All members were present. b.Pledge of Allegiance Chair Getty called on the audience to rise and recite the Pledge of Allegiance. c.Approval of Agenda Chair Getty called for a motion to approve the agenda as submitted. Member Morgan so moved, seconded by Member Miller. Motion carried unanimously. 2.PUBLIC COMMENT PERIOD Chair Getty called upon the public attendees for their comments or questions, limited to two minutes each with a total maximum time of ten minutes. Seeing and hearing no public attendees wishing to comment, Chair Getty closed the Public Comment period. 3. NEW BUSINESS a. Review of Absentee Ballot Applications Special Assistant Lisa Wurtzbacher presented a total of 12 absentee ballot applications for Board review: 8 military and overseas, including 1 requiring Board review of the photo ID provided; and 4 civilian applications. Two bipartisan teams of Board members reviewed 7 duplicated overseas ballots. After review, Chair Getty moved to approve 7 overseas ballots, seconded by Member Miller. In response to a question from Member Setz, Interim Deputy Director O’Neill said that write-in ballots will be reviewed and reported at canvass. Motion carried unanimously. Elections Specialist Regina Stokes presented 1 UOCAVA application with a photo ID, as presented, with a glare on the photo that makes the face hard to see. Special Assistant Wurtzbacher said this scenario raised a question of a deficiency where the photocopy is not readable, defined as the name cannot be read, the photograph does not depict a person, or only a shadow or outline of a person, or both. Member Miller referenced Numbered Memo 2021-03 and said none of those deficiencies apply in this case and the Board should accept the photo ID as valid. Member Morgan moved to accept the application, seconded by Chair Getty. Motion carried unanimously. Elections Specialist Stokes presented 4 civilian absentee applications. The Board opted to review them in 2 bipartisan teams. Member Miller asked about a photo ID which expired in 2019 when the voter was 64 years old. The voter was born in 1939. The submitted photo ID is acceptable because it was valid when the voter turned 65 in 2004. After completing their review, Chair Getty moved to approve 4 civilian applications, Board Minutes – 11/04/2025 Page | 3 seconded by Secretary Lyon. Motion carried unanimously. The Board authorized staff to perform the preparatory steps of opening the approved absentee applications, scanning the ballots and sorting them by precinct, and securing the results for tabulation after 7:30 p.m. close of polls on Election Day. The Board requested an overview of the steps they will take at the recessed evening session. Elections Field Specialist Adams said the Board will direct the staff to close and run results tapes from the early voting DS200s and the results saved from all absentee board meetings. Those results will be uploaded securely to NCSBE after 7:30 p.m. and will be posted for public viewing on the NCSBE public website. As the chief judges return with their materials, preliminary precinct results will be uploaded to the NCSBE public website. Scanning by precinct began at 2:20 p.m. and concluded at 2:38 p.m. 4. GENERAL DISCUSSION Chair Getty called for any general discussion by Board members of election-related matters. Hearing none, Chair Getty moved at 2:38 p.m. to recess the meeting until 7:15 p.m., seconded by Secretary Lyon. Motion carried unanimously. EVENING SESSION The Board reconvened at 7:15 p.m. with all Board members present. Chair Getty moved to close the early voting machines and tabulate the results at 7:30 p.m., seconded by Member Miller. Chair Getty called for any discussion. Member Miller asked for clarification of what will happen during this meeting. Special Assistant Wurtzbacher recommended tabulating and uploading the previously scanned absentee ballot results while proceeding with review of the supplemental absentee ballots received after 2:00 p.m.; then at 7:30 p.m. begin uploading the early voting results. Chair Getty called for the vote on the motion to close the early voting machines. Motion carried unanimously. Motion carried unanimously. Special Assistant Wurtzbacher presented 11 additional absentee ballots received after the 2:00 p.m. meeting. She presented 4 civilian ballots with staff’s recommendation to approve, and 5 overseas applications received through the portal and duplicated as required, recommended for approval, and 2 in pending status. The Board reviewed the 5 overseas applications received through the portal requiring duplication of the transmitted ballots. Elections Specialist Stokes presented 1 pending supplemental absentee application that was returned in person by the voter’s boyfriend of 10 years, and 1 pending