Subject: Alton Orchard – Performance Residential Development – Preliminary Plan Approval
The preliminary plan for Alton Orchard has been approved by the Technical Review Committee
(TRC). The approved plan consists of 55 single-family units on 22.02 acres of land located at 6200
Myrtle Grove Rd (PID# R07900-003-045-000 & R07900003-006-000.). This approval is valid for two
years unless a building permit application for all or a portion of the project is submitted to the
County. The approved preliminary plan is enclosed.
There is an approved Tree Removal Permit tied to this site plan, TR-25-000090, included in the
approval packet. Per the Tree Removal Permit, there is an outstanding 187 inches of mitigation
required for this site. The mitigation plan will need to be addressed before approval of the final plat
for this subdivision. This can be achieved by planting additional trees on site or payment into the
County’s tree fund. Either choice will need to be taken care of prior to approval of the final plat or
bonded prior to approval of the final plat.
The TRC Commercial Preliminary Plan Approval allows the project to move forward with the next step
in the development process. The project may be subject to additional regulations of the County’s
development ordinances and applicants are responsible for obtaining all applicable permits and
approvals under any law, regulation, or requirement of any other federal, state, or local government
or regulatory agency. This includes but is not limited to:
• A Tree Removal Permit from New Hanover County Planning & Land Use (see above).
• New Hanover County Engineering for any required land disturbance and stormwater permits.
• CFPUA on water and sewer utility permits and approvals.
• Construction plans must also be approved through Planning & Land Use and Engineering.
Construction plans must be approved prior to full site work taking place on the property.

Subject: Tree Removal Permit – 6200 Myrtle Grove Road – Alton Orchards
New Hanover County has approved tree removal plans and has issued a tree removal permit for the
property described below.
APPLICANT NAME: James Yopp, River Road Construction
PERMIT NUMBER: TR-25-000090
TREE REMOVAL/PROJECT DESCRIPTION: The project consists of the removal of 12,613 inches of
Documented Trees and 914 inches of Significant Trees. This permit is issued in conjunction with Land
Disturbance Permit LNDP-25-00346, which has not yet been issued by New Hanover County
Engineering. The Land Disturbance Permit is for Tree Clearing and Rough Grade for a 51-lot residential
subdivision. This project has increased to a proposed 55-lot residential subdivision, so the Land
Disturbance Permit is on hold while the project moves through TRC. The applicant has applied for a
Tree Removal Permit ahead of TRC approval, while the 55-lot project moves through the TRC process.
REQUIRED MITIGATION:
914 inches of Significant Trees removed.
914 inches x the mitigation factor of 2 = 1,828 inches of required mitigation.
1,094 inches of existing documented trees are being retained. Only Documented trees count towards
offsetting required mitigations. But retained native trees count for 1.5 inches of retention.
1,094 x 1.5 = 1,641 inches of credited retained trees for mitigation
1,828 inches required mitigation – 1,641 credit = 187 inches of mitigation required.
APPROVED TREE MITIGATION: A mitigation plan has not been approved yet. TRC approval for the site
will be withheld until a mitigation plan is submitted and approved by New Hanover County Planning
and Land Use.

Tree removal activities for the above property may begin at this time in accordance with the County’s
regulations and with the following conditions:
1. TREE REMOVAL MUST BE CONDUCTED IN ACCORDANCE WITH THE PLANS APPROVED BY
THE COUNTY (ATTACHED TO THIS PERMIT), INCLUDING PLANS FOR MITIGATING THE
REMOVAL OF SIGNIFICANT TREES. FAILURE TO FOLLOW THE APPROVED PLAN MAY
RESULT IN A REQUIRED PAYMENT INTO THE COUNTY’S TREE IMPROVEMENT FUND IN
ACCORDANCE WITH COUNTY STANDARDS.
2. EXISTING SIGNIFICANT TREES THAT ARE TO REMAIN ON THE SITE MUST BE PROTECTED
FROM VEHICULAR MOVEMENT AND MATERIAL STORAGE DURING ANY CLEARING,
GRADING, OR LAND DISTURBING ACITIVITIES. AN UNDISTURBED AREA MUST BE RESERVED
AROUND EACH TREE AS DETERMINED BY THE TREE’S DRIP LINE. THE UNDISTURBED AREA
MUST BE PROTECTED BY A SUITABLE FENCE.
3. IF A PROTECTED TREE IS DESTROYED, SUBSTANTIALLY DAMAGED, OR DIES AS A RESULT OF
NEGLIGENCE ON THE PART OF THE PROPERTY OWNER WITHIN THREE YEARS AFTER THE
CLEARING, GRADING, OR LAND DISTURBING ACTIVITY, THEN REPLACEMENT TREES MUST
BE PLANTED ON THE SITE OR A PAYMENT MUST BE MADE TO THE COUNTY’S TREE
IMPROVEMENT FUND IN ACCORDANCE WITH COUNTY STANDARDS.
4. THIS PERMIT DOES NOT RELIEVE THE PROPERTY OWNER OR APPLICANT FROM ANY LAW,
REGULATION, OR REQUIREMENT OF ANY OTHER GOVERNMENT OR REGULATORY AGENCY.
ADDITIONAL LOCAL, STATE, AND FEDERAL PERMITS MAY BE REQUIRED TO BE OBTAINED
PRIOR TO BEGINNING ANY CLEARING, GRADING, OR OTHER LAND DISTURBING
ACTIVITIES.
5. TREE REMOVAL PERMITS DO NOT GRANT ANY STATUTORY VESTING OR APPROVAL OF ANY
SITE-SPECIFIC DEVELOPMENT PLAN OR FUTURE DEVELOPMENT OF THE SUBJECT
PROPERTY. TREE REMOVAL PERMITS ARE ONLY APPROVING REMOVAL AND MITIGATION
OF TREES.
6. MODIFICATIONS MADE TO THE APPROVED TREE REMOVAL AND MITIGATION PLAN WILL
REQUIRE ADDITIONAL REVIEW BY THE COUNTY AND MAY REQUIRE THE SUBMITTAL OF A
NEW TREE REMOVAL PERMIT APPLICATION.
7. IF THE TREE REMOVAL ACTIVITIES HAVE NOT SUBSTANTIALLY COMMENCED WITHIN SIX
MONTHS OF PERMIT ISSUANCE, THIS PERMIT SHALL EXPIRE AND A NEW TREE REMOVAL
PERMIT APPLICATION MUST BE SUBMITTED.
