Dear Sam:
As we have discussed I am presenting to you this request for a waiver on several
items as outlined in your October 12th
email. Listed below are the waiver requests
and our justifications.
Road inter-connectivity – The proposed subdivision is bordered by an existing trailer
park on the north side and on the west side by Sentry Oaks subdivision. There are no
easements on either of these two tracts where a potential stub-out road can be
made. The property to the south of this lot contains substantial wetlands and
development of this property is highly unlikely. There are also wetlands on the
property which are adjacent to the property to the south and would preclude any
road stub connecting the properties. We are requesting a waiver for the road inter-
connectivity for this project.
Cul-de-sac length (1,200’) – The proposed layout of the property includes a +/- 1200’
cul-de-sac. Per County regulations cul-de-sac lengths should be limited to 500’. This
layout was dictated by the geometry of the property. The only way to develop this
property with the needed density is to run a road up the center of the narrow tract
and provide lots on either side of the road. We are requesting a waiver for the cul-
de-sac length.

Private Pavement Width per county regulations for private streets, New Hanover
County requires an asphalt pavement width of 24’. This design proposes an asphalt
pavement width of 22’ but it includes a 2’ valley curb (Type “H”) on either side of
the road. This type of curb is “mountable” with vehicles thus rendering the width of
the road to be a total of 26’. We are requesting a waiver for two feet of asphalt
width. The proposed design has been accepted by NCDOT on other projects.
