The New Hanover County Board of Health met on Wednesday,
January 5, 1994, in the Dr. Thomas Fanning Wood Library, New
Hanover County Health Department (NHCHD), Wilmington, North
Carolina.

Mr. Coble called the regular business meeting of the New Hanover
County Board of Health (NHCBH) to order at 8: 00 A.M. Ms.
Alford presented the invocation.
Mr. Coble called for corrections to the minutes of the meeting on
December 1, 1993. The minutes were approved.
Recognition:
Nutrition Division - #1 in State
Mr. Parker displayed a plague presented to Dr. Tabandeh Zand,
Nutrition Director, and American Heart Association Food Festival
Chairman, for being #1 in the State of North Carolina by
reaching the maximum number of people and distributing American
Heart Association "heart healthy education" materials for the
Heart Fest held in October 1993. The Nutrition Division has won
this award for three consecutive years.
Healthy Carolinians 2000 Certification
Mr. Parker reported that the New Hanover County Year 2000 Health
Objectives Committee received their Certification from the
Governor's Task Force at the Annual Meeting in Durham on
November 10, 1993. New Hanover County was one of five communities
which received this honor. Mr. Parker recognized and thanked Ms.
Connie Parker, Chairman, and Mr. Kevin Krisher, Chairman-Elect,
New Hanover County Health Year 2000 Health Objectives Committee,
for their commitment and contributions to this effort. Ms.
Parker commended Mr. Parker, Board of Health members and staff
members for their participation in this community project.

Mr. Parker, Health Director, showed a video: "Our Public Health
Past - A Visit to Oakdale Cemetery, July 1, 1992, Wilmington,
N. C." . This was a historical event sponsored by the Board of
Health honoring and in memory of Dr. Soloman Sampson Satchwell,
Dr. Edward Jenner Wood and Dr. Thomas Fanning Wood, Public Health
Leaders.
Committee Reports:
Environmental Health
Ms. Dianne Harvell, Environmental Health Director, reported that
the Environmental Health Committee met at 2 P.M. on December 17,
1993.
Septage and Waste Grease
Ms. Dianne Harvell, Environmental Health Director, reported she
has attended two meetings of City and County officials regarding
the disposal of septage and waste grease in New Hanover County.
She stated it was indicated at the meeting that the Health
Department should assume the responsibility of insuring that
grease is pumped from foodservice facilities. The Environmental
Health Committee recommended either pursing an alternate grease I
disposal site or modifications to the City of Wilmington
Souths ide Treatment Plant.
Mr. Parker referred the Board to a letter dated December 20, 1993
to Mr. Coble, Chairman, New Hanover County Board of Health, from
Mayor Don Betz, City of Wilmington, stating that the City and
County staff and officials are reviewing the McKim and Creed
Study and that the City and County plan to address this -
issue. Mr. Coble emphasized that the Board should continue to
study septage and grease disposal alternatives.
Ms. Harvell informed the Board that she is preparing a proposed
draft of Rules Governing The Operation of Temporary Food
Facilities. '
Executive
Mr. Coble reported that the Executive Committee met at 6:15 P.M.
on December 28, 1993.

Ms. Donna Neal, Chairman, Animal Control Advisory Committee,
presented the proposed Rabies Educational packet. It includes
Animal Control information handouts, booklets, cards, Rabies
booklets, posters, and videotapes for New Hanover County School
classrooms, kindergarten through eighth grade. The estimated
cost is $3,000. Implementation of the Rabies educational
component will be April 1994.

Mr. Coble moved from the Executive Committee for the Board to
approve the proposed Rabies Educational Program at a cost of
$3,000 as presented by Ms. Neal. Upon vote, the MOTION CARRIED.
Unfinished Business:
Amendment/Proposed Changes in Regulations Concerning Ferrets
Mr. Coble requested that the Board of Health consider the
following Animal Control issues:
1. Amendment of the existing Regulations For The Zoological
Order Carnivora Other Than The Domestic Dog and Cat And
Maintenance Of other Wild Or Exotic Animals to classify
ferrets as domesticated animals
2. Adoption of the proposed Regulations For The Possession,
Sale and Distribution of Ferrets
3. Approval of the Ferret Purchase/Adoption Agreement
4. Approvaì of revised Animal Control Fees and Animal Control
Civil Citation Fee Schedule effective February 1, 1994
After discussion of the above issues, Mr. Coble recommended that
the proposed $500 Ferret Establishment Permit Fee be decreased to
$200. Dr:. Jackson recommended that Section 9 of the proposed
Ferret Regulation should be entitled Death/Loss/Transfer of
OWnership and should state that notification of a lost ferret
shall be in writing to Animal Control within 72 hours.
Ms. Maness moved that the Board of Health approve the above four
issues with the following modifications:
1. Amendment of the existing Regulations For The Zoological
Order Carnivora Other Than The Domestic Dog and Cat And
Maintenance Of Other Wild Or Exotic Animals to classify
ferrets as domesticated animals,
2. Adoption of the proposed Regulations For The Possession,
Sale and Distribution of Ferrets by New Hanover County
Regulations with modifications to Section 9 which is to be
entitled Death/Loss/Transfer of OWnership and which is to be
amended to state that notification of a lost ferret shall be
in writing to Animal Control within 72 hours,
3. Approve the Ferret Purchase/Adoption Agreement, and
4.
Approve Animal Control Citation Fee Schedule as presented
wi th one exception which would decrease the Ferret
Establishment Permit Fee from $500 to $200. Upon vote, the
MOTION CARRIED.

