The approved plan consists of 1 building, 6000 sq ft for a Medical Office on .86 acres of land located at 501 Manassas Drive with a PID of R07906-001-002-000. The site was rezoned to (CZD) ) O & I on July 22, 2024 under rezoning case Z24-06. The site has the following seven (7) conditions: 1. Street yard landscaping will be installed along Carolina Beach Road to meet curent UDO landscape requirements for commercial projects. 2. Any freestanding sign(s) on the site shall be monument-style with landscaping around the base of the sign. No pole signs shall be permitted. 3. Exterior lighting including luminaries and security lighting shall be full cut-off fixtures that are directed downward in compliance with Figure 5.5.4.C Full Cut-off Fixtures of the UDO. In no case shall lighting be directed at or above a horizontal plane through the lighting fixture. Light posts shall be no taller than twelve (12) feet. 4. Permitted uses are limited to: a. Medical and dental office and clinic b. Bank and/or Financial Institution c. Business Service Center d. Offices for Private Business and Professional Activities e. Significant trees identified on the concept plan shall be permanently retained 6. A six-foot-tall solid wood privacy fence shall be installed along the northern and eastern sides of the project as depicted on the concept plan 7. A minimum 20-foot-wide public access easement shall be provided along the frontage parallel with Carolina Beach Road for public bicycle and pedestrian use. The site is also approved for a minor deviation from the approved concept plan related to the positioning and size of the office building. The approved concept plan showed the building in the SE corner whereas the new plan shows the building in the NE corner, while also reducing the size from 8000 sq ft to 6000 sq ft. This minor deviation is administratively approved under Section 10.3.3.C.7.b.1: 1. Modifications in building or structure placement, provided the placement complies with the setbacks of the corresponding base zoning, and does not decrease the setbacks agreed to by more than 10 percent from what was originally approved; The concept plan at the time of board approval also included one significant 8-inch magnolia tree for removal, however, the condition requiring permanent retention of significant trees on site does not apply to the 8-inch magnolia because it was proposed for removal on the approved concept plan. The approved site plan is attached. This approval is valid for two years unless a building permit application or evidence of another substantial improvement for all or a portion of the project is submitted to the County. If the TRC approval expires it would require a new application that would subject the project to all development standards in effect at the time of the new application. Please note the project may be subject to additional regulations of the County’s development ordinances. In addition, this approval does not relieve the applicant from any law, regulation, or requirement of any other federal, state, or local government or regulatory agency. Approval of this plan allows for construction plans to be submitted in COAST for the subject project. Applicants must consult with New Hanover County Engineering on any required land disturbance and stormwater permits and CFPUA on utility permits. A tree removal permit is required before any regulated trees are removed from the site. Construction plans must also be approved through the building and zoning permit review process before starting any construction.