supplemental absentee application that was returned in person with the photo ID sealed in the ballot envelope. Secretary Lyon requested a review of the requirements who may deliver an absentee ballot. Member Miller reviewed the list of persons who statutorily qualify as a near relative of the voter, citing Numbered Memo 2020-23 and 08 NCAC 18.0102 where they state that return by a person who is not a near relative as defined is not sufficient evidence alone to establish that the voter did not lawfully vote the ballot. Member Miller moved to approve the ballot returned by the voter’s resident boyfriend, seconded by Member Morgan. Motion carried unanimously. The Board considered the photo ID sealed in the ballot envelope after review. Chair Getty moved to approve the ballot, seconded by Member Miller. Motion carried unanimously. Election Specialist Stokes presented 4 civilian applications that are recommended for approval. Following Board review of the 4 civilian applications, Chair Getty moved to approve them, seconded by Member Miller. Motion carried unanimously. Staff scanned the approved ballots and presented two results tapes for Board members’ review and signature. Upload of the absentee and early voting results to the NCSBE was completed at 8:25 p.m. 6.ADJOURNMENT Chair Getty moved to adjourn the meeting, seconded by Member Miller. Motion carried unanimously. NEW BUSINESS •Review of Provisional Ballot Applications Special Assistant Wurtzbacher said the only item of business before the Board is the review and action on the provisional ballots. She called on Interim Deputy Director O’Neill to report on staff’s provisional ballot review and recommendations. Interim Deputy Director O’Neill distributed a summary sheet of the provisional ballots to be addressed today, a total of 521 provisionals with recommendations to approve 265 and disapprove 255 with 1 pending provisional application requiring Board review. There is a second report sorting the provisional ballots by precinct. Interim Deputy Director O’Neill presented the 1 pending provisional application. The voter did not have a photo ID and completed a photo ID exception form, which the help desk operator sealed inside the ballot envelope instead of the outer sleeve. She requested Board approval to open the ballot envelope to review the photo ID exception form. Secretary Lyon moved to direct the staff to open the sealed provisional ballot envelope to review the photo ID exception form, seconded by Chair Getty. Motion approved unanimously. After opening the envelope and reviewing the photo ID exception form provided by the voter, Interim Deputy Director O’Neill reported that the voter signed the form attesting that the voter’s photo ID has been lost or stolen, which is an acceptable reason. The Board reviewed the photo ID exception form Chair Getty moved to approve the pending provisional application, seconded by Secretary Lyon. Motion carried unanimously. Interim Deputy Director O’Neill suggested the Board to act on the 265 recommended for approval to allow staff to begin tabulating those along with the 1 pending now approved. Chair Getty moved to approve 265 provisional ballots that staff reviewed and recommended approval, seconded by Secretary Lyon. Motion carried unanimously. Member Miller arrived at 2:08 p.m. Interim Deputy Director O’Neill asked if the Board had any questions about the 255 Board Minutes – 11/07/2025 Page | 3 provisional applications recommended for disapproval. She said the largest group of the disapproved provisionals were not eligible to vote in the municipal election because the voters were not residents of one of the municipalities. The second largest group were voters for whom there was no record of registration. Some of those were cured by successful same day registrations during early voting. After discussion of the reasons for disapproval, Chair Getty moved to disapprove 255 provisional applications as recommended, seconded by Member Miller. Motion carried unanimously. Tabulation of 266 approved provisional ballots began at 2:12 p.m. and concluded at 2:48 p.m. The Board reviewed and signed the zero report and the provisional results report. 