HomeMy WebLinkAboutWrightsboro Commons Minor Modification Approval 10-10-2024 Wrightsboro Commons Minor Deviation Approval Letter Page | 1 COMMERCIAL SITE PLAN MINOR MODIFICATION APPROVAL To: Mike Broyhill, Engineering Technician with CSD Engineering, mike@csd-engineering.com From: Robert Farrell, Development Review Supervisor Date: October 10, 2024 Subject: Commercial Site Plan Minor Modification Approval – Wrightsboro Commons Multi-Family The minor site modification for the Wrightsboro Commons multi-family project located at 2571 Duchess Road and 2690 Tangara Way has been approved. The site was originally part of the larger BRC Castle Hayne residential development which received approval of a Traffic Impact Analysis (TIA) in 2018 that had one (1) site access drive onto Castle Hayne Road. Wrightsboro Commons Minor Deviation Approval Letter Page | 2 Figure 1 In 2019 the area highlighted in red in Figure 1 above was separated from the overall project and rezoned as Urban Mixed Use (UMXZ) in rezoning case Z19-09 for a mixed-use project. The concept plan approved by the Board of Commissioners is Figure 2 below and showed two site access drives. The UMXZ project was still included under the original 2018 BRC Castle Hayne TIA which was only analyzed for one (1) site access onto Castle Hayne Road. Figure 2 Site Access Site Access 2 Site Access 1 Internal Connection to Adjacent Commercial Internal Connection to Adjacent Commercial Wrightsboro Commons Minor Deviation Approval Letter Page | 3 Section 10.3.3.C.7.b Minor Deviations of the Unified Development Ordinance allows Planning and Land Use Department staff to administratively approve minor changes to approved conceptual plans for conditional rezonings for modifications to the driveway location(s) not exceeding 10 percent of the length of the subject property line, or as required by the North Carolina Department of Transportation. Because the original 2018 TIA was not modified to allow the second site access, NCDOT cannot approve Site Access 2 in Figure 2 above. As a result, Planning and Land Use staff has determined that Site Access 2 can be removed from the plan in accordance with the attached minor modification plan provided pedestrian infrastructure is extended from Castle Hayne Road through Site Access 1 and connects to internal pedestrian infrastructure in the site. This approval is valid for two (2) years unless the project has substantially commenced. Please note the project may be subject to additional regulations of the County’s development ordinances, including but not limited to, those referenced in the initial Technical Review Committee (TRC) review and / or subsequent revised comments. In addition, this approval does not relieve the applicant from any law, regulation, or requirement of any other government or regulatory agency.
