08/07/1991 BOH Minutes I I I 11] Mr. Blake called the regular meeting of the New Hanover County Board of Health (NHCBH) to order at 8:00 A.M. on Wednesday, August 7, 1991, in the Thomas Fanning Wood Library of the New Hanover County Health Department in Wilmington, North Carolina. De Vane, Recording Secretary Mr. Greer presented the invocation. Mr. Blake called for corrections to the minutes of the meeting on July 3, 1991. The minutes were approved. Recognition: 100% smokefree Establishments Mr. Blake recognized the following New Hanover County 100% Smokefree Establishments with certificates: Southeastern Medical Group Sun Brokers, Inc. Texilease Corporation Ms. Cynthia S. Johnson, Public Health Nurse Mr. Blake recognized Ms. Cynthia S. Johnson, a health department nurse, who served in active duty as a u.S. Army Nurse from February 1991 through July 1991. National Association of Counties (NACo) Awards Mr. Blake displayed two NACo 1991 Achievement Awards which were presented to New Hanover County at the NACo Annual Meeting in Salt Lake City, Utah. Mr. Fred Retchin, Chairman, New Hanover County Commissioners accepted these awards. They were presented to the New Hanover County Health Department (NHCHD) in recognition of the New Hanover County Smoking Pollution Control Ordinance (SPCO) and the County Pet Licenses issued through local veterinarians. 112 Super Staff Award I On behalf of the Board of Health, Mr. Blake congratulated and presented a plaque to Ms. Mary Jo Newton, Public Health Nurse, recipient of the Semi-Annual Super Staff Award. He expressed appreciation to Ms. Newton for her dedication to the health department, Public Health and the citizens of New Hanover County. Departmental Focal: Ms. Beth Day, Epidemiology/Adult Health Director, presented the department focal on AIDS and HIV testing. She stated that NHCHD has been selected as one of 17 health departments to remain as an anonYmous HIV testing site. Committee Reports: Personnel Committee: Mr. Howard, Chairman, Personnel Committee, recommended and moved from committee that a vacant half-time Home Health Public Health Nurse II position be changed to a full-time position. Upon vote, the MOTION CARRIED UNANIMOUSLY. Unfinished Business: Dangerous Dog Appeal Options I Upon request of the Board of Health, Ms. Donna Neal, Chairman, Animal Control Advisory Board, presented to the Board the following procedure from the Advisory Board for the dangerous dog appeal process: 1. Animal Control will complete the initial investigation of the potentially dangerous dog. 2. The present Animal Control Dangerous Dog Panel (ACDDP) will continue to determine if the dog is potentially dangerous. 3. Appeals from the ACDDP will be heard by the veterinarian on the Board of Health and two rotating Board of Health members. After a lengthy discussion, Mr. Greer moved that the Board of Health recommend to the New Hanover County Commissioners the following Dangerous Dog declaration and appeal process: 1. The Animal Control Director shall make the determination if the dog is to be declared potentially dangerous. 2. The Appellate Board established to hear Dangerous Dog Appeals shall consist of two members of the Animal Control Advisory Board and a veterinarian to be named by I I I I 113 the Animal Control Advisory Board. Upon vote, the MOTION CARRIED. Nursing Home Cafeteria Goes No smoking Since Ms. Jan Gains' request at the July Board meeting, Mr. Parker has requested that the nursing home cafeteria in question go no smoking. He reported that the cafeteria is now a nonsmoking area. Upon request from the Board, Mr. Parker stated he has written all New Hanover County nursing and rest homes and requested that they become smoke free. A discussion followed regarding amending the Smoking Pollution Control Ordinance (SPCO) to include nursing and rest homes. It was decided to refer this issue to the Health Promotions Committee. SPCO in New Hanover County Beach Communities To obtain the wishes of the residents of the three New Hanover County Beach communi ties regarding the adoption of the SPCO, Dr. Goins reported the Board has requested the communities conduct surveys during the fall elections. He explained that Carolina Beach plans to include the survey on their official ballot. Kure Beach has asked for a sample survey form for their consideration. At the present time Wrightsville Beach appears to be reluctant to address this issue New Business: Health Opportunities Program (HOP) Being Evaluated Mr. Parker advised the Board that HOP, the wellness program for county employees, is no longer in operation and is being evaluated by the County Manager. A report on the justification of continuance of HOP has been submitted to the County Manager. Change SPCO to Comply with New State Law Mr. Parker presented proposed changes to the New Hanover County Smoking Pollution Control Ordinance. These SPCO modifications will conform with the legislation passed by the 1991 North Carolina General Assembly raising the legal age to purchase cigarettes or other tobacco products from age 17 to 18. He also displayed signs issued by the National Tobacco Institute stating, "It's The Law - We Do Not Sell Tobacco Products To Persons Under 18." Dr. Goins moved that the Board of Health recommend that the SPCO be modified to correspond ,with the General Statute which changed the legal age to purchase cigarettes and other tobacco products from age 17 to 18 and that the National Tobacco Institute signage be utilized in establishments which sell tobacco products in New Hanover County. Upon vote, the MOTION CARRIED UNANIMOUSLY. 