Public Comment 1] My thoughts on the proposed 291 dwelling development
using a Special Use Permit is:
TOO MUCH … TOO MUCH
The developer’s Special Use Permit proposal is to change the
density from R15 (2.5 units / acre) to R??? (6.75 units / acre).
This leads to 291dwellings adjacent to Tarin Woods 2. There
are approximately 350 dwellings combined for TW 1 and 2 (all
at R15). All proposed dwellings are multi-family homes.
The 291 additional dwellings will put more of a burden on the

school system and local traffic such as Carolina Beach Road.
Note that Motts Landing – across Carolina Beach Road from
the proposed location - is adding 67 SFHs which is in harmony
with the rest of that development. No multi family homes.
2] The same developer proposed 338 homes in this area in
2023 but his proposal was voted down 7-0 at the 3/2/23
Planning Board Meeting and then voted down 4-1 at the
Commissioner’s meeting on 5/1/23. This 2023 plan had 328
townhomes and 10 SFHs.
The same developer proposed a new plan of 444 dwellings
which was voted down in June of 2025. Even though this new
proposal has less than 444 dwellings I still believe it’s too many
homes. I am concerned about:
1] the increased traffic in the general area including Carolina
Beach Road
2] the overcrowding in the schools
Maybe a solution is building only SFHs instead ?? Keep R15
zoning.
3] SPECIAL USE PERMIT
A Special Use Permit (SUP) is acceptable if it meets the
following criteria.
1] Will not materially endanger the public health or safety if
approved.
2] Meets all required conditions and specifications of the Land
Use Ordinance.
3] Will not substantially injure the value of adjoining or abutting
property or the use as a public necessity.
4] The location and character of the use is in harmony with the
area it is to be located and in general conformity with the
Comprehensive Land Use Plan for New Hanover County.
I believe this proposed development does not meet criteria #4
because there are NO single family homes proposed. Tarin
Woods 1 and Tarin Woods 2 is all single family homes.
4] Additional comments on SUP S25-04 for the updated TIA .
A] The updated TIA from 8/27/25 lists the number of additional
cars expected for the proposed plan. They list, for instance,
peak AM cars will change from 81 in the original 108 dwelling
plan to 146 in this 291 dwelling plan. Just using extrapolation
this 146 should be 218 cars. This is a significant difference
since congestion is already an issue.
B] The new TIA also lists Bellamy Elementary school as
overcrowded at 104% of capacity. Ashley HS is close behind at
99.7% of capacity. So why is it ok to put a high density
community at this site ??
C] The new TIA also lists the congestion of existing roadways
as “above capacity”. So why is it ok to put a high density

community at this site ??
D] The new TIA lists 2 access points. One at a yet to be built
road north of Rosa Parks Lane. The second is shown at
Carolina Beach Road and Manassas Drive. But how does
traffic for this access get to the proposed site? The only
available road is Sweet Gum Drive which winds through most
of Tarin Woods 2.
This second access point needs to be defined more clearly and
it should not go through existing neighborhoods.
E] Did this TIA include projected traffic from Motts Landing and
the new Target ??

Public Comment I respectfully submit this comment in opposition to the Special
Use Permit Request (S25-04 – Tarin Woods Additional
Dwelling Allowance) by James Yopp with Hoosier Daddy, LLC.
The request seeks approval for an additional density allowance
of up to 6.54 dwelling units per acre in an R-15 Residential
District on approximately 43.10 acres located at 5669, 5671,
5713, 5831 Carolina Beach Road and 1046, 1051, 1052, 1055
Rosa Parks Lane.
Studies have shown that variable density housing can provide

