Adjourn 1 MEETING MINUTES ZONING BOARD OF ADJUSTMENT-DRAFT The New Hanover County Zoning Board of Adjustment held a regular and duly advertised meeting at 5:30 P.M. at the New Hanover County Government Center Complex, 230 Government Center Drive, in the Lucie Harrell Conference Room, Wilmington, NC, on Tuesday, December 10, 2019. Members Present Members Absent Hank Adams, Vice Chairman Raymond Bray, Chairman Mark Nabell Cameron Moore Pete DeVita Kristin Freeman Michael Keenan, Sr. Richard Kern Ex Officio Members Present Ken Vafier - Executive Secretary Kemp Burpeau – Deputy County Attorney Denise Brown - Clerk The meeting was called to order at 5:30 P.M. by the Vice-Chairman, Mr. Hank Adams. Vice-Chairman Adams explained that the Zoning Board is a quasi-judicial board appointed by the Board of Commissioners to consider zoning ordinance variances from residents in New Hanover County where special conditions would create unnecessary hardships. He said the Board also hears appeals of the County’s interpretation and enforcement of the Zoning Ordinance. The appellants have thirty days in which to appeal any decision made by the Board to Superior Court. FIRST ORDER OF BUSINESS: The minutes from the November 12, 2019 meeting were reviewed and unanimously approved by the Board as submitted. ELECTION OF CHAIRMAN AND VICE-CHAIRMAN FOR 2020 Mr. Adams opened the floor to receive nominations for Chairman of the Zoning Board of Adjustment for the 2020 calendar year. Mr. Hank Adams nominated Mr. Cameron Moore as Chairman of the Board of Adjustment. With there being no further nominations the members proceeded to vote. Mr. Pete DeVita second the motion. The Board voted unanimously to elect Mr. Cameron Moore as the Chairman of the Board. Mr. Adams opened the floor to receive nominations for Vice-Chairman of the Zoning Board of Adjustment for the 2020 calendar year. Mr. Pete DeVita nominated Mr. Mark Nabell as Vice-Chairman of the Board of Adjustment. With there being no further nominations the members proceeded to vote. 2 Mr. Michael Keenan, Sr., second the motion. The Board voted unanimously to elect Mr. Mark Nabell as Vice- Chairman to the Board. The Board voted unanimously to elect Mr. Mark Nabell as the Vice-Chairman of the Board. ZONING BOARD OF ADJUSTMENT 2020 CALENDAR ADOPTION Mr. DeVita motioned to approve the 2020 calendar. Mr. Adams second the motion. The 2020 calendar was unanimously approved and adopted by the Board members. CASE ZBA-947 The Vice-Chairman then swore in County staff Mr. Ken Vafier. Myron Smith, Jr., Thomas Oliver, and Marybeth Lengyel, applicants, are requesting a variance to access standards per Section 61.2-1 of the Zoning Ordinance. The properties are located at 4245 and 4285 Buck Drive. The parcels have a zoning classification of R-15, Residential District. Mr. Vafier stated the applicants are owners of two of twelve lots with access to Buck Drive, which is an unimproved, dedicated right-of-way with direct access to Sidbury Road. Mr. Smith and Mr. Oliver are owners of 4245 Buck Drive (Parcel 1), which is 7.32-acre parcel, while Ms. Lengyel is the owner of 4285 Buck Drive (Parcel 2,) a 1.08-acre parcel directly to the north of the first parcel. Mr. Vafier stated Buck Drive is contained with a 60 ft. right-of-way north to a three-way intersection. The road is currently improved with a 26 ft wide sand-gravel surface from Sidbury north to the three-way intersection. The western portion adjoins a private driveway while the eastern portion of the right-of-way road is unimproved. Mr. Vafier stated guidelines in Section 61.2 of the New Hanover County Zoning Ordinance require that any new structure constructed or moved shall be on a lot adjacent to a road or to a right-of-way or easement which was platted and recorded prior to 1969. The ordinance refers to three subject definition allowances. Mr. Vafier stated subsection 3 of Section 61.2 pertains to the variance request as building lots must have access over a private driveway or easement at least thirty (30) feet in width (5/1/89) to a road as defined in Section 23- 86, provided the driveway or easement is an easement appurtenant to serve three (3) or fewer lots and the easement is solely owned by a lot owner or in common by three (3) or fewer lot owners. Mr. Vafier stated Buck Drive has twelve (12) properties with direct access to Buck Drive. Some properties have access to Sidbury Road or other adjacent roadways. The ordinance states the road must meet all state and local specifications and all road requirements are to be duly platted and recorded. In the past, staff has determined that Buck Drive does not meet the definition of a road due to not meeting the minimum requirement as a subdivision road specified by NC DOT and New Hanover County. Mr. Vafier stated if three or more structures are to be served, staff has interpreted that the means of ingress egress has to be improved to the minimum road standard. During