THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Zoning Map of Zoning Area #9A is hereby amended by removing
the hereinafter described tract of land from the R-15 Residential District Classi-
fication and putting it in the B-1 Business District Classification, said land
being described as follows:
BEGINNING at an iron pipe in the southern right-of-way line of North 23rd
Street 50 feet from the centerline thereof, said iron pipe being south 63 degrees
26 minutes 30 seconds west 50 feet from a point in the centerline of North 23rd
Street, said point in the centerline being south 26 degrees 33 minutes 30 seconds
east 177.06 feet as measured along the centerline of North 23rd Street from the
intersection of the centerline of North 23rd Street and Castle Hayne Road; running
thence from said beginning along the southern right-of-way line of North 23rd
Street south 26 degrees 33 minutes 30 seconds east 532.72 feet to a point;
running thence north 75 degrees 25 minutes west 460.09 feet to a point in the
eastern right-of-way line of U.S. 117 or Castle Hayne Road; running thence with
the eastern right-of-way line of Castle Hayne Road and 50 feet from the centerline
thereof north 22 degrees 44 minutes east 388.99 feet to an iron pipe; running thence
along a 200 x 200 foot sight distance north 88 degrees 05 minutes 15 seconds east
56.78 feet to the point of BEGINNING, and containing 2.37 acres.
Section 2. The County Clerk is hereby authorized and directed under the
supervision of the County Commissioners to change the zoning map of Zoning Area
#9A on file in the office of the County Commissioners, so as to make it comply
with this ordinance.
Section 3. Any ordinance or any part of any ordinance in conflict with this
ordinance, to the extent of such conflict is hereby repealed.
Section 4. This ordinance is adopted in the interest of public health,
safety, morals and general welfare of the inhabitants of the County of New Hanover,
North Carolina, and shall be in full force and effect from and after its adoption.

ADOPTED JULY 1, 1972
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Zoning Map of Zoning Area #9A is hereby amended by removing
the hereinafter described tract of land from the present B-2 Business District
Classification and putting it in the I-1 Industrial District Classification, said
land being described as follows:
BEGINNING at the intersection of the northern right-of-way line of the New
Bern Branch of the Atlantic Coastline Railroad (now Seaboard Coastline Railroad)
with the dividing line between Lots 8 and 15 as shown on the "Map of Layouts"
for D. L. Gore (now known as Fisherville), said map being recorded in Book 67
at Page 101 of the New Hanover County Registry; running thence from said beginning
point and with the northern right-of-way line of said Seaboard Coastline Railroad,
north 66 degrees 59 minutes east 362.92 feet to an iron pipe; running thence
parallel to the dividing line between the aforementioned Lots 8 and 15, south
10 degrees 17 minutes east 356.15 feet, more or less, to an old iron pipe in the
northern right-of-way line of Market Street Road; running thence with the northern
right-of-way line of said Market Street Road and with a curve to the right to a
State Highway right-of-way monument at the end of said curve, said monument being
located south 78 degrees 52 minutes 30 seconds west 138.06 feet from the preceeding
old iron pipe as measured along the chord of said curve; continuing thence with the
northern right-of-way line of said Market Street Road south 80 degrees 11 minutes
30 seconds west 216.08 feet, more or less, to the dividing line between the afore-
mentioned Lots 8 and 15 of said Fisherville Subdivision; running thence with said
dividing line north 10 degrees 17 minutes west 276.25 feet, more or less, to the
point of BEGINNING.
Section 2. The County Clerk is hereby authorized and directed under the
supervision of the County Commissioners to change the zoning map of Zoning Area
#9A on file in the office of the County Commissioners, so as to make it comply
with this ordinance.
Section 3. Any ordinance or any part of any ordinance in conflict with this
ordinance, to the extent of such conflict, is hereby repealed.
Section 4. This ordinance is adopted in the interest of public health,
safety, morals and general welfare of the inhabitants of the County of New Hanover,

Section I. The Zoning Map of Zoning Area #9-A is hereby amended by removing
the hereinafter described tract of land from the present R-15 Single Family District
Classification and putting it in the B-2 Business District Classification, said land
being described as follows:
BEGINNING at a point in the southern right-of-way line of Gordon Road, said
beginning point being 161.6 feet east of the intersection of the southern right-
of-way line of the Gordon Road with the southeastern right-of-way line of the
Castle Hayne Road (U.S. Highway 117) as measured along the southern right-of-way
line of the Gordon Road. From said beginning point in an eastwardly direction
along and with the southern right-of-way line of Gordon Road 150 feet to a point;
thence in a southwardly direction and at right angles to the southern right-of-
way line of Gordon Road 225 feet to a point; thence in a westwardly direction and
parallel to the southern right-of-way line of Gordon Road 150 feet to a point;
thence in a northwardly direction and at right angles to the southern right-of-way
line of Gordon Road 225 feet to the point of BEGINNING. The above description

