The New Hanover County Board of Health met on Wednesday, July 5,
1989, at 8:00 A.M. at the Health Department.

Dr. Leonard called the meeting to order at 8:00 A.M. Mr. Parker
presented the invocation. Dr. Leonard called for corrections to
the minutes of the June 7, 1989 meeting. Dr. Leonard moved that
the minutes be approved. Upon vote, the MOTION CARRIED
UNANIMOUSLY.
Special Presentation - Ms. Naomi Yopp
Ms. Naomi Yopp, Proprietor, The Glenn Hotel, received a letter of
commendation from the Board of Health and the New Hanover County
Health Department for having a Grade A Sanitation Rating for
fifty years. A copy of the letter is attached (Attachment 1)
and made a part of these minutes. Dr. Leonard congratulated Ms.
Yopp for this most unusual accomplishment. Mr. Parker reported
that Mr. Pete Davis, Sanitarian, had assisted in the planning and
preparation of the commendation for Ms. Yopp. Ms. Yopp
expressed her appreciation to the Board of Health and Mr. Davis
for extending this honor to her.

Mr. Chris Elrod, New Hanover County Fire Marshal, presented to
the Board a program on Fire Safety and Prevention. He stated
that the City of Wilmington provides smoke detectors upon request
to the elderly and handicapped citizens but that there are no
available funds for this project in the county. Dr.
Rosenkoetter, Chairman, Health Promotions Committee, stated that
the Health Promotions Committee has discussed smoke detector
needs in the county and recommended that Mr. Elrod present some
of the issues and problems of securing smoke detectors for county
residents of this targeted group to the Board of Health. After
discussion of the feasibility of purChasing, installing and
monitoring smoke detectors, the Board referred this issue back to
the Health Promotions Committee for further study.

project.

Unfinished Business:
Fencinq Private Swimminq Pools
A video segment of the television program 20/20 regarding
Swimming Pool Safety and Fencing was shown to the Board.
Mr. Parker reported that the Health Promotions Committee and the
Board of Health are proposing the recommendation of the adoption
of a regulation which will require the fencing of private pools.
Mr. Parker stated that a notice of the proposed Fencing of
Private Pools Regulation appeared in the Wilmington Star News ten
days prior to this Board meeting. He stated that he had not
received any responses to this pUblic notice.
Dr. Leonard moved that the Board of Health approve adoption of
the Fencing of Private Pools Regulation. Upon vote, the MOTION
CARRIED. (A copy of this regulation Attachment #2 is attached
and made a part of these minutes.)
Animal Welfare Act

Dr. Leonard moved tha t the Board of Health go on record as
endorsing the Animal Welfare Act. Upon vote, the MOTION CARRIED.

Ms. Neal expressed her appreciation to Dr. Leonard for his letter
to area legislators requesting their endorsement of the Animal
Welfare Act legislation.
New Business:
Local Rabies Ordinance for Cats
Ms. Donna Neal, Chairman, Animal Control Advisory Board,
explained that state Animal Control Laws require compliance for
the control of Rabies in dogs and cats and that the present local
Animal Control Ordinance requires compliance for control of
Rabies in dogs but excludes cats. Ms. Neal stated that the
Advisory Board recommends that the Board of Health adopt a local
ordinance to include cats.
Mr. Howard moved that the Board of Health adopt the proposed
Local Rabies Ordinance for Cats to bring New Hanover County in
compliance with the State Rabies Law. Upon vote, the MOTION
CARRIED UNANIMOUSLY.

Ms. Neal lead a discussion regarding the need for tags for cats
in New Hanover County. She stated that County tags attached to
collars would aid in the control of Rabies and was being
requested by the Animal Control Advisory Board.
Dr. Rosenkoetter moved that the Board of Health recommend to the
Board of commissioners that owners of cats be required to obtain
County License Tags for cats in New Hanover County. Upon vote,
the MOTION CARRIED.
Dr. Leonard thanked Ms. Neal and Dr. Rosenkoetter for their
support of Animal Control issues.
Parliamentary Procedures
Dr. Leonard announced that he has been attending a Parliamentary
Procedure course taught by Dr. Clayton Calloway. He distributed
information on Procedure in Small Boards from Robert's Rules of
Order and asked Board members to review for discussion at the
August Board of Health meeting.
Board Members Comments:
Mr. Corbett announced that the New Hanover County commissioners
are holding a Solid Waste Public Forum at 7:30 P.M. on Tuesday,
July 11, 1989, in the General Assembly Room, New Hanover County
Courthouse. He stated he felt Board members would find this
meeting beneficial and encouraged them to attend.
Health Director Comments:
Mr. Parker announced that the Board of Commissioners approved the
Mandatory Spay Neuter Program recommended by the Board of Health
on June 7, 1989.
The Personnel Committee will immediately following this Board of
Health meeting select the recipient of the Semi-Annual super
Staff Award.
Mr. Parker reported that Hepatitis cannot be transmitted from
dogs to humans and that he had informed the public via television
(Channel 6 WECT).
Mr. Parker encouraged Board members to attend the Annual meeting
of Boards of Health to be held on September 15, 1989, in
Charlotte, N. C. The North Carolina public Health Association
Annual meeting will be September 13 - 15, 1989.

