02/06/1991 BOH Minutes I I I 73 The New Hanover County Board of Health met on Wednesday, February 6, 1991, at 8:00 Ã.M. in New Hanover County Health Department. Members Present: Don Blake, Chairman Michael Goins, OD, Vice Chairman John Coble Robert G. Greer Marlene M. Leslie Hall, Jr., PE Julius F. De Vane, Recording Secretary Mr. Blake called the meeting to order at 8: 00 A.M. Mr. Robinson presented the invocation. Mr. Blake called for corrections to the minutes of the meeting on January 2, 1991. The minutes were approved as corrected. Recogni tion of Mr. Travis Getz, Laney High School Senior Certificate of Appreciation Award for Designing Poster for Reporting communicable Diseases On behalf of the Board of Health, Mr. Blake presented a Certificate of Appreciation Award to Mr. Getz in recognition for his design of a poster entitled Remember to Report Communicable Disease Cases. Mr. Blake congratulated Mr. Getz on his participation in the effort to encourage physician reporting of communicable diseases to the New Hanover County Health Department. Recognition of Carlos (Pete) Davis - Super Staff Award Winner Mr. Blake congratulated and presented a plaque to Carlos (Pete) Davis, Environmental Health Specialist, recipient of the Semi-Annual Super Staff Award. On behalf of the Board of Health, Mr. Blake expressed his appreciation to Mr. Davis for his years of service and dedication to Public Health. Recognition of Ms. Susan Robinson - Third Place Winner - New Hanover County Fair Mr. Blake recognized Ms. Susan Robinson, Environmental Health Specialist, for her participation in the New Hanover County Fair. The Environmental Health Division was third place winner in the exhibit category and New Hanover County received $70.00 for this exhibit on lead. 74 Dr. Michael Goins, Vice Chairman of Board of Health Wilmington Jaycees Distinguished Service Award Wins Mr. Blake recognized Dr. Goins, recipient of the Wilmington Jaycees Distinguished Service Award on January 26, 1991. Mr. Blake commended Dr. Goins for his contributions to the community and Public Health. I New Hanover County Board of Health - Recipient of OUtstanding Board of Health Award Mr. Blake congratulated the Board of Health as recipient of the Outstanding Board of Health Award from the Association of North Carolina Boards of Health on January 17, 1991 in Raleigh, N. C. Mr. Blake stated this is the first year this award has been given and he is proud to be affiliated with a Board which displays initiative and dedication to Public Health issues. Departmental Focal: Mr. Robert Swift, Soil Scientist, presented the department focal to the Board of Health on the Creation of a Management Entity: Sewage System Maintenance. He explained the importance, types and maintenance of specific septic systems. State regulations require the creation of a management entity in New Hanover County by July I, 1991 in order to continue issuing permits for alternative septic systems. Mr. Blake thanked Mr. Swift for his presentation. Committee Reports: I Health Promotions smoking Pollution Control Ordinance (SPCO) UPdate Dr. Goins, Chairman of Health Promotions Committee, reported tha t Wrightsville Beach will discuss the SPCO at a later date. Kure Beach will have a public hearing on February 19, 1991 at 7:00 P.M. A Committee of the Carolina Beach Town Council has decided rather than having the twenty-five percent (25%) rule in restaurants that Carolina Beach will post signs at every entrance notifying patrons of their smoking policy. The Carolina Beach Town Council public hearing date is to be announced. After discussion on the enforcement of the SPCO, the Board requested that Mr. Parker prepare a letter to the municipalities before their SPCO public hearings informing them if they adopt a smoking regulation that they will be responsible for the enforcement of their smoking policy. Posting of Policy Signs at Restaurant Entrances Dr. Goins referred the Board to the New Hanover County SPCO, Section I 8.5-31. Posting of Signs Required. He explained that this ordinance designates proper signage relating to an establishment's smoking I I I 75 policy. He recommended that the Board consider clarification of the intent and interpretation of the SPCO signage. Ms. Wanda Copley, Assistant County Attorney, explained that the purpose of intent and interpretation of the policy is that upon entry into an establishment a person should be able to determine the smoking policy of the owner of the establishment. It was the consensus of the Board of Health that Ms. Copley's interpretation of the SPCO was satisfactory. Dr. Goins reported that Ms. Denise Teachey, Health Promotions Director, is working on a Breast and Cancer Screening Clinic to be staffed by local physicians to be held on April 20, 1991. Personnel Committee ù Mr. Howard, Chairman of the Personnel Committee, reported that the Personnel Committee met at 7:30 A.M. on February 6, 1991, to consider the expansion of staffing of the Maternity Care Coordination Program. He explained that the North Carolina General Assembly allocated $17,500 start up funds to pay salaries