Section 1. The Zoning Map of Zoning Area No. 9A is hereby amended by removing the
hereinafter described tract from the R-15 Residential Zoning District Classification and placing it in
the O -I Office and Institution Zoning District Classification, said land being described as follows:
Beginning at a point at an existing iron pipe in the eastern right-of-way line of Racine
Drive; said point being 200 feet North of the northern right-of-way line of Oriole Drive;
running thence North 35 degrees 21 minutes East 200.31 feet to a point, thence South 53
degrees 35 minutes 23 seconds East 198.16 feet to a point, thence South 35 degrees 14
mintues 42 seconds West 200.32 feet to a point; thence North 53 degrees 35 minutes 23
seconds West 198.53 feet to the point of beginning.
Section 2. The County Clerk is hereby authorized and directed under the supervision of the
County Commissioners to change the Zoning Map of Zoning Area No. 9A on file in the office of the
County Commissioners, so as to make it comply with this ordinance.

and by ensuring that such commercial uses do not diminish the quality of life of
the existing residential communities.

Sections 55.3 and 52.1 of the County Zoning Ordinance WILL be satisfied if the property is
developed in accordance with the plans submitted to the County Commissioners and attached as
part of this approval. IT IS ORDERED that the application for the issuance of a CONDITIONAL

The County Commissioners for New Hanover County (the "County Commissioners"), having held
a public hearing on August 21, 2017 to consider application number Z17-09, submitted by Frank
Braxton of Coastal Land Design on behalf of the property owner, Corbett Package Co. (the
"Applicants"), to develop a community boating facility on 134.9 acres of land located at the 100
block of Brentwood Drive, and having heard all of the evidence and arguments presented at the
hearing, the County Commissioners conclude that the Applicants produced competent, material,
and substantial evidence tending to establish the existence of the facts and conditions which
Section 70 of the County Zoning Ordinance requires for the issuance of a special use permit, and
from the evidence adduced at the hearing, the Commissioners make the following FINDINGS OF
FACT and draw the following CONCLUSIONS:
The County Commissioners FIND AS A FACT that all of the specific requirements set forth in
Section 70-7(1-4) of the County Zoning Ordinance WILL be satisfied if the property is
developed in accordance with the plans and findings submitted to the County Commissioners
and attached as Exhibit A and incorporated into this special use permit:
(A) The use will not materially endanger the public health or safety if located where
proposed and approved;
(B) The use meets all required conditions and specifications;
(C) The use will not substantially injure the value of adjoining or abutting property, or that
the use is a public necessity; and
(D) The location and character of the use if developed according to the plan as submitted and
approved will be in harmony with the area in which it is to be located and in general
conformity with the plan of development for New Hanover County.
Therefore, because the County Commissioners conclude that all of the general and specific
conditions precedent to the issuance of a SPECIAL USE PERMIT HAVE been satisfied, IT IS
ORDERED that the application for the issuance of a SPECIAL USE PERMIT BE GRANTED subject
to the following conditions:
A. That the applicant shall fully comply with all of the specific requirements stated in Section
70, 71, & 72 of the Ordinance for the proposed use, as well as the proposed and approved
site plan, and all other state or federal requirements.
B. In accordance with Section 71-1(1) of the ordinance, the permit shall become null and
void if construction or occupancy has not commenced within 24 months of the date of
this approval.

or abutting property or that the use is a public necessity.
A. The surrounding land uses predominately include undeveloped land and industrial uses.
B. No evidence has been submitted that this project will decrease the property values of
adjacent or nearby properties.
Finding 4: The Board must find that the location and character of the use if developed according
to the plan as submitted and approved will be in harmony with the area in which it is to be
located and in general conformity with the plan of development for New Hanover County.
A. The 2016 Comprehensive Plan classifies the area proposed for the community boating
facility as Conservation, and the proposal aligns with the intent of the Conservation land
use classification because it provides for low -impact recreation. Additionally, the proposal
supports other policies of the 2016 Comprehensive Plan, including preserving
environmentally critical areas and protecting water quality.

THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The New Hanover County Zoning Map is hereby amended by removing the hereinafter
described tract from R-15, Residential District, and placing it in R-5, Residential Moderate-High
Density District, said land consisting of approximately 0.55 acres and being described legally as
follows:
Beginning at a point in the western boundary of Lennon Drive, a 60' public right-
of-way; said point being located North 09°57'0 West, 230.00 feet, and thence
South 80°03' West, 30.00 feet from the intersection of the Lennon Drive
centerline with the centerline of Ringo Drive, a 60' public right-of-way; and
running thence from the point of beginning:
South 80°03'00"West, 240.00 feet to a point;thence
North 09°57'00"West, 100.00 feet to a point;thence