benefits when integrated thoughtfully into a community. For
example, density can support affordability, walkability, and
more efficient land use (see Nelson, A.C., “The Case for
Multifamily Housing,” Journal of the American Planning
Association, 2019; and U.S. EPA, Smart Growth and Economic
Success: Benefits for Real Estate Developers, Investors,
Businesses, and Local Governments, 2014). However, these
benefits are only achieved when higher density is matched with
adequate infrastructure, particularly transportation, parking,
utilities, and community resources.
I am an engineer (EIT), but despite that, it does not take an
engineer to observe that Tarin Woods is already a high-density
neighborhood with significant infrastructure shortcomings. The
existing traffic circulation patterns are illogical, with limited
points of access to major roadways, creating both
inconvenience and safety risks. The neighborhood already
lacks adequate guest parking, which forces visitors to park
along streets in ways that restrict visibility and emergency
access, or must park far away from their homes. Adding more
dwelling units would further strain this already inadequate
system.
Furthermore, public resources and services in the area, such
as schools, emergency services, and roadway capacity, are
already under stress. Without comprehensive infrastructure
planning and investment in Wilmington, allowing additional
density will only intensify existing problems rather than
providing any community benefit.
For these reasons, I strongly oppose approval of this Special
Use Permit.

I would like to add that James Yopp and Hoosier Daddy LLC
are not the property owners as their application states.
The public schools that serve the project area are misstated.

All the wetland soils have been removed, with new soil placed
on the site over the drainage ditches that the developer
installed. There have been observed two pumps continuing to
drain the project site, both located near the perimeter with
Sentry Oaks subdivision.
Please require a development master plan for this property and
the remaining developable land in the Tarin/ Ironwood
complex. Please do not allow piecemeal development.
Please require developer to pay for the maintenance of the
pervious pavement to keep it in good working order.

Public Comment If this project is approved it will adversely affect the existing
neighborhood directly adjacent to it. It will reduce property
values in the area and most likely cause more problems from
people who don't own or have a stake in the existing
neighborhood. Higher density housing brings in transient
residents, people who don't intend to stay long term and don't
generally care about the community around them.
Please listen to the people who live there and not a developer

Public Comment Good evening, members of the board. I want to voice my
strong opposition to the proposed construction of additional
single-family units and apartments. Our city is already
experiencing significant challenges with overpopulation, and
traffic congestion has become a daily struggle for residents.
Adding more housing in this area will only worsen these issues,

making our neighborhoods overly congested and raising
serious safety concerns.
We must also consider the strain this will place on our schools,
which are already overcrowded, as well as on our
infrastructure, which is stretched thin. At some point, there has
to be a line drawn against unchecked development. I believe
this proposal represents that line.
For these reasons, I urge the board not to approve this
development. Thank you.”

Public Comment Public Comment – Special Use Permit Application #S25-04
My name is Samantha Bunge, and I live in Tarin Woods. I
submit this comment on behalf of myself and my neighbors in
Tarin Woods, Battle Park, Covington, Congleton Farms, Sentry
Oaks, Rosa Parks, and surrounding communities.
While the latest plan reduces density compared to previous
proposals, serious concerns remain about its compatibility with
our neighborhoods and the long-term impacts on safety, traffic,

and community character.
Density & Neighborhood Harmony: 291 homes on this site is
still higher than appropriate for the surrounding single-family
neighborhoods. The Special Use Permit process should be
reserved for developments truly in harmony with existing areas,
which this plan is not.
Traffic & Safety: The proposal funnels nearly all traffic through
residential streets and relies on an outdated traffic study that
does not reflect current conditions. With only one connection to
Carolina Beach Road, congestion and emergency access
could become significant issues.
Covenants & Governance: If portions of this site are legally part
of Tarin Woods, HOA covenants prohibit development of this
type without a majority homeowner vote. It is unclear how the
developer intends to reconcile these legal restrictions.
For Sale vs. Rentals: The application states the units will be for
sale. Clarification is needed to ensure rentals are not
introduced, which could impact neighborhood stability and
character.
Lack of Master Plan: The project is presented piecemeal with
no comprehensive plan for remaining acreage. Without a full
master plan, cumulative impacts on traffic, drainage, schools,
and neighborhood integrity cannot be fully assessed.
I urge the Planning Board to carefully consider these points
and ensure any approval protects the safety, character, and
quality of life for the residents of Tarin Woods and neighboring
communities.

