a. The TIA evaluated a project scope of 4,085 dwelling units. The subdivision application
currently under review by the County, however, proposes a maximum of 1,800
dwelling units. This unit count falls between Phases 2 and 3 of the TIA. At some point
before or after the completion of Phase 2, the TIA phasing plan will need to be
revised, with approval from the WMPO and NCDOT, to clearly identify which
transportation improvements will be required before any additional lots can be
recorded. Alternatively, the applicant may elect to revise the subdivision plan to
include a higher unit count. Such a revision would constitute a new project and
would require the submission of a new subdivision application and a new County
review. Any new application would be evaluated under the UDO standards in effect
at the time the new application is submitted.

a. A tree removal permit has been submitted. Staff is currently reviewing the application
materials. The conservation plan will need to be established before trees are removed
in areas near potential conservation areas.

materials that will need to be provided which are listed in the attachment.

HOA and private ownership of conservation areas:
The Unified Development Ordinance (UDO) allows for the private ownership of
conservation areas. While New Hanover County prefers conservation space to be
placed in a conservation easement, the following process has been established to
ensure conservation space under private ownership are appropriately protected
and maintained.
Each conservation space presents unique challenges that can threaten the integrity
of its habitat. To address these risks, developments containing conservation space
must undergo a site evaluation by a qualified professional. Based on this
assessment, specific measures should be recommended to preserve and manage
the area’s natural hydrology, water quality, and plant communities.
Ongoing management may be necessary to maintain ecological quality. Because
management needs vary by habitat, some conservation spaces benefit from limited
disturbance, while others require protection from any disturbance. Management
plans must also account for required buffer areas to ensure the long-term health
and functionality of the conservation space.
Alternatives to the plan requirements specified below may be approved by the
County Manager’s Office.
Permanent conservation is required for new development if specific criteria are
triggered under one or both of the following sections of the Unified Development
Ordinance (UDO):
• Section 3.1.3.D Performance Residential Development
o When Class IV soils are used to calculate residential density.
• Section 5.7 Conservation Resources
o When the minimum distinct acreage of a resource is identified on site.
The total acreage is determined by using Table 5.7.3.A.5 of the UDO.
1. Conservation plan developed by professional
• The conservation plan must be prepared by a qualified professional. The
following licensed or certified individuals may prepare a conservation plan:
o Engineer licensed in North Carolina
o Forester licensed in North Carolina
o Certified Conservation Planner
o Certified Environmental Scientist (CES)
o Certified Environmental Professional (CEP)
• In addition to any materials prepared for the TRC review of the project, a
separate surveyed map must be prepared for the conservation plan. In
addition to meeting the minimum requirements for a subdivision survey
intended for recordation with the Register of Deeds, the map must show:
o The type and acreage of each regulated conservation area subject to
conservation:
▪ Class IV soils
▪ Section 5.7 Conservation Resources
o Existing conditions, including waterbodies, streams, or other natural
features.
o Existing and proposed easements, roads, and pedestrian facilities.
• A list and written description of the existing conservation resources and
existing conditions of the conservation area.
• Photographs of the resources from different locations and the locations
where each photograph was taken. Photographs are used to document
existing conditions and may be used for comparison during future
monitoring and compliance.
• Conservation areas and their ecological needs can be unique and the same
conservation strategy for one type may not apply to another. The
conservation plan must include the following information specific to the type
of environmental resource identified for conservation:
o A list of challenges to conservation and preservation.
o A list of opportunities for maintaining or enhancing the conservation
area.
o Best practices for how the specific conservation area should be
monitored and maintained as a viable conservation area.
• The phasing of development can impact when certain conservation
requirements are triggered in the ordinance. The conservation plan must
include the phasing plan for the development so the county can track when
preservation is required.
• How the conservation area will comply with the requirements of Section
5.7.3.E.4 of the UDO.
• Initial cost estimate for 1 year of monitoring and maintenance. The estimate
allows the county to evaluate the financing and maintenance schedule
required below.
• Proposed method of financing and schedule of maintenance. The method of
financing and schedule of maintenance is reviewed to ensure adequate
provisions are made for the perpetual and appropriate maintenance of the
conservation area.
2. Review
• The conservation plan will be reviewed by the following agencies:
o Planning & Land Use
o Sustainability Manager
o Soil & Water Conservation
o Other local and state agencies as required including but not limited to
New Hanover County Cooperative Extension and Engineering.
• New Hanover County reserves the right to hire additional professional
expertise during the review process.
3. Conservation Plan Approval and Next Steps
• If the conservation plan is approved the developer must draft language for a
deed restriction and covenants to address the conservation plan.

o Soil & Water
o County Attorney’s Office
• For phased projects the timeline for recording the conservation space will be
determined as part of the review. If approved, the deed restriction, map of
the conservation areas, and covenants for the conservation space for each
phase must be recorded with the Register of Deeds before that phase of the
construction plans are approved.
• Subsequent phases shall refer to the book and page number of the
conservation documents on all future preliminary plats and final plats.

Review Process Example:
This is not intended to be part of the conservation plan requirements above but
provides a general overview of where the conservation plan review falls in the
larger development review process.
This is an example; there is the possibility that a conservation plan could be
approved before the TRC approval is issued. That will likely depend on the scale
and scope of the area that needs to be reviewed.

signing will be allowed to exceed 42 inches in height, measured from the Edge of
Pavement (EOP) within the median or sight triangle.
• All pylon signs in the median or sight distance triangle must provide a vertical
clear sight zone between 3 feet-6 inches and 10 feet-0 inches measured from the

Engineering Studies
The applicant may be required by the District Engineer to submit studies based on, but not limited to, the parameters outlined
herein. If study requirements of the local government agency are more restrictive than the NCDOT requirements, then local
government requirements will govern. However, this does not imply that the NCDOT is obligated to approve entrance designs
that are too constrictive to allow smooth and safe traffic flow. All studies including, but not limited to, Traffic Impact Analyses
(TIA), traffic signal studies, and drainage studies, must be prepared under the direct charge of and sealed by a North Carolina
licensed Professional Engineer.

Section 6: Roadway
Plan Requirements
If off-site improvements are required, roadway plans shall show, at a minimum, the items below
1)Full width typical sections must be shown (paved shoulders to match the typical section of the adjacent roadway)
2)Minimum Asphalt Typical Section (for turn lanes and/or paved shoulders)
Adjacent recently-completed or upcoming TIP projects w/ different typical sections may supersede those below
•Primary Routes (US & NC) and Secondary Routes with Annual Average Daily Traffic (AADT) ≥10,000
5.5” B25.0C, 3” I19.0C, 1.5” S9.5C; any overlay of existing pavement is to be a minimum of 1.5” S9.5C
•Secondary Routes with AADT<10,000
5.5” B25.0C, 1.5” S9.5B; any overlay of existing pavement is to be a minimum of 1.5” S9.5B
3)Pavement overlay is required if modification of existing pavement markings and/or lanes is necessary
The grinding of pavement markings will not be allowed
4)Shoulder Widths (Paved + Unpaved) Primary: 8’ minimum | Secondary: 6’ minimum
5)Ditch Slopes - front and back slopes - minimum 3:1 or flatter
6)Indicate existing roadway grade
7)All taper lengths and deceleration lengths should be appropriately designed for the given design speed (page 78)
8)All turn lanes should be designed according to the Driveway Manual and Roadway Standard Drawings (page 79)
