All members were present. Chair Miller reminded the audience, Board and staff to silence their cell phones; that the meeting is being recorded and live streamed over the internet; and that, with sensitive microphones, it is essential that the audience avoid conversation and crosstalk during Board discussion. b.Pledge of Allegiance Chair Miller invited all in attendance to rise and recite the Pledge of Allegiance. Board Minutes – 05/13/2025 Page | 2 c.Approval of Agenda Member Kemp moved to approve the agenda as submitted, seconded by Member Hinton- Stalling. Motion carried unanimously. d.Approval of Minutes Chair Miller called on the Board members for any corrections or additions to the minutes of the 4/15/2025 meeting. Chair Miller noted one correction on page 3 where the word “for” was omitted. Hearing no additional edits, changes or corrections, Chair Miller said the minutes are approved by unanimous consent. 2._PUBLIC COMMENT PERIOD Chair Miller called upon the public attendees for their comments or questions, limited to two minutes each with a total maximum time of twenty minutes. Clarice Reber of the League of Women Voters Lower Cape Fear expressed her thanks and appreciation to the Board, Director Hunter-Havens and Elections staff for their hard work and diligence during the 2024 General Election. Seeing and hearing no public attendees wishing to comment, Chair Miller closed the Public Comment period. 3.DIRECTOR’S UPDATE Chair Miller called on Director Hunter-Havens for her reports a.Financial Update Director Hunter-Havens reported that through April 2025 about 95.5% of the operating expense budget and 87.2% of salaries are expended. She anticipated routine monthly expenses and annual software renewals through June 30. Salary underspending is due to two staff vacancies since late November. She expects these positions to be filled before the end of the current fiscal year. There were no questions from the Board. b.List Maintenance Director Hunter-Havens reported that list maintenance in April resulted in removal of 672 voter registrations and processed 742 new registrations, 571 registrations without changes, and 900 voter registration updates. The agenda packet includes additional information about the sources of registration, snapshots of administrative processes, and a breakdown of county voter registrations. Board Minutes – 05/13/2025 Page | 3 c.Election Day Chief Judge and Judge Appointments Director Hunter-Havens reviewed the process for appointment of Election Day chief judges and judges. Deputy Director Caroline Schulte and Elections Program and Outreach Coordinator Jessica O’Neill worked over the past 2 months to prepare a list of recommended appointments that will be emailed to the local party chairs after this meeting. Along with the administrative recommendations, the list will include some information about the prior experience of the recommended officials. The party chairs will submit their recommendations and the Board will make the appointments at the August 19 meeting. Deputy Director Schulte noted that the list includes recommendations for 40 of the 41 polling places. The vacant precinct is one where staff are regularly challenged with recruiting officials. For the 2025 municipal elections, we expect to open 27 or 28 precincts on Election Day. That may change should the Board take action to transfer voters from a precinct with expected low turnout to an adjacent precinct. Officials in precincts not scheduled to be open for the municipal election will be invited to staff the open precincts to build skills and experience. The Board members discussed the FY25-26 budget enhancement request for Integra software for improved election official management which is included in the County Manager’s preliminary budget. 4.GENERAL DISCUSSION Chair Miller asked about the meeting schedule in July. The new Board for 2025-26 is scheduled to take their seats in a special meeting on July 22. Director Hunter-Havens noted there is also a regular meeting scheduled on July 15. The Board deferred the decision whether to cancel the July regular meeting to their June meeting. Board Legal Counsel Payne reviewed the effects of several recent court decisions on elections. Griffin v. NC State Board of Elections and Griffin v. Riggs: The US District Court for Eastern North Carolina ordered the State Board of Elections to certify the election in favor of Judge Riggs, scheduled to happen today. Mr. Payne is monitoring the unresolved federal issues remaining before the federal courts. Stein v. Berger: This case is the governor’s NC Constitution challenge to changing who appoints the chair of the State Board of Elections which determines which party holds the majority of seats. The NC Supreme Court allowed the legislative changes to take effect and the new State Board was appointed last week. Governor Stein has appealed the Court of Appeals decision to the NC Supreme Court. The Board members discussed the effects on UOCAVA voters and the group labelled “never residents” in the Griffin challenge which remain before the federal courts because their voting rights are governed by federal statute as well as NC statutes and Constitution. Board Minutes – 05/13/2025 Page | 4 The Board members discussed the status of the county board of elections FY25-26 requested budget and enhancements and reviewed the schedule for adoption of the budget by the County Commissioners. 7. CLOSED SESSION Chair Miller said there is no business requiring a closed session. 6.ADJOURNMENT Member Morris moved to adjourn the meeting, seconded by Member Hinton-Stalling. Motion carried unanimously.
