THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Zoning Map of Zoning Area #8Ais hereby amended by removing
the hereinafter described tract of land from the present R-15 Single Family
Residential District classification and putting it in the B-1 Business District
classification, said land being described as follows:
BEGINNING at an iron pipe in the eastern line of N.C. Highway 132 (200 feet
in width) where the same is intersected by the eastern line of the tract described
in a deed to Clyde C. Smith dated January 26, 1951 and recorded in Book 452 at
Page 299 of the New Hanover County Registry, said line also being the western line
of a tract conveyed to H. Winfield Smith by deed dated August 6, 1948 in Book 419
at Page 22 of said Registry; running thence north 300 13' east with said line
860.45 feet to a point in the southern line of the state road that leads from
U.S. Highway 117 to the Blue Clay Road, said point being a common corner of the
aforementioned Smith tracts; thence south 590 47' east with the southern line of
said state road 800 feet, more or less, to a concrete monument marked "R/W" near
the intersection of said state road with N.C. Highway 132; thence south 670 19'
west with a State's right-of-way line 115.3 feet to a concrete monument marked
"R/W" in the eastern line of N.C. Highway 132; thence southwardly with said line
of said highway as it curves to the right (about 1150 feet) to the end of said
curve; thence south 120 49' east 28.5 feet to the point of BEGINNING, the same
containing 8.79 acres and being the portion of the aforementioned Clyde C. Smith
Tract lying and being on the eastern side of N.C. Highway 132.
Section 2. The County Clerk is hereby authorized and directed under the
supervision of the County Commissioners to change the Zoning Area #8AMap on file
in the office of the County Commissioners, so as to make it comply with this
ordinance.
Section 3. Any ordinance or any part of any ordinance in conflict with this
ordinance, to the extent of such conflict, is hereby repealed.
Section 4. This ordinance is adopted in the interest of public health, safety,
morals and general welfare of the inhabitants of the County of New Hanover, North
Carolina, and shall be in full force and effect from and after its adoption.

Classification and putting it in the R-15 Single Family Residential District
Classification, said land being described as follows:
BEGINNING at a point in the eastern right-of-way line of Blue Clay Road
(S.R. 1318 - 60.0' right-of-way) approximately 760 feet southwardly from the inter-
section of the southern line of S.R. 1002 (100.0' right-of-way) extended and the
eastern line of Blue Clay Road. Running thence from said beginning point north
8 degrees 33 minutes west 350.0 feet with the eastern line of Blue Clay Road to a
point; thence north 81 degrees 27 minutes east 150.0 feet to a point; thence north
73 degrees 58 minutes east 700± feet to the run of Sturgeon Creek; thence up the
run of Sturgeon Creek approximately 460 feet to a point that bears north 81 degrees
27 minutes east from the point of beginning; thence south 81 degrees 27 minutes
west 920± feet to the point of BEGINNING. Above described tract contains 8.2 acres.
Section 2. The County Clerk is hereby authorized and directed under the super-
vision of the County Commissioners to change the Zoning Area #8A Map on file in the
office of the County Commissioners, so as to make it comply with this ordinance.

Section 1. The Zoning Map of Zoning Area #8A is hereby amended by removing
the hereinafter described tract of land from the present R-15 Residential District
Classification and putting it in the I-2 Industrial District Classification, said
land being described as follows:
BEGINNING at a concrete monument located in the northern right-of-way line
of N.C. Hwy. 132, said monument being located north 10 degrees 28 minutes east
1048.0 feet as measured along the western line of a tract of land deeded to
J. W. Harrell & Wife, by Herbert Bluethenthal & Wife from the beginning point
of the above mentioned tract, said deed for the Bluethenthal to Harrell tract
being recorded in the New Hanover County Register of Deeds Office in Book 452
at Page 352. Said concrete monument being also located north 10 degrees 28
minutes east 184.17 feet from a point in the centerline of the existing pavement
of N.C. Hwy. 132. This said point being located south 33 degrees 13 minutes

Sections 55.3 and 52.1 of the County Zoning Ordinance WILL be satisfied if the property is
developed in accordance with the plans submitted to the County Commissioners and attached as
part of this approval. IT IS ORDERED that the application for the issuance of a CONDITIONAL
ZONING DISTRICT BE GRANTED subject to the following conditions:
A. If any of the conditions imposed within this conditional zoning district shall be
held invalid beyond the authority of this Board of Commissioners by a court of

interest because the proposal would benefit the community by providing diverse housing

property is developed in accordance with the plans submitted to the County Commissioners and

