Additional comments may be made upon further review of subsequent revisions. Please note: following the TRC meeting, a revised preliminary plan addressing each of the below items must be resubmitted prior to receiving preliminary plan approval. Planning, Robert Farrell (910) 798-7164 1. General Comments a. Property was rezoned to a Conditional R-5 district on September 5, 2023 for a maximum of 46 dwelling units consisting of a mix of single family and attached dwelling units. b. Please include the list of required conditions as notes somewhere in the plans. The plan was approved with five (5) conditions: i. The project as shown on the submitted site plan shall be developed with water and sewer connections to a private wastewater system. Private wells and septic systems are not allowed for residential development as contemplated on the site plan. ii. As identified on the site plan, certain existing trees onsite will not be removed. iii. The zoning approval and development contemplated therein shall not impact the current and future lot owners of the following parcels, R08518-001-014-004, R08518-001-015-000, and R08518-001-015-002, right to use the access easement Seabreeze Townhomes – Major Subdivision – TRC Review Page | 2 shown on the concept plan, nor shall the zoning approval and development contemplated therein create any additional financial burden on those lot owners to contribute to the cost of maintenance for the access road. iv. The northern terminus of the access easement shall be designated for public use to allow potential future connection to and through adjoining parcels to Seabreeze Road. v. All stormwater management areas shown on the concept plan shall be required. Changes to the general shape of the basins as required by essential site improvements may be accepted administratively by Planning staff. c. To meet Condition 4 a public access easement will need to be shown at the end of the road. 2. UDO Section 5.1, Parking and Loading a. The Site Data table on C-001 states N/A for required parking. Single family dwellings require a minimum of 2 parking spaces. The preliminary plat shows the driveways for each unit. Will the driveways be sufficient to accommodate 2 vehicles or will there also be garages for vehicle storage? 3. UDO Section 5.3, Tree Retention a. Based on the tree table on page CD 101 all trees identified on site are Significant trees. Mitigation will be required for any removed trees. Mitigation can be met with additional tree planting or payment into the tree fund. b. Submit a tree removal permit application to initiate a separate tree removal permit. Tree removal is necessary before land disturbance permits may be issued. c. Please confirm that Tree T3 will be able to remain in the well site area. Per UDO Section 5.4.1.A, Single family lots less than 2 acres are not required to meet landscaping requirements. 5. UDO Section 5.5, Lighting a. Are streetlights included as part of the project? b. If streetlights are proposed note a lighting plan will be required. The lighting plan is not required at time of TRC approval however will be required prior to approval of a final plat. See below excerpt from Section 5.5.3: i. Information about the exterior lighting for the site that demonstrates compliance with the standards in this section shall be submitted in conjunction with an application for site plan approval (Section 10.3.6, Site Plan) or zoning compliance approval (Section 10.3.8, Zoning Compliance Approval), whichever comes first, approved no later than at time of construction plan approval. 6. UDO Section 5.6, Signs a. If there are any new signs proposed for this development, please apply for sign permits prior to installation. 7. UDO Section 5.7, Conservation Resources a. New Hanover County Conservation Resource Overlay map indicates there are Pocosin conservation resources on the property however they are not underlaid by Class IV soils. Because the Pocosin resources is not underlaid with Class IV soils the Conservation Resource standards do not apply. 8. UDO Section 5.8 Open Space Requirements a. A minimum 20% open space is required for performance residential developments. b. The open space areas are highlighted on the plans however please include a note specifying the total acreage and percent open space included on project. 9. UDO Article 6, Subdivision Design and Improvements. a. Section 6.2.2.A.6.g Street Connectivity Standards requires a minimum link to node connectivity ratio of 1.40. The proposed project has 11 links and 7 nodes for a ratio of 1.57. b. Section 6.3.3.J.d requires sidewalks on both sides of the road for property developed in the R-5 district. The sidewalks should be shown and labeled on the preliminary plat. c. Are any traffic calming devices proposed as part of the project? Seabreeze Townhomes – Major Subdivision – TRC Review Page | 4 i. If traffic calming devices are proposed, they will need to be shown on the plat and reviewed by the TRC. NHC Fire Services, Sunnie Batson 910-798-7464 1. Please see attached PDF. NHC Engineering, Galen Jamison 910-798-7072 1. A land disturbing and a stormwater permit issued by the County are required for this project. Please digitally submit the permit applications documentation with requisite review fees for County issued permit directly to gjamison@nhcgov.com. Application and forms can be found at https://www.nhcgov.com/251/Stormwater and https://www.nhcgov.com/249/Sediment- Erosion-Control. 2. What are the total impacts to the existing wetlands? 3. The proposed fill at the existing tree north of parcel 46 and adjacent 8 will require tree removal and thereby not meet condition #2 of the rezoning. 4. How will the offsite drainage coming from the NE be routed through the site or is the intent to let in pond near the proposed well? Should it be routed through the site, the conveyance measures shall be placed in a public drainage easement sized in accordance with NHC Stormwater Manual. Construction within this offsite drainage conveyance measure that will be maintained by the county will need to be observed during construction by Stormwater Services and a turnover meeting scheduled once the system is ready to be conveyed to the county. Please add a plan note to ensure county construction observation and a turnover meeting occurs. Note, should the applicant elect to maintain the conveyance measures themselves, the POA covenants shall indicate the operation and maintenance roles and responsibilities for the conveyance measure. 