
address review comments. Applicants are also responsible for coordinating with state and federal
agencies for compliance with any additional requirements.

page.
This meeting will be conducted remotely via teleconference.

The following comments have been received for the July 9, 2025, TRC meeting. Additional comments may
be made upon further review of subsequent revisions.
Please note: following the TRC meeting, a revised site plan addressing each of the below items must be
resubmitted prior to receiving site plan approval.

1. General Comments
a. Zoned I-1.
b. There are Duke Energy Transmission Lines/Easement on the Property but they do not
impact the site plan.
2. UDO Section 5.1, Parking and Loading
a. Use requires 1.5 parking spaces for every 1,000 square feet of building area. Project
proposes 11,083 square feet. Required parking is 11,083 / 1,000 = 11 x 1.5 = 17 required
parking spaces, while 18 are provided, including 2 ADA compliant spaces where only 1 is
required.
3. UDO Section 5.2, Traffic, Access and Connectivity
a. Please note that no building permit for any structure shall be issued which requires
NCDOT approval for a Driveway Permit until NCDOT has issued the permit approval.
Evidence of approval shall accompany the application for building permit.
4. UDO Section 5.3, Tree Retention
a. Please submit a Tree Removal Permit for the trees being removed.

b. Note: Land disturbance permits can be issued by county Engineering before a Tree
Removal Permit is approved by Planning. However, any trees removed before the Tree
Removal Permit is issued may result in enforcement action under Section 5.3.2 of the
Unified Development Ordinance to include prohibiting any development of the site for 3
to 5 years.
5. UDO Section 5.4, Landscaping and Buffering
a. 15 trees per acre disturbed, trees must be at least two inches diameter at breast height
(DBH). Site plan shows .5 acre disturbed, requiring 8 trees
b. For street yard; 25 square feet for every linear foot of street yard frontage, with a
minimum of 12.5 feet. Please include a schematic of what is currently planted and spaced.
c. Interior parking lot landscaping requires no less than 4 percent, 8 percent is provided.
i. Landscaping islands, either separate or protruding from perimeter landscaping
strips, shall be a minimum of 12 feet in width measured from the back of curb to
back of curb.
ii. A minimum of one evergreen or deciduous tree for every 20 linear feet of planting
strip on average, rounded to the highest whole number, shall be planted within
the planting strip.
iii. No parking space shall be located more than 120 feet from a landscaped island
iv. One plant or existing tree shall be required for every 144 square feet, rounded to
the next lowest whole number of total interior landscaped area, with a minimum
of one tree in each island
6. UDO Section 5.5, Lighting
a. Please note that a lighting plan is not required for TRC approval, but will be required prior
to issuance of construction plan approvals.
b. Is any new lighting proposed for the addition?
7. UDO Section 5.6, Signs
a. For any signs on the site, please submit for a sign permit, referencing Section 5.6 of the
UDO for standards.
8. UDO Section 5.7, Conservation Resources
a. Per the New Hanover County Conservation Resource Map there are no Conservation
Resources present on this property.
9. UDO Article 9, Flood Damage Prevention
a. No part of the property is in the floodplain.

conveyance system. Note, the minimum size pipe is 15” per Section 4.4.2 of the NHC
stormwater design manual.

COMMENTS: The soils are predominantly Leon sand (Le).
According to the booklet, “Wilmington/New Hanover Classification of soils for Septic
Tank Suitability, Leon is a Class III soil.
The Soil Survey of New Hanover County lists Leon as poorly drained.
Leon is on the New Hanover County Hydric Soils Ä list which means they are possibly
wetland areas and subject to regulation under the Clean Water Act. It should be noted,
according to the Soil Survey of New Hanover County, the limitation for dwellings with
or without basements and for small commercial buildings is severe for all of the soils on
this site. The limitations are due to flooding and/or wetness. An adequate drainage and
maintenance plan is needed for suitable housing.
The U.S. Army Corps of Engineers has federal jurisdiction over 404 Permits and the
NCDEHNR, Dept. of Water Quality, has state jurisdiction over 401 Permits under the
Clean Water Act. Before disturbing possible wetland areas, developers should contact
these agencies to stay in compliance with State and Federal regulations.

NCDOT Driveway Permit:
An NCDOT Driveway Permit is required. Submit plans in accordance with pages 14 and
15 of the Policy on Street and Driveway Access to North Carolina Highways to include
access locations within 500’ of the proposed access on both sides of the State Road.
Submit to the local NCDOT District Engineer’s Office.

An NCDOT Encroachment Agreement is required for any utility connections or
installations within the NCDOT right-of-way (form 16.6).

