Below are our responses to each comment. Please note that we will be submitting a separate comment response to New Hanover County Engineering for Stormwater and Erosion Control permits. Plannine, Gideon Smith 910s8-7571 1. Please update the plan with the following general corrections: a. Previously Addressed Per Comment letter Dated 3115121. b. Previously Addressed Per Comment letter Dated 3115121. c. Please delineate the passive and active recreation space within the open space area. We are requesting that the Open Space requirements be reviewed under the September 8, 2020 ordinance. 2. Please submit a Landscape Plan in accordance with Sections 5.3 and 5.4 of the UDO. a. Please show that the site meets the required parking lot interior, streetyard landscaping, and foundation planting requirements. Please include the foundation planting calculation in the Site Data Table. Landscape plan by others is enclosed. b. Please note that the parking lot interior landscaping is 8% of the total area used for parking, loading, driveways, internal drive aisles, and other vehicular use areas. i. Please verify the proNrided interior landscaping square footage noted in the. Site Data Table matches what is shown on the plan. We have revised the site data table to match the provided areas on the plan. c. Please include the buffer type and specification for the. required 20' minimum transitional buffer between the residential development and the adjacent single - homes to the cast, west, and south per Section 5.4.4.B fir D of the UDO. 5725 Oleander Dr. Unit E-7 Wilmington, NC 28403 (91O)859-8983 i. It appears that there is a driveway off Futch Creek Road that may be used by residents to the south of the residential development. Please ensure that the required buffer is installed outside of this driveway and does not impede travel. Noted. Landscape plan by others is enclosed. d. Please mote that in order to reducc the required SHOD setbacks, .in additional lice must be planted for every 40' road frontage. Please see comment 3 below. Noted. Section 5.3.4•C of the UDO that requires a minimum of 15 trees with at least a 2- inch caliper must be retained or Ulanted on the site for each acre disturbed by the proposed development. Noted. Landscape plan by others is enclosed. f. Please note that the transitional buffer along the southeastern property boundary must meet the i00% opacity requirement. Are there any conflicts with the required buffer and the drainage features/easements? i. It appears that the overall 20' wide buffer can be met based on the area between the property line and the storrawater facility. Please show the 20' buffer along the southeastern property line as it was shown on the conceptual plan that was approved through the conditional rezoning process. We are showing the buffer being reduced to io' along part of this property line to allow for required maintenance of the stormwater facility in accordance with State and New Hanover County requirements. There has to be a io' wide area at the top of bank of pond to allow for maintenance. There is now way to plant a buffer within this area and still adhere to stormwater requirements. ii. Once the landscape plan is submitted, staff will verify that the opacity requirement is met within this buffer. Landscape plan by others is enclosed. 3. The subject property is within the Special Highway Overlay District (SHOD). a. The front and side (northeastern property line) setbacks can be reduced by 25% provided additional plantings are installed along US 17. i. In addition to required streetyard landscaping, an additional tree must be planted for every 40' road frontage per Section 3.5.3•D.c of the UDO. Please include the additional plantings on the Landscape Plan. Landscape plan by others is enclosed. ii. Please note that the streetyara area ractor is 18 square feet for every linear foot of streetyard frontage in the CB district. The calculation on Sheet C-t indicates a factor of 37.5. This calculation is over estimating the required area. Calculation has been revised. iii. Please note that the minimum and maximum streetyard widths in the CB district are 9 feet and 27 feet respectively. Calculation has been revised. iv. Please show these adjustments, including the additional tree for the SHOD reduction, on the landscape plan when submitted. Landscape plan by others is enclosed. 4. Please apply for a Tree Removal Permit since regulated and significant trees are proposea to be removed. i . Previously Addressed Per Comment letter Dated 3115121. b. Previously Addressed Per Comment letter Dated 3115121. c. A tree removal permit will be issued for the site. Please show the required mitigation trees on the landscape plan. Landscape plan by others is enclosed. 5. Previously Addressed Per Comment letter Dated 3115121 6. It appears that the existing gravel driveway is immediately adjacent to the 5-unit structure on the western side of the site. Is there any intention to separate or provide landscaping between the two? We have moved the building away from the existing driveway. In addition, the owner is working with the adjacent land owner to relocate the drive as far away from the building as reasonably possible. 7. Please note that the Board of Commissioners amended the Exterior Lighting standards in the UDO (Section 5.5) on September 8, 2020. Please refer to the figures in Section 5.5.4 of the UDO and confirm the site will meet these provisions. Noted. a. Please note the illuminations are measured at ground level at the lot line in foot candles. Noted. Lighting plan by others is enclosed. b. Please note that these standards would not apply to security lighting controlled and activated by motion sensors for a duration of 15 minutes or less. Noted. c. Please be aware that a lighting plan that meets the standards of Sect. 5.5 is required and must be approved prior to the issuance of a building permit associated with this plan. The lighting plan can be submitted at any point before building permit application. Noted. Lighting plan by others is enclosed. 8. Please provide all NCDOT approvals upon receipt. Noted. 9. It appears that the required buffer between the 9-unit structure to the north of the site and the Reddick property does not meet the 2o' required buffer. However, pending the Board of Commissioners' action on November 16, 2020, the io' Buffer with fence may meet code requirements for transitional buffers. Noted. We are requesting that the Buffers be reviewed under the November 16, 2020 ordinance. Fire Services, Da►id Stop wo-798-79558 1. All new construction must comply with Section 510 of the NC Fire code. Emergency Responder Radio Coverage survey must be conducted and results given to the Building Safety Fire Plan Reviewer. (A pre -construction survey, while not required, is highly recommended). Noted. 2. All new structures must comply with Appendix J of the NC Fire Code, Building Information Signs. Noted. 3. Fire apparatus access roads cannot exceed a to percent grade with the approval of the Fire Chief. Noted. 4. A fire hydrant must be located within 400 feet of the commercial two story building. Please show a fire hydrant meeting this requirement on the site plan. Existing fire hydrant is now shown on the plan, and meets this requirement. 5. J111 fire hydrants must he installed with 5 inch Stoic ciuicl: connects ou a 4.6-inch steamer in compliance NNith NHC Fire Service requirements. Noted. 6. For sprinklered buildings, proposed FDC locations will need to be on the site plan submitted for TRC review and approved by the Fire Marshal's Office. Noted. Buildings are not proposed to be sprinkled. 7. One way streets will need to be clearly marked on the site plan and visibly marked as "One Way" with signage once the project is completed. If no streets are designated as "One Way" they must meet the minimum width of 20 feet for fire apparatus access and 26 feet where a fire apparatus road is served by fire hydrants. Noted. Signage and pavement marking have been added to the plan. Environmental Health, Marie Hemmen gio-298-666d 1. Proposed development including building structures, sewer lines, storm water ponds and any other sources of contamination shall meet the required setbacks to any existing wells. Noted. No wells are known to exist. 2. If any existing wells are located on the property, they must be protected prior to development and properly abandoned if they vrill no longer be used or do not meet setbacks per SECTION .03oo-PERMITTING AND INSPECTION OF PRIVATE DRINKING WATER WELLS and SUBCHAPTER 02C - WELL CONSTRUCTION STANDARDS SECTION .oroo. Noted. No wells are known to exist. 3. All buildings must maintain 25 feet to any existing wells on adjacent properties. All residential buildings are setback well in excess of 25' from any property line. The commercial building is adjacent to a vacant site and a commercial site which is served via public water mains.
