Voluntarily participating state agencies may also provide comments. And general information and non-binding recommendations about the site may also be provided by government agencies. The TRC meetings are considered staff meetings and are not public hearings. The TRC meeting is an opportunity for applicants to speak with county staff and any voluntarily participating state or federal agencies about the review comments they have been provided. No voting is involved in the TRC process, and no final approvals or denials are made at the TRC meetings. Following the TRC meeting, applicants are responsible for updating their plans to address review comments. Those revised plans need to be resubmitted to the assigned case planner. The case planner will facilitate additional reviews until all comments have been addressed, and the necessary departments have stated the plans comply with the applicable minimum requirements for development. Following any future TRC approval, the project is required to obtain additional permits to include a zoning compliance permit for the site. Applicants are also responsible for coordinating with state and federal agencies for compliance with any additional requirements. Any activity on the property that is not approved as part of the TRC review and zoning compliance permit will be considered a violation of the UDO and subject to enforcement action under Article 12 Violations and Enforcement. The following comments have been received for the August 6, 2025, TRC meeting. Additional comments may be made upon further review of subsequent revisions. Sheetz – 3251 Hwy 421 – TRC Review Page | 2 Planning, Amy Doss 910-798-7571 1. General Comments a. I-2, Heavy Industrial, zoning district. b. As stated in the application the intended use is convenience store and fuel sales. The Unified Development Ordinance (UDO) defines the use as: i. Convenience Store: A small retail self-service store selling a limited line of fast- moving food and nonfood items, usually with extended hours of operation and usually with a high volume of customer traffic comprised of quick transactions of a small number of items. Includes fuel sales as an accessory use. ii. Fuel Sales: A facility engaged in the storage, distribution, and retail sales of vehicle fuels for personal vehicles, fleet vehicles, and/or trucks. c. The Planning and Land Use Department’s review of the site is for compliance with the UDO and use specific requirements of the specified land use. Any other activity that might occur on the property beyond the definition above should be noted on the application and site plan for additional review and comment. d. Plans note a Carolina Power & Light ROW on this property. Please confirm with Carolina Power & Light to get approval for this site plan before proceeding with any other permits. 2. UDO Section 5.1, Parking and Loading a. Use requires 2.5 parking spaces for every 1,000 square feet of building area. Project proposes 6,879 square feet. Required parking is 6,879 / 1,000 = 6.88 x 2.5 = 17 required parking spaces. Project proposes 54 spaces, 5 of which are EV parking. Please consider reducing parking or using impervious pavement for excessive parking. b. Please include a note with parking totals on site plan sheet C2.1. 3. UDO Section 5.2, Traffic, Access and Connectivity a. Please note that no building permit for any structure shall be issued which requires NCDOT approval for a Driveway Permit until NCDOT has issued the permit approval. Evidence of approval shall accompany the application for building permit. 4. UDO Section 5.3, Tree Retention a. Note: Land disturbance permits can be issued by county Engineering before a Tree Removal Permit is approved by Planning. However, any trees removed before the Tree Removal Permit is issued may result in enforcement action under Section 5.3.2 of the Sheetz – 3251 Hwy 421 – TRC Review Page | 3 Unified Development Ordinance to include prohibiting any development of the site for 3 to 5 years. b. Please provide a completed tree removal application. 5. UDO Section 5.4, Landscaping and Buffering a. Landscape page C6.3 contains a table with explicitly clear UDO requirements and calculations. This is appreciated for clarity! b. Landscape requirements for parking lot, street yards, and foundation appear to have been met. Transitional buffer not required. 6. UDO Section 5.5, Lighting a. Please note that a lighting plan is not required for TRC approval, but will be required prior to issuance of construction plan approvals. b. Is any lighting proposed for the site? 7. UDO Section 5.6, Signs a. For any signs on the site, please submit for a sign permit, referencing Section 5.6 of the UDO for standards. 