Summary:
By statute, the Board may adopt a schedule of regular business meetings. The schedule
implemented by the previous Board called for regular business meetings on the Tuesday following the
second Monday of each month at 5:30 PM. Also included on the proposed regular meeting calendar are
special meetings. Board members are required to attend special meetings, in accordance with Chapter
163 of the NC General Statutes, in order to review absentee ballot applications, count approved
absentee ballots, and conduct the county canvass.

1. MEETING OPENING
a. Call to Order
Chair Miller called the emergency meeting to order at 5:30 p.m. The New Hanover
County Board of Elections meeting was held in the Board of Elections office, 226
Government Center Drive, Wilmington, NC. Chair Miller, Secretary Morgan, and
Member Kemp were present in person; Member Hinton-Stalling was present virtually;
Member Morris was excused.
b. Pledge of Allegiance
Chair Miller invited all in attendance to rise and recite the Pledge of Allegiance.

c. Agenda
Chair Miller requested to change the agenda order to take up General Discussion before
the Closed Session. Member Kemp moved to approve the agenda as amended, seconded
by Secretary Morgan. Motion carried unanimously.
2. PUBLIC COMMENT PERIOD
Chair Miller called upon the public attendees for their comments or questions, limited to
two minutes each with a total maximum of twenty minutes.
Seeing and hearing no public attendees wishing to speak, Chair Miller closed the public
comment period.
3. NEW BUSINESS
a. Impacts of FY25-26 Approved Budget
Chair Miller asked the Director to review the potential impacts of the County FY 25-26
budget as adopted, followed by questions from the Board. He asked Mr. Payne to step in
if the Board strayed into an area better addressed in closed session.
Chair Miller asked the Director whether, given the budget as adopted, she was confident
that the Board and staff can conduct the upcoming municipal and primary elections
accurately, securely, and in compliance with all deadlines and legal requirements.
Director Hunter-Havens responded no, she was not confident. Chair Miller called on the
Director to explain her concerns.
Director Hunter-Havens gave an overview of the potential impacts of the mandated
$216,149 reductions in the continuation (base) budget and staffing reductions, based on
the current information available. Our office cannot achieve that level of reduction by
reducing supplies or contracted services due to the statutory and administrative
requirements related to the administration of an election. In reviewing areas where our
expenses can be reduced, one of the largest expenses that could be adjusted are election
official compensation, specifically those who serve during early voting. The board is
statutorily required to open polling places on Election Day and provide early voting at the
board’s office during regular business hours during the early voting period and on the last
Saturday from 8:00 am to 3:00 pm. The opening of additional early voting sites is not
statutorily required. However, limited early voting opportunities may negatively affect
voter access. In addition, the reduction of full-time staff members from 8 to 6 will
significantly reduce capacity to perform the required and critical functions that are key to
conducting a fair and honest election.
Questions from Board members to the Director followed, who reemphasized her concerns
that the FY25-26 budget is inadequate to carry out the legal requirements for elections in
a timely and/or accurate manner to serve New Hanover County voters as the Board has
previously. In response to a question from Chair Miller, the Director made clear that the

FY25-26 budget as it stands would be inadequate to conduct the 2026 General Election in
the next fiscal year. The Board members explored the impacts of the budget reductions
on election operations in more detail with the Director. The Board authorized the
Director to proceed with her recommendations to county staff on how allocate the
reductions to the FY25-26 budget.
5. GENERAL DISCUSSION
Chair Miller called on the Board members for their items for general discussion.
Member Kemp thanked the Director for providing the conference information to the
county parties to allow plenty of notice of the training opportunities to the incoming
Board members.
Hearing no additional Board comment, Chair Miller closed the General Discussion.
4. CLOSED SESSION
Chair Miller moved that the Board enter closed session, under N.C. Gen. Stat. §§ 143-
318.11(a)(3) and (a)(6) to discuss personnel matters and receive legal guidance,
pursuant to N.C. Gen. Stat. § 143-318.11(a)(3) and (a)(6), seconded by Member Kemp.
Hearing no discussion, Chair Miller called the vote. The motion carried unanimously.
The Board moved into closed session at 6:14 p.m. and returned to open session at 6:36
p.m.
6.ADJOURNMENT
Member Kemp moved to adjourn the meeting, seconded by Secretary Morgan. Motion
carried unanimously. The meeting adjourned at 6:37 p.m.
The next Board meeting is scheduled to be held on July 22, 2025, at 5:30 p.m., at the
Board of Elections office, 226 Government Center Drive, Wilmington, NC.

2025 Municipal Elections Early Voting Plan

N.C. Gen. Stat §§ 163-166.35 and 163-166.40
Summary:
The New Hanover County Board of Elections must determine hours and sites for the 2025 Municipal
Elections Early Voting period. The tentative deadline to submit early voting plans to the NC State Board
of Elections for the November municipal election is August 8, 2025. The early voting period for each
election begins on the third Thursday before the election and ends on the Saturday before the election.
For the 2025 Municipal Elections, the early voting period begins on Thursday, October 16 and ends on
Saturday, November 1. At minimum, early voting must be available within the county board of
elections office, or at an in lieu of site, from 8:00 am to 5:00 pm on weekdays and 8:00 am to 3:00
pm on last Saturday.
The board may choose to use the larger multipurpose room adjacent to the administrative office for
the office site or the David E. Paynter Room at the Northeast Library as an in-lieu of office site. The
requirements for an in lieu site are 1) in the same city or town as the county board of elections
office, and 2) either within 4 miles driving distance of the county board office or within 10 minutes
driving time, using Google Maps or similar online calculator. As part of this decision, the board may
wish to discuss the space needs for conducting absentee meetings so the board can determine
whether our conference room provides enough space to meet the operational needs for conducting
the review of absentee applications and completing the preparatory steps for counting the
absentee ballots on Election Day.
Any other operating schedule for the office site, or the inclusion of additional early voting sites,
requires the unanimous approval of an early voting implementation plan by the county board. In
odd-numbered elections, the additional sites are not required to be open the same hours and days as
the office site. However, there is a requirement that all additional sites be open for the same days and
hours.
If the county board is unable to reach unanimity regarding an early voting plan, a member or members
of the board may petition the NC State Board of Elections to adopt a plan for it. If petitioned, the State
Board may also receive and consider an alternative petition from another member or members of the
county board. The State Board is not limited to adopting a specific plan submitted by a county board
member and can adopt a different plan altogether if they deem it more appropriate for the county.
In recent municipal elections, the board has unanimously voted to offer extended voting hours during
the second weekend to provide greater opportunities for eligible voters to cast their ballots. For the
2025 Municipal Elections, the Town of Carolina Beach has requested that the board include an early

voting site in Carolina Beach, which could include limiting days or hours of operations as allowed to
reduce expenses but still provide greater early voting opportunities for their residents.

I move that the Board enter into closed session, under N.C. Gen. Stat. §§ 143-318.11(a)(3) and
(a)(6) to discuss personnel matters and receive legal guidance.
Applicable Statutes and/or Rules:
N.C. Gen. Stat. § 143-318.11(a)(3) and (a)(6)
Summary:
Closed session is required to discuss personnel matters and receive any legal advice from counsel,
either from the county attorney’s office or from newly selected outside counsel under §§ 143-
318.11(a)(3) and (a)(6).