114 Review of Animal Control Advisory Board Goals I Ms. Donna Neal, Chairman, presented the goals of the Animal Control Advisory Board. Immediate goals are adjustment of fee schedule in accordance with the State $500 maximum fine, public education and working with Humane Society. Six-Month goals are revision of the Dangerous Dog and Animal Control Ordinances and securing funds for Animal Control shelter plans by January 1992. The One Year Goal is to present new shelter plans for approval in Fiscal Year 1992-93 Budget. Mr. Blake thanked Ms. Neal for her presentation and her volunteer services with the Animal Control Advisory Board and the Dangerous Dog Panel. Revisions in Health Department Fee Policy Mr. Parker presented the proposed increases in the fees of the New Hanover County Health Department Fee Policy. He explained that these are reflective of cost increases of supplies and services. (Attachment No.1: Clinic Fee Policy Revisions and Employee Purchase of Medications incorporated as a part of minutes.) Dr. Rosenkoetter'moved that the Board approve the above Fee Policy Revisions as presented. Upon vote, the MOTION CARRIED UNANIMOUSLY. I Comments: Board Members: Dr. Thomas inquired about the position of the Board on the proposed hazardous waste incinerator in Pender County. After a lengthy discussion on the involvement of the Board on the incinerator issue, Mr. Hall suggested that the Environmental Health Committee get involved, attend meetings and gather data on this issue. ' This issue was referred to the Environmental Health Committee. Mr. Hall commended Ms. Beth Day for her educational efforts regarding AIDS and HIV testing. Health Director: Mr. Parker announced that the Environmental Health Committee will meet following the Board meeting today. De Vane, Recording Secretary Dr. Leonard presented the invocation. Mr. Blake called corrections to the minutes of the meeting on August 7, 1991. minutes were approved. for The Association of N.C. Boards of Health (ANCBH) Survey Dr. Goins, ANCBH Representative, requested that Board members complete and return their ANCBH Survey by the September 4 Board of Health meeting. This survey has been distributed to all member boards to research policies and procedures, obtain input and assist with Public Health legislative issues. Dangerous Dog Appeal Hearing Participants testifying in the Dangerous Dog appeal hearing were sworn in by Mrs. Frances De Vane, Notary Public. Mr. Blake stated the Animal Control Dangerous Dog Panel (ACDDP) had declared the appealing dog potentially dangerous on July 30, 1991. Animal Ms. dog Ms. Chloe Rivenbark, Animal Control Officer, gave the Control investigation report which involved a dog bite. Joanne Crowe, 432-B Horne Road, Wilmington, N.C., owner of the (mix call name Charlie Brown) testified on behalf of her dog. 118 After hearing the above case, Dr. Leonard moved that the Board of Health uphold the ruling of the ACDDP that the mix call name I Charlie Brown was guilty of being potentially dangerous as pursuant to the North Carolina Dangerous Dog Act. Upon vote, the MOTION CARRIED UNANIMOUSLY. Committee Reports: None Unfinished Business: Dangerous Dog Appeal Options Mr. Blake indicated that the motion passed by the Board of Health on August 7, 1991 regarding the Dangerous Dog declaration and appeal process needs to be reconsidered. He presented from New Hanover County Commissioners' minutes meeting on October 15, 1990 the following: Designation of the New Hanover County Board of Health as the Governing Body for the "Dangerous Dogs" Act Passed by the General Assembly "The Commissioners designated the New Hanover County Board of Heal th as the body responsible for governing the "Dangerous Dogs" Act passed by the General Assembly to become effective OCtober 1990. After discussion and interpretation of the above documentation, Dr. Leonard moved that the Board of Health adopt the following Dangerous Dog declaration and appeal process: I 1. The Animal Control Director shall make the determination if the dog is to be declared potentially dangerous. 2. The Appellate Board established to hear Dangerous Dog Appeals shall consist of two members of the Animal Control Advisory Board and a veterinarian to be named by the Animal Control Advisory Board. Upon vote, the MOTION CARRIED UNANIMOUSLY. Mr. Blake thanked Ms. Neal for her services on the Animal Control Advisory Board and the Dangerous Dog Panel. New Business: Flea Problem Ms. Dorothy Nelson, 309 Southern Boulevard, Wilmington, N.C., addressed a flea problem in her yard and home. She stated that fleas infested her yard when her neighbor's yard was treated for fleas. She requested that the Board recommend or establish a Flea I Ordinance for New Hanover County. I I I 110 The Board referred Ms. Nelson to Mr. Bobby Waters, Vector Control Director, for advice in terminating the fleas in her yard. Comments: Board Members: Mr. Blake commented that he had recently visited Mr. Parker and the health department staff. He encouraged other Board members to visit the health department. Dr. Leonard presented an article on the disposal of old paint. He requested additional information on the disposal of paint and other chemicals. Mr. Parker stated he will invite Mr. Ray Church, New Hanover County Environmental Manager, to present a departmental focal on chemical disposal. Health Director: Mr. Parker reported that a local fish market was closed today. Mr. Parker announced that the next AHEC educational session for Boards of Health will be held on Tuesday, October 15, 1991, at Trai~s End Restaurant. Mr. Parker stated that Dr. Goins and Ms. Vaughn Upshaw, representatives of the ANCBH, attended the Brunswick County Board of Health meeting. The Brunswick County Board of Health has now joined the ANCBH. Mr. Parker announced that the October Board meeting will be held at the Animal Control Shelter.
