THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:

1 Section 1. The Zoning Map of Zoning Area #9 -B is hereby amended by removing

1 the hereinafter described tract of land from the I -2 Industrial District classi-
fication and putting it in the R -15 Residential District classification, said land
i
1 being described as follows:
BEING all of that area of the J. D. McCarley III farm tract bounded by the
1 City One Mile Zoning Limit on the south, the boundary line of the McCarley land
x
on the north, and Fork Branch on the east forming a triangular area. This area
is all of that area of the proposed Echo Farms Development Lands which may lie
within the present City of Wilmington zoning jurisdiction which is currently
I zoned M -2.
Section 2. The County Clerk is hereby authorized and directed under the
1 supervision of the County Commissioners to change the zoning map of Zoning Area

No. 9 -B on file in the office of the County Commissioners, so as to make it comply
1
with this ordinance.
Section 3. Any ordinance or any part of any ordinance in conflict with this
1 ordinance, to the extent of such conflict is hereby repealed.

Section 4. This ordinance is adopted in the interest of public health,
safety, morals and general welfare of the inhabitants of the County of New
i
1 Hanover, North Carolina, and shall be in full force and effect from and after
its adoption.

AN ORDINANCE OF THE COUNTY OF NEW HANOVER i
AMENDING THE ZONING MAP OF ZONING AREA #9 -B }
OF NEW HANOVER COUNTY, NORTH CAROLINA
ADOPTED JUNE 19, 1972
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:

Section 1. The Zoning Map of Zoning Area #9 -B is hereby amended by removing
the hereinafter described tract of land from the R -15 Residential District classi-
fication and putting it in the B -2 Business District classification, said land
being described as follows:

BEGINNING at an iron pipe in the southern line of U.S. Highway 74 (Oleander
Drive), said iron pipe being 30 feet at right angles from the centerline of said
highway and near the east end of a curve in said road, and in the eastern line
of a 9.3 acre tract of land formerly owned by R. B. Webb, which he purchased from I
G. A. Lumsden, and runs with the southern line of said highway north 88 degrees
40 minutes east 520 feet to an iron stake in the southern line of said highway
s 30 feet from the center thereof measured at right angles; thence runs south
1 33 degrees 03 minutes west 1100 feet to an iron pipe inthe southern line of the
G. A. Lumsden tract of which this description covers a part, and runs with the
I said line north 67 degrees 05 minutes west 427 feet to an iron pipe, the southeast
corner of a 9.3 acre tract of land formerly owned by R. B. Webb; and runs with
the eastern line of said Webb tract north 33 degrees 03 minutes east 880 feet to
a the point of BEGINNING. Containing 10 acres more or less.

supervision of the County Commissioners to change the zoning map of Zoning Area

ordinance, to the extent of such conflict, is hereby repealed.

Section 1. The Zoning Map of Zoning Area #9 -B is hereby amended by removing

land being described as follows:
BEGINNING at a point in the southern right -of -way of Oleander Drive (U.S.
Highway 76), said point being located 571.23 feet west of the intersection of
the western right -of -way line of Dogwood Lane with the southern right -of -way
of Oleander Drive as measured along the southern right -of -way line of Oleander
I Drive; thence from said beginning point south 66 ° -30' east 237.95 feet to a
point; thence south 30 -42' west 413.7 feet to a pipe; thence north 66 -30'
west 287 feet to a point; thence north 30 -42' east 267.71 feet to a point in
g the southern right -of -way line of Oleander Drive; thence in an eastwardly
direction along and with the southern right -of -way line of Oleander Drive
I 53.5 feet to the point of BEGINNING. The same being Lot #2 according to the
map or plat of the division of the lands of Mrs. A. F. Larson, as made by
E J. L. Becton, C.E., and recorded in Deed Book No. 200 at Page 477 in the Office

THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Zoning Map of Zoning Area #is hereby amended by removing
the hereinafter described tract of land from the R -15 Residential District Classi-
fication and putting it in the 0 & I Office and Institutional District Classification,
said land being described as follows:
BEGINNING at a concrete monument in the northern right -of -way line of
Wrightsville Avenue, said concrete monument being the southeast corner of
lot 1, Section 1 of Piney Acres as recorde in Book 489 at Page 671. From
said beginning point, North 17 ° -44' east 69r. 90 feet to a concrete monument;
thence South 79 east 400.17 feet to a concrete monument; thence south
17 west 628.62 feet to the northwestern corner of lot 34, Block B of
Piney Acres as recorded in Map Book 5 at Page 93; thence south 79 east
83.3 feet to the northeast corner of said lot 34; thence south 10 west
along the eastern lot line of said lot 34, 170.0 feet to a point in the
northern right -of -way line of Wrightsville Avenue; thence north 79 west
505.17 feet to the point of BEGINNING.