AN ORDINANCE OF THE COUNTY OF NEW HANOVER
AMENDING THE OFFICIAL ZONING MAP
OF NEW HANOVER COUNTY, NORTH CAROLINA
ADOPTED October 15, 1969 respectively and subsequently amended
CASE:Z22-01
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The New Hanover County Zoning Map is hereby amended by removing the hereinafter
described tract from an R-15, Residential District, and placing it in a (CZD) B-2, Regional Business
District, said land consisting of approximately 5 acres and being described legally as follows:
Beginning at a point in the southern boundary of Sidbury Road (S.R.1336), a 100'public
right-of-way; said point being located at the northern-most corner of "Tract 3—Sidbury
Station, "a division recorded among the land records of the New Hanover County Registry
in Map Book 69, at Page 154; and running thence from the point of beginning: South
56051'13" East, 558.02 feet to a point; thence South 75051'40" West, 720.27 feet to a
point; thence North 14018'55" West, 410.00 feet to a point in the southern boundary of
Sidbury Road; thence with that right-of-way, North 75051'40" East, 343.00 feet to the
point and place of beginning, containing 217,971 square feet, or 5.00 acres more or less.
Section 3. Any ordinance or any part of any ordinance in conflict with this ordinance,to the extent
of such conflict, is hereby repealed.
Section 4. This ordinance is adopted in the interest of public health, safety, morals and general
welfare of the inhabitants of the County of New Hanover, North Carolina and subject to the
conditions also approved as part of this action, shall be in full force and effect from and after its
adoption.
Section 5. The County Commissioners find, in accordance with the provisions of NCGS 160D that
the zoning map amendment of approximately 5 acres of land from an R-15, Residential District,
and placing it in a (CZD) B-2, Regional Business District, is:
Consistent with the Comprehensive Plan because it will allow for an appropriate use in
the Community Mixed Use place type. The County Commissioners also find approval of
the rezoning request is reasonable and in the public interest because the site is located
on a collector street near an approved subdivision and within a larger area identified for
future growth.

Section 6. The County Commissioners find that all of the specific requirements set forth in
Sections 3.4.5, 4.3.4.C.2 , and 10.3.3 of the County Unified Development Ordinance WILL be
satisfied if the property is developed in accordance with the plans submitted to the County
Commissioners and attached as part of this approval. IT IS ORDERED that the application for the
issuance of a Conditional Zoning District BE GRANTED subject to the following conditions:
1. No storage unit entry, other than normal ingress-egress doors to meet life-safety
code, will be permitted along the wall facing Sidbury Road.
2. Architectural features, along with foundation landscaping, will be incorporated
along the Sidbury Road building facade to enhance the aesthetics of the
streetscape.
3. The east, west and south boundaries of the tract will be buffered with an 8-foot
high solid screening fence, along with required plantings.
4. Hours of operation shall be from 6 AM to 10 PM.
5. There shall be no washing or maintenance of vehicles or boats in the outdoor
storage area.
Section 7. In accordance with Section 10.3.3.C.7.c of the ordinance, revocation of the Conditional
Zoning District approval may be considered if no building permit has been issued for the subject
tract within two years of the date of this approval.
Section 8. The applicant shall fully comply with all of the specific requirements stated in the
Ordinance for the proposed use; and all other state, federal and local rules.

along the right-of-way from its intersection with the eastern boundary of the Wilmington—
Weldon Railroad,a 130' right-of-way;and running thence from the point of beginning:

recreational service for nearby residents, includes relatively low traffic generators,and is
located on an arterial road.
Section 6. The County Commissioners find that all of the specific requirements set forth in
Sections 3.3.7, and 10.3.4 of the County Unified Development Ordinance WILL be satisfied if the
property is developed in accordance with the plans submitted to the County Commissioners and
attached as part of this approval. IT IS ORDERED that the application for the issuance of a Planned
Development Zoning District BE GRANTED subject to the following conditions:
Conditions:
1. The hours of operation will be limited to 7AM-9PM.
2. The restaurant and clubhouse may only operate as an accessory use to an
operational outdoor recreational facility.
Section 7. In accordance with Section 10.3.3.C.7.c of the ordinance,revocation of the Conditional
Zoning District approval may be considered if no building permit has been issued for the subject
tract within two years of the date of this approval or if work authorized by the approvals or
permits associated with the conditional zoning has not substantially commenced.
