05/02/1990 BOH Minutes I I I 27 The New Hanover County Board of Health met on Wednesday, May 2, 1990, at the New Hanover County Health Department, Wilmington, North Carolina. Members Present: John Leonard, DVM, Chairman Don Blake, Vice Chairman Pascal Camak, DDS Albert Corbett Michael Goins, OD Amaryallis Rehder, MA Sheram Robinson Marlene Rosenkoetter, PHD Alan Thomas, MD Catherine Vangellow, MPH Members Absent: Julius Howard, RhP Others Present: Robert S. (Bob) Parker Frances F. De Vane, Recording Secretary Wanda Copley, County Attorney Dr. Leonard called the business meeting to order at 8: 00 A.M. Dr. Pete Camak presented the invocation. Dr. Leonard called for corrections to the minutes of the meeting April 4, 1990. The minutes were approved as presented. Committee Reports: Personnel Ms. Vangellow, Personnel Cormnittee Chairman, reported that the Personnel Cormnittee met on April 24, 1990, and reviewed the Board of Health's performance appraisals of Mr. Parker, Health Director. The Cormnittee recormnended that the Board of Health request the maximum salary increase allowed by County personnel policy be granted to Mr. Parker for his outstanding performance. Ms. Vangellow moved that the Board of Health request the maximum salary increment according to County Personnel policy be granted to Mr. Parker, Health Director, for his outstanding performance. Upon vote, the MOTION CARRIED UNANIMOUSLY. Budget Mr. Don Blake, Budget Cormnittee Chairman, reported that the health department FY90-91 Budget has been submitted to Mr. Allen O'Neal, County Manager. The recormnended budget will be presented at the next Board of Health meeting. 28 Unfinished Business: Smoking Pollution Control Regulation (SPCR) Dr. Leonard stated that he was pleased with the large turnout of Board members and speakers at the SPCR Public Hearing on April 30, 1990. He presented a written document to Board members concerning his opinions on the Public Hearing and the SPCR. He . . I . requested the Board' s ~mpress~ons and cormnents concern~ng the Public Hear'ing and the SPCR. Dr. Leonard stated that he would like to have the SPCR redrafted for the June Board of Health meeting with the County Commissioners. I A lengthy discussion was held regarding application, implementation and enforcement of the SPCR in public places, heal th hazards of smoking, the possibility of displaying signs indica ting smoking and nonsmoking areas, and exemptions to the proposed draft of the SPCR. It was the consensus of the Board of Health to meet at 7 P.M. on May 16, 1990, to redraft the SPCR. Dr. Leonard requested that Board members review the proposed draft before this date. Mr. Parker suggested that a SPCR Survey be prepared for the Board members to get a more unified consensus of the feelings of the Board members on each Section of the SPCR. Mr. Parker is to prepare this survey and mail it to Board of Health members. The results of the survey will be tallied before the May 16 meeting I of the Board. Mr. Parker asked the Board how they recormnended preventing the sale of cigarettes to minors. Dr. Thomas stated that there is a $500 fine for selling cigarettes to minors. Mr. Blake stated that this is a state law and that he felt people should be more aware of the law through education. Department Focal: Building Addition Dedication Mr. Parker, Health Director, announced the New Hanover County Health Department held a successful Public Health Celebration on March 30 - 31, 1990, recognizing the New Building Addition, 111 Years of Public Health in New Hanover County and the beginning of Public Health Week. On March 30, a Dedication Program for staff was held at 11:00 A.M. and was followed by a staff luncheon. The Dedication Program for local and state officials and the public followed from 3:00 P.M. 5:00 P.M. and concluded with a Reception at the home of Mr. and Mrs. Robert S. (Bob) Parker. Mr. Parker reported that $2,400 was contributed from the cormnunity to cover the expenses for the Public Health Celebration. Mr. Dan Shingleton, Regional Maternal and Child I Care Supervisor, was the keynote speaker. II I I ; 2' 01 .J1 Mr. Parker presented an audio visual of Willard Scott displaying a t-shirt recognizing the New Hanover County Health Department Public Health Celebration on national TV (The Today Show). Healthy Living in the 90's Health Fair Ms. Jeanne Griffin, Adult Health Public Health Nurse, presented a report on the Health Fair entitled Healthy Living in the 90's Better Health, Brighter Future. The health fair was held on March 31, 1990, from 10:00 A.M. until 3:00 P.M. at the health department. Approximately 600 people attended the health fair. Mr. Blake stated that he was impressed by the spirit of department employees participating in the Public Celebration activities. Dr. Leonard cormnended the staff job well done. health Health for a New Business: Adult Health Screening RecOIIDDendation Ms. Beth Day, Adult Health/Epidemiology Director stated that the Adult Health Program of the health department has offered a comprehensive chronic disease screening clinic for the past seven years. After an assessment of the needs of clinic services by program staff, Ms. Day presented the following plan developed for Adult Health Program in 1990-91: Change clinic services to examination, eliminate lab work, clinician time for examination offer cancer screening chest x-ray and reduce Offer evening clinic for working population Reduce cost of initial and annual visit Increase health education and services in cormnunity including cholesterol and nutritional component of program Change the name of clinic from Adult Health Screening to Cancer Screening Clinic Ms. Day explained that fee collection from the clinic would probably be reduced, even though patient attendance will increase for the services offered. Cost of providing services will also be reduced. Ms. Day presented and requested that the Board of Health approve the revision of the Adult Health Screening Fee Policy to reflect these program changes. Mr. Blake moved that the Board approve the revision of the Adult Health Screening Fee Policy to reflect the program changes as presented to be effective July 1, 1990. Upon vote, the MOTION CARRIED UNANIMOUSLY. 