4. GENERAL DISCUSSION •Other Elections-Related Matters Chair Getty called on the Board members for any general discussion. The Board and staff discussed the upcoming meeting schedule. Chair Getty asked whether the Board would need to meet on November 11 for the regularly scheduled meeting at 5:30 p.m. Special Assistant Wurtzbacher recommended leaving that meeting as scheduled to address any voter challenges. One challenge is already being researched where a voter cast a ballot but died before Election Day which would make the ballot ineligible. Special Assistant Wurtzbacher presented the results tapes for Board signatures from the tabulation of the absentee ballots on November 4. Interim Deputy Director O’Neill gave an overview of the Sample Audit Count that will take place at the Pre-canvass meeting on November 13. The Board discussed the time of the Pre-canvass meeting in light of a work conflict for Member Miller and agreed to meet at 10:00 a.m. instead of the scheduled 11:00 a.m. The final canvass meeting is scheduled, by statute, for 11:00 a.m. on November 14 and requires the presence of all board members to conduct the canvass. Notice of these meeting times and dates will be sent out later today. Member Lyon reported a complaint he received from a voter at Wrightsville Beach Elementary School about the open access from the voting enclosure into the school building. Interim Deputy Director O’Neill said election officials must have access to restrooms in the classroom area. The board of elections uses several school buildings as Election Day precincts subject to accessibility and security criteria. Similar concerns arise from voters and parents about the other schools as well. The Sheriff’s Office School Resource Officers work with us on school security during election day. Regarding the Wrightsville Beach voting site, elections were held previously in the Town Hall. Plans are to explore that alternative site with town officials. The cited concern is reduced for elections in even-numbered years when the school board sets Election Day as Board Minutes – 11/07/2025 Page | 4 a teacher workday, in-service day or holiday. Chair Getty asked staff to explore an early voting site in the downtown library as an alternative to Cape Fear Community College buildings. Interim Deputy Director O’Neill said there were complaints about use of the McLeod Building for the municipal election, which served about 1,500 voters, more than the previous municipal election. Awareness, access to the building and parking were some of the concerns raised. Staff will work to increase visibility and access through improved signage should it be used in future elections. Chair Getty asked about using the BOE multipurpose room as an early voting site. Interim Deputy Director O’Neill said that was the original intent but would require the Board to use the conference room with its space and security limitations during absentee meetings. Chair Getty suggested use of space in the main County building. Interim Deputy Director O’Neill said that raises concerns about transporting voted ballots and the DS850 across the parking lot. She said she favors considering other arrangements for trial with the March primary. Member Miller suggested considering reducing public seating in the board meetings and only livestreaming the meeting. As has been discussed before, staff will be exploring alternatives to the Senior Resource Center as well. 5.CLOSED SESSION Chair Getty said there is no business requiring a closed session. 6.ADJOURNMENT Chair Getty moved to adjourn the meeting, seconded by Secretary Lyon. Seeing and hearing no public attendees wishing to comment, Chair Getty closed the Public Comment period. 3.NEW BUSINESS a.Year-to-Date Elections Financial Update Special Assistant Wurtzbacher presented the Elections year-to-date budget report through October 31. Several line items show a high percentage of expenditures to date reflecting both spent funds and encumbrances of known costs for existing contracts. Some line items may be overbudget but will be offset by other lines that come in underbudget. Leased expenses covering leased equipment for the warehouse and postage machine appear high but are annual expenses already incurred. The same is true of the contract with ES&S for licenses and maintenance which are already paid and supplies because we replaced cradle points at the beginning of the budget year, a one-time purchase. Chair Getty asked when the municipalities will reimburse the costs of the municipal elections. Interim Deputy Director O’Neill said those costs will be determined after canvass and broken down by municipality who will be sent an invoice. Special Assistant Wurtzbacher said she will investigate further the reimbursement process and that the board of elections budget is a part of the county general fund. b.Ballot Challenge Interim Deputy Director O’Neill presented a ballot challenge to the early voting ballot cast by a voter who sadly died subsequently before Election Day. Evidence for the challenge includes a copy of the death certificate and the NC Department of Health and Human Services county deaths report. The Board is required to proceed with the challenge by statute. After notice is sent to the family, the Board will conduct a hearing on the challenge at canvass on November 14 before taking final action. 