Health Care Reform Responses
Mr. Coble requested that Board members complete their Association
of North Carolina Boards of Health Surveys regarding the
Jeralds-Ezzell-Fletcher (JEF) Health Care Reform Act of 1993.
Mr. Parker announced that Representative Joe Mavretic will speak
on Health Care Reform at the ANCBH Annual Meeting.

New Business:
New Family Planning Fees
Mr. Parker presented the new FY 1993-94 Family Planning Fees
effective on July 1, 1993. Proposed fees match Medicaid
reimbursement rates.
Dr. Paul moved to approve the revised FY 1993-94 Family Planning
Fees for usage in the Family Planning Program retroactive to July
1, 1993. Upon vote, the MOTION CARRIED.
Nominating Committee and Election of 1994 Board of Health
Officers
Dr. Jackson, Chairman, Nominating Committee, submitted the
following nominations for 1994 Board of Health Officers:

There were no nominations from the floor.
Dr. Jackson moved from the Nominating Committee that Mr. Coble be
elected Chairman and Dr. Macris be elected Vice Chairman of the
1994 Board of Health. Upon vote, the MOTION CARRIED.
Comments:
Board of Health Members
Mrs. Dean requested that Mr. Parker distribute a Health Care
Reform article to the Board of Health.
Health Director
Mr. Parker reported that criminal charges against Guiseppe Viola
for assault on a government official and failure to post a
sanitation grade have been dropped and a prayer for judgment
(PJC) continued by the court.
Mr. Parker encouraged Board members to attend the Association of
North Carolina Boards of Health Eighth Annual meeting on January I
14, 1993, in Raleigh, N.C.

Mr. Parker informed the Board that Environmental Health has
received $7,867 in additional funding for their excellent 98%
compliance rate of restaurant inspections. Also, Family Planning
has received an additional $16,417 from the General Assembly.
Mr. Parker reported there were 266 teen births in New Hanover
County in 1992. This is 15% of the total births.
Mr. Parker introduced the following new health department
employee:
Kimberly Phillips, Clerical Specialist, EPI
Mr. Parker referred the Board to a letter from Senator Jesse
Helms regarding his prospective on Health Care Reform.
Mr. Parker informed the Board that he has been elected/appointed
to two Public Health leadership positions. He will be 1994
President of the North Carolina Association of Local Health
Directors and a member of the Legislative Research Commission's
Public Health Committee.
There being no further business Mr. Coble adjourned the meeting
at 9:30 A.M.

REGULATIONS FOR THE
POSSESSION, SALE AND DISTRIBUTION
OF ANIMALS BELONGING TO THE
ZOOLOGICAL ORDER CARNIVORA OTHER
THAN THE DOMESTIC FERRET AND DOG AND CAT AND
MAINTENANCE OF OTHER WILD OR EXOTIC ANIMALS
BE IT ORDAINED by the New Hanover County Board of Heal th
that the following regulations are hereby adopted, pursuant to
authority granted by Chapter 130 of the General Statutes of North
Carolina, and shall apply throughout New Hanover County for the
possession, sale and distribution of animals belonging to the
zoological order Carnivora other than the domestic ferret, dog
and cat and the maintenance of other wild or exotic animals.
Section 1. Possession. Sale and Distribution of Antmals
Belonging to the Zoological Order Carnivora Other Than The
Domestic Ferret. Dog and Cat Unlawful. It shall be unlawful in
New Hanover County to possess, sell, distribute, trade, barter,
exchange, adopt or give antmals belonging to the zoological order
Carnivora other than the domestic ferret, dog and cat. These
animals shall include but are not limited to foxes, raccoons,
skunks, weasels, minks, otters, bobcats, civet cats, margays,
ocelots, golden cats, fishing cats, leopard cats, cheetahs
lynxes, cougars, leopard, jaguars, wolves, coyotes, dingos, and
hybrids resulting from crossbreeding domestic dogs with wolves,
coyotes, and dingos, except as follows:
(1) Institutions registered by the u.S. Department of
Agriculture pursuant to the Animal Welfare Act, as amended, the
North Carolina Zoological Park, and other zoological Park Council
may possess these animals. Dealers licensed pursuant to the Act
may distribute or sell such animals to these parks and
institutions.
(2) A person in possession of a carnivore included in this
regulation on October 1, 1987 may continue to possess the animal
if by January 1, 1988, the person obtains a permit from the
Animal Control Division of the New Hanover County Health
Department. To obtain a permit for each animal in possession.
the person shall submit the following information:
a. The person's name, address, and telephone number;
b. Location of where the carnivore will be maintained;
c. Number of carnivores in possession on October 1, 1987
and;
d. Statement from a licensed veterinarian that each
carnivore has been spayed or neutered.
All permits issued pursuant to this subsection are non-
transferable and shall expire at the death of the animal. Upon
death of the antmal, the Animal Control Division must be
notified.

(3) A licensed veterinarian may have in possession any of
the aforementioned carnivores for the sole purpose of providing
veterinary services.
Section 2. Other Wild or Exotic Antmals. Maintenance of.
Employees of the Animal Control Division of the New Hanover
County Health Department shall have the right to inspect the
premises where any animals commonly categorized as wild or exotic
are to be kept to determine if the animal may be kept or
maintained without menacing the health and safety of any persons
or property. In furtherance of such goals the Board of Heal th
may require that any such animals be caged or secured and may,
after due notice, make additional rules regulating the keeping of
these animals.
Section 3. Animal control officers are authorized to
enforce the provisions of this section and shall have the right
of entry pursuant to G.S. S130A-17 for this purpose.
