10/03/1990 BOH Minutes I I I 53 The New Hanover County Board of Health met on Wednesday, October 3, 1990, at 8:00 A.M. in the New Hanover County Health Department, Wilmington, North Carolina. Members Present: John Leonard, DVM, Chairman Don Blake, Vice Chairman Pascal Camak, DDS Michael Goins, OD Robert G. Greer Julius Howard, RhP Sheram Robinson Arnaryallis Rehder, MA Marlene Rosenkoetter, PhD Alan Thomas, MD Members Absent: Others Present: Lynda F. Smith, Assistant Health Director Frances F. -De Vane, Recording Secretary Dr. Leonard called the business meeting to order at 8:00 A.M. He announced that Mr. Parker, Health Director, was attending a National Association for Horne Care meeting in Dallas, Texas. Mr. Blake presented the invocation. Dr. Leonard called for corrections to the minutes of the meeting on September 5, 1990. The minutes were approved as presented. Recogni tion for Support of New Hanover Breast Cancer Screening Program: Dr. Leonard displayed a plaque presented to the New Hanover County Health Department for staff participation in the New Hanover Breast Screening Program including the Advisory Committee, community education, screenings and follow-up on mammogram referrals. Dr. Leonard congratulated the staff for their participation in this community project. DePartmental Focal: Same Old Sewage But New Technology Mr. Bobby Waters, Vector Control Director, displayed a septic system model demonstrating the control of a recirculating sand filter using up-to-date computer control technology. The recirculating sand filter is used in coastal areas where sewage must be pretreated prior to disposal. The cost of this system is approximately $18,000. It has been approved by the state and has received notoriety throughout the state. Mr. Waters designed and constructed this system while attending and in conjunction with Cape Fear Community College. Dr. Leonard stated that this is another example of the innovative creativity in the health department. Mr. Blake thanked Mr. Waters for his presentation of the model system which treats sewage sufficiently before entering the environment. 54 Committee Reports: I Environmental Health Dr. Pete Camak, Chairman, Environmental Health Committee, gave a report on the Environmental Health Committee meeting on September 26, 1990. He explained that the Tort Claims Act does not protect Environmental Health Specialists or New Hanover County from liability on preliminary subdivision evaluations. This beneficial service to citizens of New Hanover County will probably be discontinued if the, staff and health department are held liable. On October 5, 1990, Mr. Parker will meet with county planners to discuss the liabilities involved in this service. Dr. Camak referred the Board to a draft of Rules and Regulations Governing Food Service Manager's Certification to -Supervise Foodhandling Operations in New Hanover County. He explained that food service training is needed for all restaurants in New Hanover County. Cape Fear Community College will offer college credits for this course and the health department staff will be responsible for providing the instruction. After discussion the Board decided to obtain input from the North Carolina Restaurant Association and other counties operating foodservice schools. Dr. Camak stated that the 1956 Regulation Governing the Storage, Collection, Transporting, and Disposal of Garbage and Refuse in New Hanover County are outdated. The rules are in conflict with county procedures and should be repealed. He stated that upon the advice of Ms. Wanda Copley, Assistant County Attorney, this request for repeal of this regulation will be advertised in the newspaper and presented to the Board of Health at the November 7, 1990 Board meeting. I Personne1 Mr. Howard, Chairman, reported that the Personnel Committee met at 7:30 A.M. on September 5, 1990, to consider the establishment of four new positions for Child Health Service Coordination. No county funds will be needed to fund these positions. Ms. Betty Jo McCorkle, Maternal and Child Care Director, stated that the 1990 Short Session of the General Assembly passed a number of bills to reduce infant mortality and morbidity and improve the health of children at risk in our state. She explained that the state has proposed the Coordination of Child Health Services and that the health department will play a major role in the coordination of these services. New Hanover County Heal th Department revenues for the Child Heal th Service Coordination Program will include