4. GENERAL DISCUSSION Special Assistant Wurtzbacher discussed possible timelines for hiring a new Elections Director. The Board reviewed the proposed process with the goal of having a new Director in place before the March primary, reviewed the proposed posting for the position prepared by County Human Resources, discussed the Board’s role in the hiring and selection process, and agreed on a proposed posting and timeline. The Board will recommend a candidate for the position to the State Board of Elections which makes the appointment. Board Minutes – 11/11/2025 Page | 3 Board discussion turned to other vacant positions and needed positions in the Elections office. Board members expressed concerns about the reliance on temporary staff to execute elections. Questions followed about the proposed 2025-26 enhancement request for a Voting Services Manager that was not approved. Member Setz asked about the agenda for the November 13 Pre-Canvass meeting. Interim Deputy Director O’Neill reviewed the required Sample Audit Count, a hand-eye count of 2 precincts or voting groups selected randomly by the State Board of Elections to verify the accuracy of the voting totals. The Board agreed to convene at 10:00 a.m. to authorize the Sample Audit Count, conduct any needed Board discussion, and recess to return for the results. 5. The Board recessed until 2:00 p.m. by unanimous consent. AFTERNOON SESSION The Board reconvened at 2:00 p.m. All Board members were present. Chair Getty called for the report on the Sample Audit Count (SAC). Interim Deputy Director O’Neill said the SAC for the Carolina Beach early voting site for Mayor of Carolina Beach matched exactly with the machine results. For election day voting at precinct W16, the first count showed a discrepancy by 1 vote each for Saffo and Craig, requiring a second count which matched the machine results. The Carolina Beach early voting site took 2 hours and 20 minutes to hand-eye count the ballots, covering 8 days of voting with 4 ballot styles. W16 took about 40 minutes for 1 day and 1 ballot style. 4. GENERAL DISCUSSION Special Assistant Wurtzbacher reminded the Board of the 11:00 a.m. canvass meeting on November 14 which requires the presence of all Board members. She reviewed the items for that meeting which include the administrative voter challenge, several same day registrations and machine-rejected ballots requiring review and possible adjustments to the totals before certifying the final canvass. The Board will sign 8 copies of the canvass results for distribution to the municipal clerks and the clerk of court for New Hanover County. Member Miller asked about any potential recounts. Interim Deputy Directory O’Neill said, based on current numbers, no contest is close to the 1% threshold for a recount. Chair Getty had questions about the voter challenge hearing procedure. She has seen the Board Minutes – 11/13/2025 Page | 3 memo from Board Legal Counsel Mark Payne on hearing procedure. The Board will review the evidence in the administrative voter challenge and make a decision. The challenger is the Board chair, and the Board makes the decision to uphold or deny the challenge based on the evidence that the voter died between casting an early voting ballot and Election Day, disqualifying the ballot. It is rare for a family member to appear and oppose the challenge. Motion carried unanimously. 2._PUBLIC COMMENT PERIOD Chair Getty called upon the public attendees for their comments or questions, limited to two minutes each with a total maximum time of twenty minutes. Spero Peratos, NAACP, thanked the Board on behalf of the community for adding 3 early voting sites for one week. Seeing and hearing no public attendees wishing to comment, Chair Getty closed the Public Comment period. 3.NEW BUSINESS a.Ballot challenge hearing Chair Getty opened the administrative ballot challenge hearing and called on Special Assistant Wurtzbacher, who said the Board filed the challenge at their November 11 meeting, setting the hearing for this meeting. Board Legal Counsel Payne is participating virtually to provide legal assistance with the hearing. Chair Getty said the hearing is on the vote properly cast by James Gordon Potter during early voting on October 21. Unfortunately, Mr. Potter died on October 24, before Election Day, November 4. Qualifications of voters casting a ballot, whether absentee, in early voting or on Election Day, are judged as of Election Day. Interim Deputy Director O’Neill took the oath to testify as a witness in the hearing to present evidence supporting the challenge pursuant to N.C. Gen. Stat §163-85(c)(6) (2024). Ms. O’Neill presented the following evidence: 1. The weekly report of the North Carolina Department of Health and Human Services (NCDHHS) to county elections departments reporting deaths in New Hanover County for purposes of correcting voter registrations as needed. The NCDHHS report dated 11/05/2025 listed the death of Mr. Potter on 10/24/2025, initiating this challenge. 