Dear Mr. Tripp: This office has investigated your request to add the petitioned roads to the State System for maintenance and based upon our investigation we have concluded that a denial is warranted at this time. Although the subdivision has preliminary plan approval, a certified recorded plat, and corresponding built to standards letters, it was determined that there were some deficiencies as stated in the attached deficiency letter, dated February 24, 2025. The 90-day period for deficiency corrections has expired. Generally, the Department does not complete a re-inspection until such time as we are notified that all the deficiencies have been corrected. As this office has not been informed that these items have been corrected, we must deny your petition at this time. If in the future these deficiencies are corrected, the Department will be glad to reconsider a new petition submittal. We regret that our response to your request is not more favorable. Dear Mr. Tripp: We have completed the PHASE 1 review for request for addition and have noted the following items that will need to be addressed prior to the Department advancing the review into Phase 2 (field inspection). The PHASE 1 review includes verifying the following items: 1.Preliminary Plan Approval – Approval was provided on 07/08/2020 and 2/15/2021. 2.Built to Standards – Approval was provided on 3/14/2022. 3.Housing Density – The minimum number of occupied houses has been satisfied. 4.Right-of-Way Verification – The plats have been reviewed and a valid public R/W verified. 5.Encroachment Review – Encroachment Agreements need to be submitted. Based upon our review, items 1, 2, 3 and 4 have been completed. For items 5, we noted the following deficiencies: Encroachments: An Encroachment Agreement is required for any utilities installed within the existing right-of-way. Once we have been notified that these items have been corrected and the required information provided, we will begin the PHASE 2 deficiency review. This phase will involve a field inspection to determine the existing state of maintenance of each of the requested routes.
