Subject: Commercial Site Plan TRC Approval – Sheetz – 803 S Seabreeze Rd
The subject Commercial Site Plan has been approved by the Technical Review Committee (TRC). The
site is approved for the following use defined by the Unified Development Ordinance (UDO):
• Convenience Store: A small retail self-service store selling a limited line of fast-moving food
and nonfood items, usually with extended hours of operation and usually with a high volume
of customer traffic comprised of quick transactions with a small number of items. Includes
fuel sales as an accessory use.
And the following incidental and ancillary activities associated with the above defined use.
• Fuel Sales: A facility engaged in the storage, distribution, and retail sales of vehicle fuels for
personal vehicles, fleet vehicles, and/or trucks.
• Restaurant: Establishments where food and beverages are prepared and sold on a retail basis
for consumption on or off premises as its principal business.
The approved plan consists of one 6,139 sq ft convenience store and restaurant and 12-station fuel
sales on 2.27 acres of land located at 803 S Seabreeze Road. Please refer to the attached site plans
for Parcel ID numbers.
The site was rezoned to (CZD) CB (Community Business) on February 5, 2024 under rezoning case
Z23-23. The site has the following seven (7) conditions:
1. Specified excluded uses will include electronic gaming, outdoor recreation, commercial
parking lot, car wash, vehicle rentals, minor vehicle service station, artisan manufacturing,
commercial recycling facility, animal shelter, kennel, hotel / motel, event center, indoor
recreation, funeral services, micro-brewery, and micro-distillery.

2. Exterior lighting, including luminaries, including security lighting, for nonresidential, multi-
family, and mixed-use developments adjacent to single family residential subdivisions
shall be full cut-off fixtures that are directed downward in compliance with Figure 5.5.4.C
Full Cut-off Fixtures of the Unified Development Ordinance. In no case shall lighting be
directed at or above a horizontal plane through the lighting fixture.
3. A connection to a public or private water and sewer utility provider is required. Private
wells and septic systems are not permitted.
4. If a convenience store with fuel stations is developed on this site, it must be developed
adjacent to Carolina Beach Road. Other uses in the Conditional District not specifically
excluded in Condition #1 may be permitted adjacent to Carolina Beach Road or to the rear
of the project.
5. Buildings on the east side of the internal drive shown on the concept plan shall be limited
to 2 stories or 35 feet.
6. Sidewalks will be extended along the entire frontage of North and South Seabreeze Road.
7. An additional 5 feet of vegetative buffer width will be added to the applicant selected Type
A opaque buffer option along the southeastern property line.
The approved site plan is attached. This approval is valid for two years unless a building permit
application or evidence of another substantial improvement for all or a portion of the project is
submitted to the County. If the TRC approval expires it will require a new application that will subject
the project to all development standards in effect at the time of the new application.
The TRC Commercial Preliminary Plan Approval allows the project to move forward with the next step
in the development process. The project may be subject to additional regulations of the County’s
development ordinances and applicants are responsible for obtaining all applicable permits and
approvals under any law, regulation, or requirement of any other federal, state, or local government
or regulatory agency. This includes but is not limited to:
• A Tree Removal Permit from New Hanover County Planning & Land Use.
• A lighting plan approved by New Hanover County Planning & Land Use meeting the
requirements of Section 5.5.
• A sign permit through COAST for any signs on site.
• New Hanover County Engineering for any required land disturbance and stormwater permits.
• CFPUA on water and sewer utility permits and approvals.
• NCDOT Driveway Permit.
• Construction permits and a Zoning Compliance permit.
Any changes to the approved plan, use, or incidental and accessory uses must be reviewed by and
receive written approval from New Hanover County Planning. Changes to the approved plan without

approval is considered a violation of the New Hanover County Unified Development Ordinance.
Violations may be subject to fines or legal action to ensure compliance with required development
standards and process.