the 1990’s, several lots having access to Buck Drive were divided and conveyed via metes and bounds description outside of the county’s approval process. Improving Buck Drive at that time did not occur. Due to the 3 fact that there are more than three (3) lot at the site on an unapproved road, additional building permits cannot be issued. A notice of non-compliance was filed in the New Hanover County Register of Deeds in 1995 stating building permits would be withheld on certain lots accessing Buck Drive until the necessary road improvements were completed. Mr. DeVita inquired which lots remained at the subject site in restriction. Over the years, due to the non-compliance order, applicants seeking building permits for Buck Drive worked with staff in researching the specific parcels and allowed permits to be issued if it was determined that the lot in question was not subject to the restriction placed in 1995 by the county. Per the Zoning Ordinance, Buck Drive is limited from additional structures until the road is approved to private road standards or relief via a variance be provided. The applicants present today are seeking a variance to improve the condition of Buck Drive to the lots. In addition, the variance request is to exceed the 3-lot limitation on lots being served by a private driveway or access easement by an amount not to exceed 5 additional lots. The current requirement for a local subdivision road includes a 45’ right-of-way, 24ft travel surface, and a sidewalk on one side of the street. In addition, all NCDOT local road standards must be met, which consist of base course and pavement surface specifications. The applicant is proposing to meet all requirements with the exception of the sidewalk and pavement specifications. The applicant proposes to resurface and improve condition to the road. The applicant is seeking a variance with the proposed improvement to Buck Drive to have no more than five (5) additional lots to be served by private driveway or easement, as well as to the requirement to serve the proposed lots by a means of access that would not meet the minimum county private road standards. A maintenance agreement is proposed by the applicant to present to residents. Mr. DeVita inquired how many lot owners are on the opposite side of the street. Mr. Vafier stated each property would need to request relief based on case situation. Mr. Keenan asked when was Section 61.2-1 established in the ordinance. Mr. Vafier stated Section 61.2-1 was added to the county’s ordinance in 1981. Mr. Matthew Nichols, PLLC- Mr. Nichols presents representing Mr. Myron Smith, Jr., Thomas Oliver and Marybeth Lengyel who are seeking a variance from the sidewalk requirements in the county’s ordinance. Mr. Oliver and Mr. Smith purchased their larger tract in 2018. Mr. Nichols stated there are quite a few structures on Buck Drive, however the road is not considered an NC DOT maintained road. Mr. Nichols stated per county records, there were discussions regarding road conditions to Buck Drive, and members of the community have stated the road was used as easement for the past 50 years. Previously in the early 1980’s Mr. Buck subdivided the land without securing county approval and did not dedicate the right-of- way or make improvements to bring Buck Drive to NCDOT road standards. 4 The applicants propose to improve Buck Drive road conditions to enhance safety for all motorists. Buck Drive is a 60 ft right-of-way and the applicants propose a 26 ft wide travel surface to be improved. Mr. Nichols stated the applicants are proposing improvement of 1500 ft. from Sidbury Road to the T-junction. Plans detailing the improvements were prepared by Mike Nichols at Paramount Engineering and were provided in the application packet for the variance. Mr. Nichols stated they are seeking a variance to not install the sidewalks as it will increase impervious surface to the area. Pavement specifications meet the required 26 ft wide travel surface and sight line radii. They applicants are proposing a compacted surface that would satisfy the safety and county standards. Mr. Nichols stated there have been a series of historical transactions relating to Buck Drive, which has existed as an easement for 50 years. Per county records, Mr. Buck did not secure adequate permits in sub diving lots on Buck Drive. All the applicants are in agreement to bear the coast to improve Buck Drive for all to access A maintenance agreement would be submitted to the satisfaction of the county attorney; the applicant is in agreement to maintain what will be installed. Currently, the applicants cannot construct a structure on their property as constructing a road to NCDOT standards is cost prohibitive. Buck Drive is wide and is being utilized currently and there have been no traffic issues. The road is currently providing access to more than three structures. Mr. Nichols stated this is a unique situation and the