My name is Samantha Bunge, and I am submitting this
comment on behalf of concerned residents of Tarin Woods I
and II, Battle Park, Sentry Oaks, Covington, Congleton Farms,
and the broader New Hanover County community.
It has come to our attention that Jack J. Carlisle, the person
who signed the Owner/Agent Authorization form for this
application, passed away on August 24, 2025 (confirmed via

the NHC Register of Deeds Vital Records on September 11,
2025).
Under North Carolina law, an agent’s authority ends
immediately when the principal dies (N.C. Gen. Stat. § 32C-1-
110(a)(1); Restatement (Third) of Agency § 3.07(2)). This
means the authorization on file is no longer valid, and the
application as submitted is incomplete.
Despite this, the application appears to have continued moving
forward without informing Planning staff, the Planning Board, or
the Board of Commissioners. This raises serious concerns
about transparency and following proper procedures.
The New Hanover County Unified Development Ordinance §
10.2.4 clearly states that incomplete applications must be
corrected and resubmitted as a new, complete application.
Because the authorization is invalid, this application should be
withdrawn and refiled with proper authorization from the
property owner(s) or LLC manager(s). Any application on file
with this agency form in use should not be processed further
until this is done.
We respectfully request that Planning staff enforce these rules
to maintain fairness, transparency, and compliance with the
County’s procedures, and that the Board of Commissioners
take appropriate action to ensure the application is not
approved or heard at a quasi-judicial hearing unless it is fully
compliant with UDO §10.2.4.

Public Comment James Yopp with Hoosier Daddy LLC should not get their
application approved. They have already uprooted harmony in
Battle Park by creating more traffic than the community can
handle. This traffic has is creating noise, pollution, and most of
all a huge safety hazard. There are no sidewalks on Manassas
and none where Manassas meets Appomattox. A lot of
students walk in this area to reach school bus stops. The
additional dwelling allowance will only add more traffic through
our neighborhood, coming through tarin woods and into battle

park along Appomattox drive and Manassas drive. Manassas is
already coming apart again after being repaved only a couple
of years ago. Also we’re still waiting for
Mr. Yopp to have the trees and barriers that were in our
medium replaced since he got ahead of himself and had them
removed in order to replant and replace. Then when his
application was denied he simply walked away and abandoned
the project. I feel that this behavior should not be acceptable.
Please deny this application and stop adding more traffic
through battle park.

Public Comment Dear Members of the Board of Commissioners,
I am writing to express my strong opposition to the Special Use
Permit Request S25-04 submitted by Hoosier Daddy, LLC for
an Additional Dwelling Allowance at Tarin Woods. This
proposal seeks to increase residential density to 6.54 dwelling
units per acre in an R-15 district, which is significantly above
the current zoning allowance and incompatible with the
surrounding neighborhoods.
My concerns include:

1. Traffic Congestion and Safety Risks
The proposed development would generate substantial
additional traffic—estimated at over 250 peak hour trips daily—
on Carolina Beach Road and surrounding streets. These roads
are already overburdened, with daily traffic counts exceeding
30,000 vehicles. Increased congestion without infrastructure
improvements poses serious safety risks for drivers,
pedestrians, and cyclists.
2. Flooding and Stormwater Management
Residents in nearby communities have already experienced
worsening flooding during storms. Adding hundreds of new
units will exacerbate runoff and strain existing stormwater
systems. The developer’s traffic and environmental impact
studies are outdated and do not reflect current conditions or
seasonal variations.
3. Loss of Neighborhood Character and Property Value
The R-15 zoning was established to preserve low-density,
single-family residential communities. Approving this permit
undermines the intent of the zoning ordinance and threatens
the peaceful character and property values of adjacent
neighborhoods like Battle Park, Covington, and Congleton
Farms.
4. Precedent and Planning Integrity
Granting this permit would set a dangerous precedent for
circumventing zoning protections through special use permits.
This project has already been rejected multiple times due to
public opposition. The repeated attempts to push through
higher density via SUPs erode public trust in the planning
process.
I urge the Board to deny this request and uphold the integrity of
our zoning laws. Please prioritize the long-term health, safety,
and quality of life of our community over short-term
development interests.