of a Public Health Nurse I and a Social Worker II for a three month period to be expended by June 30, 1991 to decrease infant mortality. Ms. Betty Jo McCorkle, Maternal and Child Care (MCC) Director, stated these funds are needed to increase the Medicaid MCC caseload and provide a better delivery of service to the present case load . Fees earned through Medicaid will reimburse this budget. Mr. Howard moved that the request for the approval of the Maternity Care Coordination State Grant ($17,500) and the establishment of one Public Health Nurse I position and one Social Worker II position for the MCC Program be approved by the Board of Health and submitted to the New Hanover County Commissioners for their consideration. Upon vote, the MOTION CARRIED UNANIMOUSLY. Health Department Budget Mr. Blake recognized Ms. Lynda F. Smith, Assistant Health Director, who reported that the proposed FY1991-92 Budget of $6,000,000 with revenues of $3,000,000 is to be submitted to the County Budget Office on Monday, February 11, 1991. The budget hearing with Mr. Allen O'Neal, County Manager, is to be on March 22, 1991 at 10 A.M. Ms. Smith asked Budget Committee members to review their budget packets. The Recommended FY1991-92 Budget will be presented to the Budget Committee and then to the Board of Health for their consideration. Unfinished Business: HIV Testing, Anonymous/Confidential Mr. Blake explained that the health department offers either anonymous or confidential HIV testing. There is a proposal by the North Carolina Commission for Health Services (NCCHS) to discontinue 76 anonymous HIV testing by January 1, 1994. This determination will be made by the NCCHS on February 22, 1991. Mr. Blake asked the Board I if they would like to go on record as supporting either anonymous or confidential HIV testing. Dr. Goins, Dr. Leonard, Dr. Rosenkoetter, and Dr. Thomas expressed that they felt AIDS should be treated as a reportable communicable disease. Mr. Blake referred the Board to a letter to the NCCHS from Ms. Beth Day, Epidemiology and Adult Health Director , giving comments and concerns about the proposed change to reduce anonymous HIV testing to 12 regional sites on July 1, 1991, and to eliminate anonymous HIV testing in health departments by January 1994. Ms. Day stated that the health department may lose access to HIV and AIDS patients if HIV anonymous testing is discontinued. Dr. Thomas moved that the Board of Health endorse HIV confidential testing in the health department as proposed by the North Carolina Commission for Health Services. Upon vote, the MOTION CARRIED UNANIMOUSLY. New Business: Public Concern, Potentially Dangerous Dog Law Mr. Blake introduced to the Board Ms. Maura McCaughey, Attorney representing Mr. and Mrs. Rudolph Mallette. Ms. McCaughey stated that Mr. and Mrs. Mallette are the owners of three dogs declared potentially dangerous by the Animal Control Dangerous Dog Panel (ACDDP) on November 29, 1990. Ms. McCaughey explained that Mr. and Mrs. Mallette were not at the ACDDP hearing. The attorney requested that her clients be given the opportunity to be heard. Ms. Wanda Copley, Assistant County Attorney, stated that the Dangerous Dog Law states that appellant must appeal within three days of receiving the written decision of the ACDDP. She explained that the time had lapsed and she does not feel the Board of Health can proceed even as the Appellate Board. MOTION: After a lengthy discussion Dr. Rosenkoetter moved that the Board of Health function as the Appellate Board and hear the case. 3 yes 6 oppose Upon vote, MOTION NOT CARRIED. MOTION: Dr. Rosenkoet ter moved tha t the Dangerous Dog Law be referred to the Animal Control Advisory Board for review of issues and problems and submit their recommendations back to the Board of Health and then refer to the General Assembly for consideration of revision of state statute. Upon vote, the MOTION CARRIED UNANIMOUSLY. I I I I I 77 Name Tags Ms. Smith requested that Board members desiring their picture made for identification cards should go the Department of Social Services immediately following the Board of Health meeting. Review of Health Department Fees Mr. Blake announced that a review of the health department fees will be placed on the March Board of Health agenda. '- Appointment of Animal Control Advisory Board Members Mr. Blake presented these applicants for reappointment to the Animal Control Advisory Board for two year terms: Diane Connor - Kennel Club Representative Joe Filion - Dog Trainer Bill Huffine - Field Trial and Hunter It was moved that the above applicants be reappointed to the New Hanover County Animal Control Advisory Board. Upon vote, the MOTION CARRIED UNANIMOUSLY. Association of N. C. Boards of Health Representative Mr. Blake asked for nominations from the floor for a Representative to the Association of North Carolina Boards of Health for a two year term. Dr. Rosenkoetter nominated Dr. Goins. The nominations were closed. Upon vote, the MOTION CARRIED UNANIMOUSLY. Dr. Goins was elected Representative to the Association of North Carolina Boards of Health.