2.A copy of the NCDHHS death certificate confirming the date of death. 3. A copy of the Voter Challenge form signed by the Chair on 11/11/2025. Board Minutes – 11/14/2025 Page | 3 Chair Getty confirmed the submission of the public documents and asked whether any Board members had any objections to their admission to the record. Hearing none, Chair Getty said these documents are entered into the record. Member Miller asked whether the Board has any discretion in resolving this complaint. Interim Deputy Director O’Neill replied that State law requires that any ballot cast during early voting must be removed if the voter has died as of Election Day. Chair Getty called on the Board members to discuss the complaint and the evidence presented. Hearing none, Chair Getty moved to uphold the challenge, direct staff to invalidate the ballot cast in early voting, and remove the voter from the voting list, seconded by Member Miller. Motion carried unanimously. b.Canvass of 2025 Municipal Election Interim Deputy Director O’Neill presented the 2025 Municipal Election Reconciliation Report for the Board to review in the meeting and return as it is not a public document. She said Elections Database and Systems Specialist Worsley prepared the early voting report and they worked together to prepare the Election Day report. She reported that the Northeast Library and McLeod Building early voting sites reconciled on all days of early voting. Reconciled means that the number of eligible ballots cast equaled the number of voters who voted with no anomalies and all cancellations where the wrong voter was selected were accurately cancelled and the correct voter was able to cast their ballot. The Carolina Beach site did not reconcile due to an erroneous same day registration. A data entry error by a laptop operator on the same day registration cannot be cancelled on site and then processed correctly. Instead, the operator must enter a new correct registration. After canvass, those two registrations will be linked to use the correct registration data in the voter list. Carolina Beach site did reconcile in terms of the number of ballots cast by eligible voters. In response to a question from Member Miller, Interim Deputy Director O’Neill confirmed that the number of eligible voters equaled the number of ballots cast. The Senior Resource Center site is not currently reconciled but will be after the Board considers a machine-rejected ballot and authorizes its duplication. She reported that 27 of 28 Election Day precincts reconciled. Precinct W15 did not reconcile but will after the Board considers a machine-rejected ballot and authorizes its duplication. Additional Board action is needed to complete the canvass. Given the outcome of the voter challenge, the ballot cast by deceased voter Potter will be removed. Board action is also needed to remove ballots cast by 4 same day registrants where the required verification mailing was returned undeliverable, voters Garcias, Barney, Camerzelle, and Chandler. Board action is also needed to remove the ballot of voter Falk who voted a provisional ballot at the Northeast Library site on 10/16/2025 based on a photo ID exception. The provisional ballot was approved. However, voter Falk returned to the Board Minutes – 11/14/2025 Page | 4 Northeast Library site on a subsequent day and voted a traditional ballot. The duplicate voter history for the traditional ballot was missed due to the short deadline for processing the provisional ballots. During reconciliation, staff discovered that voter Falk has two voter history records, one for the provisional ballot and one for the traditional ballot. Because the provisional ballot was already approved, Board action is needed to remove the traditional ballot from the tally. Interim Deputy Director O’Neill reviewed several other anomalies that were resolved administratively and do not require Board action. Secretary Lyon asked for clarification of which Falk ballot is recommended for removal from the results. Interim Deputy Director O’Neill said the provisional ballot was cast first and the Board approved it on November 7. Removal and deduction of the traditional ballot is recommended to the Board as corrective action. Member Miller asked for clarification of what constitutes a machine-rejected ballot. Ms. O’Neill said it is a ballot that, when fed into the DS200 for tabulation, may have markings or errant marks that cause the DS200 to reject the ballot and the voter has already left the voting site and cannot be offered the choice to spoil their