applicants present with a hardship to build on the lots they own, and that road improvement they propose will be a benefit to all. The road improvement proposal offers a solution and provides harmony to all residents. There has been no opposition to the applicants’ proposal to Buck Drive. Mr. Nichols stated the situation was not created by the applicants. Mr. Tom Oliver relayed he purchased a lot on Buck Drive a few years ago the title search and perk test came back positive. He purchased the lot aware of the residential district regulations, however was not aware of history relating to the road. He purchased the seven acres which included a house on Sidbury Road for four hundred thousand dollars. Mr. DeVita inquired was the applicant aware of ordinance requirements prior to purchase. Mr. Keenan asked how much would the road improvements cost, and of the price to purchase the lot. Mr. Paul Lengyel is a resident stated he and his sister relocated and purchased the property in 2018. They are seeking relief in the variance to construct their forever home on their property. Mr. Robert Ransom is a resident and constructed his home on Buck Drive in 1981. He has maintained the road to keep it usable for all motorists. He welcomes the improvements and has no oppositions to the applicants’ variance request. The Vice-Chairman informed all four members must agree for the variance to be approved. Mr. Nichols stated the applicants’ traveled from out of state and request to move forward with the hearing. 5 Mr. Mike Nichols, Paramount Engineering stated the composites used would be compacted on the road with 4 inches of gravel to cover and clarified that the road would not be an asphalt road. Road maintenance should keep the road in good standards. Mr. Kemp Burpeau, County Attorney gave history that he put the notice of non-compliance to Buck Drive in 1995 on behalf of county legal department. Mr. Kemp stated he does not view this case as presenting a precedent to other private roads as to this is a unique situation. The applicants’ proposal to enhance road conditions would satisfy the notice of compliance. Mr. Kemp stated to his knowledge this is the only subdivision that created an illegal subdivision and once the county was informed, a notice was placed in the Register of Deeds. He stated over the years, the county has tried to incrementally improve the situation as property owners have come to the county for building permit approval. Mr. Burpeau stated that there are other roads that are subject to the Buck Drive parcel that may or may not require a variance. Any residents that are present would require agree to the maintenance agreement to Buck Drive. Mr. Kemp stated other property owners may require a variance depending on location of lot and if road conditions are required for their parcel. Mr. Vafier stated potential additional lots beyond what are included in the applicants’ proposal are not subject to the variance at this time; the current applicant is requesting variance to only what is presented to be approved in today’s presentation. Any potential future lots of this subdivision will be required to adhere to zoning provisions at that time. The Vice-Chairman then closed the public hearing. BOARD DELIBERATION. Mr. DeVita stated he has traveled down Buck Drive and it is visible to see the road requires improvements. He stated a variance would benefit all the residents in enhanced road conditions. Mr. DeVita stated he is in favor of approving the variance with a modification that states that all residents that own parcels adjacent to the improved portion of the road on Buck Drive be included as well. Mr. DeVita stated the request is solely for road improvements to the end of the T-turn around. Vice-Chairman stated if the variance is approved conditions should apply as included in the applicants’ packet. Mr. Keenan made a motion to accept the applicants, testimony to approve the variance to include the five lots on two parcels solely. Mr. Nabell second the motion to approve the variance. All ayes to approve the variance. Deputy County Attorney, Kemp Burpeau mentioned that the Board’s approval of the variance is incorporated with the finding of facts requirements. The Board cited the following conclusions and findings of fact: 6 1. It is the Board’s conclusion that, if the applicant complies with the literal terms of the ordinance, specifically the structures to have access requirements in Section 61.2-1 of the New Hanover County Zoning Ordinance, that an unnecessary hardship would result. This conclusion is based on the following FINDINGS OF FACT:  Per County regulations, the applicants are currently unable to construct a residence on property until the appropriate improvements are made.  There is a prohibitive cost to the applicant of improving road to all County/NCDOT standards.  Buck Drive is an accessible, wide, and usable road.  Buck Drive already provides access to more than 3 structures.  