Mr. Parker thanked Board members for their participation in the
public Hearing on Septic Tanks on June 26, 1989, at Laney High
School. This was an opportunity for the public to be heard and
information regarding septic tanks was shared.

1>11:. Parker reported that the health department has received and
lost the following funding during the past two months for Fiscal ~
Year Budget 1989-90:

Mosquito Control - $11,225
Family Planning - ($ 4,152)
Neurology $ 400
Mr. Parker stated that the House Committee of the General
Assembly voted not to accept the Senate amendment that would have
allowed people denied septic tank permits to appeal to county
health boards.
Outpatient Freestanding Endoscopy Ambulatory Surqical Facilities
Mr. Parker presented requests to the Board from Wilmington
Health Associates, P.A., and New Hanover Memorial Hospital for
letters of endorsement and support of projects for licensed
Outpatient Freestanding Endoscopy Ambulatory Surgical Facilities.
These letters would accompany Certificate of Need (CON)
applications.
Dr. Leonard moved that the Board of Health not endorse these
requests for CON in this area. Upon vote, the MOTION CARRIED
UNANIMOUSLY.
The Board requested that Mr. Parker respond by letter to these
agencies thanking them for the opportunity to participate in this
project and explain that the Board of Health does not feel that
they are in an appropriate position to endorse these requests for
a CON in this area.

Dear Miss Yopp:
The rocking chairs are in place on the porches at THE GLENN as
they probably were during the first season of operation. THE GLENN, a
small lodging establishment by today's comparison, remains a true
landmark on the southern end of Wrightsville Beach. It has withstood
northeasters and hurricanes. The wood frame building was constructed to
endure time and storms. THE GLENN still retains a Pre-world War II
atmosphere, submitting only to mandated changes. In many of the rooms,
ventilated by the sea breeze, one can find a copy of the state lodging
rules as ratified in April of 1937. For senior clientele, a visit to
THE GLENN can spark a reminiscence of yesteryear's fun at the beach.
All of THE GLENN'S guests are special people. Many of the guests have
developed a true friendship with the operator and keep coming back to
renew the bonds of that friendship.
On this fiftieth season of continuous operation for THE GLENN, the
Health Department considers it to be both fitting and appropriate to
recognize the manager for a most unusual achievement. You, Miss YoPP,
were on the management staff at THE GLENN'S opening day June 1, 1939
and you have been there each season since insuring that everything is
clean and proper. For fifty years, THE GLENN, has always had a Grade A
Sanitation Rating. We consider such to be a remarkable accomplishment.
OUr wish for you is that this will be a truly Golden Year for THE
GLENN.
A copy of this letter is to be filed with the minutes of the July
1989 New Hanover County Board of Health Meeting. Another copy is to be
forwarded to the Environmental Health Section of the Division of Health
Services in Raleigh.

Attachment 2
A REGULATION
OF THE
NEW HANOVER COUNTY
BOARD OF HEALTH
The Board of Health of New Hanover County, pursuant to
North Carolina General Statutes S130A-39, which authorizes a
local board of health to adopt rules necessary to protect and
promote the public health, does hereby ordain that the "Rules
Governing Construction and Operation of Public Swimming Pools in
New Hanover County" is hereby amended as follows:
Title. Delete the word "public".
Section 1. Definitions. Following section 1.5., Add:
"Private Swimming Pool" is any swimming pool
operated in conjunction with a single family
residential unit, the use of which is limited
to occupants of that residence and their
invitees. Unless specifically provided
herein, private swimming pools are exempt
from the provisions of these rules.
Section 6. Site Layout. Following Section 6.10, Add:
6.11 All outdoor private swimming pools
shall be enclosed by a fence or other
permanent barrier which discourages climbing
and designed so as to minimize the
possibility of unauthorized or unwary persons
entering the pool area. Entrances through
the barrier shall be provided with
self-closing gates having simple positive
self-latching closure mechanisms with
hardware provided for padlocking. The
barrier shall not be less than forty-eight
(48) inches in height above the adjacent
ground surface outside the barrier. Fencing
will be required around all four (4) sides of
pool. All private pool enclosures shall be
completely installed within thirty (30) days
of the pool completion.
It is recommended that all private swimming
pools have a walk or deck around the entire
perimeter of the pool of a minimum width of
three (3) feet of unobstructed clear distance.
Section 6.12. Non-conforminq Private Swimminq Pools.
Private swimming pools constructed prior to the
effective date of this regulation must be brought into
compliance at the earliest possible date, but in no
case longer than two (2) years from the effective date.
This regulation shall be effective October 1, 1989.