ballot and receive and vote a replacement ballot. Any machine-rejected ballots are placed in a separate bag and submitted to the Board for authorization for staff to duplicate them. The Board may also be called on the rule on the voter’s intent if it was not clear from the voted ballot, such as voting for too many candidates or other markings making the voter’s choice unclear. The ballots before the Board for authorization to duplicate today do not involve unclear voter intent issues. Two bipartisan duplication teams are standing by for these or any other issues that arise during tabulation on the DS850. Member Miller asked for clarification on which Falk ballot was being removed, the early voting provisional ballot or the Election Day traditional ballot. Interim Deputy Director O’Neill confirmed that both ballots were cast during early voting, allowing for retrieval because the provisional ballot is coded differently from a traditional early voting ballot. Member Miller said the reconciliation process took the entire period available up to the day before canvass. He asked what are the implications for a larger election? Interim Deputy Director O’Neill said staff worked until 7:30 or 8:00 p.m. most days of post- election to address the municipal volume for reconciliation, trying not to wear out staff going directly into candidate filing December 1. The March primary will require much longer hours to get the work done under the new deadlines. Member Miller thanked Interim Deputy Director O’Neill for answering his questions. Chair Getty moved to authorize staff to take the recommended actions to complete the municipal canvass, seconded by Secretary Lyon. Motion carried unanimously. Interim Deputy Director O’Neill reviewed how write-in votes are addressed in municipal elections. If someone receives 5 or more write-in votes, they become eligible candidates for that office, and their votes must be reported to the NC State Board of Elections Board Minutes – 11/14/2025 Page | 5 (NCSBE). Elections Logistics Coordinator Eric Navagh and Elections Database & Systems Specialist Joey Worsley compiled the write-in vote report: •Carolina Beach Mayor: Kristen Dunn received 16 write-in votes •Carolina Beach Council: Kristen Dunn received 12 write-in votes and Danny Tangredi received 5 write-in votes •Wilmington City Council: Kelly Roberts, already on the ballot, received 15 write-in votes, Kevin Spears received 7 write-in votes, and Ricky Meeks received 6 write-in votes •Wrightsville Beach Mayor: John Jarvis received 5 write-in votes and Tony Saffo received 5 write-in votes. The Board reviewed the duplicated Senior Resource Center early voting ballot and the Election Day ballot for accuracy. Interim Deputy Director O’Neill presented the report of approved supplemental absentee ballots for Board signature. Denise Brown, Campaign Finance Specialist, will notarize. Member Setz asked how voters are flagged as having a felony conviction. Interim Deputy Director O’Neill said those are flagged in SEIMS which will show when attempting to vote. In addition, the ATV form includes a question about an active felony conviction that the voter signs under penalty of perjury. Interim Deputy Director O’Neill reported that all duplicated ballots have been run and, with the Board’s permission, Jennifer and Joey will make those adjustments to the Electionware software for the final canvass reports which will be presented for Board signatures. This work began at 11:43 a.m. and concluded at 12:15p.m. Interim Deputy Director O’Neill presented the final canvass reports to the Board for their signature on duplicate copies. Multiple copies are required for distribution to the municipalities and clerk of court for New Hanover County. Interim Deputy Director O’Neill said a total of 27,951 ballots were cast out of a total municipal registration of 103,364 with 3 blank ballots cast for a total of 27,948 ballots cast for the municipal offices on the ballot, an amazing turnout. 4. GENERAL DISCUSSION Chair Getty called on the Board members for discussion of election-related matters. Member Miller asked whether the Elections Director position has been posted. Special Assistant Wurtzbacher said it is posted on the County website and she will check to see whether it has been sent to the various professional groups as well. Member Miller asked the Board to start thinking about the interim deputy director position and about the permanent deputy director position, setting timelines, or deferring discussion to a later time. Board Minutes – 11/14/2025 Page | 6 Chair Getty said the Elections Director appoints the Deputy Director and normally the Board does not act on that appointment. Member Miller said the Elections Director position is vacant so the question is do we