The applicants are willing to make substantial improvements to Buck Drive to enhance emergency access along entirety of Buck Drive to the T-junction. 2. It is the Board’s conclusion that the hardship of which the applicant complains results from unique circumstances related to the subject property, such as location, size, or topography. This conclusion is based on the following FINDINGS OF FACT:  There is a unique situation and hardship resulting from complicated and unique history of development along Buck Drive.  The subject property is situated along Buck Drive, and there have been historical issues with Buck Drive, but other parcels currently accessing Buck Drive, thus there are inconsistencies in the status of parcels and permits along Buck Drive. 3. It is the Board’s conclusion that the hardship did not result from actions taken by the applicant or the property owner. This conclusion is based on the following FINDINGS OF FACT:  The applicant did not create or have any involvement with history of Buck Drive dispute.  Site conditions are not indicative of outstanding issues (street sign, wide, accessible road, other residences/structures have driveways).  The applicants are willing to significantly improve Buck Drive to a much better standard than currently exists.  The proposed improvements to Buck Drive benefit all residents along Buck Drive and improve and enhance County emergency access. 4. It is the Board’s conclusion that, if granted, the variance will be consistent with the spirit, purpose, and intent of the ordinance, such that public safety is secured, and substantial justice is achieved. This conclusion is based on the following FINDINGS OF FACT:  Buck Drive is a wide and usable drive already providing access to more than 3 structures.  The applicants are willing to make significant improvements to Buck Drive. 7  The applicant’s proposal to limit density on subject property protects the character of Buck Drive.  The applicants will provide an agreement to maintain the proposed improvements.  Improvement of Buck Drive provides improved emergency access that benefits other property owners and enhances public safety.  The applicant’s request offers a needed situation, remedy and path forward from longstanding issues with Buck Drive. The variance is also subject to the following conditions as proposed by the applicant and modified by the Board: 1. Improvement of existing Buck Drive approximately 1,500 feet in length, 26-feet in width, from Sidbury Road to and including the northerly lane at the T-junction of Buck Drive as shown on the Variance Exhibit attached hereto as Exhibit A-2, including 4” ABC Stone or other non- compacted parking surface, geosynthetic soil stabilizer fabric, and compacted subgrade as shown on the Gravel Driveway Section of Exhibit A-2, or to a standard otherwise acceptable to the New Hanover County Fire Marshal. 2. Limiting the density of the subject property to a maximum total of five (5) lots and single-family residences, including any permitted accessory structures allowed under the County ordinances. 3. Maintenance Agreement for improved section of Buck Drive. 4. The variance shall apply to all lots with direct access to the improved portion of Buck Drive. 5. This variance is applicable to all parcels having direct access and frontage on the portions of Buck Drive propose to be improved. REQUEST: Variance to allow an increase in height of an existing telecommunications tower from 147’ to 162’ per Section 63.5-1(G)(1) of the New Hanover County Zoning Ordinance. LOCATION: 1219 Middle Sound Loop Road PID: R04400-003-030-000 ZONING: R-20, Residential District ACREAGE: 2.97 Acres BACKGROUND AND ORDINANCE CONSIDERATIONS: In December 2005, the Board of Commissioners approved a special use permit for a 130’ telecommunications tower on the subject property, which is located in an R-20 district in the northeastern portion of the county. American Tower Corporation leases a 2,500 square foot area on the 2.97-acre parcel, owned by the Peterson’ on which the tower and its associated equipment compound are located. The initial approval for the tower limited the height to 130’ and was conditioned to require that all antennas on the tower were flush mounted and light gray in color. In October 2015, an extension of the tower’s height to 147’ was granted administratively by the Planning Department. The zoning ordinance allows for administrative increases in height to a lawfully constructed tower if the proposed increase does not exceed 15% of the originally constructed tower height: Section 63.5-1: Telecommunication Facilities, Cellular and Related Towers (G) Any tower and associated equipment which was lawfully constructed under the terms of the Ordinance, which is now considered a nonconforming improvement, may continue or be reconstructed as a conforming improvement even through the tower and associated equipment may not conform