5. Is it the intent for the offsite drainage from the SE to be routed to the SCMs? 6. Depending on subsurface investigation, the 100 year pre and post storm attenuation may be required for the site by the DOT. Therefore, it is highly recommended contact be made with the NCDOT drainage division should the discharge from the entire parcel be directed to South Seabreeze Road roadside ditch. Historical drainage patterns have the half the parcel going to Seabreeze Road and the other half going to Salt Spray Lane. 7. The resulting changes to the watershed from both offsite and onsite drainage appears to impact adjacent and downstream property owners. Therefore, and in accordance with NHC Stormwater Ordinance, Section 7.8.B, last paragraph, a stormwater impact analysis will be required for the culvert under Seabreeze Road. Please have the designer of record contact our office prior to initiating the analysis once the final proposed drainage/grading intent is determined. The offsite utility easement to the NW should be expanded to provide stormwater conveyance to Seabreeze Road as there are no drainage conveyance measures immediately adjacent the site. 9. Please contact the State for the stormwater permit modification requirements. It is assumed a high density permit will be required NHC Environmental Health, Dustin Fenske 910-798-6732 1. Wells for old homes identified on page 3 of the submitted plans must be identified, protected and abandoned properly by a certified well driller. Proposed sewer infrastructure and storm water improvements must maintain setbacks to existing well heads for homes located on Seabreeze Rd. and Roscoe Freeman Ave. 2. Site Plan identifies a well as a water source for this development. This well must have permits issued by NC DEQ Public Water Supply Section. 3. Site plan reflects connection to a public sewer system. Sewer manholes and force mains must maintain setbacks to surrounding properties well heads. Old septic tanks for existing homes identified on page 3 of the plans must have the septic tanks pumped, crushed and filled. NHC Addressing, Katherine May 910-798-7443 1. This shall include the complete set of civil plans. Failure to submit the comments or complete set of civil plans will result in a resubmittal for review for verification of compliance. • Per NCFC 503.6, submit for review the details and manufacturer information for the gate across the fire department access road. • Per NCFC 507.1, Provide an Engineered fire flow analysis report in accordance with the fire code and Appendix B to include pertinent information. A fire flow test shall be conducted in accordance with NFPA 291 and NCFC 507.4. This report shall be submitted by a P.E. and include the stamp of the submitting individual on the report. Accessibility • Fire apparatus access roads are required at time of construction. They are to be capable of handling the weight of fire apparatus and be passable in all weather conditions. Fire apparatus access roads are to be a minimum of 20 feet wide (Chapter 5), unless there are fire hydrants installed along the roadway then minimum is 26 feet wide (Appendix D). The fire code official may increase this width as necessary based on potential for fire apparatus response. Dead end roads greater than 150 feet in length shall require an approved means for fire apparatus to turn around (Chapter 5 and Appendix D). Fire apparatus access roads shall provide a clear vertical clearance of 14 feet including trees, canopies, bridges, etc. (Chapter 5 requirement is 13 feet 6 inches, however AHJ requires 14 feet based on local apparatus). • Street and road signs are required, temporary signs during construction are acceptable as long as they are legible and weather resistant. (Chapter 5). • Fire apparatus access roads that access commercial buildings greater than 30 feet in height are to be a minimum of 26 feet wide, be capable of handling the weight of aerial fire apparatus (100,000 lbs.) and be passable in all weather conditions. If roadside parking is desired the minimum road width shall be increased, contact the fire code official for further information. No Parking signs shall be a minimum of 12 inches wide and 18 inches tall. Commercial buildings shall have fire lanes marked (Chapter 5) • A secondary fire apparatus access road may be required if an impairment of a single fire apparatus access road would limit access under emergency conditions. Secondary access may also be required to facilitate evacuation during a natural or man-made disaster Chapter 5 and Appendix D). • Gates on fire apparatus access roads are discouraged due to the delay in response. If gated access is deemed necessary it shall be either staffed with personnel 24 hours per day every day, 365 days of the year or must include KNOX key bypass switch and siren activation (both). (Chapter 5). • Traffic calming devices are highly discouraged due to the delay in response. Speed bumps/humps are prohibited. Requests for other traffic calming devices must be evaluated during the Technical Review (TRC). • Premises identification is required. Address and or unit numbers are required on the street side as well as unit identification on rear access doors. Letters and Numbers shall not be less than 6 inches tall and ¾ inches wide; must be weather resistant and contrasting in color to their background. (Chapter 5). Buildings constructed under the 2018 code shall require additional signage per Appendix J. Water Supply (Chapter 5 and Appendix C) • If a water supply is required for fire protection a fire hydrant system or other means approved by the fire code official must be present prior to beginning construction and be maintained operable during the construction period. (For construction, fire dept. water shuttle counts as long there is a fill site within range) • An engineered fire flow calculation indicating the available fire flow shall be submitted to the Fire Marshal’s Office during plans review. • If an approved water supply capable of supplying the required fire flow for fire protection is available, fire hydrants shall be provided. Further information on the technical specifications is available from the fire code official or Cape Fear Public Utility Authority. o All fire hydrants shall be installed so they are visible from the fire apparatus access road with unobstructed access and a clear space no less than 36 inches in all directions. They shall be protected from vehicle impact by curbing, guard posts or other means approved by the fire code official. They shall be oriented with the large discharge facing the nearest street. All discharges shall meet the NFPA requirements for distance above grade. o Fire hydrants in general residential areas shall be installed so that all insured properties are within 500 feet of a hydrant (hydrant spacing approximately 1000 feet apart along a fire apparatus access road, installed at intersections where possible). The first fire hydrant should be installed at or near the entrance to the residential area. o Fire hydrants should be located 50 feet or more from the structure they protect. If study requirements of the local government agency are more restrictive than the NCDOT requirements, then local government requirements will govern. However, this does not imply that the NCDOT is obligated to approve entrance designs that are too constrictive to allow smooth and safe traffic flow. All studies including, but not limited to, Traffic Impact Analyses (TIA), traffic signal studies, and drainage studies, must be prepared under the direct charge of and sealed by a North Carolina licensed Professional Engineer.