BEGINNING 200 feet south on Forest Park Road from a point where the southern
line of Oleander Drive (U.S. Highway 76, 100 feet in width) is intersected by the

Section 1. The Zoning Map of Zoning Area #9 -B is hereby amended by removing
the hereinafter described tract of land from the present R -15 Residential District
Classification and putting it in the 0 &I Office and Institutional District Classi-
fication, said land being described as follows:
BEGINNING at the intersection of the northern line of Wrightsville Avenue
with the northern extension of Wallace Avenue as shown on the map of the division
of the W.W. All tract by M.H. Lander, C.E., and dated June 3, 1941; running
thence from said beginning point and with the northern line of said Wrightsville
Avenue south 79 degrees 20 minutes east 367.8 feet, more or less, to the south-
eastern corner of a 1.26 acre tract of land conveyed to R.B. King, et ux, and t
recorded in Book 295 at Page 207 of the New Hanover County Registry; running
thence with the eastern line of said King tract of land and parallel to the north-

THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Zoning Map of Zoning Area #9 -B is hereby amended by

removing the hereinafter described tract of land from the present R -15 1
Single Family District Classification and putting it in the 0 & I Office a
and Institutional District Classification, said land being described as

follows:

BEGINNING at a point in southern right -of -way line of Wrightsville
Avenue, said point being 350 feet eastwardly as measured along southern 1
right -of -way line of Wrightsville Avenue from its intersection with the
eastern right -of -way line of Wallace Avenue, the same being the north-
IL; western corner of Lot 8 in Block E of Winter Park Heights Subdivision
as the same is shown on map recorded in Book 56 at Page 688 in the New E
Hanover County Registry. Running thence eastwardly along and with the
southern right -of -way line of Wrightsville Avenue, south 79 degrees 30
minutes east 350 feet, to the northeastern corner of Lot 14 in said
block; thence south 10 degrees 30 minutes west 230 feet to southeastern t
corner of Lot 34, said point also being in the northern right -of -way line

with this ordinance, to the extent of such conflict, is hereby repealed. 1

THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Zoning Map of Zoning Area 9 -B is hereby amended by removing
the hereinafter described tract of land from the R -15 Residential Zoning Dis-
trict Classification and placing it in the B -1 Light Commercial Zoning District
Classification, said land being described as follows:
Beginning at a point 200 feet south of the southern right -of -way line of
Shipyard Boulevard, said point being in the centerline of the old
Federal Point Road, a common boundary between Cameron and Newkirk
lands, and being on the existing City limits line; running thence
southeastwardly along said Cameron /Newkirk line about 200 feet to
a point;thence west (parallel with Shipyard Boulevard) 80 degrees,
13 minutes south 620 feet to a point, said point being at the exist-
C ' , ing northeast corner of Francis Marion Drive; thence continuing north
9 degrees 47 minutes west 200 feet to a point, said point being 200
feet south of the southern right -of -way line of Shipyard Boulevard;
thence east 80 degrees 13 minutes north about 570 feet to the point
of BEGINNING, and containing 2.7 acres, more or less. This being
the same land as shown on New Hanover County Tax Map 65, Masonboro
Township; Block 03, Parcel 01 (part).
Section 2. The County Clerk is hereby authorized and directed under the
supervision of the County Commissioners to change the Zoning Map of Zoning
Area 6 on file in the office of the County Commissioners, so as to make it
comply with this ordinance.
Section 3. Any ordinance or any part of any ordinance in conflict with
this ordinance, to the extent of such conflict, is hereby repealed.
Section 4. This ordinance is adopted in the interest of public health,
safety, morals and general welfare of the inhabitants of the County of New
Hanover, North Carolina, and shall be in full force and effect from and after

Beginning at a point in the southern line of the right -of -way of
U.S. Highway 76 (Oleander Drive) where the same is intersected by
the eastern line of Herbert G. Saunders land, the said Herbert G.
Saunders line being the dividing line between the Herbert G. Saun-
ders land and the land of the Surburban Land Company; running
thence southwestwardly with and along the said Herbert G. Saunders
line 270 feet to a point; thence south 60 degrees east 160 feet to
a point; thence northeastwardly and parallel to the above mentioned
Herbert G. Saunders line 370 feet to the southern line of the right -
of -way of U.S. Highway 76 (Oleander Drive); thence west 88 degrees
5 minutes south with and along said southern line of the right -of-
way of U.S. Highway 76 (Oleander Drive) 200 feet to the point of
BEGINNING and containing 1 acre, more or less. This being the same

II; Section I. The Zoning Map of Zoning Area 9B is hereby amended by removing
the hereinafter described tract from the B-2 Business Zoning District
Classification and R-I5 Residential Zoning District Classification and placing
it in the B-2 Business Zoning District Classification, said land being described
as follows:
BEGINNING at an iron pipe in the northern line of State Highway
leading from Wilmington to Wrightsville Beach (US 74 & 76) said
beginning point being about one mile east of where the Masonboro
Loop Road crosses said highway east of Winter Park Gardens; said

THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Zoning Map of Zoning Area No. 9B is hereby
amended by removing the hereinafter described tract from the R -15
Residential Zoning District Classification and placing it in the
B -2 Highway Business Zoning District Classification, said land
being described as follows:
Portions of five (5) parcels on the southeast side of US 17
(Market Street); said parcels being identified as 001, 002,
003, 005, 006, Block 005, Tax Map 50 -09 on the New Hanover
County Tax Maps.
Section 2. The County Clerk is hereby authorized and

THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Zoning Maps of Zoning Areas No 6 and 9B are
hereby amended as follows:
Tract 1: The hereinafter described tract shall be rezoned
to CD(B -2) Conditional Use District, Highway Business from
SC Shopping Center District for a "Home Improvement Shopping
Center."
Beginning at a point, said point being at the southwest
corner of the terminus of Verbenia Drive; running thence in
a northwesterly direction along the northern boundary of

THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH
ORDAIN:
Section 1. The Zoning Map of Zoning Area 9B is hereby
amended by removing the hereinafter described tract from the R -15
Zoning District Classification and placing it in the B -2 Zoning
District Classification, said land being described as follows:
Beginning at an old iron pipe in the northern line of the
S.C.L.R.R. right -of -way (New Bern Branch, 125 feet in width)
that is north 67 degrees 00 minutes east along said right -
of -way line 90.34 feet from its intersection with the
dividing line between tracts 17 and 18 as shown on the map
of Fisherville recorded in Book 67 at page 101 of the New
Hanover County Registry; said pipe being the southwestern
corner of that portion of the tract lying north of said
right -of -way as conveyed to Hanover Used Auto Parts, Inc. by
deed recorded in Book 751 at Page 157 of said registry;

AN ORDINANCE OF THE COUNTY OF NEW HANOVER
AMENDING THE ZONING MAP OF ZONING AREA NO. 9B
OF NEW HANOVER COUNTY, NORTH CAROLINA
ADOPTED July 1, 1972
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Zoning Map of Zoning Area No. 9B is hereby amended by removing the
hereinafter described tract from the R -15 Residential Zoning District Classification and placing it
in the O -I Office and Institution Zoning District Classification, said land being described as follows:
Beginning at a point in the southern right -of -way line of Wrightsville Avenue, said point also
being the Northeast corner of the property owned by ACGS Associates as noted in Deed
Book 2296, page 697; running thence along the right -of -way of Wrightsville Avenue, North
68 degrees 47 minutes 01 seconds East a chord distance of 169.60 feet to a point in the right-
of-way and the Northwest corner of the Brown property as noted in Deed Book 1445 page
659; thence Southwest 468± feet along the western line of the Brown property to a point in
the northern right -of -way line of Park Avenue; said point also being the Southwest corner
of the Brown property; thence Northwest along the right -of -way of Park Avenue, a chord
distance of 56.48 feet to a point in the Southeast corner of the Larry Ray property, Deed
Book 1121, page 116; thence North 04 degrees 35 minutes 00 seconds East 390.99 feet to
the point of beginning.
Section 2. The County Clerk is hereby authorized and directed under the supervision of the
County Commissioners to change the Zoning Map of Zoning Area No. 9B on file in the office of the
County Commissioners, so as to make it comply with this ordinance.
Section 3. Any ordinance or any part of any ordinance in conflict with this ordinance, to the
extent of such conflict, is hereby repealed.
Section 4. This ordinance is adopted in the interest of public health, safety, morals and
general welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in
full force and effect from and after its adoption.

at the Southwest corner of Charter Drive and Eastwood Road (formerly Old Telephone
Road); also a 28 foot strip of land located West of and contiguous with lots 40 through 49
of said subdivision running approximately 430± feet from First Avenue North up to the
existing B -2 District.
Section 2. The County Clerk is hereby authorized and directed under the supervision of the
County Commissioners to change the Zoning Map of Zoning Area 9B on file in the office of the
County Commissioners, so as to make it comply with this ordinance.
Section 3. Any ordinance or any part of any ordinance in conflict with this ordinance, to the
extent of such conflict, is hereby repealed.
Section 4. This ordinance is adopted in the interest of public health, safety, morals and
general welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in
full force and effect from and after its adoption.

Section 2. The County Clerk is hereby authorized and directed under the supervision of the
County Commissioners to Change the Zoning Map Areas No. 4, Masonboro, and Area No.
( 9B on file in the office of the County Commissioners, so as to make it comply with this
ordinance.

Section 3. Any ordinance or any part of any ordinance in conflict with this ordinance, to the
extent of such conflict, is hereby repealed.
Section 4. This ordinance is adopted in the interest of public health, safety, morals and
general welfare of the inhabitants of the County of New Hanover, North Carolina, and shall
be in full force and effect from and after its adoption.
Section 5. The County Commissioners find, in accordance with the provisions of NCGS
153A -341, that this zoning map amendment of 4.62 acres from R -15 Residential district and
24 acres CD(B -1) conditional district to total 17.58 acres CD(B -1) and 11.77 acres CD(B-
2)is:
A. Consistent with the purposes and intent of the transition land classification and
associated policies in the 2006 land use plan.
B. Reasonable and in the public interest to allow a movie theater and a limited range
of B -1 uses as noted on site plan for the companion special use permit.