Public Comment I live in Tarin Woods, which is the impact zone on the project
area map. We travel Manassas Road daily as does five other
subdivisions (Battle Park, Tarin Woods, Congleton, Covington,
and those east of Congleton that use it as a quicker access to
Carolina Beach Road than going further north to Piner Road.
While listed out of convenience as Tarin Woods Additional
Dwelling Allowance, it is another phase of the Ironwood
Development adjacent to Tarin Woods.

Flooding - The entire Tarin Woods development is subject to
flooding, as is this proposed area. Hoosier Daddy is trying to fill
in this area with dirt being trucked from Fawn Valley and is now
being trucked back to this development. Even with all this effort
to hide water issues, there was standing water on top of the
recently dumped soil on the eastern portion of the development
near its boundary with Sentry Oaks. Some of the homeowners
in Tarin to install french drains to be able to walk in their yards.
This flooding is an ongoing issue, which has been previously
documented and provided to the Planning Board in previous
attempts by Hoosier Daddy LLC to continue to develop this
area. Hoosier Daddy is irresponsible, and they do not care
about the flooding in my, or adjacent communities. They should
NOT be allowed to conceal water issues.
Traffic - the plan for this area shows ingress and egress
through Tarin Woods streets to Manassas as well as the
currently undeveloped Shiloh Road. It also shows a new, not
yet approved road north of Rosa Parks onto Carolina Beach
Road. There is already TOO MUCH DEVELOPMENT on
Carolina Beach Road. Trips that used to take 15 minutes now
take 30. All the traffic gets backed up. The Traffic Impact
Analysis is totally outdated. There needs to be a new one done
to reflect 2025! No development should continue until the
proposed access road north of Rosa Parks is approved by NC
DOT and NH County. The roads here in Tarin Woods have
been trashed by the all the trucks hauling dirt to and from the
proposed area for over a year. Now our roads need repair, and
it should be Hoosier Daddy LLC to make these repairs, not our
HOA. Our area is already straining under increasing traffic.
According to NCDOT data, congestion is steadily worsening,
and the addition of hundreds of new residences would further
burden our already inadequate highway system and evacuation
routes. If we have a major storm, it will take hours to evacuate
now, nevermind all the additional housing that is being built
around this corridor.
This proposal is being rushed through the planning process so
it is one of the last residential special use permits. They have
been changing the development parameters since 2018, every
one seeking higher density. The area here is for single-family
homes, not high density projects. The roads & schools are
already over capacity. The environmental impact has not been
calculated -with all the development along Carolina Beach
road, the environmental impact needs to be updated.. The
county should DENY this proposal as it is poorly planned, does
not take into account traffic, ingress/egress, flooding, impact on

schools and safety of residents. Furthermore it does not fit into
the surrounding communities of single family homes. If he
wants to build single family homes, as he already has the
zoning to do, then that is fine. It is the high density projects that
have GOT TO BE DENIED.

Public Comment I respectfully urge you to deny the Tarin Woods Additional
Dwelling Allowance. It violates existing zoning, ignores
infrastructure limits, and puts residents at greater safety and
flooding risk. It also erodes the character and livability of the
neighborhoods that so many families have invested in and call
home. Adding hundreds of high density units will push daily
and peak-hour volumes toward (or beyond) the corridor’s
planning threshold and push more cut-through traffic into family
streets that were never designed for it (and are privately

maintained like Lt. Congleton). The County already treats this
area as capacity-constrained. The site area contains
Pamlico (Pm) “Class IV” soils, documented in a 2025 soil
review for the Congleton Tract. Class IV Pamlico muck is
recognized as very poorly drained and wetland-associated. It is
exactly the kind of substrate that amplifies runoff, standing
water, and failures when paved over. This is the sixth
attempt since 2018 to force dense development onto this
property despite consistent rejection and community
opposition. Filing just before new County rules took effect
undermines public trust in the zoning process and evades the
more transparent legislative review residents were promised.
It's time to end this fiasco. He can develop single family homes
within the current zoning allowance. Full stop.

