Dr. Goins called the regular business meeting of the New Hanover
County Board of Health (NHCBH) to order at 8: 00 A.M. on
Wednesday, May 6, 1992, in the Dr. Thomas Fanning Wood Library of
the New Hanover County Health Department (NHCHD), Wilmington,
North Carolina.

Ms. Mary King Dean presented the invocation. Dr. Goins called
for corrections to the minutes of the meeting on April 1, 1992.
The minutes were approved.
Recognition:
100\ Smokefree Establishments/Organizations
New Hanover County 100% Smokefree Establishment Certificate for
SCI Coastal House was accepted by Ms. Wanda Covil. Carolina
Furniture was also awarded a certificate.
Departmental Focal:
Ms. Karen Hogan, Director, New Hanover County Health Department
Home Health Agency, presented the departmental focal on the Home
Care Accreditation process and the standards that relate to the
Board of Health as the governing body of our Home Health agency.
Committee Reports:
Budget
Mr. Greer, Chairman, Budget Committee, stated that the NHCHD
FY92-93 Recommended Budget has not been received from the County
Manager and Budget staff. Ms. Lynda Smith, Assistant Health
Director, stated that the Board of Health Budget Committee will
review the Recommended FY92-93 Budget before it is presented to
the full Board on June 5, 1992.

Environmental Health
I
Mr. John Coble, Chairman, Environmental Health Committee,
reported that the committee met at 8:00 A.M. on Friday, April 16,
1992. Plans for the disposal of septage and grease generated in
the county are to be reviewed by County Engineering, Phil Ricks,
Agriculture Extension, and Ted Lyons, Department of Environment,
Health and Natural Resources.
Mr. Coble informed the Board that the advertisement requirements
for the proposed repeal of the local Regulations for the Control
of Childhood Lead Poisoning adopted by the Board of Health on
October 1, 1977 and the repeal and amendment of Rules Governing
Public Swimming Pools in New Hanover County adopted June 3, 1987
have been completed.
Unfinished Business:
Amendment to "Rules Governing Public Swimming Pools in New
Hanover County"
Mr. Tom Stich, Environmental Health Supervisor, requested that
the Board amend the "Rules Governing Public Swimming Pools in New
Hanover County."
Mr. Coble moved to repeal and amend the "Rules Governing Public I
Swimming Pools in New Hanover County". Upon vote, the MOTION
CARRIED.
Dr. Thomas moved for the Board to adopt the Amendment to "Rules
Governing Public Swimming Pools in New Hanover". Upon vote, the
MOTION CARRIED. (Attachment 11)
Repeal of Regulations for the Control of Childhood Lead Poisoning
Mr. Stich gave a brief history of the Childhood Lead Poisoning
Regulation in New Hanover County. He requested that the Board of
Health repeal this regulation.
Mr. Coble moved for the Board of Health to Repeal the Regulations
for the Control of Childhood Lead Poisoning. Upon vote, the
MOTION CARRIED.
New Business:
Inner City Rabies Clinics
Ms. Donna Neal, Chairman, Animal Control Advisory Committee,
expressed the need for the establishment of Inner City Rabies
Clinics. She explained that the Animal Control Advisory
Commi ttee and the Humane Society have targeted the inner city I
area to control rabies where transportation of animals to
veterinarians offices is limited. Rabies vaccinations will be
provided at cost and through private donations. Local volunteer

veterinarians, off duty Animal Control Officers, policemen and
citizens will participate in this project.
Year 2000 Health Objectives
Mr. Hall reported that the Year 2000 Health Objectives Committee
will meet on May 8, 1992 at Cape Fear Memorial Hospital. A copy
of the objectives has been distributed to committee members.
Minors and Purchase of Tobacco Products
Dr. Goins stated that the word "knowingly" had been inserted in
the law prohibiting the sale of cigarettes to minors and had kept
a convenient store clerk from being found guilty of selling
cigarettes to a minor (age 14). After a discussion, the Board
decided to refer this regulation back to the Health Promotions
Committee for consideration.
Comments:
Board Members:
Ms. Dean stated she was grateful for the opportunity of
participating in the Health Department Orientation Program. She
expressed that this was most meaningful and feels it makes a
difference in approaching health related problems.
Health Director:
Mr. Parker announced Environmental Health Revenues have
increased. Collections from January - March 1992 were $68,774.
The Board of Health will meet at Oakdale Cemetery for a historic
ceremony honoring Dr. Thomas Fanning Wood, Dr. Edward Jenner
Wood, and Dr. Solomon S. Satchwell at 7:00 A.M. on July 1, 1992'.
Board of Health members and Health Directors are invited to
attend a Food For Thought conference sponsored by Association of
North Carolina Boards of Health to be held on June 2, 1992 in
Greenville and on June 9, 1992 in Raleigh.
Mr. Parker gave an update on the Dangerous Dog Law. He reported
that 39 dogs have been declared dangerous.
An invitation was extended to attend the Safety Seatbelt
Promotion Kickoff at 10:00 A.M. on Monday, May 11, 1992, at New
Hanover Regional Medical Center.
The New Hanover Adolescent Health Council, Inc. will sponsor
activities in recognition of Teen Pregnancy Prevention Week from
May 3 - May 9, 1992.
Mr. Parker announced a slide presentation on Operation SAS will
be presented at the June Board of Health meeting. Hoggard High

School won regional competition and first place in state
competition for this science project.
Ms. Smith announced that the new health department telephone
system installation is on schedule.
Dr. Macris thanked Board members for completing the Continuing
Education Survey. The AHEC Committee will meet at AHEC at 6:00
P.M. on May 12, 1992.
There being no further business, Dr. Goins adjourned the meeting
at 9:20 A.M.

A REGULATION OF THE
NEW HANOVER COUNTY BOARD OF HEALTH
The Board of Health of New Hanover County, pursuant to North
Carolina General Statutes G.S. 130A-39, which authorizes a local
board of health to adopt rules necessary to protect and promote
the public health, does hereby ordain that the "Rules Governing
Construction and Operation of Public Swimming Pools in New
Hanover County" is hereby amended as follows:
Title. Change the title to "RULES GOVERNING THE FENCING OF
PRIVATE SWIMMING POOLS IN NEW HANOVER COUNTY".
Section 1.1 Definitions . "Private Swimming Pool" is any
swimming pool operated in conjunction with a single family
residential unit, the use of which is limited to occupants
of that residence and their invitees. Above ground private
swimming pools which are not accessible by a deck or other
similar permanent structure are exempt from these rules.
Section 1.2 Site Layout. All outdoor private swimming
pools shall be enclosed by a fence or other permanent
barrier which discourages climbing and is designed so as to
minimize the possibility of unauthorized or unwary persons
entering the pool area. Entrances through the barrier shall
be provided with self-Closing gates having simple positive
self-latching closure mechanisms with hardware provided for
padlocking. The barrier shall not be less than forty-eight
(48) inches in height above the adjacent ground surface
outside the barrier. Fencing will be required around all
four (4) sides of the swimming pool. All private swimming
pool enclosures shall be completely installed within thirty
(30) days of the pool completion.
It is recommended that all private swimming pools have a
walk or deck around the entire perimeter of the pool of a
minimum width of three (3) feet of unobstructed clear
distance.
Section 1.3 Non-conforminq Private Swimminq Pools.
Private swimming pools constructed prior to the effective
date of this regulation must be brought into compliance at
the earliest possible date, but in no case longer than two
(2) years from the effective date. This regulation shall be
effective October 1, 1989.