with the provisions of this Ordinance for the district in which it is located. Towers and associated equipment may only be enlarged and/or relocated if the enlarged or relocated tower eliminates the need for an additional tower, provides additional collocation opportunities on the tower, or provides additional antenna space on the tower; and provided further that the enlargement and/or relocation shall be in conformance with the following regulations and design limitations: 1. Tower height may not be increased by more than 15% of the originally constructed tower height. Increases in height greater than 15% will require a variance from the Board of Adjustment. Although the tower was initially approved not to exceed 130’, it was constructed at a height of 125’. Thus, the administrative extension in 2015 appears to have been granted on the basis that the increase in height from 130’ to 147’ as approved in the Special Use Permit did not exceed 15% of the originally approved tower height. The existing tower is a monopole style tower which supports 4 carriers and a total of 18 exterior mounted antennas. The tower and equipment compound are located in the northern rear portion of the subject property, approximately 340’ from the nearest residential structure to the southwest, and approximately 230’ to the nearest residential structure to the east. When the tower was initially approved in 2005, it met the minimum setback requirement at the time, which required the tower to be setback a distance equal to its height from any residential dwelling unit. In 2010, a Zoning Ordinance text amendment was approved by the Board of Commissioners which revised the telecommunications tower requirements. As part of this amendment, the setback requirement was amended to require that a tower be setback a distance equal to its height from any residential property line or residential zoning district boundary. Currently, the tower is approximately 65’ to the nearest residential property line, making the setback a legal non-conformity. The current tower and associated equipment compound is in compliance with all other ordinance requirements. Due to the need to increase wireless communications coverage in this area of the county, the applicant is proposing to relocate the AT&T antennas to a height of 158’, with the total tower height proposed to reach 162’. In addition to the improved coverage, this will also allow for the potential to host an additional carrier or for one of the existing carriers to move their equipment higher on the tower. New telecommunications towers are permitted by-right in the I-1 and I-2 districts, and via special use permit in all other districts, subject to all requirements in Section 63.5-1 which generally address setbacks, aesthetic appearance, landscaping, signage, and justification for the need for a new tower. The Board of Adjustment is authorized specifically within subsection 63.5-1(G)(1) to grant a variance for a height increase that exceeds 15% of the originally constructed tower’s height, subject to finding that the 4 conclusions granted to the Board in their power and duty are affirmative. As the proposed height extension exceeds 15% of the original constructed tower height of 125’, the applicant is requesting a variance from the Board of Adjustment per the applicable language in Section 63.5-1(G)(1). BOARD OF ADJUSTMENT POWER AND DUTY: The Board of Adjustment has the authority to authorize variances from the terms of the Zoning Ordinance where, due to special conditions, a literal enforcement of the regulations would result in unnecessary hardship. In granting any variance, the Board may prescribe appropriate conditions and safeguards in conformity with the Zoning Ordinance. A concurring vote of four-fifths (4/5) of the voting members of the Board shall be necessary to grant a variance. A variance shall not be granted by the Board unless and until the following findings are made: 1. Unnecessary hardship would result from the strict application of the ordinance. It shall not be necessary to demonstrate that, in the absence of the variance, no reasonable use can be made of the property. 2. The hardship results from conditions that are peculiar to the property, such as location, size, or topography. Hardships resulting from personal circumstances, as well as hardships resulting from ZBA-946 Page 4 of 4 conditions that are common to the neighborhood or the general public, may not be the basis for granting a variance. 3. The hardship did not result from actions taken by the applicant or the property owner. The act of purchasing property with knowledge that circumstances exist that may justify the granting of a variance shall not be regarded as a self-created hardship. 4. The requested variance is consistent with the spirit, purpose, and intent of the ordinance, such that public safety is secured, and substantial justice is achieved. ACTION NEEDED (Choose one): 1.