Public Comment I am writing in STRONG opposition AGAIN to the proposed
addition of 290 high-density units (apartments and townhomes)
in the middle of our single-family neighborhoods. This project is
reckless, irresponsible, and poses serious, immediate risks to
current residents. Here’s why:
Safety and Overpopulation: This project would overwhelm our
already limited infrastructure. Emergency vehicle access, daily
traffic congestion, and evacuation during hurricanes will be

dangerously compromised. This is not an exaggeration.
OUTDATED TRAFFIC STUDY: The traffic study being used to
justify this proposal is from 2021—during COVID, before Tarin
Woods 2 was completed, and before the full impact of current
traffic volumes was felt. This data is irrelevant and misleading.
Our current roads (that are already falling apart) cannot safely
handle today’s traffic, let alone hundreds of additional units.
DEVELOPERS PROVEN NEGLIGENCE: The developer has
already failed our community once, and that failure is still
visible in Tarin Woods 2. Promised amenities like the pool and
clubhouse were never delivered. The area has been neglected,
left filthy, and basic upkeep IS NOT BEING PERFORMED. He
has proven, time and again, that he DOES NOT follow through
with existing approved plans. To even consider another
development when he hasn’t completed his current obligations
is reckless.
No Safe Second Entrance: SAME WITH THE AMENITIES--
While the current plan shows a road leading out to Carolina
Beach Road, this is nothing new. The developer has shown a
second entrance before that was never approved or built, and
based on his track record, there is every reason to believe this
will not be part of the final project either. Residents should not
be misled by drawings on paper when history has proven
otherwise. The absence of a guaranteed, safe secondary
entrance poses a massive safety risk, especially during
emergencies.
Increased Flooding: Adding impervious surfaces from this
project will only make these conditions worse. This particular
area floods on to existing Sweet Gum Drive after ONE HOUR
of rain. Residents’ safety and property are already at risk, and
this proposal would intensify the danger.
Loss of Home Value & Community Character: Adding 290 high-
density units—including multi-story apartments—does not fit
the harmony or character of Tarin Woods, Battle Park,
Covington, Congleton Farms, Sentry Oaks, Rosa Parks, or any
surrounding communities. It will drive down property values
and strip away the single-family neighborhood character we
invested in.
Developer Cannot Be Held Accountable: At the end of the day,
even if this plan looks acceptable on paper, we all know the
reality: this developer does not follow his plans. He didn’t
deliver on Tarin Woods 2, he hasn’t maintained what already

exists, and he certainly won’t deliver on a safe second entrance
or any promises here.
This project prioritizes unchecked growth over resident safety,
honesty, and livability. Until this developer proves he can
complete what he has already promised, NO NEW PROJECTS
SHOULD BE CONSIDERED. I strongly urge you to reject this
proposal.

Public Comment I oppose the latest proposal to build 290 high density dwellings-
-apartments and townhomes--in our Tarin Woods community.
The developer has never honored their original commitments to
our community, but insists on trying, again, to get maximum
profit out of the remaining land, while the concerns of the
residents in our community are ignored. We are very

concerned about the increased traffic, the safety of our children
who actively play, walk to and from school bus stops. I'm also
concerned that traffic studies are out of date and do not
accurately reflect the expected volume. The aesthetic of a
single family community is also going to be changed
immediately by introducing apartments right next to our homes.
My wife and I have had serious talks about moving out of a
community we love if this proposal goes through. We don't
want to live in a community next to a lot of apartments, where
traffic is high, the roads already falling apart, and our property
value diminishes. I don't understand why this keeps coming up.
Why can't the builder finish the project with single family homes
and move on? Why does this need to be high density?
Please deny this motion. Thanks for your attention and for what
you do.