8. UDO Section 5.7, Conservation Resources a. Per the New Hanover County Planning Map, there are no Conservation Resources on the site. 9. UDO Article 9, Flood Damage Prevention a. The property is not located in the floodplain. Please digitally submit the permit applications documentation with requisite review fees to the COAST online permit portal (https://newhanovercountync- energovpub.tylerhost.net/apps/selfservice#/home). Site plan reflect connection to public water. Environmental Health records indicate a well that was drilled in 1976. Locate old well head, protect during demolition and properly abandon with the assistance of a Certified Well Driller. Site had Soil and Groundwater Remediation through the NC DEQ in 1995. Proposed infrastructure does not violate setbacks to surrounding properties wells. 2. Any Food Service Facility within the Sheetz must submit plans to the NC Environmental Health Plan Review Unit and gain approval prior to building permit issuance. 3. Site plan reflects connection to public sewer. Environmental Health records reflect two structures on the parcel with septic systems. Locate and properly abandon the septic tanks prior to demolition of the site. Proper abandonment of a septic tank is pump the tank, crush and fill. This action does not require a permit. TO: New Hanover County Planning Department, New Hanover SWCD, July 16th, 2025 FROM: Dru Harrison, Soil & Water Director RE: 3251 US 421 I HAVE REVIEWED THIS PLAN AS REQUESTED AND HAVE THESE COMMENTS: The soils are predominantly Kureb sand (Kr). According to the booklet, “Wilmington/New Hanover Classiflcation of soils for Septic Tank Suitability”, Kureb is a Class I soil. The Soil Survey of New Hanover County lists Kureb as excessively well drained. Kureb is on the Hydric Soils “B” list which means there may be areas of wetland included in the mapping units. It should be noted, according to the Soil Survey of New Hanover County, the limitation for dwellings with or without basements and for small commercial buildings is severe for all of the soils on this site. The limitations are due to fiooding and/or wetness. An adequate drainage and maintenance plan is needed for suitable housing. The U.S. Army Corps of Engineers has federal jurisdiction over 404 Permits and the NCDEHNR, Dept. of Water Quality, has state jurisdiction over 401 Permits under the Clean Water Act. Before disturbing possible wetland areas, developers should contact these agencies to stay in compliance with State and Federal regulations. Site Plan Comments: Signal Agreement:  Due to the proposed traffic signal installation / modification for this project a Traffic Signal Agreement is required. o Contact Stonewall Mathis, Division 3 Deputy Traffic Engineer at 910- 341-2200 to execute a Traffic Signal Agreement.  The signal plans will need to be approved prior to the issuance of this encroachment agreement to make sure that the pavement markings match. If study requirements of the local government agency are more restrictive than the NCDOT requirements, then local government requirements will govern. All studies including, but not limited to, Traffic Impact Analyses (TIA), traffic signal studies, and drainage studies, must be prepared under the direct charge of and sealed by a North Carolina licensed Professional Engineer. Based on the information provided and conversations held to date, it is our understanding that the proposed development will be built in 2027 and will consist of:  ITE LUC 945 Convenience Store with Gas Station (16-24 VFP) – 6,879 SF The following improvements are required for this development: US 421 at I-40 Westbound Ramps (existing signalized intersection)  No improvements are required. US 421 at I-40 Eastbound Ramps (future signalized intersection by others)  No improvements are required. US 421 at Site Access 1 (proposed right-in, right-out intersection w/ left-over)  Construct Site Access 1 (eastbound approach) with one ingress lane and one egress lane, configured as a left-in, right-in, right-out (LIRIRO) intersection.  Provide an internal protected stem length of 100 feet, as measured from the right-of-way line.  Provide stop control for the eastbound approach.  Construct a southbound right turn lane on US 421 with 100 feet of storage and appropriate full-width deceleration and taper lengths. If changes are made to the proposed site driveways and/or land uses, the current trip distribution may need to be modified and would require a revised Traffic Impact Analysis to be submitted for review by the NCDOT, WMPO, and New Hanover County, in which instance this approval would become null and void.