wait and keep things status quo or should the Board act on the Deputy Director on a more definite timeline? Secretary Lyon said he would defer that appointment for the new Director to address, noting that the municipal election went well. Member Miller added that currently staff is operating with an interim deputy director, which means there is another position the Board cannot fill, and Jessica is doing two jobs, creating a pressure point, a counter point to seeing and waiting. Member Miller said he wonders if the staffing shortages going into the March primary might outweigh the normal course of operations. Special Assistant Wurtzbacher reviewed the planned timeline for receiving applications, beginning telephone interviews with in-person interviews beginning December 17-19. Chair Getty said it is hard to know how quickly the hiring process is going to go. Secretary Lyon asked whether the Special Assistant duties as delegated include filling staff vacancies. If it does, then Special Assistant Wurtzbacher could take steps to fill the position. Chair Getty said she would need to review the delegation to the Special Assistant to determine that. Member Miller said he would be more comfortable keeping Board of Elections business “in house” with the Board making that decision. Secretary Lyon said he would have more confidence in Special Assistant Wurtzbacher making such a decision than he would have in his own ability to make that decision. After further discussion, the Board agreed to return to this topic at the regular meeting on December 9. Member Miller asked whether the December 9 regular meeting includes the Board acting on an early voting plan for the March primary. Interim Deputy Director O’Neill said she and Logistics Coordinator Navagh are scheduled to tour the new library downtown to evaluate as an early voting site. If that space does not work, a decision about staying in the McLeod Building will be needed. Working with staff, we have some ideas on how to raise the profile to help voters to access that site. Member Setz asked about relocating early voting from the Senior Resource Center to the Elections office. Interim Deputy Director O’Neill said the Elections space is too small to use both as an early voting site and a Board meeting room. Staff are looking at moving the Board meetings back to the conference room while balancing voter confidentiality with public observation of the meetings. Staff is also considering moving the Senior Resource Center site to the Trillium facility about a mile away to eliminate the conflicts between early voting and the programs of the Senior Center. Out of that work we will present a cohesive plan for early voting for the Board’s decision. Secretary Lyon thanked Interim Deputy Director O’Neill and the staff for running a seamless election, working as a cohesive team, and excellent communications from Lisa. Gen. Stat. § 163-166.4 Summary: North Carolina law requires county boards of elections to establish and enforce electioneering restrictions at each voting place. When a polling place is located in a nonpublic building, N.C. Gen. Stat. § 163-166.4(c) allows a county board of elections to adopt site-specific electioneering restrictions by resolution, subject to approval by the North Carolina State Board of Elections. The polling place for Precinct H05 is located at Port City Community Church, a nonpublic facility located at 250 Vision Drive, Wilmington, North Carolina. Port City Community Church has requested an amendment to its 2025–2027 Usage Agreement with the New Hanover County Board of Elections to prohibit all electioneering activities on its property at any time. This request would become effective beginning with the Primary Election scheduled for March 3, 2026. In order to lawfully approve this request, the Board must certify all of the following as required by statute: 1.That no other suitable voting place can be secured for the precinct; and 2.That the Chief Judge of the precinct will monitor the voting place to ensure that election- related restrictions are applied equally to all candidates and political parties; and 3.That the pattern of voting place restrictions does not disproportionately favor any political party, racial group, ethnic group, or candidate. If adopted, this resolution will formally approve the updated electioneering restrictions for Precinct H05 and authorize submission of the request to the Executive Director of the North Carolina State Board of Elections for review and approval. NEW HANOVER COUNTY BOARD OF ELECTIONS RESOLUTION TO UPDATE ELECTIONEERING RESTRICTIONS AT THE H05 POLLING SITE, PORT CITY COMMUNITY CHURCH Pursuant to NCGS 163-166.4(c), the New Hanover County Board of Elections request an exception to the requirements of NCGS 