immediate Medicaid reimbursement of $34,500 and up-front grant funding of $21,000 I with $10,000 to be continued funding on an annual basis. Projected annual revenues for this program are $132,400. Ms. I I I -55 McCorkle said the following new positions will need to be established for Child Health Service Coordination: Public Health Nurse II Clerk Typist IV Social Worker II Community Health Assistant Mr. Howard moved that the request for the establishment of four new positions for Child Health Service Coordination Program to include a Public Health Nurse II, Clerk Typist IV, Social Worker II and Community Health Assistant be approved by the Board of Health and submitted to the New Hanover County Commissioners for their consideration. Upon vote, the MOTION CARRIED UNANIMOUSLY. Animal Control Advisory Board Ms. Donna Neal, Chairman, Animal Control Advisory Board, presented a report from the Advisory Board. She stated that the Board is researching for adequate facilities for a new Animal Control Shelter. The Shelter Committee plans to obtain the estimated cost of the new shelter and maintenance expenses to prepare a budget to submit to the County Manager and County Commissioners. The Foundation Committee will meet October 30, 1990, to consider forming a foundation for Animal Control donations. Ms. Neal explained that the proposed merger between New Hanover County Animal Control and the Humane Society is pending. She reported that the City of Wilmington has not defined kennel in their zoning code. The City Planning Board has requested that a committee be formed to define kennel. Ms. Neal stated that the North Carolina General Assembly passed the Dangerous Dog Statute which became effective October 1, 1990. It states.. "that the county or municipal authority responsible for animal control shall designate a person or a Board to be responsible for determining when a dog is a potentially dangerous dog and shall designate a separate Board to hear any appeal." Mr. Ron Currie, Animal Control Director, stated that once the animal is proclaimed potentially dangerous or dangerous, the animal must be kept in a secure area as designated in the Dangerous Dog Statute. Penalties for noncompliance are, also, specified in the Dangerous Dog Statute. The Dangerous Dog Statute also mandates that a separate appellate Board be designated to hear any appeals. Mr. Greer inquired if the Board of Health was automatically assigned this responsibility. Mr. Currie stated that he would refer this matter to Ms. Wanda Copley, Assistant County Attorney. 56 , After discussion the Board decided that the Dangerous Dog Review Panel will include the Chairperson of the Animal Control Advisory Board, one member of the Animal Control Advisory Board, and one area veterinarian. Mr. Currie will serve as an advisor to the Dangerous Dog Review Panel. I Mr. Blake moved that the Board of Health approve the formation of a Dangerous Dog Review Panel for determination if a dog is potentially dangerous. Upon vote, the MOTION CARRIED. Dr. Rosenkoetter stated she had prepared a letter to Dr. Leonard requesting that the Board of Health investigate the issue of dumping animals. Mr. Blake stated that this is a serious problem. Dr. Leonard suggested that this issue be researched by the Animal Control Advisory Board. The Board voted to refer this issue to the Animal Control Advisory Board for further study. New Business: Repeal of 1956 Board of Health Disposal of Garbage and Refuse Regulation Dr. Camak reiterated that the request for the repeal of the 1956 Board of Health Disposal of Garbage and Refuse Regulation would be brought before the Board at the meeting on November 7, 1990. Conments: I Board Members Mr. Blake recognized Ms. ArnyLee Brooks, Communicable Disease Control Specialist. He thanked her for assisting him in the application and interpretation of communicable disease laws as they applied to a local restaurant situation. He stated that he wanted to commend Ms. Brooks for her expertise in the management of this situation. Assistant Health Director Ms. Smith, Assistant Health Director, reminded Board members of the Continuing Education Session for Boards of Health members on Groundwater Contamination to be held on Tuesday, October 23, 1990, from 6:30 P.M. to 9:30 P.M. at the Wilmington Hilton. Ms. Smith referred the Board to a letter addressed to Mr. Jim Hayes, R. S., Environmental Health Specialist, praising him for his excellent presentation to the State of Practice Committee workshop which dealt with swimming pools.
