AFFIDAVIT
The undersigned representative of EIP Holdings IV, LLC, a Delaware limited liability
company ("EIP"), with respect to an application for a Special Use Permit related to the wireless
telecommunications tower being proposed by EIP to be constructed at 613 Valley Brook Road,
Wilmington, NC 28412 (PID: R08500-002-070-000) ("Tower"), hereby deposes and states as follows:
1. The construction or placement of the Tower and related structures meets the provisions of
the Federal Communications Act, 47 U.S.C. § 332, as amended, section 6409 of the Middle
Class Tax Relief and Job Creation Act of 2012, 47 U.S.C. § 1455 (a), in accordance with
the rules promulgated by the Federal Communications Commission ("FCC"), and all other
applicable federal, state, and local laws.
2. The Tower will meet or exceed all current standards and regulations of the Federal Aviation
Administration ("FAA"), the FCC, and any other state or federal government agency with
the authority to regulate towers and antennas.
3. The Tower will comply with all applicable federal regulations regarding interference
protection.
4. The Tower will comply with FCC regulations regarding susceptibility to radio frequency
interference, frequency coordination requirements, general technical standards for power,
antenna, bandwidth limitations, frequency stability, transmitter measurements, operating
measurements, and any and all other federal statutory and regulatory requirements relating
to radio frequency interference.
5. The Tower will be designed to meet or exceed current American National Standards
Institute standards as adopted by the FCC.
6. The Tower will comply with "Good Engineering Practices" as defined by the FCC in its
rules and regulations.
7. Radio frequency emissions from the antenna array(s), both individually and cumulatively,
will comply with FCC standards.
8. Construction of the Tower will be legally permissible before construction begins.
