From: Gideon Smith Current Planner Date: April 21, 2020 Subject: Parsons Mill Farm Phase 2 – Preliminary Plan – TRC Review The following comments have been received for the March 11, 2020 TRC meeting. Please note: Strikethrough comments are satisfactory and Staff comments are shown in BLUE below. Please note: following the TRC meeting, a revised preliminary plan addressing each of the below items must be resubmitted prior to receiving preliminary plan approval. Planning, Gideon Smith 910-798-7571 1. Please update the plan with the following general corrections: a. It appears that the phasing shown on this Preliminary Plan does not match what is shown on the recorded Final Plats for Phases 1 and 2. Please adjust accordingly. b. Please add the passive open space to the Site Data Table. 2. Per Section 41 of the Subdivision Ordinance, rights-of-way and improvements must be extended to the boundary of the development and the connection to Creekstone Lane is required. In addition, subdivisions may be exempt from the connectivity ratio standard provided there is no option for providing stub streets or connectivity due to existing documented environmental features. If this connection is made, it will remove a node and will result in a ratio closer to what is typically required by the Ordinance without a waiver. a. Please provide documentation stating why the connection to Creekstone Lane is unable to be made. 3. Please provide the roadway cross section and a cul-de-sac detail. a. Private roadway standards will not apply as all streets are to be built to NCDOT standard and meet Fire Services’ access road requirements, as stated in Note 21 on the Preliminary Plan. 4. Based upon comments provided by the USACE on March 4th and April 15th (noted below), there appears to be permit non-compliance issues within the site. It is Staff’s understanding that the developer is working directly with the USACE to resolve these issues. In addition, it appears that there are issues with the existing Erosion and Sedimentation controls on-site and the land Parsons Mill Farm Phase 2 – Preliminary Plan – TRC Review Page | 2 disturbance and stormwater plans may need to be revised to address the modifications included in this submittal. a. Please note that the Preliminary Plan will be approved with a condition that the USACE’s and New Hanover County Engineering’s permit compliance issues are addressed and approved by these agencies prior to Construction Plan or Final Plat approvals. Fire Services, Raymond Griswold 910-798-7448 1. I have reviewed the changes for this proposed subdivision. It appears they are adding more homes and dropping some Town Homes. The issue I have is with eliminating the connectivity of Creek Stone Lane. This needs to continue through into the adjacent sub-division. We are only talking a few feet. Not only would this aide Fire, EMS and Law response, school bus connectivity would be enhanced. We are against not connecting this thorough fare. 2. Everything else meets County Fires Expectations. 3. No further comments except that Creekstone Lane be connected. NHC Engineering, Phil Bevilacqua 910-798-7072 1. A New Hanover County Stormwater Authorization-to-Construct is required. Stormwater control measures are required to maintain the pre-development runoff rate for the 2-, 10- and 25-yr storms. Analysis for the 100-yr storm is required to verify that no buildings are flooded. 2. On-site collection systems are required to be designed for the 25-yr storm and analyzed for the 100-yr storm. 3. Off-site drainage is required to be delineated and conveyed through the site in accordance with NHC standards (25-yr design & 100-yr analysis). 4. A drainage easement is required for off-site drainage conveyances and is to be sized according to NHC standards. 5. No additional comments. Cape Fear Public Utility Authority, Bernice Johnson 910-332-6620 1. CFPUA Plan Review Required. 2. CFPUA water and sewer available. 3. The is no update to the above CFPUA comments. NCDOT, Patrick Wurzel 910-398-9100 These preliminary comments and are based on the plans as submitted for the proposed site and are subject to further review upon receipt of any additional information. Subsequently, additional comments and/or requirements may be necessary for this site. 1. A TIA will be required due to the change of use a. A TIA will not be required, as noted in case files, “Parsons Mill Farm WMPO TIA Determination 3.18.2020” and “Parsons Mill Farm Final TIA Determination 3.18.2020” 2. Outstanding deficiencies will need to be corrected from the original permit 3. A NCDOT Driveway Permit is required. Submit a plan in accordance with pages 14 and 15 of the Policy on Street and Driveway Access to North Carolina Highways to include access locations Parsons Mill Farm Phase 2 – Preliminary Plan – TRC Review Page | 3 within 500’ of the proposed access on both sides of the State road. Submit to the local NCDOT District Engineer’s Office. 4. A NCDOT Encroachment Agreement is required for any utility connections or installation within NCDOT right-of-way. 5. NCDOT Division 3 District 3 is now paperless. When ready to submit email all documents to Div3Dist3@ncdot.gov USACE, Rachel Capito 910-251-4487 1. The Corps has concerns about the Parsons Mill Site. The most recent Corps permit was issued July 24, 2013 and expired March 18, 2017 with our new Nationwide Permits. Under our permit rules we would have allowed for the continuation of the development through the 5 year period which would have been July 24, 2018. The applicant has continued work in wetlands/waters through 2019 as well which the Corps considers to be a permit non-compliance issue. The Corps is also concerned that the original permit conditions that required a Conservation Declaration be recorded in the New Hanover County Register of Deeds was never recorded. The Corps will be contacting the applicant directly to resolve these issues, but no permits will be issued from our office until this issue is resolved and the Corps considers this to be a permit non-compliance matter. 2. The Corps has been contacted by the applicant's agent, but the issue has not been resolved. This is still a permit non-compliance issue/ unauthorized activity. Based on the amount of previously impacted areas it is unlikely that the applicant will be able to use a Nationwide Permit from the Corps for any lot fill associated with this development in Phase 3, as they would likely need to apply for an Individual Permit. The Corps has requested an updated delineation of all wetlands onsite as well as showing the previously impacted areas (mostly the roads have already bisected the wetlands and there is also concern that no culverts have been added to maintain those wetland/water connections) including impact totals, but has not received anything from the agent to date. New Hanover County Schools, Mark Clawson 910-254-4084 1. High School and Middle School bus stop will be located on College Road at Huntsman Court. 2. Elementary School bus stops will be located at the following intersections (with approval from the subdivision if the roads are private): a. Huntsman Court and Parsons Mill Drive b.