163-166.4(b) for the polling site H05, Port City Community Church, which is a nonpublic building. In order to enter into such a special agreement, the New Hanover County Board of Elections certifies that: 1.No other suitable voting place can be secured for the precinct; and 2.The County Board will require the Chief Judge of the precinct to monitor the grounds around the voting place to ensure that the restriction on election-related signage shall apply to all candidates and parties equally; and 3.The pattern of voting place subject to agreement under this subsection does not disproportionately favor any party, racial or ethnic group, or candidate. At a meeting duly called and held on December 9th, 2025, at 226 Government Center Drive in Wilmington, North Carolina, the New Hanover County Board of Elections unanimously adopted the following resolution: WHEREAS, the County Board of Elections shall have power to approve amended Electioneering restrictions under the requirements outlined in N.C. Gen. Stat §§ 163-166.35 and 163-166.40 Summary: The New Hanover County Board of Elections must approve the early voting sites and hours for the 2026 Primary Election. The working deadline to submit the county’s early voting plan to the North Carolina State Board of Elections for the March primary is December 19, 2025. Under G.S. 163-166.40(b), the in-person early voting period must begin “not earlier than the third Thursday before an election and not later than 3:00 p.m. on the last Saturday before that election.” For the 2026 Primary Election, this results in an early voting period beginning on Thursday, February 12, 2026, and ending at 3:00 p.m. on Saturday, February 28, 2026. State law requires that early voting be conducted at the county board of elections office, or at an approved in-lieu-of site, for the full early voting period. For 2026, the required office site is proposed as: •New Hanover County Board of Elections – Multipurpose Room – 226 Government Center Drive, Wilmington, NC 28403 The following additional early voting sites are recommended for consideration: •Carolina Beach Town Hall — 1121 N. Lake Park Blvd, Carolina Beach, NC 28428 •NHC Senior Resource Center — 2222 S. College Road, Wilmington, NC 28403 •CFCC Main Campus – McLeod Building — 411 N. Front Street, Wilmington, NC 28401 Because the 2026 Primary Election occurs in an even-numbered year, all early voting sites must operate on the same days and the same hours, including mandatory weekday hours of 8:00 a.m. – 7:30 p.m. and the required final Saturday hours of 8:00 a.m.–3:00 p.m. If any site is open on a Sunday, all sites must be open for the same hours. Early voting schedules cannot be staggered across locations. Any expansion beyond the statutory minimum, including the addition of supplemental early voting sites, must receive the unanimous approval of the county board. If the county board does not reach unanimity, any board member(s) may petition the North Carolina State Board of Elections to adopt an early voting plan for New Hanover County. This page intentionally left blank. NEW HANOVER COUNTY BOARD OF ELECTIONS RESOLUTION TO ADOPT THE 2026 PRIMARY EARLY VOTING PLAN Pursuant to N.C. Gen. Stat. §§ 163-166.35 and 163-166.40, the New Hanover County Board of Elections is authorized and directed to establish Early Voting sites and hours for each election. WHEREAS, the New Hanover County Board of Elections is required to approve the early voting sites and hours for the 2026 Primary Election and submit the county’s Early Voting Plan to the North Carolina State Board of Elections no later than December 19, 2025; and WHEREAS, pursuant to N.C. Gen. Stat. § 163-166.40(b), the in-person early voting period must begin not earlier than the third Thursday before an election and not later than 3:00 p.m. on the last Saturday before that election; and WHEREAS, for the 2026 Primary Election, the early voting period shall begin on Thursday, February 12, 2026, and conclude at 3:00 p.m. on Saturday, February 28, 2026; and WHEREAS, because the 2026 Primary Election occurs in an even-numbered year, all early voting sites are required to operate on the same days and during the same hours, including mandatory weekday hours of 8:00 a.m. to 7:30 p.m. and final Saturday hours of 8:00 a.m. to 3:00 p.m.; and WHEREAS, State law requires early voting to be conducted at the county board of elections office or at an approved in-lieu-of site for the full early voting period. NOW, THEREFORE, BE IT RESOLVED that the New Hanover County Board of Elections hereby adopts the following four (4) Early Voting locations for the 2026 Primary Election: •New Hanover County Board of Elections – Multipurpose Room 226 Government Center Drive, Wilmington, NC 28403 •Carolina Beach Town Hall 1121 N.