Site Plan Comments:
Include/update the NCDOT Standard Drawings (2024) that are applicable to the
development.
Sight Triangles and Sight Distance:
• Show and label the 10’ X 70’ NCDOT sight triangles.
o No obstructions shall be placed within the NCDOT sight triangles.
• Show and label the stopping sight distance.
o No obstructions shall be placed within the stopping sight distance.
Identification Signing and Landscaping:
• Identification signing or landscape vegetation within the median and the sight
distance triangle must not obstruct the driver’s line of sight. No landscaping or
signing will be allowed to exceed 42 inches in height, measured from the Edge of
Pavement (EOP) within the median or sight triangle.
• All pylon signs in the median or sight distance triangle must provide a vertical
clear sight zone between 3 feet-6 inches and 10 feet-0 inches measured from the
EOP. Signing located within a clear recovery area shall be of a “breakaway
design.”
• Only low growing shrubbery, consistent with the NCDOT’s landscaping policies,
as contained in the publication “Guidelines for Planting Within Highway Right of
Way,” will be allowed within a landscaped median and the sight distance triangle
at the entranceway to a development, whether the street or driveway connection to
the State Highway System is designated as a public facility or not. Landscaping
within the right-of-way and sight distance triangles may require additional
approval by the District Engineer.

Engineering Studies
The applicant may be required by the District Engineer to submit studies based on, but not limited to, the parameters outlined
herein. If study requirements of the local government agency are more restrictive than the NCDOT requirements, then local
government requirements will govern. However, this does not imply that the NCDOT is obligated to approve entrance designs
that are too constrictive to allow smooth and safe traffic flow. All studies including, but not limited to, Traffic Impact Analyses
(TIA), traffic signal studies, and drainage studies, must be prepared under the direct charge of and sealed by a North Carolina
licensed Professional Engineer.

IN THE EVENT THATMATERIAL ENCOUNTERED AT PIPE GRADE, SUBGRADE OF PARKINGOR ROADWAYS AND SUBGRADE OF BUILDING FOUNDATIONS ISFOUND TO BE SOFT, SPONGY, OR IN ANY OTHER WAY UNSUITABLE,THE CONTRACTOR SHALL NOTIFY THE GEOTECHNICAL ENGINEERIMMEDIATELY. SUCH UNSUITABLE MATERIAL SHALL BE REMOVEDTO A DEPTH AS SPECIFIED BY THE GEOTECHNICAL ENGINEER ANDREPLACED WITH A MINIMUM OF SIX (6) INCHES OF STONE, OR ASDIRECTED BY THE GEOTECHNICAL ENGINEER.

BEFORE PLACINGANY BACKFILL, ALL RUBBISH, FORM, BLOCKS, WIRES OR OTHERUNSUITABLE MATERIAL SHALL BE REMOVED FROM EXCAVATION.THE BACK-FILLING OVER PIPES SHALL BE PLACED IN LAYERS NOTOVER SIX (6) INCHES THICK AND COMPACTED TO A MINIMUMDENSITY OF NINETY-FIVE (95) PERCENT OF THE MAXIMUM DRYDENSITY AS DETERMINED BY THE MODIFIED PROCTORCOMPACTION TEST TO A DEPTH OF 12 INCHES BELOW FINISHEDGRADE. THE LAST 12 INCHES OF BACKFILL SHALL BE PLACED INLAYERS NOT OVER SIX (6) INCHES THICK AND COMPACTED TO AMINIMUM DENSITY OF NINETY-EIGHT (98) PERCENT OF THEMAXIMUM DRY DENSITY AS DETERMINED BY THE MODIFIEDPROCTOR COMPACTION TEST.
STORM DRAINAGE AND GRADINGNOTES
1. IN ACCORDANCE WITH NC GENERAL STATUTES, NPDESREGULATIONS, AND NCDENR REQUIREMENTS, STORMWATERDISCHARGE OUTFALLS SHALL BE INSPECTED BY THE CONTRACTOR.INSPECTIONS SHALL BE PERFORMED BY THE CONTRACTOR AFTEREACH STORM EVENT OF 1/2 INCH OR GREATER, WITH ONE WEEKLYINSPECTION MINIMUM. NCDENR STANDARD INSPECTION REPORTSSHALL BE PREPARED AND SIGNED WITH COPIES PROVIDED TO THEOWNER, ARCHITECT, AND ENGINEER, BY THE CONTRACTOR.
2. INLET PROTECTION SHALL BE INSTALLED AROUND OUTFALL.DEVICES SHALL BE CONSTRUCTED TO FINAL PROPOSED CONDITIONUPON STABILIZATION OF CONTRIBUTING GROUND SURFACES ANDREMOVAL OF SEDIMENT FROM STORM PIPES.
3. ALL DIMENSIONS AND GRADES SHOWN ON THE PLANS SHALL BEFIELD VERIFIED BY THE CONTRACTOR PRIOR TO CONSTRUCTION.CONTRACTOR SHALL NOTIFY CONSTRUCTION MANAGER IF ANYDISCREPANCIES EXIST PRIOR TO PROCEEDING WITHCONSTRUCTION FOR NECESSARY PLAN OR GRADE CHANGES. NOEXTRA COMPENSATION SHALL BE PAID TO CONTRACTOR FOR ANYWORK DONE DUE TO DIMENSIONS OR GRADES SHOWNINCORRECTLY ON THESE PLANS IF SUCH NOTIFICATION HAS NOTBEEN GIVEN.

construction. The project is identified as 5.5% complete per NCDOT Division 3 June project
updates. Project completion is estimated to be December 2029. The site location is in close
proximity to this project.
U- 4902C: Access Management Improvements on Market Street from north of US 117/NC
132 (College Road) to Station Road. Construction Year is currently set for 2030. The site
location is in close proximity to this project.