80 Citizen Review Panel Appointments Ms. Day explained that Ms. Doris McNeill and Mr. Ralph Parker resigned from the AIDS Awareness in the Black Cormnunity Citizen Review Panel in February 1990. Ms. Daffinette Dudley, Health/Physical Education teacher at Roland-Grice Middle School and Reverend Joseph Windley, Pastor at First Baptist Church and New Hanover County Prison Chaplain, have agreed to serve on the panel. Ms. Day requested the Board's approval of these prospective panel members. Dr. Camak moved that the Board of Health approve the appointments of Ms. Daffinette Dudley and Reverend Joseph Windley to the Citizen Review Panel. Upon vote, the MOTION CARRIED UNANIMOUSLY. De Vane, Recording Secretary Wanda Copley, County Attorney Dr. Leonard called the business meeting to order at 7:30 P.M. ~- Unfinished Business: Smoking Pollution Control Regulation (SPCR) Dr. Leonard, Chairman, stated that the purpose of this Board of Health meeting was to consider the revision of the proposed draft of the SPCR and review the results of the SPCR Survey which was completed by the Board members. Mr. Parker announced there were ten Board member responses to the survey. Dr. Leonard requested that the Board agree on Sections of the SPCR prohibiting smoking in restaurants, bars, businesses and places of employment. It was the consensus of the Board to phase in the SPCR. Smoking will be limited by January 1, 1991 in designated public places and eliminated in designated areas of public places by January 1, 1992. I The Board agreed to recei ve cormnents from the audience. Mr. Billy Nichols stated he felt everyone would go along with the posting of signs. He was not agreeable to a no smoking policy in public places by 1992. He stated he wished the Board would survey restaurant and bar owners. ,32 Mr. John Coble distributed to the Board a copy of the Raleigh Ordinance requiring nonsmoking, smoking signage. He stated he felt with signs and designated smoking areas, clients and management could make their choices. Ms. Rehder asked if the health department would enforce the regulation of displaying appropriate signs in restaurants and bars. Mr. Parker explained that the health department does not have sufficient staff for enforcement of the regulation but once the signs are posted compliance should be very good. Restaurants and Bars Dr. Leonard asked for Board agreement on the following revisions of smoking regulation in restaurants and bars. The Board considered the posting of signs in restaurants. The Board voted that restaurants with fewer than 50 seats shall post signs effective January 1, 1991, at all entrances designating whether the restaurant provides a nonsmoking section or does not provide a nonsmoking section. Upon vote, the VOTE CARRIED UNANIMOUSLY. The Board considered the restaurants in New Hanover Upon vote, the VOTE CARRIED. prohibi ting of County effective smoking January in all 1,1992. -- 6 1 Ayes No -.., Dr. Leonard requested that the Board make a decision on the banning of smoking in bars. After discussion the Board voted that effective January 1, 1991, all bars shall post a sign designating: "We Do Not Provide A Nonsmoking Section In The Bar," or "Nonsmoking Section Available In Bar", or "No Smoking". Upon vote, the VOTE CARRIED UNANIMOUSLY. Dr. Goins stated he would like for all bars to provide a nonsmoking area. Dr. Goins moved that effective January 1, 1992, all bars in New Hanover County shall provide a nonsmoking area with a sign stating "Nonsmoking Section Available In Bar". Upon vote, the MOTION CARRIED. 5 Ayes 1 Abstained 1 No I I I I 33 Dr. Leonard moved that the def ini tion of Bar be def ined in the SPCR as it is defined in the Aspen, Colorado, Smoking Ordinance. Upon vote, the MOTION CARRIED UNANIMOUSLY. Businesses and Places of Employment Dr. Leonard requested that the Board consider the regulation on smoking in businesses and places of employment. The Board voted effective January 1, 1991, all businesses would prohibit smoking in all areas open to the public. The Board voted effective January 1, 1991, each employer within New Hanover County shall adopt and implement a written smoking policy. Upon vote, the VOTE CARRIED. 6 1 Ayes No Mr. Parker stated that the health department will furnish places of employment a model copy of a smoking policy. Dr. Goins stated that he felt an employee should have the authority to designate their irmnediate area as a nonsmoking area. Dr. Goins moved that an employee shall have the authority to designate their immediate work area as a nonsmoking area. Upon vote, the MOTION CARRIED UNANIMOUSLY. Dr. Goins moved that smoking be prohibited in cafeterias, lunchrooms and employee lounges in places of employment except in designated smoking areas. Upon vote, the MOTION CARRIED. It was the consensus of the Board that the health concerns of the nonsmoker should be given precedence. Sale of Cigarettes to Minors Mr. Parker asked the Board if they plan to assist in the enforcement of the prohibition of sale of cigarettes to minors. Mr. Parker displayed a pack of cigarettes which were purchased by his 15-year-old daughter. Dr. Camak expressed that this is a state law and should be enforced by state law enforcement agencies. Mr. Howard, Dr. Goins and Ms. Vangellow stated that they would like to see the health department pursue an educational effort regarding the illegal sale of cigarettes to minors. Dr. Leonard thanked Ms. Wanda Copley, Assistant County Attorney, for her assistance in the preparation of revisions of the SPCR. Dr. Leonard requested that Ms. Copley redraft the SPCR to be presented to the County Cormnissioners prior to the June 6, 1990, joint meeting of the Board of Health and County Cormnissioners. 34 There being no further business the meeting was adjourned at 9:15 P.M. ~~ Dr. John Leonard Chairman, Board of Health ~~ (/~ Robert S.
