01/12/1955 159 REGULAR MONTHLY MEETING BOARD OF HEALTH HELD IN OFFICE OF BOARD JANUARY 12, 1955 . Present: Mr. Ralph T. Horton, Chairman; Dr. J. C. Wessell, Dr. J. C. Knox, Mr. H. M. Roland and Dr. James H. Smith. Since copies of the minutes if the last meeting had been received by the Board members, motion was made by Dr. Wessell, seconded by Mr. Roland, that the read- ing' of the minutes be dispensed with. '.. This being the first meeting of the Board in the odd year, Chairman Horton mentioned that it was time for the reorganization of the Board and euggested that he read to the Board certain portions from the Legislative Act of 1913 creating the Consolidated Board of Health. At this meeting the ex-officio members; namely, Mr. Ralrn T. Horton, Chairman County Commissioners, Mr. E. L. White, Mayor City of Wilmington and Mr. H. M. Roland, Superintendent County Board of Education, were to elect the two medical members and a dental member for the next two years. On motion by Mr. Roland, seconded by Mr. Horton, Dr. J. C. Wessell and Dr. J. C. Knox were appointed medical members and Dr. James H. Smith the dental member of the Board of Health for the mxt two years. Motion carried. Following the organization of the Board of Health, motion was made by Dr. J. C, Wessell, seconded by Mr. Roland, that Dr. C. B. Davis be re-elected Superintendent of Health. After the election of Dr. DaviS, Superintendent of Health, on recom- mendation by Dr. Davis, motion was made by Dr. Wessell, s.econded by Dr. Smith, that the present personnel of the health department be re-employed. Motion carried. Chainuan Horton asked that we remembsr Mayor White in our prayers and wis,h for him a speeqy recovery. Mr. Lassiter gave a report on the Leeuwenburg hog. and cattle pen and stated that the hogs and cattle had been move to Sloop Point. The Health Officer stated th~t he had conferred with Mr. Cicero Yow, Attorney, in regards to an Ordinance covering this situation and it was the opinion of Mr. Yow that it would be difficult to write a law that would apply to every case and it would be better to let each case take care of itself. It wall reported that Mr. John Stevens, Attorney for Mr. Otto Leeuwenburg, was pleaBed with the way in which the Board handled the matter. Dr. Wessell suggested that the matter pertaining to the other hog pens IIhould be left in status quo until they become a nuisance; but continu1-0 check on them. Mr. Lassiter was in agreement with Dr. Wessell's suggestion. Mr. Lassiter reported that big improvement had been made at the Wilmington PaclCing Company on the Castle Hayne Road, but he eas not sure if the other line had been put into a tank.' . Mr. Edwards, reporting on the tests made on the bulk milk dispensers now being used, said he had taken forty-four (44) samples and 4rJ1, of them showed some colon bacteria; 25% showed contamination in excess of What is allowed by law. Of the ninety-four (94) samples on the single milk containers only 5% showed any colon and only 1% was in excess of that allowed. Mr. Edwards further stated that only by extreme calle can the bulk milk dispeneers be made to operate reasonably well. - - In view of the above, Mr. Edwards recolllllended that the 9Q-day trial test be extended 160 another 9Q-days since some new facilities to service the containers had just been received. Dr. Wessell made the motion that the time be: ex- tended for another 90-days; motion was seconded by Mr. Roland and carried.. Mr. Lassiter reported that it had been suggested by the Plumbing Inspector. that a performance bond be required for plumbers since plumbers sometimes contract for a job, get the work started, collect the money and then welk off the job. The question was asi:ed by some of the Board members if this Board had the legal right to require a performance bond, and it was suggested that the Board get legal advice before any action bet-aken on this matter. It was reported by Mr. Lassiter that a make-shift arrangement is being used at Carolina Beach where a sewer was washed out by the hurricane, and that the sewer should be replaced as soon as possible. At Wrightsville Beach the water line connecting the Harbor Island pump to the rest of the Wrightsville Beach system was broken by the hurricane and had not yet been replaced. Any power interruption would mean that Harbor Island would have no water at all. The installation of septic tanks and the use of cinders was discussed. Mr. Lassiter stated that in some cases cinders were not being used in sufficient amount in the effluent drainage line from septic tanks; that the present Ordinance states that they shall be used. under and over the drainage line with- out fixing a definite amount. Mr. Lassiter suggested that in place of leaving to the discretion of the inspecting officer the amount of cinders to be used that the present Code be changed requiring at least three inches underneath and two inches above the drainage line.