Farms, Sentry Oaks, and Rosa Parks. As a resident of this
community, I urge you to carefully consider the following issues
before approving this project:
Outdated Traffic Study: The traffic study provided by the
developer fails to account for current congestion levels in our
area. The existing road infrastructure is already strained, and
adding 290 units will exacerbate traffic issues, creating unsafe
and inefficient conditions for residents.
Increased Flooding and Drainage Risks: The proposed site is
located on land already prone to drainage and flooding
problems. Developing 290 high-density units risks worsening
these issues, potentially causing property damage and safety
hazards for surrounding neighborhoods.
Unmet Developer Obligations: Hoosier Daddy has not fulfilled
its current obligations to the Tarin Woods community. Allowing
further development without addressing these outstanding
commitments undermines trust and accountability.
Overcrowded Schools and Stretched Resources: Our local
schools and public services are already at capacity. The
addition of hundreds of new residents will place unsustainable
pressure on educational facilities, emergency services, and
other critical resources, compromising safety and quality of life.
Incompatibility with Neighborhood Character: The proposed
high-density development does not align with the character or
harmony of our single-family neighborhoods, including Tarin
Woods, Battle Parkmeets and exceeds your expectations. The
scale and density of this project clash with the established low-
density, single-family aesthetic of our communities, threatening
their sense of place and community cohesion.

We respectfully request that the Board of Commissioners deny
Hoosier Daddy’s proposal until these concerns are adequately
addressed through updated studies, fulfilled obligations, and a
plan that preserves the integrity of our neighborhoods. We

Public Comment As a resident of Tarin Woods, I am writing to ask that the
Special Use Permit request from Hoosier Daddy (developer
James Yopp) be denied. Not only is the developer trying to
circumvent the normal rezoning process where his plans were
repeatedly rejected by the commission due to density
concerns. As the Special Use Permit process itself is currently
under review and may be eliminated, it would be irresponsible
to approve this request as the method under which it’s being
presented is under review. This developer has arrogantly

the affected residents and neighbors but of the commission
that had reviewed his previous plans (which again included

harmony in the neighborhood with a high density project being
put in our neighborhood where it does not belong. The
committee has denied this many times and we beg you to

continue to deny this. This neighborhood needs to be single-
family homes as it was planned out in the beginning. Having
high traffic coming down through the streets is not something
feasible for us to live with. It is already hard as it is with the
amount of mistakes and shortcomings the developer has
made.

Dear NHC Planning Staff,
I am writing regarding Special Use Permit Application #S25-04 for the properties located at 5669,
5671, 5713, 5831 Carolina Beach Road and 1051, 1055, 1052, 1046 Rosa Parks Lane. It has come to
our attention that Jack J. Carlisle, the individual who executed the Owner/Agent Authorization forms
on file for this application, passed away on August 24, 2025. This was confirmed in person by the
NHC Register of Deeds Vital Records on September 11, 2025.
Mr. Carlisle signed the Owner/Agent Authorization form simply as “Jack Carlisle” on the owner line,
without clarification that he was executing it on behalf of Hoosier Daddy, LLC. Because of this his
authorization must be treated as personal. Under North Carolina law, an agent’s authority terminates
immediately upon the death of the principal (N.C. Gen. Stat. § 32C-1-110(a)(1); Restatement (Third)
of Agency § 3.07(2)). Therefore, his death renders the authorization void. The form does not reflect
execution by the surviving members or managers of the LLC, and until such proper authorization is
provided, the application remains incomplete and defective.
Despite this, the application appears to have continued moving forward, presumably without
disclosure of the principal’s death to Planning staff, the Planning Board, or the Board of
Commissioners. The applicant and his counsel failed to make mention of this important material fact
at the September 4 preliminary hearing, despite the legitimacy of the signatures and authorizations
being questioned in a public forum. This raises serious concerns about procedural compliance and
transparency.

New Hanover County’s Unified Development Ordinance § 10.2.4 requires that if an application is
found to be incomplete, any corrections or amendments must be resubmitted as a new, complete
application. Because the authorization on file is now invalid, this situation constitutes a substantive
amendment, and the application should therefore be withdrawn and resubmitted with a valid
Authorization of Agency from the appropriate property owner or LLC manager. The application
cannot proceed until a fully compliant, new submission is filed.
Please consider this correspondence part of the official record and as formal notice of the procedural
deficiency in this application. We request that Planning staff enforce the UDO requirements and
ensure that this application is not advanced and that a valid authorization is properly submitted
through a new, complete application. For transparency, please note that both the applicant and their
legal counsel have been provided with written notice of this matter.
Thank you for your attention to this matter. We appreciate your diligence in maintaining compliance
and procedural integrity in the County’s quasi-judicial process.
